HOW TO TESTIFY
If you would like to address the Council, please go to the podium and state your name and address clearly for
the record. Please observe the basic riles of courtesy when speaking and limit your comments to five
minutes. The Council appreciates hearing from citizens but may not be able to take immediate action on
comments received until they are referred to a Committee or discussed under New Business.
COUNCIL MEETINGS
No Council meetings are scheduled on the 5th Monday of the month unless prior public notification is given.
Regular Meetings - The Mayor, elected by the people to a four -year term, presides at all Regular Council
Meetings held on the 1 st and 3rd Mondays of each month at 7:00 p.m. Official Council action in the
form of formal motions, adopting of resolutions and passing of ordinances can only be taken at Regular
Council meetings.
Committee of the Whole Meetings - Council members are elected for a four -year term. The Council
President is elected by the Council members to preside at all Committee of the Whole meetings for a
one -year term. Committee of the Whole meetings are held the 2nd and 4th Mondays at 7:00 p.m.
Issues discussed are forwarded to the Regular Council meeting for official action.
GENERAL INFORMATION
At each Council meeting citizens are given the opportunity to address the Council on items that are not
included on the agenda during CITIZENS COMMENTS. Please limit your comments to 5 minutes.
Special Meetings may be called at any time with proper public notice. Procedures followed are the same as
those used in Regular Council meetings.
Executive Sessions may be called to inform the Council of pending legal action, financial, or personnel
matters.
PUBLIC HEARINGS
Public Hearings are required by law before the Council can take action on matters affecting the public interest
such as land -use laws, annexations, rezone requests, public safety issues, etc. Section 2.04.150 of the
Tukwila Municipal Code states the following guidelines for Public Hearings:
The proponent shall speak first and is allowed 15 minutes for a presentation.
2. The opponent is then allowed 15 minutes to make a presentation.
Each side is then allowed 5 minutes for rebuttal.
4. Citizens who wish to address the Council may speak for 5 minutes each. No one may speak a second
time until everyone wishing to speak has spoken.
5. After each speaker has spoken, the Council may question the speaker. Each speaker can respond to the
question, but may not engage in further debate at this time.
6. After the Public Hearing is closed and during the Council meeting, the Council may choose to discuss
the issue among themselves, or defer the discussion to a future Council meeting, without further public
testimony. Council action may only be taken during Regular or Special Meetings.

ISSUE
The Police Neighborhood Resource Center (NRC) lease agreement (No. 12 -063) with Mike
West expires on June 30, 2015.
BACKGROUND
Beginning 07/01/12, the City entered into a lease agreement for the property located at 14862
Tukwila International Boulevard (Contract 12 -063). That lease expires June 30, 2015 and
currently provides for a $1700 /month rent.
DISCUSSION
The Lessor, Mike West, is willing to extend the current lease to June 30, 2016, with an amended
rent of $1750 per month. This represents an increase of $50 per month ($600 over the life of
the lease extension) from the current agreement. This location meets the operational needs
and requirements of the police department and is currently a budgeted item; no new monies are
being requested, the existing PD budget will be used to fund this request. It is anticipated that
the construction of Tukwila Village will be well under way at the time of the expiration of this
extension and we will have a good idea of the additional time we will have a need to lease this
property. The current construction schedule indicates a likely completion of the Tukwila Village
building that will house a new NRC is December 2017.
FINANCIAL IMPACT
This is a budgeted item currently and no new monies are being requested to fulfill this request.
The cost of the 12 month extension is $21,000.
RECOMMENDATION
The Committee is being asked to consider the 1 -year lease extension and forward it to the
May 26, 2015 Committee of the Whole and subsequent June 1, 2015 Regular Meeting.

Between the City of Tukwila and Mike West
That portion of Contract No. 12 -063 between the City of Tukwila and Mike West is
amended as follows:
Section 3 (Rent):
Lessee shall pay Lessor rent in the amount of $1,465 per month for the period from
711112 through 12131112, $1,650 per month for the period from 111113 through
12131113, $1,700 per month for the period from 111114 through 6130115, and $1,750 per
month for the period from 7/1/15- 6/30/16. Rent shall be due to Lessor on the first
day of the month.
Section 5 (Term):
This Lease Agreement shall be in effect until June 30, 2016, unless sooner
terminated as a result of either party's default hereunder or in accord with the
termination provisions set forth in paragraph 18. At the conclusion of the stated
term, the lease will remain in effect on a month -to -month basis.
All other provisions of the contract shall remain in full force and effect.

LEASE AGREEMENT
THIS LEASE AGREEMENT, dated this day ofTU1— 2012, is entered into by and
between Mike West, the property owner, hereinafter referred to as "Lessor," the City of Tukwila, a
political subdivision of the State of Washington and hereinafter referred to as "Lessee," for the
purpose of leasing the former Southtowne Auto Rebuild office building located at 14862 Tukwila
International Boulevard, Tukwila, Washington 98168.
WITNESSETH:
1. Description of Premises. Lessor hereby leases to Lessee, upon the terms and conditions
herein set forth, the building located at 14862 Tukwila International Boulevard, Tukwila,
Washington (hereinafter "Premises "). The Premises include the entire building except the basement
and rear entryway /foyer.
2. Additional Rights of Access. Lessor hereby grants . Lessee non - exclusive rights for
ingress and egress to and from the Premises through the rear entryway /foyer. Lesssor hereby grants
Lessee exclusive rights to park between the Premises and Tukwila International Boulevard and non-
exclusive rights to park up to six vehicles in the lot behind the building.
3. Rent. Lessee shall pay Lessor rent in the amount of $1,465 per month for the period
from 7/1/12 through 12/31/12, $1,650 per month for the period from 1/1/13 through 12/31/13, and
$1,700 per month thereafter. Rent shall be due to Lessor on the first day of the month.
4. Deposit. Lessee shall pay Lessor a $2,500.00 refundable security deposit prior to taking
possession of the Premises.
5. Term. The term of this Lease Agreement is three (3) years commencing on July 1, 2012
and terminating on June 30, 2015 unless sooner terminated as a result of either party's default
hereunder or in accord with the termination provisions set forth in paragraph 18. At the conclusion
of the stated term, the lease will remain in effect on a month -to -month basis.
6. Ownership. The real property, improvements, and all permanent fixtures shall become
and remain the property of Lessor. Any personal property on the premises shall remain the property
of the party that supplied it.
7. Permitted Uses. Lessee intends to use the Premises for a police department
neighborhood resource center but may use the Premises for any other lawful purpose.
8. Acceptance of Premises. Lessee has examined the premises and accepts them in their
present condition.
9. Maintenance and Repair. Lessee may maintain, clean, and repair any part of the interior

of the Premises. Said maintenance, cleaning and repairs shall be at Lessee's sole discretion and
expense. Lessor shall maintain, clean, and repair the exterior of the Premises and related property.
10. Utilities. Lessee shall be responsible for paying for all utilities.
11. Property Taxes. Lessee shall reimburse Lessor for 50% of the property taxes paid by
Lessor for the parcel on which the Premises are located (assessor parcel number 004100- 0329).
Lessee's portion of said taxes shall be prorated to reflect the term of this lease as it relates to the
calendar year of the respective property taxes. Lessee shall issue payment due under this section to
Lessor within 30 days of receiving proof of payment from Lessor.
12. Tenant Improvements. Lessee may make improvements and other alterations to the
interior of the Premises at Lessee's expense. Lessee may make any interior and exterior alterations
necessary to install communications cabling and equipment. Any improvements proposed under
this paragraph must receive approval from the Lessor before such improvements are undertaken.
Lessor shall not unreasonably withhold approval and shall consider Lessee's installation costs when
evaluating alteration alternatives.
13. Signage. Lessee has exclusive rights to signage on the Premises and may remove all or
a portion of the existing Southtowne pole sign. Lessee may, at its own expense, install a sign or
signs on the existing pole sign or exterior wall of the Premises. Lessee may install exterior lighting
for the signage on the Premises at Lessee's expense.
14. Default. Failure to comply with provisions of this Lease Agreement renders this Lease
Agreement null and void, and gives either party the right to terminate this agreement.
15. Hold Harmless. Lessee shall defend, indemnify, and hold harmless the Lessor from and
against any and all claims, suits, actions, or liabilities for injury or death of any person, or for loss or
damage to property, which arises out of Lessee's use of the Premises, or from the conduct of
Lessee's business, or from any activity, work or thing done, permitted, or suffered by Lessee in or
about the Premises except only such injury or damage as shall have been occasioned by the
negligence of the Lessor.
16. Assignment. Neither party shall assign or sublet its rights or responsibilities under this
Lease Agreement without the written authorization of the other party. Written authorization shall
not be unreasonably withheld.
17. Binding on Heirs Successors, and Assigns. This Lease shall be binding upon the heirs,
executors, administrators, successors, and assigns of both parties hereto.
18. Termination. Pursuant to the terms and conditions of this Lease Agreement between the
parties, this Lease Agreement may be terminated upon written mutual agreement between the
parties hereto.

19. Insurance. Lessee shall procure and maintain for the duration of this Lease Agreement,
insurance against claims for injuries to person or damage to property which may arise from or in
connection with the Lessee's operation and use of the Premises.
21. Liens. Lessee shall keep the premises free from liens arising out of obligations incurred
by Lessee.
22. Access For Inspection or Upkeep. Lessor reserves the right to inspect the premises at a
reasonable time and with reasonable notice. Lessee must be present during such times.
23. Compliance With All Laws and Regulations. In using the premises, Lessee shall
comply with all applicable laws, ordinances and regulations from any and all authorities having
jurisdiction.
24. Entire Lease. This agreement contains all of the terms and conditions agreed upon by
the parties. The parties agree that there are no other understandings, oral or otherwise, regarding the
subject matter of the Lease. No changes or modifications of this Lease shall be valid or binding
upon either party to this Lease unless such changes or modifications are in writing and executed by
both parties.
25. Severability. It is hereby agreed that no waiver of any condition or covenant in this
Lease Agreement, or any breach thereof, shall be taken to constitute a waiver of any subsequent
breach.
26. Applicable Law; Venue: Attorney's Fees. This Lease shall be governed by and
construed in accordance with the laws of the State of Washington. In the event any suit, arbitration,
or other proceeding is instituted to enforce any term of this Lease, the parties specifically
understand and agree that venue shall be properly Iaid in King County, Washington. The prevailing
party in any such action shall be entitled to its attorney's fees and costs of suit.
27. Notices. Any written notice required or permitted to be given herein shall be made by
registered or certified U.S. mail, or by delivery in person to the party which is the intended recipient
of the notice, at the following addresses or to such other respective addresses as either party hereto
may from time to time designate in writing:

CALL TO ORDER: Committee Chair Hougardy called the meeting to order at 5:31 p.m.

II. BUSINESS AGENDA
A. Lease Extension for the Neighborhood Resource Center
Staff is seeking Council approval of a one -year extension to the lease agreement for the
Neighborhood Resource Center located at 14862 Tukwila International Boulevard. The
current lease expires June 30, 2015 and is paid at a monthly rent of $1700. The proposed
extension would go through June 30, 2016 and be paid at an increased rent of $1750 per
month, or $21,000 for the year. This is a budgeted expense and the Police Department wishes
to continue use of this property until a new facility is constructed as part of the Tukwila Village
development. More information about the status of that construction will be available by the
time this extension will expire next summer.of this extension next summer. UNANIMOUS
APPROVAL. FORWARD TO JUNE 1, 2015 REGULAR CONSENT AGENDA.
B. Transportation Benefit District Update
During the 2015 -2016 Budget review process, the Council requested an update in 2015 on
the Transportation Benefit District (TBD) revenue option. In 2014 King County proposed a
combination vehicle license and sales tax TBD that was rejected by voters. Had it been
successful Tukwila could have received over $500,000 annually. There are various funding
options available through a TBD as outlined in the information memo, some requiring voter
approval and others not. If Tukwila implemented a $20 vehicle license fee, the estimated
revenue to the City would be $552,420. If Tukwila voters approved a sales tax of 0.2 %, the
estimated revenue would be $3,600,000.
Committee members discussed the information and requested that this topic return to
Committee as part of a larger conversation about revenue options such as levy lid lift and
B &O tax. Committee Chair Hougardy noted that 2015 is a good opportunity to become
informed about revenue options as it is an off -year in the budget cycle. A similar presentation
will then be presented to the entire Council following Committee review and refinement.

The City completed Phase 1 development of the 3 phase Master Plan for Duwamish Hill
Preserve in 2010, which included the upland "Hill" portion of the site. The West parcel was
purchased in 2012. Design for Phase 2 began in 2013 and continued through 2014 to include
the flat West and North portion of the site and was completed in early 2015.
DISCUSSION
The Duwamish Hill Preserve Phase 2 project was advertised for bids on May 5 and 12, 2015.
Five bids were received and opened on May 19, 2015. The bids were checked, corrected, and
tabulated. Paul Brothers, Inc. is the apparent low bidder with a bid of $564,170.20. The
Engineer's Estimate was $620,870.00. References were checked and Paul Brothers, Inc. has
successfully constructed other municipal projects throughout Oregon and Washington.
The overall bid is less than the Engineer's Estimate and Budgeted amount.
The timing of the -grant calls for the need to begin the contract in June, thus going from
CAP to Re_gular Meeting.

COMMENT: $313k for use of site. Grants: Recreation Conservation Office (RCO), State Heritage Fund, 4Culture,

The Tukwila Park Commission unanimously recommended the partnership at its May meeting.
The Committee unanimously supported the pursuit of the Green City partnership via a budget
amendment proposal and draft agreement. UNANIMOUS APPROVAL TO RETURN TO
COMMITTEE.
C. Park Watch Program
Staff provided a status update of the Park Watch Program that has been in development since
2014. This program aims to connect City staff with park users and various neighborhoods in an
effort to improve communications, connections and livability. The project charter, scope and
schedule were described to Committee members. A kick -off meeting for several ad -hoc
committees will take place on May 27, 2015. Several "See you in the Park" events are being
planned for this summer. Committee members expressed support for the program.
Coucilmember Robertson emphasized the importance of outreach and communication as
community members have a lot of valuable information to share regarding their parks.

Staff is seeking Council approval to award a construction bid in the amount of $620,587.22 to

Contract for 4Leaf Inc. inspections services
ISSUE
Should council approve a $100,000.00 contract to fund building inspections services with 4Leaf Inc.
until December 31, 2015? Previous contracts with 4Leaf Inc. have reached Director /Mayor contract
approval limitations. The proposed contract has the same terms as the original contract.
BACKGROUND
The Building Division last year experienced the retirement of two positions a Senior Plans Examiner
and Combination Building Inspector. In addition, earlier this year, we lost another Combination Building
Inspector who relocated to the bay area. The recruitment for these positions is on- going, as we are
having some challenges finding qualified applicants to feel these positions. This problem is not unique
to Tukwila, it is also affecting our neighboring jurisdictions due to the boom in the Construction Industry.
During our efforts to attract viable candidates the building division has been relying heavily on the
building inspection services of 4Leaf Inc. We will continue to rely on contract inspection services until
the three vacant positions have been filled.
DISCUSSION
We currently have many highly technical, complex commercial projects in plan review or ready to issue
such as Tukwila Village, King County Library, and Museum of Flight Structure. We are also aware of
upcoming projects such as the 19 story Washington Place tower and the North West Arena (with a five
story 5,000 vehicle parking structure). There is no doubt that there are also many upcoming projects
.that we are not aware of. These could be considered a once in a decade project and they are looming
together over an understaffed building division. Staff is working at maximum proficiency to
accommodate the current workload. However, when the above projects begin and start demanding
additional time for daily inspections and plan reviews, staff will not be able to handle the workload.
Additional contract staff will be required beyond filling the three current vacancies. Each of these large
projects will require minimum of one full time inspector, two when they are fully engaged. Each project
will also need City supervision of the contract staff in order to insure their work is in compliance with all
codes.
FINANCIAL IMPACT
None. The financial savings from the three vacant positions will cover the $100,000.00 contract to fund
building inspection services with 4Leaf Inc.

CONTRACT FOR SERVICES
This Agreement is entered into by and between the City of Tukwila, Washington, a non - charter
optional municipal code city hereinafter referred to as "the City," and 4Leaf Inc. ,
hereinafter referred to as "the Contractor," whose principal office is located at 2110 Rheem Drive, Ste. A
Pleasanton, CA 94588.
WHEREAS, the City has determined the need to have certain services performed for its citizens
but does not have the manpower or expertise to perform such services; and
WHEREAS, the City desires to have the Contractor perform such services pursuant to certain
terms and conditions; now, therefore,
IN CONSIDERATION OF the mutual benefits and conditions hereinafter contained, the parties
hereto agree as follows:
1. Scope and Schedule of Services to be performed by Contractor. The Contractor shall perform
those services described on Exhibit A attached hereto and incorporated herein by this reference as if
fully set forth. In performing such services, the Contractor shall at all times comply with all Federal,
State, and local statutes, rules and ordinances applicable to the performance of such services and the
handling of any funds used in connection therewith. The Contractor shall request and obtain prior
written approval from the City if the scope or schedule is to be modified in any way.
2. Compensation and Method of Payment. The City shall pay the Contractor for services rendered
according to the rate and method set forth on Exhibit B attached hereto and incorporated herein by this
reference. The total amount to be paid shall not exceed $100,000.00 at a rate of $70.00 per hour.
3. Contractor Budget. The Contractor shall apply the funds received under this Agreement within the
maximum limits set forth in this Agreement. The Contractor shall request prior approval from the
City whenever the Contractor desires to amend its budget in any way.
4. Duration of Agreement. This Agreement shall be in full force and effect for a period commencing
June 1, 2015, and ending December 31, 2015, unless sooner terminated under the provisions
hereinafter specified.
5. Independent Contractor. Contractor and City agree that Contractor is an independent contractor
with respect to the services provided pursuant to this Agreement. Nothing in this Agreement shall be
considered to create the relationship of employer and employee between the parties hereto. Neither
Contractor nor any employee of Contractor shall be entitled to any benefits accorded City employees
by virtue of the services provided under this Agreement. The City shall not be responsible for
withholding or otherwise deducting federal income tax or social security or contributing to the State
Industrial Insurance Program, or otherwise assuming the duties of an employer with respect to the
Contractor, or any employee of the Contractor.

6. Indemnification. The Contractor shall defend, indemnify and hold the City, its officers, agents,
officials, employees and volunteers harmless from any and all claims, injuries, damages, losses or suits
including attorney fees, arising out of or in connection with the performance of this Agreement, except for
injuries and damages caused by the sole negligence of the City. Should a court of competent jurisdiction
determine that this Agreement is subject to RCW 4.24.115, then, in the event of liability for damages
arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent
negligence of the Contractor and the City, its officers, officials, employees, and volunteers, the
Contractor's liability hereunder shall be only to the extent of the Contractor's negligence. It is further
specifically and expressly understood that the indemnification provided herein constitutes the Contractor's
waiver of immunity under Industrial Insurance, Title 51 RCW, solely for the purposes of this
indemnification. This waiver has been mutually negotiated by the parties. The provisions of this section
shall survive the expiration or termination of this Agreement.
7. Insurance. The Contractor shall procure and maintain for the duration of the Agreement, insurance
against claims for injuries to persons or damage to property which may arise from or in connection
with the performance of the work hereunder by the Contractor, their agents, representatives,
employees or subcontractors. Contractor's maintenance of insurance, its scope of coverage and limits
as required herein shall not be construed to limit the liability of the Contractor to the coverage
provided by such insurance, or otherwise limit the City's recourse to any remedy available at law or in
equity.
A. Minimum Scope of Insurance. Contractor shall obtain insurance of the types and with the limits
described below:
1. Automobile Liability insurance with a minimum combined single limit for bodily injury and
property damage of $1,000,000 per accident. Automobile liability insurance shall cover all
owned, non - owned, hired and leased vehicles. Coverage shall be written on Insurance Services
Office (ISO) form CA 00 01 or a substitute form providing equivalent liability coverage. If
necessary, the policy shall be endorsed to provide contractual liability coverage.
2. Commercial General Liability insurance with limits no less than $1,000,000 each occurrence,
$2,000,000 general aggregate and $2,000,000 products - completed operations aggregate limit.
Commercial General Liability insurance shall be written on ISO occurrence form CG 00 01
and shall cover liability arising from premises, operations, independent contractors, products -
completed operations, stop gap liability, personal injury and advertising injury, and liability
assumed under an insured contract. The Commercial General Liability insurance shall be
endorsed to provide the Aggregate Per Project Endorsement ISO form CG 25 03 11 85 or an
equivalent endorsement. There shall be no endorsement or modification of the Commercial
General Liability Insurance for liability arising from explosion, collapse or underground
property damage. The City shall be named as an insured under the Contractor's Commercial
General Liability insurance policy with respect to the work performed for the City using ISO
Additional Insured endorsement CG 20 10 10 01 and Additional Insured- Completed
Operations endorsement CG 20 37 10 01 or substitute endorsements providing equivalent
coverage.
3. Workers' Compensation coverage as required by the Industrial Insurance laws of the State of
Washington.

B. Other Insurance Provision. The Contractor's Automobile Liability and Commercial General
Liability insurance policies are to contain, or be endorsed to contain that they shall be primary
insurance with respect to the City. Any insurance, self- insurance, or insurance pool coverage
maintained by the City shall be excess of the Contractor's insurance and shall not contribute with
it.
C. Acceptability of Insurers. Insurance is to be placed with insurers with a current A.M. Best rating
of not less than A: VII.
D. Verification of Coverage. Contractor shall furnish the City with original certificates and a copy
of the amendatory endorsements, including but not necessarily limited to the additional insured
endorsement, evidencing the insurance requirements of the Contractor before commencement of
the work.
E. Subcontractors. The Contractor shall have sole responsibility for determining the insurance
coverage and limits required, if any, to be obtained by subcontractors, which determination shall
be made in accordance with reasonable and prudent business practices.
F. Notice of Cancellation. The Contractor shall provide the City and all Additional Insureds for this
work with written notice of any policy cancellation, within two business days of their receipt of
such notice.
G. Failure to Maintain Insurance. Failure on the part of the Contractor to maintain the insurance as
required shall constitute a material breach of contract, upon which the City may, after giving five
business days notice to the Contractor to correct the breach, immediately terminate the contract or,
at its discretion, procure or renew such insurance and pay any and all premiums in connection
therewith, with any sums so expended to be repaid to the City on demand, or at the sole discretion
of the City, offset against funds due the Contractor from the City.
8. Record Keeping and Reporting.
A. The Contractor shall maintain accounts and records, including personnel, property, financial and
programmatic records which sufficiently and properly reflect all direct and indirect costs of any
nature expended and services performed in the performance of this Agreement and other such
records as may be deemed necessary by the City to ensure the performance of this Agreement.
B. These records shall be maintained for a period of seven (7) years after termination hereof unless
permission to destroy them is granted by the office of the archivist in accordance with RCW
Chapter 40.14 and by the City.
9. Audits and Inspections. The records and documents with respect to all matters covered by this
Agreement shall be subject at all times to inspection, review or audit by law during the performance
of this Agreement.
10. Termination. This Agreement may at any time be terminated by the City giving to the Contractor
thirty (30) days written notice of the City's intention to terminate the same. Failure to provide
products on schedule may result in contract termination. If the Contractor's insurance coverage is
canceled for any reason, the City shall have the right to terminate this Agreement immediately.
11. Discrimination Prohibited. The Consultant, with regard to the work performed by it under this
Agreement, will not discriminate on the grounds of race, religion, creed, color, national origin, age,
veteran status, sex, sexual orientation, gender identity, marital status, political affiliation or the
presence of any disability in the selection and retention of employees or procurement of materials or
supplies.

12. Assignment and Subcontract. The Contractor shall not assign or subcontract any portion of the
services contemplated by this Agreement without the written consent of the City.
13. Entire Agreement; Modification. This Agreement, together with attachments or addenda,
represents the entire and integrated Agreement between the City and the Contractor and supersedes
all prior negotiations, representations, or agreements written or oral. No amendment or modification
of this Agreement shall be of any force or effect unless it is in writing and signed by the parties.
14. Severability and Survival. If any term, condition or provision of this Agreement is declared void or
unenforceable or limited in its application or effect, such event shall not affect any other provisions
hereof and all other provisions shall remain fully enforceable. The provisions of this Agreement,
which by their sense and context are reasonably intended to survive the completion, expiration or
cancellation of this Agreement, shall survive termination of this Agreement.
15. Notices. Notices to the City of Tukwila shall be sent to the following address:

16. Applicable Law; Venue; Attorney's Fees. This Agreement shall be governed by and construed in
accordance with the laws of the State of Washington. In the event any suit, arbitration, or other
proceeding is instituted to enforce any term of this Agreement, the parties specifically understand and
agree that venue shall be properly laid in King County, Washington. The prevailing party in any such
action shall be entitled to its attorney's fees and costs of suit.

In addition, staff is proposing transferring $171,295.00 from the 412 Surface Water
Utility, since habitat projects are now included in that fund due to surface water runoff
impacts. The East Marginal Way South Stormwater Outfalls Project construction will be
delayed until 2016 and those funds could be applied to Duwamish Gardens in 2015.
Also, that project has tentatively been approved to receive $1,106,000 in grant funding
through the Department of Ecology, well over the anticipated $300,000 reflected in the
adopted CIP. UNANIMOUS APPROVAL. FORWARD TO MAY 18, 2015 REGULAR
MEETING.
C. North Highline Annexation Area Update
Staff provided an update on the North Highline Annexation Area. The City of Seattle has filed
a Notice of Intent to Annex its Duwamish Annexation Area, including the Duwamish Industrial
Area (North Highline Area Q) and the South Park "Sliver by the River." Area Q overlaps with
Tukwila's designated Potential Annexation Area. In 2012 property owners in the Duwamish
Industrial area filed a petition to annex into the City of Seattle, but the Boundary Review Board
denied Tukwila's Notice of Intent and a subsequent mediation process resulted in no
agreements. The City of Tukwila plans to submit comments to the Boundary Review Board
opposing Seattle's Notice of Intent on the basis that it does not offer the comprehensive solution
that was the basis for denying Tukwila's Notice in 2012, and because the property owners in
the area desire to be part of the City of Tukwila as evidenced by the 2012 petition. The
Committee will be briefed following the Boundary Review Board action on Seattle's Notice of
Intent. INFORMATION ONLY.
D. Contract: Inspection Services
Staff is seeking Council approval of a contract with 41-eaf, Inc. in an amount not to exceed
$100,000.00 for building inspection services, negotiated at $70 perhour. The proposed contract
includes the same terms and scope of work as an existing contract signed in January 2015, but
the dollar amount for the services required by the City now exceeds the amount requiring
Council approval. The Buiding Division has recently lost three staff members due to retirements
and resignation, and recruitment for these positions is ongoing. Cities are generallyexperience
trouble filling positions like these due to the construction boom and fewer qualified applicants
coming up through the trade. There are many highly technical commercial projects underway
such as Tukwila Village, King County Library, Museum of Flight, and Washington Place. The
expertise and services provided by 41-eaf will be necessary until the City can fill its vacant
positions. UNANIMOUS APPROVAL. FORWARD TO MAY 26, 2015 COMMITTEE OF THE
WHOLE.

SUBJECT: City process update on the Northwest Arena
ISSUE
On May 1, 2015, the City of Tukwila received a SEPA application from RLB Holdings Sports and
Entertainment, LLC, a developer interested in building a multipurpose arena in the City of
Tukwila. The City has initiated the environmental review process, which has multiple steps.
Due to the nature of this project, staff will regularly update Council on the City's process around
this potential development. This is the first such briefing.
BACKGROUND
Staff have determined that an Environmental Impact Study (EIS) is warranted for this project
due to the scale, location, and potential impacts to the surrounding neighborhood. However,
because the City undertook an extensive EIS during the development of the Southcenter
Subarea Plan, it has been determined that the EIS for the proposed arena can build on that
earlier work. As such, the City is moving forward with a limited scope EIS focused on:
• Land use
• Height, bulk, scale , and aesthetics
• Air quality
• Transportation, including parking, vehicle traffic, transit, and bicycle /pedestrian
movement /circulation
On Tuesday, June 2nd the City will host a scoping meeting at the Tukwila Community Center
from 4:30 to 6:30 PM where members of the public will have the opportunity to comment on the
scope of the EIS. Comments will be accepted on alternatives, mitigation measures, probable
significant adverse impacts, and licenses or other approvals that may be required. The scoping
process will last for 21 days and the public can also provide written comments via both email
and traditional mail.
After the scoping is complete the EIS will be written and a draft released for public comment in
late summer. These public comments will be incorporated into a final EIS. It is expected that this
process will take between six and twelve months to complete.
Once the EIS is finalized, decisions on other permits and approvals will follow. Because the
zoning code does not include a parking standard for multipurpose arenas, the applicant has
applied to the Director of Community Development for a determination as to how many parking
stalls must be associated with this project. Design review, sign, demolition and development
permits will be required. The developer is also expected to apply for a development agreement
and street vacation.

Should this project move forward, there are many other review and regulatory steps ahead,
some of which will require Council approval. Staff will provide regular updates to ensure
Council has a timely understanding of the City's process. In addition, recognizing the public
interest in this potential project, a webpage has been created on the City's website to heighten

The City Administrator Report is meant to provide the Council, staff and community an update on the
activities of the City and on issues that concern Tukwila. Please let me know if you have any questions
or need additional information about any of the following items.
Intergovernmental Update
• Southwest King County Chamber of Commerce Business Roundtable: Mayor Haggerton,
Council President Kruller, Councilmember Ekberg, and economic development staff attended
the quarterly Business Roundtable at Westfield Mall. Mayor Haggerton provided an overview
on current projects and Linda Stewart form the Port of Seattle explained the process for
adopting a Sustainable Airport Master Plan and requested Chamber suggestions for business
outreach.
• Sound Cities Association Meeting: Mayor Haggerton hosted the Sound Cities Association
(SCA) monthly Board Meeting at Billy Baroo's. After the meeting Bob Giberson, Public Works
Director and Jack Pace, Community Development Director provided a tour of the City to the
SCA board members.
• Annual Tourism Networking Meeting: Seattle Southside Visitor Services (SSVS) hosted the
annual tourism networking meeting with over 75 people in attendance including Council
President Kruller, Councilmember Ekberg, and economic development staff. SSVS Executive
Director Katherine Kertzman presented on the importance of tourism to the local economy
and on the transition to the new public development authority.
• Presentation to the King County Housing Authority: On May 18 Economic Development
Administrator Derek Speck presented to the Board of the King County Housing Authority on
development activities and opportunities along Tukwila International Boulevard.
• Forterra's Annual Breakfast: On May 1g Councilmembers and numerous City staff attended
Forterra's annual breakfast.
• Regional Fire Authority (RFA) Update: The Regional Fire Authority Annexation Steering
Committee is continuing its monthly meetings and learning about fire service functions as well
as budgeting. The focus of the Finance Sub- committee is on developing an expenditures
number for incorporating the Tukwila Fire Department into the Kent RFA. Staff of the Kent
RFA and Tukwila have been meeting to determine costs associated with supporting the Fire

Department. The costs associated with the Tukwila Fire Department will include operational
costs for fire suppression and emergency medical services as well as facility and asset
replacement costs. The Kent RFA is also requesting a preliminary decision on any services for
which Tukwila may choose to contract, such as fire investigation and or permitting services.
II. Community Events
• See You in the Park Summer Events: Staff representing all City departments are excited to
collaborate in planning See You in the Park events this summer. Events are scheduled for July
8 at Foster Memorial Park, July 15 at Riverton Park, July 22 at Duwamish Park, July 29 at
Tukwila Park and August 4 (in conjunction with National Night Out) at Crestview Park. The
goal is to establish communication opportunities between neighbors and staff; establish
positive relationships with neighbors; improve image and awareness of programs; and increase
safety in parks.
III. Staff Updates
Public Safety
• Citizen's Academy Graduation: On May 20 ten participants graduated from the Citizen's
Academy offered by the Police Department. Councilmembers Ekberg and Robertson, Deputy
Chief Bruce Linton, Sergeant Todd Rossi, Community Orientated Policing Coordinator Chris
Partman and a large number of friends and family were present to applaud for the graduates.
• Park Safety: The Police Department, Public Works and Parks & Recreation are working
collaboratively to address park maintenance and safety concerns at the City parks. Officers
have increased walking patrols and citizen interaction at various parks throughout the City.
• Community Connectors: On May 20, Joyce Trantina facilitated a discussion with
representatives from the Police Department and the City's Community Connectors to
determine what areas are of greatest interest to our diverse communities. A similar discussion
will be held with representatives from Fire and Emergency Management in June, with a
planned community safety discussion planned for early fall.
Project Updates
• Tukwila Village - New Library: On May 20, the City closed escrow on the sale of a parcel of
land to the King County Library System (KCLS) for the new library. On May 21 KCLS issued the
bid notice for construction. Bids are due by June A. The City has approved the building
permits and they are ready for the library to pick up. KCLS expects to start construction in July
and be complete in fall 2o16.
• Tukwila Village - Building A: (8o apartments, street level commercial, 4 live /work units) plus
the cafe, community meeting room, and plaza - The building permits have been approved.
Developer can pick up the permits after he buys the land.
• Government Performance Consortium Training Forum: On May 21 staff from several City
departments and Council President Kruller attended a training forum: From Public Good to
Public Great sponsored by the Government Performance Consortium and other agencies. The
forum included a presentation by Ken Miller, author of "We Don't Make Widgets ", and a panel

of leaders who have been at the forefront of transforming local government in Washington
State. Staff participated in small group discussions with other leaders from government to
share best practices and lessons learned. The City of Tukwila is one of the founding members
of this consortium committed to creating high performing city organizations.
• Interurban Ave 5: The Contractor continues to work on placing backfill for the soldier pile wall.
Sidewalk forms are being placed on the east side of the street and additional fill will be needed
to meet the required grades. Traffic is expected to be shifted from the west side to the east
side in early June so that construction of west side improvements can begin. Due to delays in
installing the retaining wall and storm detention vault, the project will be slightly delayed
beyond October 2015.
• Thorndyke Safe Routes to School (South 15oth Street from TIB to 42nd Ave 5): The project
will be complete in June with the final thermoplastic pavement markings expected soon.
• WSDOT - Paving SR181 (West Valley Hw /W: West Valley Hwy is now completely resurfaced
from 1 -405 to S.18oth St. Upcoming activities will be focused on raising utility covers to grade
and final restoration /cleanup. The project will then be suspended for a few weeks until the
pavement has cured and then the new pavement markings can be installed.
• 2015 Overlay Program: The 2015 contract is expected to start construction in July after a
May /June bid advertisement and bid award process. This year's repair and overlay roadway
segments include portions of Gateway Drive, South 124th St, Tukwila Parkway, Southcenter
Boulevard, and the Fort Dent Park parking lot.
• Washington Place — 223 Andover Park E: A permit application was received for the
construction of a new 1g -story 111,115 square foot hotel and 288,898 square foot apartment
complex with an attached four (4) level 118,38o square foot parking garage. The building
permit value forthe new building is $84..3 million. A separate foundation pilings permit was
submitted in June 2014 and has been reviewed and approved by the necessary departments.
The Circuit City building located on this site was demolished last week with site clean -up
continuing this week.
• 1521 Macadam Av 5: This property has been subject of multiple complaints from residents
and Police. Weeds cut and removed, rubbish removed and boarding of house have been
completed.
• 4232 5164th St: This property has received many complaint from citizens, visitors and Police
regarding illegal activities, overgrowth, illegal dumping and unsecured structures. Code
Enforcement sent requests to contractors on the small works roster for estimates for the
abatement of this property. The scope of work includes: cut /remove overgrowth, remove
rubbish, paint over graffiti, and secure structures. Proposals are due to Code Enforcement by
May 22.
• NW Arena Project: Staff issued a combination Notice of Application /Notice of EIS Scoping for
the NW Arena project on May 21. A public meeting is scheduled on June 2 from 4.:30 — 6:3o at
the Community Center and comments will be accepted through June 12.
• Comprehensive Plan Update Open House: Planning staff hosted an open house showcasing
the proposed updates to the City's Comprehensive Plan on May 20 at the Valley View Sewer

District meeting room. The open house provided the community an opportunity to see how
their ideas have been included in proposed updates, speak with staff about issues affecting the
Tukwila International Boulevard district, housing and residential neighborhoods, and learn
about upcoming meetings. Over 25 people attended, including residents and members of the
business community.
• Upcoming Planning Commission Public Hearings: The Planning Commission will hold a
public hearing on the draft Tukwila International Boulevard element of the Comprehensive
Plan on May 28 and will hold a work session and public hearing on proposed updates to the
Housing and Residential Neighborhood Elements in June. City Council will begin reviewing the
updated Comprehensive Plan July 27.
