UNFIT FOR OCCUPANCY
IPMC 108.1.3 A structure is unfit for human occupancy whenever the code official finds
that such structure is unsafe, unlawful or because of the degree to which the structure is in
disrepair, lacks maintenance, in insanitary, vermin or rat infested, contains filth and
contamination, or lacks ventilation, illumination, sanitary or heating facilities or other
essential equipment required by this code, or because the location of the structure
constitutes a hazard to the occupants of the structure or to the public.
This property was declared unfit for occupancy at a hearing held on May 14, 2013. The
property was declared unfit due to lack of water services and lack of electrical service. The
property owner was ordered to obtain an inspection of the entire structure by the City of
Tukwila building inspector. Inspection to include electrical systems, mechanical systems,
plumbing systems, and structural components, as well as any other areas deemed
appropriate by the building official. This inspection required a City of Tukwila Building
Safety Inspection permit and fees. This inspection was to have taken place not later than
June 24, 2013. There is no record of this inspection having taken place.
Corrective Action: 1. Immediately discontinue occupancy of this structure.
2. Obtain the required building safety inspection permit and inspection. When this
inspection is completed and found to be safe, occupancy may resume. If
occupancy is not by owner of the property, then a Residential Rental License must
be obtained prior to occupancy.
Compliance Date: 8/3/2015
Violation # 2 WEEDS
Code Reference: IPMC 302.4 All premises shall be maintained free from weeds in excess of 24 inches.
All noxious weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants
and vegetation, other than trees or shrubs provided, however, this term shall not include
cultivated flowers and gardens.
The entire back of the property is severely overgrown with weeds and blackberry vines
taller than 24 inches. The vines are encroaching on neighboring properties.
Corrective Action: Remove all blackberry vines and other weeds and non - native plants in excess of 24 inches
in height. Because a portion of the property is located in a sensitive area, all removal must
•
be performed by hand (no heavy machinery that would disturb the underlying ground).
Keep the entire property clear of weeds and non - native plants into the future. Do not
allow these plants to encroach on neighboring properties.
Contact Andrea Cummins, Urban Environmentalist at 206/431 -3663 for an on -site meeting
to discuss overgrowth removal from the sensitive area.
Compliance Date: 8/17/2015
FAILURE TO COMPLY WITH THIS ORDER MAY SUBJECT YOU TO A MONETARY PENALTY OF UP TO $500 PER DAY
PER VIOLATION FOR EACH DAY THAT THE VIOLATION EXISTS PER TMC 8.45.100(2).
Appeal Provisions
A person may, within ten days of receipt of this notice, file with the City Clerk a written notice of appeal
containing the following:
1. A heading with the words: "Before the Hearing Officer of the City of Tukwila"
2. A caption reading: "Appeal of " giving the names of all appellants participating
in the appeal.
3. A brief statement setting forth the legal interest of each of the appellants in the property involved in the
notice and order.
4. A brief statement of the specific order or action protested, together with any material facts claimed to
support the contentions of the appellant(s).
5. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order should be
reversed, modified, or otherwise set aside.
6. The signature of all persons named as appellants and their official mailing addresses.
7. The verification (by declaration under penalty of perjury) of each appellant as to the truth of the matters
stated in the appeal.
8. The appeal fee for violations in the LDR zone is $100.00. All other zones $200.00. Fees must accompany the
written notice of appeals.
Failure to appeal this Violation Notice and Order shall constitute a waiver of all rights to any additional
administrative hearings. Failure to respond may result in the matter being forwarded to the City Attorney for
further action.
