THIS PRIVATE PROPERTY EASEMENT is between Lee C. Perry, hereinafter "Grantor," and
Lance Oyler, hereinafter "Grantee."
For and in consideration of Ten Dollars ($10.00) and other good and valuable
consideration, the adequacy and receipt of which is hereby acknowledged, Grantor hereby
conveys, grants, and warrants to Grantee a permanent non- exclusive easement ( "Easement ")
for driveway access and quite enjoyment, including all appurtenances related thereto, under,
over, through, upon, and across the real property as shown on the map attached as Exhibit A.
Grantee shall have the right, without prior institution of any suit or proceeding at law, at
times as may be necessary, to enter upon the Easement for the purpose of maintaining,
removing, repairing, replacing, and using the easement for driveway access and quiet
enjoyment.
The Grantee shall, if the easement is disturbed by the maintenance, removal, repair, or
replacement of the easement area, restore the surface of the easement to a condition
substantially equal to the condition that existed prior to the commencement of the
maintenance, removal, repair, or replacement.
The Grantor shall have the right to use the surface of said easement area so long as
Grantor's use does not interfere with the work of repairing, removing, replacing, and
maintenance of the easement area, provided that no permanent building or structure of any
kind shall be located on said Easement.
This Easement and the covenants herein shall be covenants running with the land and
shall benefit and bind the parties and their respective successors and assigns. Grantor warrants
that Grantor has good title to the property, and warrants Grantee's title to quiet enjoyment of
the Easement conveyed herein.
