ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, VACATING THAT PORTION OF
PUBLIC RIGHT -OF -WAY WITHIN THE CITY OF TUKWILA,
GENERALLY DESCRIBED AS A PORTION OF MAULE AVENUE
LYING NORTH OF SOUTH 140TH STREET TO ITS TERMINUS.
WHEREAS, the City of Tukwila has initiated vacation of a portion of Maule Avenue right -of-
way lying east of Interurban Avenue and north of South 140th Street, and
WHEREAS, by resolution dated May 18, 1992, the Council set June 8, 1992 as the date for a
public hearing, and
WHEREAS, a public hearing was held on said vacation petition before the City Council on June
8, 1992, and
WHEREAS, notice of the pendency of the street vacation and hearing were given as prescribed
by law, and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS:
Section 1. That certain public right -of -way located within the City of Tukwila, Washington, and
more particularly described on Exhibit A, and shown on Exhibit B, both of which are attached hereto and
hereby incorporated herein, is vacated.
Section 2. That the street so vacated shall belong to the abutting owner, as provided in RCW
35.79.040.
Section 3. The City reserves the right to retain an easement for water, sanitary sewer, and storm
drain lines in the event the abutting property is to be sold.
Section 4. The City Public Works Director is hereby instructed to amend the City's official street
map to be consistent with this ordinance.
Section 5. If any section, sentence, clause or phrase of this ordinance shall be held to be invalid or
unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect
the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance.
Section 6. The City Clerk is directed to record this ordinance and to provide a certified copy
thereof to the King County Department of Records and Elections upon its effective date.
Section 7. This ordinance shall be in force and effect five days after publication of the attached
summary which is hereby approved.

On 6 99� the City Council of the City of Tukwila passed
Ordinance Nor //4 Z4 initiating vacation of a portion of Maule Avenue right -of -way lying
east of Interurban Avenue and north of South 140th Street.
The full text of this ordinance will be mailed without charge to anyone who submits a
written request to the City Clerk of the City of Tukwila for a copy of the text.
