Thomson, the sole abutting property owner, filed a petition for vacation of a portion of 51st Avenue South located at 13450 51st Avenue South, previously taken by the State of Washington, for highway right of way, and WHEREAS, said property was conveyed to King County, Washington by deed dated January 6, 1981, recorded under King County File No. 8107060294 which deed provided that should the property be no longer used for public road purposes all rights to the property shall revert to the State of Washington, and WHEREAS, the City of Tukwila acquired the property pursuant to annexation, and WHEREAS, in order to acquire title to the property, the abutting property owner will be required to pay to the state of Washington the full appraised value of the vacated portion, and WHEREAS, a public hearing was held on said vacation petition before the City Council on November 20, 1989, and WHEREAS, notice of the pendency of the street vacation and hearing were given as prescribed by law, and WHEREAS, an easement acceptable to Seattle City Light has been executed by Peter M. Thomson and delivered to the City Clerk, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That certain public right of way located within the City of Tukwila, Washington and more particularly described on Exhibit A, and shown on Exhibit B, both of which are attached hereto and hereby incorporated herein is vacated upon the terms and conditions set forth herein. Section 2. That the street so vacated shall revert to the State of Washington as provided in deed dated January 6, 1981, recorded under King County File No. 8107060294. Section 3. That in light of the fact that the abutting property owner will be required to pay the State of Washington the full appraised value of the vacated right of way, the City of Tukwila will require no compensation. Section 4. The City Public Works Director is hereby instructed to amend the City's Official Street Map to be consistent with this ordinance. Section 5. The City Clerk is directed to send the original easement document and a certified copy of this Ordinance to the State of Washington, to be recorded with the King County Department of Records and Elections with the deed from the State of Washington to Peter M. If any section, sentence, clause or phrase of this ordinance shall be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 7. This ordinance shall be in force and effect five days after publication of the attached Summary which is hereby approved. AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, VACATING A CERTAIN PUBLIC RIGHT OF WAY WITHIN THE CITY OF TUKWILA, GENERALLY DESCRIBED AS A PORTION OF 51st AVENUE SOUTH LOCATED AT 13450 51st AVENUE SOUTH On ie ii 1990, the City Council of the City of Tukwila passed Ordinance No. /.5-. 2 which provides as follows: for the vacation of a public right of way within the City of Tukwila generally described as a portion of 51st Avenue South at 13450 51st Avenue South, that the vacated property shall revert to the State of Washington, that no compensation shall be required by the City of Tukwila, for amendment of the Official Street Map, for severability; and establishes an effective date. The full text of this ordinance will be mailed without charge to anyone who submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
