AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON,
VACATING CONSTRUCTION AND UTILITY EASEMENT ES-
TABLISHED BY ORDINANCE 671 OVER THE DEADEND
PORTION OF MACADAM ROAD LOCATED NORTH OF SOUTH
aD O CENTER BOULEVARD AND WEST OF 65TH AVENUE SOUTH.
WHEREAS, the City of Tukwila, by Ordinance No. 671, passed on
In the 17th day of May, 1971, and recorded under Auditor's File #7108120429,
o vacated a portion of Macadam Road generally located north of Southcenter
Boulevard at 65th Avenue South reserving an easement for construction,
QO maintenance and repair of public utilities and services over and across
a portion of that vacated roadway, and
WHEREAS, Kenneth E. Kinnear, a single person, as lessee, has
leased from James S. Huntington and Helen Diane Huntington a /k /a Diane
Huntington, husband and wife, as landlord, certain real property located
in the City of Tukwila which includes a portion of the vacated road shown
on Exhibit A, and
WHEREAS, lessee intends to develop said leased property but
cannot develop the property or obtain financing required for development
as long as this easement remains on the property on which the proposed
development is to be constructed, and
WHEREAS, Pacific Northwest Bell by letter dated 5/29/81
agrees to abandon the buried cable in the easement after receipt of a
5 foot easement along the easterly boundary of the property, and owner
agrees by letter dated 5/29/81 to furnish said easement within
60 days.
NOW, THEREFORE, THE.CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Onlythat portion of the utility easement (shown in Exhibit A),
retained by Section 3 of Ordinance No. 671, lying west of 65th
Avenue South and north of Southcenter Boulevard is hereby for-
ever vacated. That portion of the easement lying east of 65th
will be retained.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
at a regular meeting thereof this op< day of 1981.

RE: Granting of easement for buried telephone cable on
65th Ave. So., north of Southcenter Blvd.
This letter will confirm that we the undersigned, James S.
Huntington and Diane Huntington, husband and wife do agree
to grant to Pacific Northwest Bell an easement over a strip
of land five feet in width and sixty feet (more or less) in
length along the easterly boundary of the property starting
at the northeast corner of the property and running parallel
to 65th Avenue South for the purpose of installing, main-
taining, repairing and replacing telephone communications
transmission lines and such easement is recorded, then and
without further action by the City Council of Tukwila, said
construction and utility easement as reserved by Ordinance
#671 and recorded under King County auditor's File Number
7108120429 shall automatically be forever vacated and
terminated.

Re: Granting of Easement for Buried Telephone Cable on 65th
Avenue South, north of South Center Boulevard
As shown on the attached sketch a new easement is requested
by Pacific Northwest Bell Telephone Company in lieu of an existing
easement for buried cable as described in Tukwila Ordinance #671,
and recorded under the King County Auditor's File #7108120429.
As part of the granting of this easement, Pacific Northwest Bell
will cut off, and abandon approximately 130' of buried cable
west of 65th Avenue South.
