Home My WebLink About1963 - Agreement - Val Vue Sewer District - 614789AGREEMENT This is an Agreement between Val Vue Sewer District, a municipal corporation duly authorized by.the laws of the,State of Washington hereinafter called Val Vue, and the City of Tukwila, a City of the Third class of the State of;Washington hereinafter Tukwila. 0 WHEREAS, the state of Washington contemplates in the very near future to install a highway facilities which would affect the present'and future use of the parties sewer systems and, whereas, the parties to this agreement have determined that it is to their . mutual advantage to engage in a joint facilities project in the con struction of certain sewer facilities in the area where the state of Washington is to install highway facilities and whereas, it is financially advantageous to both parties to install said joint facilities in the immediate future prior to the . installation of the highway facilities, NOW, THEREFORE, In consideration of the mutual promises herein contained, the parties herein agree as follows: Construction of facilities, Tukwila shall construct the following facilities: (1) Trunk Sewers within Tukwila L.I.D. 0, serving as both trunk sewers and collection lines located within Tukwila L.I.D.. #5... Approx. 300' S. of S.S.M. 1 -L 1 point approx. 470's of S.S.M. 1 -L and approx. 1530' N of S 162nd Street 57th Avenue S. Approx. 1300' N of S. 162nd Street Construction costs of the foregoing facilities shall be paid for by the municipality constructing the same. Each municipality - discharged through said station by Val Vue. In computing cost of operation fdr the Sewer Lift station and the lagoon system actual cost of said operation shall include; direct costs consisting of chemicals and supplies used at the installation, electric power, 0 labor for operating, servicing, repairing,_ of operational tests —supe _v s.ion•, replacement of parts and equipment computed as an average for two months based on the total yearly amount of parts and equipment, and • indirect costs of transportation and office personnel which shall be a sum equal to twenty (20) per cent of the direct cost. Said . cost shall be paid every two months. Installation of meters to register the gallonage being discharged through said sewer Lift Station shall be installed and paid for by Val Vue. In the event • of future expansion of sewer Lift Station services, the municipality+ which requires said increased servicesshall pay both the cost of in- stallation and the costs of operation on the actual cost value based upon the gallonage pumped through said station. Val Vue shall pay to Tukwila for the use of its lagoon system, the actual cost of operation of said use based upon the amount of gallonage discharged into said lagoon by Val Vue. In the event the lagoon must be expanded beyond its present capacity.of 640 services, the municipality which requires said expansion shall pay the cost there of; provided that until Tukwila is using the total present capacity of the lagoon they shall be credited with the total number of services 0 they are not using in determining cost of expansion. upon mutual expansion of the lagoon system, each municipality shall bear its pro rated share of the cost of the expansion. After any expansion of the lagoon system Tukwila shall be the sole owner of the expanded lagoon facilities. Cost of use of the expanded lagoon shall be on the basis of gallonage discharged into said lagoon and in accordance with cost of operation as defined herein.
