AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TUKWILA, WASHINGTON, VACATING PORTIONS
OF RICHARD STREET AND BERKSHIRE PLACE SOUTH,
LOCATED SOUTHWEST OF THE 50th PLACE SOUTH
RIGHT OF-WAY I11T ALLENTOWN, LOCATED IN THE
CITY OF TUKWILA; AMENDING THE OFFICIAL STREET
MAP OF THE CITY; PROVIDING FOR SEVERABILTTY;
AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Tukwila conducted a public hearing on
August 6, 2001, for the purpose of considering the vacation of certain property located in the
City of Tukwila, as described above; and
WHEREAS, TMC 11.60 identifies street vacation procedures including a public hearing
by resolution; review and comment by the Departments of Community Development and
Public Works; and forwarding all relevant information to City Council, all of which have been
done; and
WHEREAS, no water, electrical or communication utilities exist within the rights -of -way
being vacated; and
'WHEREAS, the creation of a salmon habitat side channel requires lot consolidation of all
City property; and
WHEREAS, the lot consolidation necessitates the vacation of rights way;
NOW, THEREFORE,, THE QTY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Vacation. The following property located in the City of Tukwila is hereby
vacated:
Portions of Richard Street and Berkshire Place South, located to the southwest
of 50th Place South in Allentown, and more particularly shown on Exhibit A,
attached hereto.
Section 2. Utilities. No utilities exist within the rights -of -way.
Section 3. Compensation. The rights -of way being vacated will remain public property,
and no property valuation is required.
Section 4. Duties of City Clerk. The City Clerk is hereby directed to record a certified
copy of this ordinance with King County, upon determination by the City Public Works
Director that the conditions referenced above have been satisfied.
Section 5. Amendment of Official Street Map. Upon the recording of a certified copy of
the ordinance, the City Public Works Director shall amend the City's official street map to be
consistent with this ordinance.

Section 6. Severability. If any section, subsection, paragraph, sentence, clause or phrase
of this ordinance or its application to any person or situation should be held to be invalid or
unconstitutional for any reason by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining portions of
this ordinance or its application to any other person or situation.
Section 7. Ordinance Effective Date. This ordinance shall take effect five (5) days after
passage and publication as provided by law; provided that the vacation specified above shall
not become effective until the conditions contained herein have been fully satisfied.
Section 8. Vacation Effective Date. This street vacation shall take effect once all the
conditions have been met, and all documents have been recorded with King County Records.

Ordinance No. vacating portions of Richard Street and Berkshire Place
South, located to the southwest of 50th Place South in Allentown, with the rights -of
way being vacated remaining public property and no property valuation required;
providing for severability; and establishing an effective date.
The full text of this ordinance will be mailed without charge to anyone who
submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
