AN ORDINANCE ordering the improvement of portions of South 178th Street by reconstructing and relocating the street, including excavating, shaping, ballasting, grading, paving with Port- land Cement Concrete, and land acqui- sitions, all in accordance with City standards and in accordance with Reso- lution No. 199 of the City Council of City of Tukwila, Washington; establish- ing Local Improvement District No. 13, an enlarged local improvement district; providing the method of assessment in said district; providing the part payment of said improvement to be made by spe- cial assessments upon property in said district, payable by the mode of "pay- ment in bonds;" and providing for the issuance and sale of local warrants re- deemable in cash and local improvement district bonds. WHEREAS, by Resolution No. 199, adopted February 19, 1968, the City Council of the City of Tukwila declared its intention to im- prove a portion of South 178th Street by creation of an enlarged local improvement district for reconstructing and relocating the street, including excavating, shaping, ballasting, grading, paving with Portland Cement Concrete, and land acquisitions necessary to construct the project and fixed the 25th day of March 1968, at 8:00 p.m. (P.S.T.) in the Council Chambers of the City Hall of the City of Tukwila, Washington, as the time and place of hearing all matters x�r relating to said proposed improvement and all objections thereto and for determining the method of payment for said improvement; and WHEREAS, Resolution No. 199 described the local improve- ment district to be created as an enlarged district and stated what proportion of the amount to be charged to the property specially bene- fitted would be charged to the property lying between the termini of the proposed improvement extending back from the marginal lines there 5 of to the middle of the block on each side thereof and what proportion of the amount to be charged to the property specially benefitted would be charged to the remainder of the enlarged district; and WHEREAS, Hill Ingman, Chase Co., City engineers, caused an estimate to be made of the cost and expense of the proposed improve- ment and certified said estimate to the City Council, together with all papers and information in its possession touching the proposed improvement, a description of the boundaries of the District, a statement of what portion of the cost and expense of the improvement ot r A- should be borne by the property within the proposed district, a state ment in detail of the local improvement assessments outstanding or unpaid against the property in the proposed district, and a statement of the aggregate actual valuation.af_the real estate, including 25% of the actual valuation of the improvements in the proposed district, according to the valuation placed last upon it for the purpose of general taxation; and WHEREAS, said estimate is accompanied by a diagram of the pro- posed improvement showing thereon the lots, tracts, parcels of land, and other property which will be specially benefitted by the proposed improvement, and the estimated amount of the cost and expense there- of to be borne by each lot, tract and parcel of land or other proper- ty; and WHEREAS, due notice of the hearing upon said Resolution No. 199 was given in the manner provided by law and said hearing was held by the City Council on March 25, 1968, and all written protests filed with the City Council on or before said date were duly considered by the City Council and all persons appearing at said hearing were heard; and WHEREAS, the City Council has now determined it to be in the best interests of the City that said improvement as hereinafter described be carried out and that an enlarged local improvement district be created in connection therewith, NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON DO ORDAIN as follows: Section 1. The improvement is hereby ordered of the streets and avenues in the City of Tukwila, Washington, in accordance with and as described in Exhibit "A" attached hereto and by this reference made -2- 5083 635 a part hereof and incorporated herein. The improvement shall be carried out in accordance with the plans and specifications therefore to be prepared by Hill, Ingman, Chase Co., the City's engineers, and such plans and specifications are hereby adopted for said improvement. Section 2. There is hereby created and established an enlarged local improvement district to be called "Local Improvement District rF No. 15" to the City of Tukwila, Washington, which District is described and contains the are set forth in Exhibit "B" attached hereto and by this reference made a part hereof and incorporated herein. Such en- larged district includes as nearly as practical all the property to be specially benefitted by the improvement and such property special- ly benefitted extends beyond the boundaries of the improvement as de- fined in RCW 35.43.080. Section 3. The total estimated cost of said improvement is here- by declared to be $83,300. Ninty per cent of the cost of said improvement shall be paid from funds derived from the State of Washington Urban Arterial Board. The entire remaining cost and expense of such improvement shall be borne by and assessed against the property specially benefitted by such im- provement. There shall be included in the cost and expense of said improvement all cost items specified in RCW 35.44.020. Section 4. The nature of the improvement provided for herein is such that special benefits conferred upon the property in the lo- cal improvement district herein created are not fairly reflected by the zone and termini method of assessment, therefore, it is hereby provided and ordered that assessments shall be made against the pro- perty in the local improvement district herein created in accordance with the special benefits such property derives from the improvements without regard to the zone and termini method of assessment provided by statute. Section 5. Local improvement district warrants shall be issued in payment of the portion of the cost and expense of the improvement herein ordered to be specially assessed, such warrants to be payable out of the "Local Improvement Fund, District No. 15 hereinafter -3- 5083 636 created, to bear interest from the date thereof at a rate to be hereafter fixed by ordinance not to exceed 7% per annum and to be redeemed in cash, and /or local improvement bonds herein authorized of be issued, said interest bearing warrants to be hereafter referred to as "revenue warrants." Such bonds shall bear interest at a rate to be hereafter fixed by ordinance not exceeding 7% per annum and shall F be payable on or before twelve (12) years from the date of issuance, the life of the improvement ordered being not less than twelve years, and shall be issued in exchange for and in redemption of any and all revenue warrants issued hereunder and not redeemed in cash within a period of not to exceed 60 days after the first publication by the City Treasurer of notice that the assessment roll for Local Improve- ment District No. 15 is in her:hands for collection. The bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said District, payable in ten (10) equal annual installments, with interest at a rate to be here- after fixed by ordinance not exceeding 7% per annum. under the made of "payment by bonds," as defined by law and the ordinances of the City of Tukwila, Washington. In the event of default in the payment of any assessment when the same shall become due, there shall be add- ed interest at a rate to be hereafter fixed by ordinance not to ex- ceed 7% per annum and a penalty of 5% which shall also be collected. The exact form, amount, date, and interest rate and denomination of said warrants and bonds shall be hereafter fixed by ordinance of the City Council. Said warrants and bonds shall be sold in such manner as the City Council shall hereafter determine. Section 6. Ali the work necessary to be done in connection with the making of said improvement shall be done and made by con- tract upon competitive bids and the City shall have and reserves the right to reject any and all bids. The call for bids for work au- thorized pursuant to this ordinance shall include a statement that payment for such work will be made in cash warrants drawn upon the "Local Improvement Fund, District No. 15." Section 7. There is hereby created and established in the of- fice of the City Treasurer of the City of Tukwila, for Local Improve -4- 5083 637 ment District No. 15, a special fund to be known and designated as "Local Improvement Fund, District No. 15," into which fund shall be deposited the proceeds from the sale of revenue warrants drawn against said fund which may be issued and sold by the City, cash contributions to be made by the City as aforesaid, and collections pertaining to assessments, and against which fund shall be issued cash warrants to the contractor or contractors in payment for the work to be done by them in connection with said improvements, and against which fund cash warrants shall be issued in payment of all other items of expense ro 4 in connection with said improvements.
