Mayor VanDusen announced that the parties involved in
public hearing had submitted written requests asking for a
for a second continuance.

CONTINUANCE THE PUBLIC HEARING TO NOVEMBER 5,
1990. MOTION CARRIED.
Mayor VanDusen opened the public hearing. Rick Beeler, Director of
the Department of Community Development, explained that the
applicant is requesting the waiver in order to construct an addition for
general equipment maintenance to the north side of the current shop
structure at 18801 Southcenter Parkway. Part of the applicant's
property is on slopes greater than 15 percent; however, the 6700
square foot addition would be constructed on an area that is currently
paved and would be located approximately 48 feet from the toe of the
slope. It would not be affected by the sensitive areas ordinance as now
drafted. It is the recommendation of the staff that the request be
considered with the condition that the applicant agree to conform to
the adopted Critical Area Sensitive Areas Ordinance.
Bill Arthur, M.A. Segale Co., added that the construction will take
place on a portion of the property paved 23 years ago.

THE WAIVER BE GRANTED SUBJECT TO THE APPLICANT
FILING AN AGREEMENT TO CONFORM TO THE ADOPTED
SENSITIVE AREAS ORDINANCE. MOTION CARRIED.

PROPOSED RESOLUTION BE READ BY TITLE ONLY.

Attorney Kenyon read a Resolution of the City Council of the City of
Tukwila, Washington, requesting the King County Council activate the
Green River Flood Control Zone District ( GRFCZD) for the purpose
of funding flood control activities within the authority of the district
as established pursuant to the Revised Code of Washington, Title 86,
Section 15.

RESOLUTION NO. 1157 BE APPROVED AS READ. MOTION
CARRIED.

MINUTES
CALL TO ORDER Mayor VanDusen called the Regular Meeting of the
Tukwila City Council to order and led the audience in
the Pledge of Allegiance.

SPECIAL PRESENTATIONS '• Mayor VanDusen introduced Rhonda Berry to the Council and
welcomed her to the City. Rhonda has joined the staff as the Assistant
' to the City Administrator.
CITIZEN CO Dharlene Crostick, 14406 - 58th Ave. So., requested information on
*o issues: 1)the Rebanco dump site; 2) Council's plan to go on
record regarding Initiative 547. In response to the first question, John
McFarland stated that the City of Renton has indicated they will work
closely with Tukwila during the developmental stages of the property
since the visual impacts of anything that happens there will be visited
upon Tukwila and not Renton. The EIS has been published in draft
form andi currently being reviewed by City staff. The property lies
within the Renton limits and is not`in Tukwila's jurisdiction.
Regarding the impacts of trafficbn the City, Rick Beeler, Director of
the Department of CommunityDevelopment, reported that DCD and
public works staffinet with : enton and King County earlier today to
discuss the pro and t traffic mitigation that may be associated
with this and future roj . The Rebanco roject is a recycling of
construction materi aterials are brow t to the site in trucks,
deposited at the site, . o ed, and trucked o by category. The site is
across the river fro ' . Mo ter Road on the lefthand corner going
north. The ques ' • n is h e to handle Monster Road as it goes up to

Councilmen r oriwaki ad ed that he had received a flyer in the
mail notin community works op on the subject scheduled for
October d at 7 p.m. at the Re on Community Center. In answer to
Ms. Cros ck's second question re ding Council's stand on Initiative
547, Cquncilmember Ekberg respon ed that the Council has not
discussed the issue to date.

This letter is written for the purpose of fulfilling the
application requirements for a wavier from the Sensitive Areas
Moratorium now in effect in the City of Tukwila (Tukwila Ordinance
No. 1544).
Site plan showing existing and proposed development
Attached to this letter is a site plan, entitled "SHOP BUILDING
EXTENSION, Drawing No. 1 ", showing existing and proposed
development on the property which is the site of M. A. Segale,
Inc.'s Shop Facility. You will note from these plans that M. A.
Segale, Inc. desires to construct an addition on the north side of
the current shop structure. This addition will occupy a portion of
the existing asphalt -paved area and will be used for general
equipment maintenance.
Topographic survey or map of existing conditions
Also attached to this letter is a topographic map of existing
conditions, entitled "SHOP BUILDING EXTENSION Drawing No. 2 ". This
map indicates that the proposed location of the addition is on an
existing asphalt -paved portion of the site, and at a near 0° grade.
Building elevations of the proposed development
Building elevations are also attached, labeled "ELEVATIONS & BLDG.
SECTIONS ", Sheet A - 2, dated 8 -9 -90, prepared by Lance Mueller &
Associates, Architects. As you can see, the proposed elevations
are consistent with existing zoning and other applicable
regulations.

Landscaping Plan
A landscaping plan has not been incorporated into this application
because if landscaping were installed in conjunction with the
proposed addition, any such landscaping would necessarily have to
be removed and replaced at the time of the realignment of
Southcenter Parkway /57th Avenue South, which is anticipated to
occur in the near future.
The applicant has proposed delaying the installation of landscaping
until the realignment of 57th Avenue South /Southcenter Parkway has
been completed. The City has indicated its willingness to
entertain a written commitment to this effect in lieu of requiring
immediate compliance with the landscaping requirements of the
zoning code. Although we recognize that the provisions of TMC
18.70.090 would otherwise require that landscaping be installed at
the time of construction of the proposed addition, we request, and
believe it in the best interests of the City to allow, that such
landscaping be installed at a time when predictability will allow
us to exert our efforts to provide a first class landscaping job,
in compliance with all City requirements.
Hardship
M. A. Segale, Inc. will experience hardship if the requested waiver
is not granted in that it will not be able to construct the planned
shop addition which is crucial to M. A. Segale, Inc.'s growth and
continued equipment maintenance.

TO THE

IMPACT OF THE SENSITIVE AREAS ORDINANCE:

PETITIONER: M.A. Segale
PROPERTY LOCATION: 18801 Southcenter Parkway, Tukwila
PROPOSAL DESCRIPTION: The petitioner proposes to construct an
addition on the north side of the
existing shop structure.
The moratorium Ordinance No. 1544 precludes filing of new
development - related applications in sensitive areas, including
those with slopes greater than 15 %. Since a portion of the
applicant's property is in a sensitive area with slopes averaging
15 and 40 %, the project requires a waiver from Ordinance #1544 to
proceed. The waiver request is for completing SEPA review and all
permits in order to construct the addition this winter.
That portion of the property on which the applicant wishes to build
is completely flat. It is already fully paved and developed with
a functioning maintenance shop. The petitioner wishes to add a
6,720 square foot addition to the shop structure. The addition
constitutes a 19% extension to the building. No net increase in
impermeable surface will result, since the garage would be built on
an area that is already paved.
The applicant feels that the waiver is required to ensure the
smooth functioning of his business.
Any waiver granted will be conditioned on the applicant's filing an
agreement to conform to the adopted Sensitive Areas Ordinance and
accepting any associated risk and expense.
DECISION CRITERIA:
Ordinance No. 1550 states the City Council must use the following
criteria to review waiver requests:
1. Intent of the moratorium;
2. Best interests of the City weighed against the interests of
the individual;
3. Circumstances and hardship caused by the moratorium;
4. Damage that could result from strict adherence to the
moratorium.
