Paragraph (A) of Paragraph I shall be amended to read as followss (A) In A OVIR I10CUSTRIAL PARK no land shall be used and no building or structure shall be used, erected or converted to any use other than those per- mitted under City of Tukwila C-M zoning. 2. The first paragraph of Paragraph 12 (ARCHIT8CTURAL CO>IPum oo1amxx) shall be amended to read as follows: For the period until 90% of the ANDOM ISMUS- TRIAL PARK shall be originally sold by the developers, or by the successor or successors in interest of any thereof, the A.C.C. shall be composed ofs (1) Charles O. Bakery (2) Chairman of Planning Commission of Tuk- wilay (3) Wells B. XcCurdyy (4) Robert C. Keever, (5) Robert C. For the purpose of the preceding notice provision, "Applications for Approval" shall be deemed to include all matters submitted by owners of tracts for the approval of the A.C.C. pursuant to the require - mente of these protective covenants. t. A truck loading dock running parallel to a frontage street but positioned at G least 60 feet back of the front face of the remain- ing part of the building shall be considered to qualify under this requirement, providing the length of said loading dock does not exceed 75% of i" the total frontage width of the building. (ii) in the subparagraphs under "BUILD29G" the sub- paragraph denoted '(d)" shall be deleted and the follow- ing shall be substituted in lieu thereoft (d) Laud to be conveyed subject to 10 -foot utility easements an frontage streets and 27 -foot rail and utility easements at rear or side of prop- erty, together with easements wider, over and across a right of way 5 feat in width on each side of the colon boundary of any two tracts. Said 10 -foot utility easements along frontage streets shall be landscaped and maintained by owner in a manner ap- proved by the A.C.C. in accordance with the remain- ing provisions of Paragraph III relating to land- scaping. Placement and maintenance of all utilities conditioned upon any entry for installation, re- placement, or maintenances the entities furnishing the utilities shall restore the surface of the ground substantially to its original condition with reasonable expediencl. All utility service lines, whether part of the primary service connections to the building or secondary services to other build- ings and appurtenances shall be entirely underground. (iii) In the subparagraphs under "BUIMING" follow- ing subparagraph (e) there shall be added subparagraph (f), which si 11 read as followaa (f) on corner lots both frontages shall be con- sidered "front" yards. A minimum of 25% of the lot area located between the street and the setback line and 100% of the 10 feet nearest the street (except for driveways) shall be landscaped. The remaining setback area may be developed with either landscaping or as paved automobile parking areas. -3- Description: King,WA Deeds -Docld 5500900 Page: 3 of 6 Order: afsf Comment: "4330 W-W (v) In the original Protective Covenants the fifth main paragraph following subparagraph (e) of Paragraph III, beginning with the words "The building Codes," shall be amended to read as follows= The building codes of the city of Tukwila in effect at the time of any construction shall apply to such construction, except to the extent that such building code requirements are less than the requirements prescribed by these Protective Coven- ants. (vi) In the original Protective Covenants the sixth main paragraph following subparagraph (e) of Paragraph III, beginning with the words "Employee, customer," (including subparagraphs (1) and (2) thereof) shall be deleted and the following shall be substituted in lieu thereof: Employee, customer, owner or tenant parking will not be permitted on private or public dedicated streets in ANDOVER INDUSTRIAL PARK, and it will be the responsibility of the property owners, their suc- cessors and assigns, to provide such minimum parking facilities as follows* eM Description: King,WA Deeds -Docld 5500900 Page: 4 of 6 Order: afsf Comment: {iT) In the original Protective Covenants the seoeed awls► paragraph following subparagraph (e) of Paragraph III, beginning with the words "Plans and Q specifications," shall be deleted and in lieu thereof the following shall be sabstituteds `f Plans and specifications for the construction, L installation cc alteration of all signs and land- ►!} soape,plantimq =at first be submitted to and have the written approval of the A.C.C. (3) no more than one driveway entrance to parking or load- ing areas shall be permitted for each 100 feet of frontage and the nearest edge of a driveway entrance shall be no closer than 20 feet to a side lot line or 125 feet from the second front line in the case of corner lots. Driveways shall not exceed 25 feet in width (not counting curb returns). 5.
