ORDINANCE NO. 503 0 3
AN ORDINANCE ordering the improvement of
portions of South 180th Street and South
Center Parkway by excavating and grading
including curbs and gutters, asphalt
paving, lighting, drainage, and land
acquisition on either side of the existing
treets; and ordering the further im-
provement of South Center Parkway by
the installation of a storm sewer on the
West side of South Center Parkway together
with necessary pipes and manholes, all
in accordance with City standards, and
in accordance with Resolution No. 193 of
the City Council of the City of Tukwila,
Washington; establishing local Improve-
ment District No. 13; providing the
method of assessment in said district;
providing that part payment of said improve-
ment to be made by special assessments upon
property in said district, payable by
the mode of "payment in bonds and pro-
viding for the issuance and sale of local
warrants redeemable in cash and local im-
provement district bonds.
WHEREAS, by Resolution No. 193, adopted November 6,
1967, the City Council of the City of Tukwila declared its inten-
tion to improve portions of South 180th Street and South Center
Parkway by excavating and grading including curbs and gutters,
asphalt paving, lighting, drainage, and land acquisition on
either side of the existing street; to improve a portion of
South 178th Street by reconstructing and relocating the street
including paving with Portland cement concrete, relocation and
land acquisition, regrading and drainage; to further improve
South Center Parkway by the installation of a storm sewer on
the east and west sides of South Center Parkway together with
necessary pipes and manholes and fixed the 27th day of November,
1967, at 8:00 P.M. (PST) in the Council Chambers in the City
Hall in the City of Tukwila, Washington, as the time and place
of hearing all matters relating to said proposed improvement
and all objections thereto and for determining the method of

payment for said improvement; and
WHEREAS, Hill, Ingman, Chase, Co., city engineers, caused
an estimate to be made of the cost and expense of each continuous
unit of the proposed improvement and certified said estimate to
the City Council, together with all papers and information in
its possession touching the proposed improvement, a description
of the boundaries of the District, a statement of what portion

PI of the cost and expense of the improvement should be borne by the

CO property within the proposed District, a statement in detail of
the local improvement assessments ourstanding or unpaid against
the property in the proposed District, and a statement of the
aggregate actual valuation of the real estate, including 25% of
the actual valuation of the improvements in the proposed District,
according to the valuation placed last upon it for the purpose
of general taxation; and
WHEREAS, said estimate is accompanied by a diagram of
the proposed improvement showing thereon the lots, tracts, par-
cels of land, and other property which will be specially benefited
by each continuous unit of the proposed improvement, and the es-
timated amount of the cost and expense thereof to be borne by
each lot, tract, and parcel of land or other property; and
WHEREAS, due notice of the hearing upon said Resolution
No. 193 was given in the manner provided by law and said hearing
was held by the City Council on November 27, 1967, and all written
protests filed with the City Council on or before said date were
duly considered by the City Council and all persons appearing at
said hearing were heard; and
WHEREAS, as a result of the protests filed the City Coun-
cil determined to defer the improvement of South 178th Street,
Unit 2, of the described improvement until a later date; and over-
ruled all other protests presented; and
WHEREAS, the City Council determined to delete the im-
provement of South Center Parkway by installation of a storm sewer
on the east side of South Center Parkway, Unit 4 of the described

improvement; and
WHEREAS, the City Council has now determined it to
be in the best interests of the City that said improvement as
modified and as hereinafter described be carried out and that
a local improvement district be created in connection there-
with, NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
01 DO ORDAIN as follows:

g4 Section 1. The improvement is hereby ordered of the

streets and avenues in the City of Tukwila, Washington, in
accordance with and as described in Exhibit A attached hereto and
by this reference made a part hereof and incorporated herein.
The improvement shall be carried out in in accordance
with the plans and specifications therefore to be prepared by
Hill, Ingman, Chase Co., the City's engineers, and such plans
and specifications are hereby adopted for said improvement.
Section 2. There is hereby created and established a
local improvement district to be called "Local Improvement Dis-
trict No. 13" to the City of Tukwila, Washington, which District
is described and contains the area set forth in Exhibit B attached
hereto and by this reference made a part hereof and incorporated
herein.
Section 3. The total estimated cost of each continuous
unit of said improvement is hereby declared to be as follows:
Section 1 Unit (1) 1,177,600.00
Unit (3) 137,000.00
At least $952,340.00 and possibly 90% of the cost of
Unit (1) shall be paid from funds derived from the State of
Washington Urban Arterial Board. The entire remaining cost and
expense of such improvement shall be borne by and assessed against
the property specially benefited by such improvement. There shall
be included in the cost and expense of said improvement all cost
items specified in RCW 35.44.020. The assessment rate shall be
computed on the basis of the cost and expense of each continuous

unit of said improvement as above- described.
Section 4. The nature of the improvements provided for
herein is such that special benefits conferred upon the property in
the local improvement district herein created are not fairly re-
flected by the zone and termini fiethod of assessment, therefore,
it is hereby provided and ordered that assessments shall be made
against the property in the local improvement district herein
created in accordance with the special benefits such property de-
rives from the improvements without regard to the zone and termini
method of assessment provided by statute.
Section 5. Local improvement district warrants shall
be issued in payment of the portion of the cost and expense of
the improvement herein ordered to be specially assessed, such
warrants to be payable out of the "Local Improvement Fund, Dis-
trict No. 13," hereinafter created, to bear interest from the date
there -of at a rate to be hereafter fixed by ordinance not to ex-
ceed 7% per annum and to be redeemed in cabh, and /or local improve-
ment bonds herein authorized to be issued, said interest bearing
warrants to be hereafter referred to as "revenue warrants." Such
bonds shall bear interest at a rate to be hereafter fixed by or-
dinance not exceeding 7% per annum, shall be payable on or before
twelve (12) years from the date of issuance, the life of the
improvement ordered being not less than twelve years, and shall be
issued in exchange for and in redemption of any and all revenue
warrants issued hereunder and not redeemed in cash within a period
of not to exceed 60 days after the first publication by the City
Treasurer of notice that the assessment roll for Local Improve-
ment District No. 13 is in her hands for collection. The bonds
shall be redeemed by the collection of special assessments to be
levied and assessed upon the property within said District,
payable in ten (10) equal annual installments, with interest at
a rate to be hereafter fixed by ordinance not exceeding 7% per
annum, under the made of "payment by bonds," as defined by law
and the ordinances of the City of Tukwila, Washington. In the

Base of default in the payment of any assessment when the same
shall become due, there shall be added interest at a rate to be
hereafter fixed by ordinance not to exceed 7% per annum and a.
penalty of 5% which shall also be collected. The exact form,
amount, date, interest rate and denomination of said warrants
and bonds shall be hereafter fixed by ordinance of the City
Council. Said warrants and bonds shall be sold in such manner
as the City Council shall hereafter determine.

Section 6. All the work necessary to be done in con
nection with the making of said improvement shall be done b

and made by contract upon competitive bids and the City shall
have and reserves the right to reject any and all bids. The
call for bids for work authorized pursuant to this ordinance
shall include a statement that payment for such work will be
made in cash warrants drawn upon the "Local Improvement Fund,
District No. 13."
Section 7. There is hereby created and established in
the office of the City Treasurer of the City of Tukwila, for Lo-
cal Improvement District No. 13, a special fund to be known and
designated as "Local Improvement Fund, District No. 13," into
which fund shall be deposited the proceeds from the sale of
revenue warrants drawn against said fund which may be issued
and sold by the City, cash contributions to be made by the City
as aforesaid, and collections pertaining to assessments, and
against which fund shall be issued cash warrants to the contractor
or contractors in payment for the work to be done by them in
connection with said improvements, and against which fund cash
warrants shall be issued in payment of all other items of
expense in connection with said improvements.
PASSED by the City Council and APPROVED by the Mayor
of the City of Tukwila, Washington, at a regular meeting there-

EXHIBIT A
Unit (1) Improvement of South 180th Street from the
Green River to the South Center Parkway and an improvement of
South Center Parkway from South 180th Street to Strander
Boulevard including curbs and gutters, asphalt paving, lighting,
drainage, land acquisition on either side of the existing street.
Unit (3) Improvement of the west side of South Center
cal Parkway from Minkler Boulevard to several hundred feet northerly
of South 180th Street by the installation of a storm sewer.
This storm sewer includes pipe from 18 inch to 42 inch in
diameter together with the necessary manholes.

Beginning at the intersection of the Northerly margin of Strander
Blvd. and the North -South centerline of Section 26, Township 23 North,
