WHEREAS, by Resolution No. 226, adopted April 21, 1969, The City Council determined to consider vacation of a portion of Musiel Road (South 178th Street) described below; and WHEREAS, Resolution No. 226 fixed the 19th day of May, 1969, at 8 o'clock P.M., in the Council Chambers of the City Hall of the City of Tukwila, Washington, as the time and place when Resolution No. 226 would be heard and determined by the City Council of Tukwila; and WHEREAS, due notice of the hearing upon said resolution was given in the manner provided by law and said hearing was held by the City Council on May 19,1969, pursuant to R.C.W. 35.79; and WHEREAS, the City Council has now determined to vacate that portion of Musiel Road (South 178th Street) described below, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: That that portion of Musiel Road (South 178th Street) in the Northeast 1/4 of the Northwest 1/4 of Section 35, Township 23 North, Range 4 East, W.M., described as follows: Commencing at the Southeast corner of said subdivision; thence along the South line thereof North 87 °50'57" West 319.21 feet; thence North 20 °03'27" East 31.53 feet to the True Point of Beginning; thence North 87 50'57" West 31.53 feet; thence North 20 °03'27" East 221.29 feet; thence South ATTEST: CITY CLERK FORM APPROVED: 24 °56'33" East 216.19 feet; thence Westerly along the arc of a curve to the right having a radius of 50 feet, the radial point of which bears North 48 °12'58" West through a central angle of 35 °05'45" an arc distance of 30.63 feet; thence North 24 °56'33" West 146.77 feet; thence South 20 °03'27" West 139.18 feet to the True Point of Beginning. be and it is hereby abandoned, discontinued, closed and vacated as a public street. That the Mayor and Clerk are authorized to execute the attached agreement (designated Exhibit A) between Mario Segale and the City of Tukwila to implement the terms of this street vacation. PASSED BY THE CITY COUNCIL AND APPROVED by the Mayor of the City of Tukwila, Washington, at a regular meeting thereof this 15th day of June, 1970. SEGATE, dealing in his separate property and estate, and the CITY OF TUKWILA, a minicipal corporation. WHEREAS, the City of Tukwila desires to purchase the following described property, hereinafter referred to as the purchased property for street improvement purposes: "That portion of the Northeast 1/4 of the North- west 1/4 of Section 35, Township 23 North, Range 4 East, W.M., described as follows: Beginning at a point on the South line of said subdivision North 87 50'57" West, 319.21 feet from the Southeast corner thereof, thence North 20 03'27" East 31.53 feet, thence South 87 50' 57" East 96.47 feet, thence along the arc at a curve to the left having a radius of 50 feet through a central angle of 15 16'16" an arc distance of 13.33 feet, thence South 24 56'33" East 35.68 feet to the South line of said sub- division, thence North 87 50'57" West 135.58 feet to the point of beginning." WHEREAS, the following described property, presently street rights -of -way, hereinafter referred to as the "property vacated" will no longer be used by -the City of Tukwila: "That portion of Musiel Road (South 178th Street) in the Northeast 1/4 of the Northwest 1/4 of Section 35, Township 23 North, Range 4 East, W.M., described as follows: Commencing at the Southeast corner of said subdivision; thence alcnc T' Scutn line thereo- North 87 50'57" West 319.21 feet; thence North 20 03'27" East 31.53 feet to the True Point of Beginning; thence North 87 50'57" West 31.53 feet; thence North 20 03'27" East 221.29 feet; thence Sc'ith 24 56'33" East 216.19 feet; thence Westerly along the arc of a curve to the right hav- ing a radius of 50 feet the radial point of which bears North 48 12'58" West through a central angle of 35 05'45" an arc distance of 30.63 feet; thence North 24 56'33" West 146.77 feet; thence South 20 03'27" West 139.18 feet to the True Point of Beginning." 1 VOL 4 0 °AGE 7 57 NOW, THEREFORE, the parties agree as follows: MA.RIO A. SEGAT,F; agrees to sell to the City of Tukwila the above described property, together with all improvements thereon, upon the following terms and conditions: 1. Purchase Price: The purchase price for the purchased :property shall be the sum of Z C C� but if the City of Tukwila fails to vacate the vacated property within one year from the date of this agreement, then the City of Tukwila agrees to pay to MARIO A. SEGALE an additional dollars. 2. MARIO A. SEGALE agrees to petition the City Council of the City of Tukwila to vacate the given property within three months of the date of this agreement in accordance with RCW 35.79.010. 3. As a part of this transaction, the City of Tukwila agrees as follows: (a) To grant to Mario A. Segale an easement for ingress and egress appurtenant to the said Segale property as described in the preamble hereof, for access to and from Southcenter Parkway over and across a tract of land owned by the City of Tukwila lying between the said Segale property and Southcenter Parkway. (b) That it will not limit nor restrict the right of in- gress and egress to South 180th Street from property owned by Mario A. Segale abutting South 180th Street on the North side thereof as described in the preamble hereof.
