RESOLUTION NO. 231
WHEREAS, a petition for a variance in back yard set-
back requirements under RMH Zoning has been submitted to the
Planning Commission, and
WHEREAS, a Public Hearing on said petition has been
held by the Planning Commission, and
WHEREAS, the City Council has taken the petition
under consideration in regular session wherein all interested
persons were heard.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Tukwila, Washington as follows:
Section 1. A variance of rear yard setback requirements
under Ordinance 251, as amended by Ordinance 533, is hereby
granted to construct buildings No. 2 and 3 as shown on the
plot plan on file with the City Supervisor, on the following
described property:
Lots 22 and 23 Brookvale Garden Tracts.
Section 2. This variance is granted subject to the
following covenants and conditions:
A. Property owner will provide adequate erosion protection
on the slopes.
B. Property owner will provide any retaining wall required
in the ensuing 10 years from the date of this resolution to
enable the widening and upgrading of adjoining streets.
C. Property owner agrees not to protest the formation
of an LID for widening and upgrading of streets if that
method is used.
D. Property owner agrees to replace earth removed from
street right of way.
ADOPTED by the City Council of the City of Tukwila,
Washington this MX', day of 1969.

The property owners agree on behalf of themselves,
their heirs, and assigns, to comply with the covenants and
conditions of the foregoing resolution and that this resolution
may be filed with the County Auditor and shall be a covenant
running with the land.
