HomeMy WebLinkAboutOrd 0321 - Local Improvement District #3 TOWN OF TUKWILA, WASHINGTON ORDINANCE NO. 321 AN ORDINANCE ordering the carrying out of the system or plan for acquiring and construct- ing a system of sewerage for the Town, all to become a part of the waterworks utility of the Town, as specified and adopted in Ordinance No. ?)3.0 establishing Enlarged Local Improvement District No. 3, pursuant to property owners' petition therefor; providing the method of assessment in said District; providing that payment for a part of said improvement be made by special assessments upon properties in said District payable by the mode of "payment by bonds and providing for the issuance and sale of local improvement dis- trict warrants redeemable in cash and local im- provement district bonds. WHEREAS, by Ordinance No. 3') -0 passed by the Town Council, Town of Tukwila, Washington, and approved by the Mayor on the 1st day of May, 1961, the Town specified and adopted a system or plan for acquiring and constructing a system of sewerage for the Town, all to become a part of the waterworks utility of the Town, including a system of sewers, outfalls, works, plants and facilities for sewage treatment and disposal to provide for the needs of the areas within the Town, commonly known as the "South Central Regional Shopping Center" and "Andover Industrial Park," and providing for the payment of the cost of acquiring, con- structing and completing said system or plan from assessments to be levied in the amount of not to exceed $56,000.00 against the property included in the local improvement district proposed to be formed and the balance from the proceeds received from the issuance and sale of "Water and Sewer Revenue Bonds, 1961" in the amount of not to exceed $138,000.00 par value; and WHEREAS, a petition has been filed with the Town Council by the owners of property aggregating a majority (1) of the lineal frontage upon the improvement, and (2) of the area within u 3 3 the proposed Enlarged District setting forth the nature and ter- ritorial extent of the proposed improvement the mode 4f payment and what portion of the lineal frontage upon the improvement and of the area within the proposed Enlarged District is owned by the petitioners as shown by the records in the office of the County Auditor of King County petitioning for the carrying out of the system or plan for a system of sewerage as specified and adopted in Ordinance No. 1.-0 and WHEREAS Harstad Associates of Seattle, Washington, consulting engineers for the Town, have caused an estimate to be made of the cost and expense of the proposed improvement and have certified said estimate to the Town Council, together with all papers and information in their possession touching the pro- posed improvement, a description of the boundaries of the Enlarged District, a statement in detail of the local improvement assess- ments outstanding and unpaid against the property in the proposed Enlarged District and a statement of the aggregate actual valuation of the real estate, including 25% of the actual valuation of the improvements in the proposed Enlarged District, according to the valuation placed last upon it for the purpose of general taxation; and WHEREAS, said engineers have also determined that the petition is sufficient and the facts therein set forth are true; and WHEREAS, said estimate is on file in the office of the Town Clerk, together with a detailed copy of the preliminary Assessment Roll and the plans and assessment maps of the proposed improvement; and WHEREAS, the Town Council determined it to be in the best interests of the Town and of the owners of the property within -2- the Enlarged Local Improvement District that said improvement petitioned for as hereinafter described be carried out, and that an Enlarged Local Improvement District be created in connection therewith; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TUKWILA, WASHINGTON, as follows: Section 1. It is hereby ordered that the system or plan for acquiring and constructing a system of sewerage, including a system of sewers, outfalls, works, plants and facilities for sewage treatment and disposal, all to become a part of the water- works utility of the Town, as specified and adopted by Ordinance No. 3 a,p passed by the Town Council of the Town of Tukwila, Washington, and approved by the Maaor on the 1st day of May, 1961, be carried out, said improvement to consist of the following: (1) There shall be constructed and in- stalled a gravity sewage collection system, consisting of laterals of the following approxi- mate described size in, on, along, and over or under the following- described streets and roads: Approx. South 158th Street South 162nd Street 12" 1{ (2) There shall be constructed and installed a sewage lift station, complete with pumps, motors, electrical controls and other appurtenances as required, at or in the near vicinity of the inter- section of South 164th and 63rd Avenue South. (3) There shall be constructed a sewage treat- ment plant consisting of a stabilization pond, together with comminutor, flow measuring device, chlorinator and chlorine detention chamber, auxiliary effluent pump for high river conditions, control house and chlorinator building, and other appurtenances necessary for operation, with an 8" discharge line and outfall into the Green River, the said stabilization pond to be constructed -3- on the E 272.25 feet of the N 800 feet of the NW 1/4 of the SE 1/4 of Section 26, Twp. 23 N, R 4 E, W.M., containing 5.0 acres more or less, and the said discharge line to be constructed on an ease- ment on the S 30 feet of the SE 1/4 of the NE i/4 of Sec. 26, Twp. 23 N, R 4 E, W.M., and the S 30 feet of the SW 1/4 of the NW 1/4 of Sec. 25, Twp. 23 N, R 4 E, W.M., to the west bank of the Green River. (4) The treatment plant above provided for shall be connected to the sewage collection system above provided for with a pressure sewer line lo- cated and sized as follows: Approx. There shall be included the acquisition and installa- tion of all of the necessary valves, fittings, couplings, con- nections, equipment and appurtenances and the acquisition of any easements and rights of way and land that may be required; and there shall be included the performance of such work as may be incidental and necessary to the foregoing construction and installa- tion. The Town of Tukwila may modify the details of the fore- going system or plan, provided such modifications are deemed necessary or advisable in the judgment of the Town Council and will not substantially modify the functioning of the system. Section 2. There is hereby created and established an enlarged local improvement district to be called "Enlarged Local Improvement District No. 3," the boundaries of such enlarged local improvement district being described as follows: Beginning at a point 90.05 ft. E of the NW corner of Sec. 25, Twp. 23 N, R 4 E, W.M., King County, Washington, measured along the N line of said Sec. 25, which is a point on the centerline of 68th Ave. S.; -4- Thence S 0 12 1 09 E. 979.25 ft.; Thence S 73 0 23 1 09 E. 274.02 ft.; Thence S 52 °35 E. 116.32 ft.; Thence S 26 22 1 09" E 35 ft. more or less to the intersection with a line parallel to and 180 ft. N of the S line of the NW 1/4 of the NW 1/4 of Sec. 25, Twp. 23 N, R 4 E, W.M.; Thence easterly along said parallel line to the intersection with the W bank at the Green River in the NW 1/4 of said Sec. 25; Then generally southerly along the said west bank to the intersection with the following described line: Beginning at a point on the westerly line of said Sec. 25, 410.03 ft. S of NW corner of the SW 1/4 of the NW 1/4 of said Sec. 25; thence S 89'30 E. 55.31 ft.; thence on a curve to the right with a radius of 410.28 ft. a distance of 304.70 ft.; thence S 46 57' 4 9" E 700 ft. more or less to said W bank. Thence generally northwesterly along said des- cribed line to the W line of said Sec. 25; Thence westerly along a line parallel to and 410.03 ft. S of the N line of the S 1/2 of the NE i/4 of Sec. 26, Twp. 23 N, R 4 E, to the intersection with a line parallel to and 410.03 ft. W of the E line of the W 1/2 of the NE 1/4 of said Sec. 26; Thence northerly along said parallel line to the N line of the NW 1/4 of the NE 1/4 of said Sec. 26; Thence northerly 970.00 ft. along a line parallel to and 410.03 ft. W of the northerly rojection of the E line of the NW 1/4 of the NE 1/4 of Sec. 26, Twp. 23 N, R 4 E, W.M.; Thence S 78 E 425 ft. more or less to the inter- section with the said northerly projection of the E line; Thence N 85 E 480.00 ft.; Thence N 80' E 1100 ft. more or less to the intersection with centerline of 68th Ave. S in Sec. 24, Twp. 23 N, R 4 E, W.M.; Thence generally southerly along the centerline of 68th Ave. S. to the point 90.05 ft. E of the NW corner of said Sec. 25, Twp. 23 N, R 4 E, measured along the N line of said Sec. 25 which is the point of beginning. -5- Section 3. The estimated cost, as near as may be, of the improvement is hereby declared to be $194,000.00, and not to exceed $56,000.00 of said cost and expense shall be levied and assessed against all the property legally and properly assess- able therefor as provided by the laws of the State of Washington and the ordinances of the Town of Tukwila. Section 4. The assessments shall be made against the property in said Enlarged Local Improvement District in accordance with the zone and termini method of assessment provided by statute. Section 5. Local improvement district warrants shall be issued in payment of the cost and expense of the improvement herein ordered, such warrants to be payable out of the "Local Improvement Fund, Enlarged District No. 3," hereafter created, to bear interest from the date thereof at a rate to be hereafter fixed by ordinance not to exceed 6% per annum and to be redeemed in cash, and /or by local improvement district bonds herein authorize to be issued, said interest bearing warrants to be hereafter re- ferred to as "revenue warrants." Such bonds shall bear interest at a rate to be hereafter fixed by ordinance not exceeding 6% per annum, shall be payable on or before twelve (12) years from the date of issuance, the life of the improvement ordered being not less than twelve years, and shall be issued in exchange for and in redemption of any and all revenue warrants issued hereunder and not redeemed in cash within a period not to exceed 60 days after the first publication by the Town Treasurer of notice that the assessment roll for "Enlarged Local Improvement District No. 3" is in her hands for collection. The bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said District, payable in ten (10) equal annual installments, with interest at a rate to be hereafter fixed -6- by ordinance not exceeding 6% per annum, under the mode of payment by bonds," as defined by law and the ordinances of the Town of Tukwila. In the case of default in the payment of any assessment when the same shall become due, there shall be added interest at a rate to be hereafter fixed by ordinance not to exceed 6% per annum and a penalty of 5% which shall also be collected. The exact form, amount, date, interest rate and denominations of said warrants and bonds shall be hereafter fixed by ordinance of the Town Council. Said warrants and bonds shall be sold in such manner as the Town Council shall hereafter de- termine. Section 6. All the work necessary to be done in con- nection with the making of said improvement shall be done by and made by contract upon competitive bids and the Town shall have and reserves the right to reject any and all bids. The call for bids for work authorized pursuant to this Ordinance shall include a statement that payment for said work will be made in cash warrants drawn upon the "Local Improvement Fund, Enlarged District, No. 3." Section 7. There is hereby created and established in the office of the Town Treasurer of the Town of Tukwila, for Enlarged Local Improvement District No. 3, a special fund to be known and designated as "Local Improvement Fund, Enlarged District No. 3," into which fund shall be deposited the proceeds from the sale of revenue warrants drawn against said fund which may be issued and sold by the Town and collections pertaining to assessments, and against which fund shall be issued cash war- rants to the contractor or contractors in payment for the work to be done by them in connection with said improvement, and -7- against which fund cash warrants shall be issued in payment of all other items of expense in connection with said improvement.
