I been gone for near two months and I can't find the letter or letters. The addresses are 13217 40th Avenue S. and 4033 S. 128th st. I am trying to come up with money for the windows. I want them wood windows double hung matching the house and the bid I got is $21,000 by Van Tone who is a fair company. No wonder people use vinyl! I used the money allocated to fix my home so that I could refinance while waiting for the permit that dragged on and on, on the foundation & framing in the green house that cost me a bundle. The gas line run next to the footing so I had to dig by hand. Now I am having a hard time getting funding. I need more time. On my home, I have a real problem with my neighbors on both sides. I am attaching my letter in response to the Brenner's lawyer sent certified have not heard from them but they have not removed their fence from my property. I found my garage door screwed to the frame. he called me one day at 4 a.m. to tell me that my door was banging I used to sleep facing it for years and never heard it. 1 went out and closed it. I have had to call the police after Mr. Brenner came to my home about 7 a.m. knocking on the door and screaming. The officer talked to him and then told me to get a restraining order. I been told that he is doing crack and amphetamines by various neighbors. I am really scared. 1 need to fence everything and put a gate before I move the house I need to have people staying in the house while I am gone on my job I will get a restraining order to do the construction and removal of their fence. It is going to be ugly. I have had stolen from my home a chop saw, a reciprocating saw, a palm sander, a portable table saw. The stealing is not at once. I have all my portable tools at a friends house because I can't leave them at home. Now, there is like a couch and several windows outside of my home, in the street. Candy Spencer the old owner of the house next to David Stein had two refrigerators dumped at her place. She believes that Nara, a guy that works cleaning windows with Mr. Brenner, and used to live next to her, put them there. Who is responsible for it? On the new houses they have added the dirt of the foundation to their backyards what is going to exacerbate an already serious problem of flooding in my basement. So even if I was ready to lift the house, 1 am very concerned about where their water Is going to go this winter, They have no plan for gutters in their permit and their soil does not drain. When they dug for the foundations, the water stayed in like a pool. On the mechanical permit at 40th I do not know why I got it out since it is going to be a while before I can deal with it. It already was extended. Sorry for the long letter. There is just too much happening. The item of this letter is to extend the permits. 1 ma not a builder that builds with standard Home Depot like materials. I am doing custom made work and that takes more time and money. I believe the house could be a nice B &B when the neighborhood improves, but I have no intention of starting one. The house will remain residential for the foreseeable future. I plan to build a double deck after this phase is completed and the spiral stairs are part of it.. 2. The basement will remain open space as it is now. I am including some small walls to satisfy Plans Review. With the plumbing permit, I may install some drain stubs for future use. 3. Lot grade is an even -37" from the bottom of the joist through out. There will be an increase grade of 11" at front and 24" decrease along the house in the west side. See contours page 2 4. There used to be large maples on the property line with the Hemenway's to the East. In 1990, I paid $5,000 to the previous owner for a survey of the property and for taking the large maples out that had been poisoned, but I did not specified for the removal of the stumps so they were left in. In June 1997 the Hemmenway's cut down my birch and lilac trees to build a fence with posts placed on mounds of concrete. See pictures. I believe the posts are in my property and that the marker was moved since I only have 49' of property. I have until mid 2007 to challenge the fence in court. I was hopping that they sell the property after the recent short plat and that I can come to an agreement with a new owner without litigation. Building a driveway without removing the stumps and with the fence in the wrong place would be very wasteful. I am told that you have no provisions for an exception while this issue is resolved and I need to get this permit approved without more delays. 5. Any person who only furnished materials, supplies, or equipment without fabricating them into, or consuming them in the performance of, the work of the contractor, 10. Any work or operation on one undertaking or project by one or more contractors, the aggregate contract price of which for labor and materials and all other items is less than $500.00, such work, or operations being considered as of a casual, minor, or inconsequential nature. The exemption prescribed in this subsection does not apply in all instance wherein the work or construction is only a part of a larger or major operation, whether undertaken by the same or a different contractor, or in which a division of the operation is made into \applications\8 -2004 affidavit in lieu of contractor registration contracts of amounts less than $500.00 for the purpose of the evasion of this chapter or otherwise. The exemption prescribed in this subsection does not apply to a person who advertises or puts out any sign or card or other device which might indicate to the public that he is a contractor, or that he is qualified to engage in the business of contractor; 11. Any construction or operation incidental to the construction and repair of irrigation and drainage ditches of regularly constituted irrigation districts or reclamation districts; or to farming, dairying, agriculture, viticulture, horticulture, or stock or poultry raising; or to clearing or other work upon land in rural districts for fire prevention purposes; except then any of the above work is performed by a registered contractor; 12. An owner who contracts for a project with a registered owner, 13. Any person working on his own property, whether occupied by him or not, and any person working on his residence, whether owned by him or not but his exemption shall not apply to any person otherwise covered by this chapter who constructs an improvement on his own property with the intention and for the purpose of selling the improved property; 14.
