ORDINANCE NO 658
AN ORDINANCE vacating a portion of 57th
South within the City of Tukwila.
WHEREAS, the City of Tukwila passed Resolution No. 253
commencing proceedings for the vacation of a Portion of 57th South
within the City of Tukwila and,
WHEREAS, the Public Hearing was held on said Resolution
before the City Council on December 7, 1970, and
WHEREAS, Notice of the Pendency of the Street Vacation and
Hearing were given as prescribed by law, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF TUKWILA DO ORDAIN AS FOLLOWS:
Section 1: That the following described street within the
City of Tukwila, County of King, State of Washington, is vacated
upon the terms and conditions set forth herein.
LEGAL DESCRIPTION
That portion of Riverside Avenue (57th Ave. S.) bounded
by Blocks 3 and 8 of Hillmans Seattle Garden Tracts
according to plat thereof recorded in Volume 11 of Plats,
Page 24, Records of King County, Washington, lying South
of the Southwesterly right -of -way line of S.R. 181 and
North of the Southwesterly projection of a line 50.00
feet Northwesterly of, as measured at right angles to,
the Southeasterly line of Lot 10, said Block 8.
Section 2. That the Street so vacated shall belong to the
abutting property owners in accordance with RCW 35.79.040.
Section 3. That in lieu of the owner of the abutting prop-
erty compensating the City for said property in an amount not to
exceed one -half the appraised value of the area so vacated, as
provided in RCW 35.79.030, the owner shall deed by Warranty Deed
to the City an alternate route described as the Southeasterly
50.00 feet of Lot 10, Block 8, of Hillmans Seattle Garden Tracts,
according to Plat thereof recorded in Volume 11 of Plats, page 24,
records of King County, Washington, as measured at right angles
to the Southeasterly line of said lot 10, (except State and County
Roads).
Section 4. That the Deed required in Section 3 of this
Ordinance shall be filed with the City Clerk, of the City of Tukwila
prior to this ordinance becoming effective and in no event later
than thirty (30) days from the date of passage of this ordinance.
This ordinance shall not be published until said Deed is filed
in accordance with this paragraph with the City Clerk.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, this
4th day of January, 1971.
