1: ** *BUILDING DEPARTMENT CONDITIONS * **
2: No changes shall be made to the approved plans unless approved by the design professional in responsible charge and the
Building Official.
3: All mechanical work shall be inspected and approved under a separate permit issued by the City of Tukwila Permit Center
(206/431- 3670).
4: All permits, inspection records, and approved plans shall be at the job site and available to the inspectors prior to
start of any construction. These documents shall be maintained and made available until final inspection approval is
granted.
5: New suspended ceiling grid and light fixture installations shall meet the non - building structures seismic design
requirements of ASCE 7.
6: Partition walls that are tied to the ceiling and all partitions greater than 6 feet in height shall be laterally braced
to the building structure.
7: All construction shall be done in conformance with the approved plans and the requirements of the International
Building Code or International Residential Code, International Mechanical Code, Washington State Energy Code.
8: All rack storage requires a separate permit issued through the City of Tukwila Permit Center. Rack storage over 8 -feet
in height shall be anchored or braced to prevent overturning or displacement during seismic events. The design and
calculations for the anchorage or bracing shall be prepared by a registered professional engineer licensed in the State
of Washington.
9: There shall be no occupancy of a building until final inspection has been completed and approved by Tukwila building
inspector. No exception.
10: Ventilation is required for all new rooms and spaces of new or existing buildings and shall be in conformance with the
International Building Code and the Washington State Ventilation and Indoor Air Quality Code.
11: All electrical work shall be inspected and approved under a separate permit issued by the City of Tukwila Building
Department (206- 431 - 3670).
12: All plumbing and gas piping work shall be inspected and approved under a separate permit issued by the Cityof Tukwila
Permit Center.
13: VALIDITY OF PERMIT: The issuance or granting of a permit shall not be construed to be a permit for, or an approval of,
any violation of any of the provisions of the building code or of any other ordinances of the City of Tukwila. Permits
presuming to give authority to violate or cancel the provisions of the code or other ordinances of the City of Tukwila
shall not be valid. The issuance of a permit based on construction documents and other data shall not prevent the
Building Official from requiring the correction of errors in the construction documents and other data.

15: The attached set of building plans have been reviewed by the Fire Prevention Bureau and are acceptable with the
following concerns:
16: The total number of fire extinguishers required for an ordinary hazard occupancy with Class A fire hazards is
calculated at one extinguisher for each 1,500 sq. ft. of area. The extinguisher(s) should be of the "All Purpose" (2A,
20B:C) dry chemical type. Travel distance to any fire extinguisher must be 75' or less. (IFC 906.3) (NFPA 10, 3 -2.1)
17: Portable fire extinguishers, not housed in cabinets, shall be installed on the hangers or brackets supplied. Hangers or
brackets shall be securely anchored to the mounting surface in accordance with the manufacturer's installation
instructions. Portable fire extinguishers having a gross weight not exceeding 40 pounds (18 kg) shall be installed so
that its top is not more than 5 feet (1524 mm) above the floor. Hand -held portable fire extinguishers having a gross
weight exceeding 40 pounds (18 kg) shall be installed so that its top is not more than 3.5 feet (1067 mm) above the
floor. The clearance between the floor and the bottom of the installed hand -held extinguishers shall not be less than 4
inches (102 mm). (IFC 906.7 and IFC 906.9)
18: Fire extinguishers shall not be obstructed or obscured from view. In rooms or areas in which visual obstruction cannot
be completely avoided, means shall be provided to indicate the locations of the extinguishers. (IFC 906.6)
19: Extinguishers shall be located in conspicuous locations where they will be readily accessible and immediately available
for use. These locations shall be along normal paths of travel, unless the fire code official determines that the
hazard posed indicates the need for placement away from normal paths of travel. (IFC 906.5)
20: Fire extinguishers require monthly and yearly inspections. They must have a tag or label securely attached that
indicates the month and year that the inspection was performed and shall identify the company or person performing the
service. Every six years stored pressure extinguishers shall be emptied and subjected to the applicable recharge
procedures. If the required monthly and yearly inspections of the fire extinguisher(s) are not accomplished or the
inspection tag is not completed, a reputable fire extinguisher service company will be required to conduct these
required surveys. (NFPA 10, 4 -3, 4 -4)
21: Egress doors shall be readily openable from the egress side without the use of a key or special knowledge or effort.
(IFC 1008.1.8.3 subsection 2.2)
22: Dead bolts are not allowed on auxiliary exit doors unless the dead bolt is automatically retracted when the door handle
is engaged from inside the tenant space. (IFC Chapter 10)
23: Door handles, pulls, latches, locks and other operating devices on doors required to be accessible by Chapter 11 of the
International Building Code shall not require tight grasping, tight pinching or twisting of the wrist to operate. (IFC
1008.1.8.1)
24: Exit hardware and marking shall meet the requirements of the International Fire Code. (IFC Chapter 10)
25: Exits and exit access doors shall be marked by an approved exit sign readily visible from any direction of egress
travel. Access to exits shall be marked by readily visible exit signs in cases where the exit or the path of egress
travel is not immediately visible to the occupants. Exit sign placement shall be such that no point in an exit access
corridor is more than 100 feet (30,480 mm) or the listed viewing distance for the sign, whichever is less, from the
nearest visible exit sign. (IFC 1011.1)

26: Every exit sign and directional exit sign shall have plainly legible letters not less than 6 inches (152 mm) high with
the principal strokes of the letters not less than 0.75 inch (19.1 mm) wide. The word "EXIT" shall have letters having
a width not less than 2 inches (51 mm) wide except the letter "I ", and the minimum spacing between letters shall not be
less than 0.375 inch (9.5 mm). Signs larger than the minimum established in section 1011.5.1 of the International Fire
Code shall have letter widths, strokes and spacing in proportion to their height. The word "EXIT" shall be in high
contrast with the background and shall be clearly discernible when the exit sign illumination means is or is not
energized. If an arrow is provided as part of the exit sign, the construction shall be such that the arrow direction
cannot be readily changed. (IFC 1011.5.1)

27: Exit signs shall be illuminated at all times. To ensure continued illumination for a duration of not less than 90
minutes in case of primary power loss, the sign illumination means shall be connected to an emergency power system
provided from storage batteries, unit equipment or on -site generator. (IFC 1006.1, 1006.2, 1006.3)
28: Means of egress, including the exit discharge, shall be illuminated at all times the building space served by the means
of egress is occupied. The means of egress illumination level shall not be less than 1 foot -candle (11 lux) at the
floor level. The power supply for the means of egress illumination shall normally be provided by the premise's
electrical supply. In event of a power failure an emergency power system shall provide power for a duration of not less
than 90 minutes and shall consist of storage batteries, unit equipment or on -site generator. (IFC 1006.1, 1006.2,
1006.3) The path of egress shall require emergency lighting until exit discharge is accomplished.
29: Aisles leading to required exits shall be provided from all portions of the building and the required width of the
aisles shall be unobstructed. (IFC 1013.4)
30: Minimum required sprinkler density for mercantile occupancies is ORDINARY HAZARD GROUP 2. Submit hydraulic calculations
to substantiate required density.
31: Maintain sprinkler coverage per N.F.P.A. 13. Addition/relocation of walls, closets or partitions may require relocating
and/or adding sprinkler heads. (IFC 901.4)
32: Sprinklers shall be installed under fixed obstructions over 4 feet (1.2 m) wide such as ducts, decks, open grate
flooring, cutting tables, shelves and overhead doors. (NFPA 13- 8.6.5.3.3)
33: All new sprinkler systems and all modifications to existing sprinkler systems shall have fire department review and
approval of drawings prior to installation or modification. New sprinkler systems and all modifications to sprinkler
systems involving more than 50 heads shall have the written approval of the W.S.R.B., Factory Mutual, Industrial Risk
Insurers Kemper or any other representative designated and /or recognized by the City of Tukwila, prior to submittal to
the Tukwila Fire Prevention Bureau. No sprinkler work shall commence without approved drawings. (City Ordinance #2050)
34: The fire department connection (FDC) shall have a downward angle bend between 22.5 and 45 degrees, with a 5 -inch Storz
fitting(s) and Knox FDC locking Storz cap. (NFPA 13- 6.8.3) (City Ordinance #2050)
35: The height of fire department connections (FDC's) shall be 36 to 48 inches above grade.
36: Fire department connections (FDC's) shall be oriented in the direction of fire apparatus access, have a 4 foot clear
space in front and to the sides of the connection, be appropriately signed, have the building address served by the FDC
stenciled vertically in 3 -inch high white numbers on a "safety red" background directly beneath the hose connection
facing the direction of vehicular access, and protected from potential vehicular damage.
37: Post Indicator Valves (Ply's) shall have the building address served by the PW stenciled vertically in 3 -inch high
white numbers on a "safety red" background, facing the direction of vehicular access.
38: Fire hydrants shall conform to American Water Works Association specifications C- 502 -54; it shall be compression type,
equipped with two 2 -1/2" N.S.T. hose ports and one 5" Storz pumper discharge port, and shall have a 1 -1/4" Pentagon
open -lift operating nut. (City Ordinance #2052)
39: A fire alarm system is required for this project. The fire alarm system shall meet the requirements of N.F.P.A. 72 and
City Ordinance #2051. (THIS REQUIREMENT INCLUDES 2nd FLOOR ALSO.)
40: An approved manual fire alarm system including audible /visual devices and manual pull stations is required for this
project. The fire alarm system shall meet the requirements of Americans With Disabilities' Act (I.B.C.), N.F.P.A. 72
and the City of Tukwila Ordinance #2051.
41: Local U.L. central station supervision is required. (City Ordinance #2051)

42: Maintain fire alarm system audible /visual notification. Addition/relocation of walls or partitions may require
relocation and/or addition of audible /visual notification devices. (City Ordinance #2051)
43: All new fire alarm systems or modifications to existing systems shall have the written approval of The Tukwila Fire
Prevention Bureau. No work shall commence until a fire department permit has been obtained. (City Ordinance #2051) (IFC
104.2)
44: An electrical permit from the City of Tukwila Building Department Permit Center (206- 431 -3670) is required for this
project.
45: All electrical work and equipment shall conform strictly to the standards of the National Electrical Code. (NFPA 70)
46: New and existing buildings shall have approved address numbers, building numbers or approved building identification
placed in a position that is plainly legible and visible from the street or road fronting the property. These numbers
shall contrast with their background. Address numbers shall be Arabic numbers or alphabet letters. Numbers shall be a
minimum of 4 inches (102mm) high with a minimum stroke width of 0.5 inch (12.7mm). (IFC 505.1)
47: The maximum flame spread class of finish materials used on interior walls and ceilings shall not exceed that set forth
in Table No. 803.5 of the International Building Code.
48: This review limited to speculative tenant space only - special fire permits may be necessary depending on detailed
description of intended use.
49: Contact The Tukwila Fire Prevention Bureau to witness all required inspections and tests. (City Ordinances #2050 and
#2051)
50: Any overlooked hazardous condition and/or violation of the adopted Fire or Building Codes does not imply approval of
such condition or violation.

Permit # D10 -051 was issued to you on May 18, 2010 regarding the above referenced property for which
you paid $13,518.88 in traffic impact fees. On June 2, 2010 you subsequently submitted a letter protesting
the calculation of those fees in accordance with the Tukwila Municipal Code (TMC). In an effort to resolve
this matter without the time and effort involved by using a hearing examiner, this letter offers a
recalculation of your Traffic Impact Fees using a slightly modified methodology.
Your transportation engineer provided letters dated April 20th and May 5th of 2010 that included discussions
of trip generation analysis for the proposed development. We have reviewed the information provided in
those letters as well as the methodology used to calculate the initial traffic impact fees and are proposing a
slightly modified calculation that we hope is acceptable to both parties and will resolve your appeal. In
short, the net new number of p.m. peak hour trips has been reduced from 12 (as initially calculated) to 6
(recalculation). This effectively reduces the traffic impact fee by half to a new total of $6,759.44. Also, in
light of your expenses incurred by hiring your own transportation engineer, the traffic concurrency fee in
the amount of $1,800 is proposed to be waived. Since the concurrency fee was never paid, no refund
would be in order. In effect, a refund to you in the amount of $6,759.44 will be processed if you agree to
accept this recalculation of your traffic impact fee.
I trust that this explanation of your revised traffic impact fee is clear. Please respond in writing if you
accept this recalculated fee and wish to drop your appeal. If accepted, a refund will be processed as quickly

Dear Mr. Barber:
In a letter dated April 26, 2010 written on your behalf by Mikhail Ekshtut, PE, you presented
arguments on using a different approach in calculating traffic impact fees for the above
mentioned property. You are proposing to convert 15,764 square feet of an existing office
building to a retail use.
In your April 26, 2010 letter, arguments were made regarding existing trip generation based on
the application of the ITE Land Use Code 715, Single Tenant Office Building, to the existing
building. That is an incorrect application of the land use code. According to ITE, a Single
Tenant Office Building is described as "generally contain(ing) offices, meeting rooms, and space
for file storage and data processing of a single business or company, and possibly other service
functions, including a restaurant or cafeteria." While the building at 375 Corporate Drive S
may have been previously occupied by a single tenant, the building was originally constructed in
1979 as part of the Southcenter Corporate Square business park and effectively functions as an
office or business park. On page 3 of the letter from Mr. Ekshtut, it is clearly stated that this
building is located within the business park.
The existing building better meets the description of an office park. From the ITE Trip
Generation manual, "office parks are usually suburban subdivisions or planned unit
developments containing general office buildings and support services, such as banks,
restaurants and service stations, arranged in a park- or campus -like atmosphere." The
development history and the site layout clearly points to an office park development. The City's
initial application of Office Park (ITE LU 750) remains the correct choice. Use of General
Office Building (I');E LU 710) could also be applied, but the net result is the same in this case as
the Office Park.
A further argument was presented against the City's application of Shopping Center (ITE LU
820) for the proposed retail use. Mr. Ekshtut stated that shopping centers are integrated groups
of commercial establishments encompassing hundreds of thousands of square feet. Instead, the
proposal was made to use the Specialty Retail Center (ITE LU 814).

According to ITE, a shopping center is defined as follows.
A shopping center is an integrated group of commercial establishments that is
planned, developed, owned and managed as a unit. A shopping center's
composition is related to its market area in terms of size, location, and type of
store. A shopping center also provides on -site parking facilities sufficient to serve
its own parking demands.
The Trip Generation manual goes further in clarifying the definition with the following.
Shopping centers, including neighborhood centers, community centers, regional
centers and super regional centers, were surveyed for this land use. Some of
these centers contained non - merchandising facilities, such as office buildings,
movie theaters, restaurants, post offices, banks, health clubs and recreational
facilities (for example, ice skating rinks or indoor miniature golf courses. The
centers ranged in size from 1,700 to 2.2 million square feet gross leasable area
(GLA). The centers studied were located in suburban areas throughout the United
States and therefore represent typical U.S. suburban conditions.
It is reasonable to assume that the proposed conversion could fall under the Shopping Center
land use. However, application of Specialty Retail Center can be considered. Specialty Retail is
defined by ITE as "generally small strip shopping centers that contain a variety of retail shops
and specialize in quality apparel, hard goods, and services, such as real estate office, dance
studios, florists and small restaurants." From the information provided in Mr. Ekshtut's letter, it
appears that the proposed retail is intended to be a discount retail store, not a quality or highly
specialized establishment which would be expected under the proposed land use code.
Presuming that the surrounding area operates as an office park, an argument could be made that
retail is present and integrated within the office park. The fallacy of this argument is that the
retail associated with an office park is generally a supporting or complementary retail use. If this
retail conversion were to be an office supply store, bank, or other complementary use,
application of Office Park could be applied, but a discount retailer is not a supporting use for an
office park.
The conclusion is that the proposed retail conversion matches neither retail land use description
nor the office park definition perfectly and it becomes a matter of engineering judgment to
determine the proper application.
The City will accept the application of Specialty Retail Center, even though the amount of data
supporting the ITE Trip Generation rate is extremely low and falls under the recommendation for
supplementation with local data. With this acceptance, there are changes to how the trip
generation adjustments are calculated from those presented on April 15, 2010. Specialty Retail,
by its very nature, is more of a destination and less subject to pass -by trip influences. As a
destination, patrons are expected to be traveling longer distances on average than patrons of a
shopping center. Inclusion of a 3% capture rate is acceptable.

Applying the ITE Trip Generation Handbook methodology to calculate trip generation is
appropriate. Calculating trip generation for this site as a Specialty Retail land use can be done by
using either the weighted average or the regression equation — selection is left to the discretion of
the analyst. Because of the extremely small amount of study data behind this land use, the City
is recommending using an average of the two methodologies, which yields 48 trips.
Since Specialty Retail Center has not been specifically defined within the Traffic Impact Fee
Schedule (2007), application of the adjustment factors used for Miscellaneous Retail will be
applied. A 25% pass -by rate will be applied, even though arguments could be readily made that
the actual rate will be lower. Using the 34% pass -by rate associated with the Shopping Center
land use is incorrect as it has been established that the proposed site is not a Shopping Center. As
stated above, the trip length adjustment factor will also be modified from that used for a
Shopping Center to reflect the longer trip lengths associated with a more specialized retail. This
is summarized in the attached table.
The proposed site will generate an additional 12 pm peak hour trips using the discussion above.
Application of a reduction for trip length results in a Traffic Impact Fee amount of $13,518.88
due at the time of building permit issuance.

a more reasonable dollar number. I trust your team will agree. As we discussed, there are two
common areas in the building used by the second floor tenants that are not a part of the retail.
The front lobby is 1,147 SF and the rear stairway is 190 SF for a total of 1,337 SF. This could
be removed from the 15,764 SF previous noted as change of use to retail so that the real retail
area would then be 14,427 SF.
I'm not sure how much it changes things but you can review in light of Mike's report.

In a letter dated April 9, 2010, you requested an explanation as to how the Traffic Impact Fee Schedule
(2007) would be applied to your proposed conversion of an administrative office area to a general retail
use. You have already provided information to the City describing the first floor of the building at 375
Corporate Drive S would be changed from office to retail space, but the remainder of the building would
not change.
Breaking down the floor space into office area, storage area, and retail sales floor area does not affect the
trip generation of the conversion, which is the basis of the Traffic Impact Fee. The overall usage of the
converted area is considered to be gross leasable area for the retail use. Applying the ITE Trip Generation
Manual to the total 15,764sf yields a total trip generation of 157 pm peak hour trips. Retail trips have a
high percentage of pass -by trips — essentially people driving by and deciding to stop and shop. A reduction
of 67 trips is applied to the overall trip generation of the retail space yielding a net new trip generation of
91 pm peak hour trips.
Since the existing building has been vacant for less than 12 months, the site is credited with the previous
trip generation of 23 trips. Subtracting the 23 trips from the 91 trips associated with the retail development
yields a net new trip generation of 67 pm peak hour trips. Within the Traffic Impact Fee schedule are
additional adjustments for trip length, which when applied to the net new trips generated by this
redevelopment, results in an impact fee of $47,175.24 due at the time of building permit issuance. This is
all detailed in the attached table. Without application of the trip length adjustment factor, the impact fee
calculated straight from the 2007 Schedule would yield a much larger sum of $116,365.60.

On behalf of Mr. Fred Barber, I am pleased to submit this Trip Generation and Traffic Mitigation
Analysis for the Barber Retail Building located at 375 Corporate Drive S in the City of Tukwila.
The remodel of this building proposes to convert 15,764 square feet of previously occupied
single- tenant office space into a discount retail store. This Analysis provides detailed vehicle trip
generation calculations for both existing and proposed future land uses of this redevelopment
project
Additionally, this Analysis is in response to the City's April 8, 2010 memorandum and follow -up
letter, dated April 15, 2010, from Bob Giberson, PE, the City's Public Works Director. Copies of
this memorandum and letter are attached at the end of this report.
Project Trip Generation
A vehicle trip is defined as a single, one directional, vehicle movement either originating or
terminating (exiting or entering) in the study area. These trip generation values account for all
site trips made by all motor vehicles for all purposes, including customer, employee, visitor and
service and delivery trips.
The Trip Generation Summary below shows the estimated number of vehicle trips generated
by the existing and proposed project during the PM peak hour. The PM peak hour is typically
the hour of the highest volume of vehicle traffic generated during the course of an average
weekday.
The trip generation was calculated using the fitted curve equations, or average rates, per the
Institute of Transportation Engineers (ITE) Trip Generation, 8th Edition, 2008, for a Specialty
Retail Center (ITE Land Use Code 814) for the proposed use and as a Single Tenant Office
Building (ITE Land Use Code 715) for the existing use. These particular land uses were chosen
because they most accurately represent the existing and proposed land uses for this
redevelopment project, and most accurately account for the relatively small floor area being

incorporated. The Shopping Center land use (ITE Land Use Code 820), while somewhat similar,
would not be appropriate for this proposed land use. Shopping centers are an "integrated group
of commercial establishments ", and typically encompass hundreds of thousands of square feet
of gross leasable area. They are similar to Southcenter Mall, and are not stand -alone stores
such as the one being proposed by the Barber Building redevelopment project. The use of the
fitted curve equation versus using the average rate was determined based on the number of
data points (trip generation studies) that most closely matched the small size of this proposed
redevelopment project.

The Trip Generation Summary shows that after the proposed redevelopment project, the Barber
Building would generate 10 net new [entering] trips during the PM peak hour. These trip
calculations account for the reductions taken for pass -by trips and captured trips.
Pass -by trips are those vehicle trips already "passing -by" on an adjacent roadway, heading to
another destination, that decide to turn into the project site. These are not considered to be new
trips generated by the project site.

Barber Building Redevelopment
Per the ITE Trip Generation Handbook, the calculated average pass -by rate of 34% for a
Shopping Center (ITE Land Use Code 820) was used to account for the pass -by trip reduction,
since this land use is the most similar to the project's proposed discount retail store. This rate
also appears to be reasonable given the amount of adjacent and nearby retail venues,
including; Tuesday Morning, a similar discount retail store located on the east side of Andover
Park W, directly across from the project building, and the adjacent (to the west) Southcenter
Square shopping center, which includes Nordstrom Rack, Kohl's and many restaurants. The
pass -by fitted curve equation, shown in the City's April 15th Barber Retail Building Trip
Generation Matrix, cannot be used because it gives a value higher than the total number of
proposed retail trips generated by the project.
Captured trips are those trips considered to be internal within the site and are also not
considered to be new vehicle trips, because they do not generate traffic onto the surrounding
•streets. Therefore, a small trip reduction (3 %, per the average rate calculated in the ITE Trip
Generation Handbook) was also taken in order to account for the captured trips generated by
the proposed discount retail store. This captured trip reduction is also very reasonable,
considering that the Barber building is located within the Southcenter Corporate Square
business park, which includes about eight other buildings and provides space for 21 other retail,
office and education activities.
Transportation Impact Mitigation
Per the City's Traffic Impact Fee schedule and as indicated in the City's April 15, 2010 letter, a
trip adjustment is also made to the net new trips to account for trip length. Thus, using the City's
identified Trip Length Adjustment Factor of 0.4 (calculated in the Barber Retail Building Trip
Generation Matrix) there would be four net new [entering] trips (10 net new trips x 0.4)
generated by the proposed discount retail store during the PM peak hour. Applying the City's
traffic impact fee of $1,736.80 per trip to these four net new trips would amount to a traffic
impact mitigation fee of $6,947.20 for the proposed Barber building redevelopment.
No further traffic mitigation has been identified by the City, nor should be necessary for this
proposed building redevelopment project. Furthermore, as indicated in the City's April 8, 2010
memorandum, the Traffic Concurrency Certificate Application has been completed and provided
by the Applicant.

5) In accordance with Washington State Department of Health guidelines for Group A Public Water
Systems, Public Works has implemented a cross - connection control program to protect the public
water system from contamination via cross - connection. The City has determined that the Barber
Retail building has deficiencies on domestic, fire, and irrigation backflow devices; requiring the
following upgrades.
a) Domestic Water Service
A Reduced Pressure Principle Assembly (RPPA), previously called a Reduced Pressure
Backflow Assembly (RPBA), shall be installed immediately downstream of the existing 1.5 -inch
domestic water meter. Installation at another location requires approval by the Director of Public
Works. The RPPA shall be installed in a Hot Box/Hot Rock or equal freeze protection enclosure
anchored to a minimum 4" thick concrete pad. Public Works recommends, but does not require,
a power supply for the freeze protection enclosure. Please specify RPPA size, manufacturer, and
model number on plans and submit a cut sheet for the proposed device. Show location of the
new RPPA on a plan sheet.
b) Landscape Irrigation
The annual test required by the Washington State Department of Health for the existing irrigation
backflow device (DCVA) is past due. Please have the backflow device tested by a certified
tester and submit passing test report to Public Works.
An AMR upgrade to the existing irrigation deduct meter is required.
c) Fire Prevention
The private fire hydrant at the NW corner of the building needs to be upgraded with a Storz
adapter.
The annual test required by the Washington State Department of Health for the existing Fire
(DCDVA) is past due. Please have the backflow device tested by a certified tester and submit
passing test report to Public Works.

I have enclosed Public Works Bulletin C5 (design and installation requirements for cross
connection control), which spells out design and installation requirements for cross connection control.
The Public Works Director will withhold issuance of this Tenant Improvement permit until the backflow
issues are resolved or the Permit Center receives plans for the subject backflow items. Applicant can
post a bond for these items in the amount equal to 150% of the design, installation, and testing cost of
required backflows together with a letter from the Owner of the Building, stating the installation will be
completed by a certain date.

The Building Division has deemed the subject permit application incomplete. To assist the applicant in
expediting the Department plan review process, please forward the following comments.
(GENERAL NOTE)
PLAN SUBMITTALS: (Min. size 11x17 to maximum size of 24x36; all sheets shall be the same size).
(If applicable) Structural Drawings and structural calculations sheets shall be original signed wet
stamped, not copied.)
1. Please provide a means of egress plan. Refer to section 106.1.2 of the 2006 IBC. We prefer to see the
means of egress depicted as a shaded path through the space connecting at least two exits when two or
more exits are required. The common paths leading to the means of egress should not be shaded. The
maximum distance a person can travel from a most remote point to the means of egress is per section
1014.3 IBC, 1014.4.2 IBC and 1025.8 IBC. Once a person reaches the means of egress pathway, they
need to be able to travel in at least two distinct directions to an exit. The means of egress path is required
to have emergency lighting along its entire length at intensity levels per section 1006.4 IBC. Please show
compliance with this requirement on plans. This plan is also a good place to show placement of lighted
exit signage. The width of the means of egress path shall be per section 1005.1 IBC and shall be
indicated on the plan.

1. I have made application for a permit from the City of Tukwila, Washington.
2. I understand that state law requires that all building construction contractors be registered with the
State of Washington. The exceptions to this requirement are stated under Section 18.27.090 of the
Revised Code of Washington, a copy of which is printed on the reverse side of this Affidavit. I have
read or am familiar with RCW 18.27.090.
3. I understand that prior to issuance of a permit for work which is to be done by any contractor, the
City of Tukwila must verify either that the contractor is registered by the State of Washington, or that
one of the exemptions stated under RCW 18.27.090 applies.
4. In order to provide verification to the City of Tukwila of my compliance with this requirement, I
hereby attest that after reading the exemptions from the registration requirement of RCW 18.27.090,
I consider the work authorized under this permit to be exempt under number 1 , and will therefore
not be performed by a registered contractor.
5. I understand that the licensing provision of RCW 19.28.161 through 19.28.271 shall not apply to
persons making electrical installations on their own property or to regularly employed employees
working on the premises of their employer. The proposed electrical work is not for the construction
of a new building for rent, sale or lease.

18.27.090 Exemptions, The regtion provisions of this chapter do not apply
1. An authorized representative of the United States
government, the state of Washington, or any incorporated
city, town, county, township, irrigation district, reclamation
district, or other municipal or political corporation or
subdivision of this state;
2. Officers of a court when they are acting within the scope
of their office;
3. Public utilities operating under the regulations of the
utilities and transportation commission in construction,
maintenance, or development work incidental to their own
business;
4. Any construction, repair, or operation incidental to the
discovering or producing of petroleum or gas, or the
drilling, testing, abandoning, or other operation of any
petroleum or gas well or any surface or underground mine
or mineral deposit when performed by an owner or lessee;
5. The sale of any finished products, materials, or articles of
merchandise that are not fabricated into and do not become
a part of a structure under the common law of fixtures;
6. Any construction, alteration, improvement, or repair of
personal property performed by the registered or legal
owner, or by a mobile /manufactured home retail dealer or
manufacturer licensed under chapter 46.70 RCW who shall
warranty service and repairs under chapter 46.70 RCW;
7. Any construction, alteration, improvement, or repair
carried on within the limits and boundaries of any site or
reservation under the legal jurisdiction of the federal
government;
8. Any person who only furnished materials, supplies, or
equipment without fabricating them into, or consuming
them in the performance of, the work of the contractor;
9. Any work or operation on one undertaking or project by
one or more contracts, the aggregate contract price of
which for labor and materials and all other items is less
than five hundred dollars, such work or operations being
considered as of a casual, minor, or inconsequential nature.
The exemption prescribed in this subsection does not apply
in any instance wherein the work or construction is only a
part of a larger or major operation, whether undertaken by
the same or a different contractor, or in which a division of
the operation is made into contracts of amounts less than
five hundred dollars for the purpose of evasion of this
chapter or otherwise. The exemption prescribed in this
subsection does not apply to a person who advertises or
puts out any sign or card or other device which might
indicate to the public that he or she is a contractor, or that
he or she is qualified to engage in the business of
contractor;
10. Any construction or operation incidental to the
construction and repair of irrigation and drainage ditches
of regularly constituted irrigation districts or reclamation
districts; or to farming, dairying, agriculture, viticulture,
horticulture, or stock or poultry raising; or to clearing or
other work upon land in rural districts for fire prevention
purposes; except when any of the above work is performed
by a registered contractor;
11. An owner* who contracts for a project with a registered
contractor, except that this exemption shall not deprive the
owner of the protections of this chapter against registered
and unregistered contractors. The exemption prescribed in
this subsection does not apply to a person who performs
the activities of a contractor for the purpose of leasing or
selling improved property he or she has owned for less than
twelve months;
12.* Any person working on his or her own property,
whether occupied by him or her or not, and any person
working on his or her personal residence, whether owned
by him or her or not but this exemption shall not apply to
any person who performs the activities of a contractor on
his or her own property for the purpose of selling,
demolishing, or leasing the property;
13. An owner* who performs maintenance, repair, and
alteration work in or upon his or her own properties, or
who uses his or her own employees to do such work;
14. A licensed architect or civil or professional engineer
acting solely in his or her professional capacity, an
electrician certified under the laws of the state of
Washington, or a plumber certified under the laws of the
state of Washington or licensed by a political subdivision of
the state of Washington while operating within the
boundaries of such political subdivision. The exemption
provided in this subsection is applicable only when the
person certified is operating within the scope of his or her
certification;
15. Any person who engages in the activities herein
regulated as an employee of a registered contractor with
wages as his or her sole compensation or as an employee
with wages as his or her sole compensation;
16. Contractors on highway projects who have been
prequalified as required by RCW 47.28.070, with the
department of transportation to perform highway
construction, reconstruction, or maintenance work;
17. A mobile /manufactured home dealer or manufacturer
who subcontracts the installation, set -up, or repair work to
actively registered contractors. This exemption only applies
to the installation, set -up, or repair of the
mobile /manufactured homes that were manufactured or
sold by the mobile /manufactured home dealer or
manufacturer;
18. An entity who holds a valid electrical contractor's
license under chapter 19.28 RCW that employs a certified
journeyman electrician, a certified residential specialty
electrician, or an electrical trainee meeting the
requirements of chapter 19.28 RCW to perform plumbing
work that is incidentally, directly, and immediately
appropriate to the like -in -kind replacement of a household
appliance or other small household utilization equipment
that requires limited electric power and limited waste
and /or water connections. An electrical trainee must be
supervised by a certified electrician while performing
plumbing work.
• Per Washington State Department of Labor and Industries, lessee has been
interpreted to be equivalent to owner for the purpose of these exemptions.
