UNDERGROUNDING AGREEMENT
WAIVER TO UNDERGROUNDING ORDINANCE
OBLIGATION FOR FUTURE UNDERGROUNDING
In accordance with the Tukwila Municipal Code, the City of Seattle, Department of
Information Technology's proposed fiber optic system on existing Seattle City Light
utility poles located within the City of Tukwila right -of way (S 135" St., 37 Ave S., S
126" St. and 35 Ave S.) requires undergrounding.
The undergrounding requirement is hereby waived provided that the City of Seattle,
Department of Information Technology agrees to participate in future undergrounding
improvements for its proportionate share of the undergrounding costs. Furthermore, if
the L.I.D/U.L.I.D process is used to carry out the construction of the undergrounding
improvements, the City of Seattle Department of information Technology waives the
right to protest the L.I.D/U.L.I.D formation. City of Seattle, Department of Information'
Technology retains the right to contest the method of calculating assessments in such'
uch'
L.I.D/U.L.I.D and the amount thereof to be levied.
This Agreement shall be recorded by the City Clerk with the King County Auditor as
required by the RCW. This Agreement shall be binding upon the parties, their respective
heirs, legal representatives, assignees, transferees and successors.
