AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, VACATING CERTAIN
PROPERTY LOCATED WITHIN THE CITY, DEDICATED
FOR STREET PURPOSES, GENERALLY DESCRIBED AS
MAULE AVENUE FROM SOUTH 144TH STREET TO SOUTH
147TH STREET ABUTTING LOTS 1, 2, AND 12 THROUGH
22, BETWEEN INTERURBAN AVENUE SOUTH AND
MAULE AVENUE; AMENDING THE OFFICIAL STREET
MAP OF THE CITY; PROVIDING FOR SEVERABILITY; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Tukwila City Council conducted a public hearing on July 20, 1998
for the purpose of considering the vacation of certain property located in the City of Tukwila,
as described above; and
WHEREAS, TMC 11.60 identifies street vacation procedures including a public hearing
by resolution, review and comment by the Departments of Community Development and
Public Works, and forwarding all relevant information to City Council, all of which have been
done; and
WHEREAS, utilities exist within the right -of -way which is being vacated; and
WHEREAS, following conclusion of the public hearing, the City Council found the
property should be vacated, subject to conditions identified in the Staff Report to City Council,
dated July 20, 1998; and
WHEREAS, the City Council has determined that the fulfillment of the conditions
specified herein shall constitute consideration in lieu of money, as authorized by the Tukwila
Municipal Code 11.60.050;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Vacation.
A. The following property located in the City of Tukwila is hereby vacated:
Maule Avenue right -of -way from South 144th Street to South 147th
Street, which abuts the westerly boundary of Lots 1, 2 and 12 -22,
Block 16, Hillman's Seattle Garden Tracts, as shown on Exhibit A.
B. This vacation is conditioned upon satisfaction of the following:
STV -Maule 12 -99
1. Fulfillment of compensation requirement through dedication to the City of
additional 20 feet of right -of -way along the easterly margin of Interurban
Avenue South.
2. Retention by the City of a 20- foot -wide public utility easement along Maule
Avenue from South 144th Street to South 147th Street.

3. Provision of alternative legal access to Lots 12 through 22, Block 16, Hillman's
Seattle Garden Tracts.
Section 2. Duties of City Clerk. The City Clerk is hereby directed to record a certified
copy of this ordinance with King County, upon determination by the City Public Works
Director that the conditions referenced above have been satisfied.
Section 3. Amendment of Official Street Map. Upon the recording of a certified copy of
the ordinance, the City Public Works Director shall amend the City's official street map to be
consistent with this ordinance.
Section 4. Severability. If any section, subsection, paragraph, sentence, clause or phrase
of this ordinance or its application to any person or situation should be held to be invalid or
unconstitutional for any reason by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining portions of
this ordinance or its application to any other person or situation.
Section 5. Effective Date. This ordinance shall take effect five (5) days after passage and
publication as provided by law, provided that the vacation specified above shall not become
effective until the conditions contained herein have been fully satisfied.

On 42 the M the City Council of the City of Tukwila passed
Ordinance No. %I 7 vacating certain property located within the City, dedicated
for street purposes, generally described as Maule Avenue from South 144th Street to
South 147th Street abutting Lots 1, 2, and 12 through 22, between Interurban Avenue
South and Maule Avenue; conditioned upon satisfaction of dedication to the City of
additional 20 feet of right -of -way along the easterly margin of Interurban Avenue
South, retention by the City of a 20- foot -wide public utility easement along Maule
Avenue from South 144th Street to South 147th Street, and provision of alternative legal
access to Lots 12 through 22; providing for severability; and establishing an effective
date.
The full text of this ordinance will be mailed without charge to anyone who
submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
