Tukwila, WA 98168 Parcel 8864000660 CASE NO.: RFA10 -519 SUMMARY OF HEARING On December 17, 2010, at 11:00 a.m., the Improvement Officer held a hearing regarding this matter to gather information to supplement what was discovered during the Code Enforcement Officer's initial investigation of the Subject Property. The following City of Tukwila staff attended the hearing: Kathryn Stetson, Improvement Officer Mary Hulvey, Code Enforcement Officer Bob Benedicto, Building Official Don Tomaso, Fire Marshal Representing the property owner: Property owner did not attend the hearing FINDINGS OF FACT Based on the Code Enforcement Officer's initial investigation of this matter, and the information gathered at the above described hearing, the Improvement Officer makes the following Finding of Facts. 1. On November 22, 2010, the Tukwila Fire Department responded to a fire at the above location. When they entered the building they found the entire structure filled nearly to the ceiling with personal items and debris. The Fire Department contacted Code Enforcement Officer Mary Hulvey, who responded to the location. 2. Fire fighters were forced to cut through a bedroom wall from the outside and pull out the smoldering contents into the front yard in order to extinguish the blaze. 3. The structure was secured with plywood over the cut out openings after the fire was extinguished. The debris pulled from the house remains piled in the front yard. 4. The Fire Marshal indicated that a portion of the structural support will need to be replaced and all wallboard, appliances and electrical components will need to be removed and replaced with new. All items inside the structure have been smoke and water damaged. 5. The issued Complaint of Unfit Building issued on November 29, 2010 cited the following: a. IPMC 108.1.3 Structure unfit for human occuioancv. "Structure is unfit for human occupancy whenever the code official finds that such structure is in disrepair or lacks maintenance, in insanitary, vermin or rat infested, contains filth and contamination, or lacks ventilation, illumination, sanitary or heating facilities or other essential equipment required by this code, or because location of the structure constitutes a hazard to the occupants of the structure or to the public." b. IPMC 108.1.5.7 Danaerous structure or premises. "The building or structure is neglected, damaged, dilapidated, unsecured or abandoned so as to become an attractive nuisance to children who might play in the building or structure to their danger, becomes a harbor for vagrants, criminals or immoral persons, or enables persons to resort to the building or structure for committee a nuisance or an unlawful act." 6. The structure is unfit for human occupancy due to the extent of the fire damage, the lack of electrical power, and because is it filled with debris. It currently lacks cooking facilities, utilities, heat, contains broken windows and doors. Determination and Order Based on the initial investigation of this matter, and the information gathered at the above described hearing, the Improvement Officer makes the following Determination and Order: The structure is unfit for human occupancy due to the extent of the fire damage, the lack of required utilities, and the amount of debris contained inside the structure. The property owner is herebv ordered to: 1. Remove all fire damaged debris and all other debris and household goods inside the structure and outside in the yard and properly dispose of same. 2. Obtain City- issued building repair permit for structural repairs to all fire damaged components. All required inspections must be completed satisfactorily. 3. Obtain City- issued plumbing, mechanical, and electrical permits as needed. All required inspections must be completed satisfactorily. 4. Utility service may be restored when the repairs are completed. An electrical safety inspection is required prior to restoring electrical service. 5. Structure must be secured against unlawful entry at all times. 6. All debris removal must be completed not later than January 10, 2011. 7. Repair permit applications must be submitted to the City by January 31, 2011. 8. Structure must be secured against unlawful entry immediately (not later than 12/23/10). Appeal You are entitled to appeal this Determination, Findings of Fact, and Order. You must request an appeal within thirty (30) calendar days after receiving this Determination (by January 28, 2011). The appeal must be in writing to the Tukwila Office of the City Clerk, 6200 Southcenter Boulevard, Tukwila, WA 98188. An appeal fee must be submitted with the written appeal request. An open record appeal hearing will be scheduled before the Tukwila Hearing Examiner within 30 days from the date the appeal is filed. At that hearing you may present evidence and testimony from you and other witnesses, including new information not previously presented to the Improvement Officer, challenging this Determination, Findings of Fact, and Order. Remediation /Penalties If you do not appeal this ruling and fail to comply with the Determination, Findings of Fact, and Order, the Improvement Officer may direct or cause the subject dwelling, building, structure or premises to be repaired, altered, improved, vacated, and closed, removed or demolished pursuant to RCW Chapter 35.80. The cost of any action taken by the Improvement Officer under TMC 8.45.200 shall be assessed against the subject property pursuant to RCW Chapter 35.80. Upon certification by the City of Tukwila Finance Director that the assessment amount is due and owing, the King County Treasurer shall enter the amount of such assessment upon the tax rolls against the subject property pursuant to the provisions of RCW 35.80.030.
