The City of Tukwila sent out a technical comments letter on August 22, 2008, for the above -
referenced land use application. Typically, the City allows ninety days for an applicant to provide
additional information to continue with an application. Please submit the additional information
requested in the technical comments letter, or a written request for an extension (if you require
additional time), within ninety days; by April 13, 2009. If you do not submit a request for an
extension or the additional information requested in the technical comments letter, this permit will
expire on April 14, 2009.

Design Review does not meet Public Works requirements.
The following comments need to be addressed for Public Works -

Per TMC 17.20 — A Short Plat over four (4) lots, requires a Private Access Road to be designed
and constructed as follows; twenty eight (28) feet of pavement, curb /gutter /sidewalk, street
light(s), storm drainage w /detention & water quality, and utilities.
Applicant may request in writing; to the Director of Public Works, for a lesser standard.
Waiver to the above standards, shall be upon approval by the Director of Public Works.
In order to grant an exception to the requirement to construct a twenty eight (28) foot Private
Street, a minimum of three (3) guest parking spaces on -site is required. Additionally, the
CC &Rs for this development; shall include the requirement, that residents can not park in any
guest parking areas.
A minimum width of twenty five (25) feet is required for vehicles to turn into garages. This
may require widened driveway areas and/or recessed garages. There must be enough room
provided for vehicles to enter and back out of garages.

Below is a list of technical comments, based on a review of plans submitted for
Design Review of the Vu Duplex/Townhouse project (Tukwila file #L08 -015).
Application materials were routed to the Building, Fire, Public Works, and Planning
departments. The Building Department did not have any comments related to design
review. Planning and Fire department comments are listed below. Our Public Works
Department has not yet finalized their comments. I will coordinate with Public Works
to send you their written comments as soon as they are finalized. Requirements
related to adding guest parking, turning radii, access road widths, fire department
turnaround, and variation in floor plans and building orientation will have a
significant impact on the site design for this project. Significant issues related to Site
Planning are listed below. You may want to work out the site planning issues prior to
addressing some of the more detailed design comments. Once you have had time to
review the comments, I would recommend that we set up a meeting to go over them
in more detail.
PLANNING DEPARTMENT COMMENTS
Site Planning
• Please indicate the area of required recreation space for each unit, and whether the
recreation space is private or common. Please note that a minimum of 400 square
feet of recreation space is required for each unit, and a minimum of 250 square
feet of the total required open space must be for private use as a front or back
yard, patio area, etc.). All required recreation space for this project may be
private.
• At least 3 guest parking spaces will be required for this development. Please
revise the site plan to show where these spaces will be located.
• A greater width will be required for the access road, in order to meet turning
radius requirements. One option would be to explore shared access with adjacent
properties. Additionally, garages may be recessed from the face of the building to
provide addition width for required turning radii.
• A Fire Department turnaround is required for this project, since the access road
has a length greater than 150 feet. The turnaround must meet fire department
specifications. Please see the Fire Department comments contained in this letter.

• You may apply to allow landscape averaging for the required perimeter
landscaping areas. For example, the required perimeter landscaping on the
western property line may be reduced to a width of 5 feet if the landscaped area
on the eastern property line is increased to 15 feet. The criteria for allowing
perimeter landscape averaging are contained in TMC 18.52.020.
• Transition from public to private spaces
o Buildings that will be adjacent to S 142 °d Street should face the street,
with garages accessed from the back (north side) of the units. To transition
from the public sidewalk to the private yard and entrance to the units, you
should have a pathway leading from the public sidewalk to the front
porch. Access to this pathway could be restricted through construction of a
low, transparent fence or wall (i.e., less than 4 feet high, visually open
fencing materials such as wrought iron bars or wooden pickets). Steps
leading up to the porch also provide a vertical separation, delineating
private from public space.
• Development area coverage cannot exceed 75% of lot area. Low - impact
development techniques (i.e., use of grasscrete, pervious pavement, rain gardens,
etc.) are required if development coverage will exceed 50% of the total lot area.
• The floor plan and form of the units must be varied. Please demonstrate how this
requirement will be met.
Circulation
• Walkways must be provided which connect the entrances of each unit to common
areas, including parking and recreation space. Walkways should be located so that
they do not cross through the access road or driveway areas.
• Buildings should be separated at least 8 feet from driveways and parking spaces
where facing windowed walls (but not the entry) of ground units and have a
minimum of 13 foot separation when facing the entry of ground units.
• Separate buildings from common walkways by at least 8 feet in the structure's
front and rear, and a minimum of 4 feet on its side.
Parking
• At least 3 guest parking spaces should be provided on site. Show how this parking
will be accommodated.
• The size of surface parking spaces as shown on the plans does not meet the
minimum size requirements of TMC Chapter 18.56. Please refer to Figure 18 -6 in
the Tukwila zoning code to determine minimum size requirements.
• Special attention must be given to maneuvering of vehicles on the site. For the
northernmost units, is there enough space for cars to back out of the units? Will
on -street spaces for residents interfere with the room needed for cars backing out
of garages?
Solar Orientation
• Show how buildings will be arranged to optimize exposure to winter sunlight.

• Since this project is less than 9 units, all required open space may be private.
Use of fences, landscaping, and other design elements should be employed to
delineate privately -owned space from commonly accessible, shared areas.
• Orient windows so that the site is easily surveyed by residents. The Tukwila
Police Department will review your revised site design to identify areas on the
site that could potentially offer hiding spaces (areas not easily seen from
nearby buildings or landscaping that acts to block the view of nearby activity,
areas that are unlit).
• Locate mailboxes, garbage collection enclosures and common play areas in
such a way that they are easily observed by others. Mailboxes should not be
located in dark alcoves out of sight.
Neighborhood Compatibility
• See comments from Jeff Scherer, owner of Maple Apartments (the apartment
complex to the west of the project site). Please provide a written response
explaining how elements of this project may address his concerns.
Building Elevations
• Provide elevations for each duplex building, to demonstrate how elements of
the different buildings will be varied in order to create a more varied and
visually interesting development.
Windows
• Provide windows that are designed to create shadows (either deeply recessed
or protruding).
• Use visually significant window elements (i.e., frame dimensions, lintels,
casings, sills, and trim).
• Locate windows so that the occupants from one residence cannot look directly
into an adjacent residence.
• Consider use of accessories to window areas such as sunscreens or and/or
planting boxes
Roofline
• More variation in the roofline should be provided in among the different
buildings, through a combination of building orientation and addition of
elements such as dormers and brackets.
Building Massing
• Building separation as shown on the plans is at least 20 feet. For 2 -story
buildings, only 10 feet of separation is required by code.
• The building elevations provide a preliminary idea of the proposed building
modulation. However, the building shapes on the site diagram are rectangles.
Please show on the site plan and elevations how far different building
elements project from the horizontal plane.
• Consider including any number of the following elements:
o Provide roof elements such as gables, eyebrow roof forms or dormers.

o Incorporate prominent cornice, soffit, or fascia details that emphasize
the top of the building.
o Provide prominent roof overhangs.
o Articulate the roof with rafter tails and brackets.
Material and Colors
• Please specify the material and color for the railing around the balcony.
• Please specify and provide sample of the material /color for the roof.
• The colors and materials used for each duplex building should be varied to
provide visual interest, instead of using the same colors and materials for each
throughout the development.
Garage Design
• Garages may be recessed in order to accommodate additional width to meet
turning radius requirements.
• With variation in floor plans required for this project, two -car garages could
be incorporated into some of the units to meet the minimum parking
requirement of two parking spaces per unit, including tandem parking within
the garage.
Landscape Design
• Spacing of kinnickinnick should be closer together, at least 18 inches on
center at triangular spacing.
• Replace Blue Fescue with tall - growing grasses, such as Pheasant -Tail Grass.
• Make sure to coordinate location of trees with any overhead lines.
• There is too much use of Otto Luyken Laurel. Please add more variety. A
good substitute for Otto Luyken Laurel to consider is Lonicera Pileata,
common name Privet Honeysuckle.
• Consider the function that landscaping will serve in an area, whether it's to
provide screening, to delineate open spaces vs. private areas on site, or for
decoration. Where plantings are grouped around lawn areas, a variety of
different planting should be used of differing heights and colors (including
blooming plants) to add interest.
• Plant shrubs used to define spaces or separate environments as a staggered
double row whenever possible. This provides the significant depth especially
necessary to separate environments such as parking areas from grassed fields
and building entries.
Protection of Existing Trees
• As much as possible, preserve existing trees on the site, incorporating them
into the Landscape Planting Plan.

• Provide a diagram and/or photos from other townhouse projects to
demonstrate how private yard areas will be separated through a combination
of elements including fencing and landscaping.
Lighting
• A variety of different lighting should be used on site. This should include a
combination of street lamps to light the sidewalk and parking areas, lighting
for walkways area areas where there are stairs, such as bollards, and building -
mounted lighting.
• Maximum parking area light standard height is 20 feet or the height of the
building; whichever is less.
• Where walkway lighting is provided primarily by low fixtures, provide
sufficient peripheral lighting to illuminate the immediate surroundings.
Peripheral lighting contributes to a feeling of security in an individual because
he can see his surroundings to determine whether or not passage through an
area is safe. Such an area should be lighted so that the object or person may be
seen directly or in silhouette.
• Provide all lighting standards with glare cut -off features to avoid off -site
spillover.
• For street lamps along the sidewalk and in parking areas, place fixtures so that
light patterns overlap at a height of 7 feet which is sufficiently high to
vertically illuminate a person's body.
Fencing, Walls, and Screening
• All fencing, walls, and screening should reflect building architecture and be
harmonious with adjacent project designs. This includes consideration of
proportion, color, texture, and materials. Design perimeter fencing to be
attractive from both sides. In revised drawings, show the location, height,
color, texture, and material of any fencing, along with how its placement
relates to the proposed landscaping.
Service Areas
• Screen all exterior maintenance equipment, including HVAC equipment,
electrical equipment, storage tanks, satellite dishes, and garbage dumpsters
from off -site and common area view in an architecturally integrated manner.
Revised site plan should show where mailboxes and recycling and trash areas
(to include screening material) will be located.
Street Furniture
• Foster opportunities for social gathering by residents in shared open spaces by
the provision of seating and other amenities. Separate vehicular traffic from
pedestrian- oriented areas with the use of bollards and other barrier features.

FIRE DEPARTMENT COMMENTS
• Minimum access road width is required to be 20 feet, with no parking on
either side of the road.
• A turnaround per Tukwila Fire Department specifications is required if the
access road will be over 150 feet in length.
• Provide radii at entrance from the public street per Tukwila Fire Department
specifications.
• A fire hydrant is required within 150 feet of all structures, with no portion of
any structure allowed to be located greater than 300 feet away from the
hydrant by vehicular travel.
• Provide ground ladder access to second story bedroom rescue windows.

Dear Sirs,
I am the owner of the Maple Apartments, located at 14132 37th Ave. S, a 14 unit multifamily apartment
building and located next to the above referenced project.
I would like to address the gap of street improvements that will result between 3720 S. 142"d St., the
proposed new construction site, along S. 142nd St. until it intersects with 37th Ave S.
The Tukwila Municipal Code requires street frontage improvements to be installed for new construction
prior to issuance of a certificate of occupancy.
Should the above named project go forward, the street improvements between Highway 99 and 37th
Ave. S will look like this:
As one walks on the north side of S. 142nd St., west from Highway 99, to reach 37th Ave S., there will be
no sidewalks until the pedestrian reaches the project location, whereby a nice, new, 5 foot sidewalk
complete with curbs and gutters will exist. After passing the project location, the pedestrian will
encounter no sidewalks but the driveway entrance to the Maple Apartments followed by a solid row of
parked cars. The pedestrian will have a choice of paths to take — walk in the street, behind the parked
cars, risking injury OR trespass on the Maple Apartments. The choice is clear which path is taken by
anyone concerned for their safety. This is the choice that so many have had to make in the past.
Increased demand for parking
With the addition of 6 townhouses to our neighborhood, there will be an increase in demand for public
parking along S. 142nd St.
The on- street parking strip located directly in front of the Maple Apartments (14132 37th Ave. S.) is
owned by the City of Tukwila and is used heavily by residents living at the Maple Apartments as well as
the Dragon Court Apartments and the Mountainview Apartments. And will certainly be used by new
occupants of the proposed project.
The city of Tukwila has done very little to maintain this small strip of property.
Not only do people leave their trash there, but it has become a favorite place for people to service their
vehicles — some vehicles left on jack stands for days and even weeks. I personally have picked up so
• •
much garbage including floor mats, oil filters, brake pads, fan belts, spark plugs, and even alternators
and automobile body parts until I am tired of it. More demand will mean more garbage for me to pick
up.
Because the property is grade level and the city has not provided curbing, people have pulled forward
enough to damage curbing on my property beyond repair.
Many years ago, the city removed 9 Lombard Poplar trees from this property and left the stumps.
But, this provides a convenient route for people to use traveling west from Highway 99 to reach 37th
Ave. S. Adults, including mothers with children and strollers coming from Highway 99, use this route
regularly to reach their homes. And students from Foster High School and Showalter regularly walk
through here to and from school.
If I look north and south along 37th Ave. South at the intersection of S. 142nd St., I can see beautiful
sidewalks and curbing on the west side of the street, but the east side has been left untouched.
This project will increase the demand for use of this parking area that means more auto servicing and
more garbage unless the city does something about it.
This project provides an opportune time for the City of Tukwila to devote some attention and finally
clean up this area.
Perimeter landscaping
The project includes 6 townhouses and, presumably, they could be individually owned and could be
considered 6 individually owned, single family dwellings.
The City of Tukwila Townhouse Design Manual (III. Landscape /Site Treatment, Design for Screening
and Separation, paragraph K.) suggests providing a "privacy fence along side and rear yards if
adjoining single family zoning ", but does not address adjoining multifamily, rental properties.
Installing a privacy fence along the west side of the project would provide separation between
(potentially) single family dwellings and multifamily residences and should be
included in this project.
Additionally, a fence will prevent foot traffic "short cut" routes from crossing landscaping between the
project property and the Maple Apartments parking lot to access, among other things, vehicles parked
in the city's parking area in front of the Maple Apartments.

Design Review does not meet Public Works requirements.
The following comments need to be addressed for Public Works -
Per TMC 17.20 — A Short Plat over four (4) lots, requires a Private Access Road to be designed
and constructed as follows; twenty eight (28) feet of pavement, curb /gutter /sidewalk, street
light(s), storm drainage w /detention & water quality, and utilities.
Applicant may request in writing; to the Director of Public Works, for a lesser standard.
Waiver to the above standards, shall be upon approval by the Director of Public Works.
In order to grant an exception to the requirement to construct a twenty eight (28) foot Private
Street, a minimum of three (3) guest parking spaces on -site is required. Additionally, the
CC &Rs for this development; shall include the requirement, that residents can not park in any
guest parking areas.
A minimum width of twenty five (25) feet is required for vehicles to turn into garages. This
may require widened driveway areas and/or recessed garages. There must be enough room
provided for vehicles to enter and back out of garages.

Dear Mr. Galloway:
Your application for Public Hearing Design Review for development of six duplex units has been
found to be incomplete. The City of Tukwila recently adopted an ordinance to allow townhouses as
a development type. Prior to submittal of the items that are outstanding for this application, we
would like to discuss with you differences and/or implications of review and development of the
proposed project as multifamily development versus townhouse development, so that you may
discuss this information with your client to determine which standards and design review criteria
the City of Tukwila should apply to review of the Vu Duplex proposal. Once you determine which
type of development the Vu Duplex will fall under (multifamily vs. townhouse), the following must
be submitted to the permit center to make the application complete:
a. Dimensioned and scalable building elevations with keyed colors and materials. Show
mechanical equipment and/or any proposed screening.
b. Colors and materials board.
c. A rendering or photo montage showing the project in context. It must accurately show
the project and be from a realistic perspective (5 to 6 feet above the sidewalk).
d. A luminaire plan including location and type of street and site lighting. Include
proposed fixture cut sheets, site light levels (foot - candles), and measures to shield
adjacent properties from glare.
Upon receipt of these items, the City will re- review them for completeness and will mail you
written notification of completeness or incompleteness within 14 days.
These applications will expire if we do not receive the additional information within ninety days of
the date of this letter unless an extension is granted pursuant to Section 18.104.070(E).

GUARANTEE CONDITIONS AND STIPULATIONS
1. Definition of Terms.
The following terms when used in the Guarantee mean:
(a) the "Assured ": the party or parties named as the Assured in this Guarantee, or
on a supplemental writing executed by the Company.
(b) "land ": the land described or referred to in Schedule (A) (C) or in Part 2, and
improvements affixed thereto which by law constitute real property. The term "land"
does not include any property beyond the lines of the area described or referred to in
Schedule (A) (C) or in Part 2, nor any right, title, interest, estate or easement in
abutting streets, roads, avenues, alleys, lanes, ways or waterways.
(c) "mortgage ": mortgage, deed of trust, trust deed, or other security instrument.
(d) "public records" : records established under state statutes at Date of
Guarantee for the purpose of imparting constructive notice of matters relating to real
property to purchasers for value and without knowledge.
(e) "date ": the effective date.
2. Notice of Claim to be Given by Assured Claimant.
An Assured shall notify the Company promptly in writing in case knowledge shall
come to an Assured hereunder of any claim of title or interest which is adverse to the
title to the estate or interest, as stated herein, and which might cause Toss or damage
for which the Company may be liable by virtue of this Guarantee. If prompt notice
shall not be given to the Company, then all liability of the Company shall terminate
with regard to the matter or matters for which prompt notice is required; provided,
however, that failure to notify the Company shall in no case prejudice the rights of
any Assured under this Guarantee unless the Company shall be prejudiced by the
failure and then only to the extent of the prejudice.
3. No Duty to Defend or Prosecute.
The Company shall have no duty to defend or prosecute any action or proceeding to
which the Assured is a party, notwithstanding the nature of any allegation in such
action or proceeding.
4. Company's Option to Defend or Prosecute Actions; Duty of Assured
Claimant to Cooperate.
Even though the Company has no duty to defend or prosecute as set forth in
Paragraph 3 above:
(a) The Company shall have the right, at its sole option and cost, to institute and
prosecute any action or proceeding, interpose a defense, as limited in (b), or to do
any other act which in its opinion may be necessary or desirable to establish the title
to the estate or interest as stated herein, or to establish the lien rights of the
Assured, or to prevent or reduce loss or damage to the Assured. The Company may
take any appropriate action under the terms of this Guarantee, whether or not it shall
be liable hereunder, and shall not thereby concede liability or waive any provision of
this Guarantee. If the Company shall exercise its rights under this paragraph, it shall
do so diligently.
(b) If the Company elects to exercise its options as stated in Paragraph 4(a) the
Company shall have the right to select counsel of its choice (subject to the right of
such Assured to object for reasonable cause) to represent the Assured and shall not
be liable for and will not pay the fees of any other counsel, nor will the Company pay
any fees, costs or expenses incurred by an Assured in the defense of those causes of
action which allege matters not covered by this Guarantee.
(c) Whenever the Company shall have brought an action or interposed a defense
as permitted by the provisions of this Guarantee, the Company may pursue any
litigation to final determination by a court of competent jurisdiction and expressly
reserves the right, in its sole discretion, to appeal from an adverse judgment or order.
(d) In all cases where this Guarantee permits the Company to prosecute or
provide for the defense of any action or proceeding, an Assured shall secure to the
Company the right to so prosecute or provide for the defense of any action or
proceeding, and all appeals therein, and permit the Company to use, at its option, the
name of such Assured for this purpose. Whenever requested by the Company, an
Assured, at the Company's expense, shall give the Company all reasonable aid in any
action or proceeding, securing evidence, obtaining witnesses, prosecuting or
defending the action or lawful act which in the opinion of the Company may be
necessary or desirable to establish the title to the estate or interest as stated herein,
or to establish the lien rights of the Assured. If the Company is prejudiced by the
failure of the Assured to furnish the required cooperation, the Company's obligations
to the Assured under the Guarantee shall terminate.
5. Proof of Loss or Damage.
In addition to and after the notices required under Section 2 of these Conditions and
Stipulations have been provided to the Company, a proof of loss or damage signed
and sworn to by the Assured shall be furnished to the Company within ninety (90)
days after the Assured shall ascertain the facts giving rise to the loss or damage. The
proof of loss or damage shall describe the matters covered by this Guarantee which
constitute the basis of loss or damage and shall state, to the extent possible, the
basis of calculating the amount of the loss or damage. If the Company is prejudiced
by the failure of the Assured to provide the required proof of loss or damage, the
Company's obligation to such Assured under the Guarantee shall terminate. In
addition, the Assured may reasonably be required to submit to examination under
oath by any authorized representative of the Company and shall produce for
examination, inspection and copying, at such reasonable times and places as may be
designated by any authorized representative of the Company, all records, books,
ledgers, checks, correspondence and memoranda, whether bearing a date before or
after Date of Guarantee, which reasonably pertain to the loss or damage. Further, if
requested by any authorized representative of the Company, the Assured shall grant
its permission, in writing, for any authorized representative of the Company to
examine, inspect and copy all records, books, ledgers, checks, correspondence and
memoranda in the custody or control of a third party, which reasonably pertain to the
Loss or Damage. All information designated as confidential by the Assured provided
to the Company, pursuant to this Section shall not be disclosed to others unless, in
the reasonable judgment of the Company, it is necessary in the administration of the
claim. Failure of the Assured to submit for examination under oath, produce other
reasonably requested information or grant permission to secure reasonably necessary
information from third parties as required in the above paragraph, unless prohibited
by law or governmental regulation, shall terminate any liability of the Company under
this Guarantee to the Assured for that claim.

6. Options to Pay or Otherwise Settle Claims: Termination of Liability.
In case of a claim under this Guarantee, the Company shall have the following
additional options:
(a) To Pay or Tender Payment of the Amount of Liability or to Purchase the
Indebtedness.
The Company shall have the option to pay or settle or compromise for or in the name
of the Assured any claim which could result in loss to the Assured within the coverage
of this Guarantee, or to pay the full amount of this Guarantee or, if this Guarantee is
issued for the benefit of a holder of a mortgage or a lienholder, the Company shall
have the option to purchase the indebtedness secured by said mortgage or said lien
for the amount owing thereon, together with any costs, reasonable attorneys' fees and
expenses incurred by the Assured claimant which were authorized by the Company up
to the time of purchase.
Such purchase, payment or tender of payment of the full amount of the Guarantee
shall terminate all liability of the Company hereunder. In the event after notice of
claim has been given to the Company by the Assured the Company offers to purchase
said indebtedness, the owner of such indebtedness shall transfer and assign said
indebtedness, together with any collateral security, to the Company upon payment of
the purchase price.
Upon the exercise by the Company of the option provided for in Paragraph (a) the
Company's obligation to the Assured under this Guarantee for the claimed loss or
damage, other than to make the payment required in that paragraph, shall terminate,
including any obligation to continue the defense or prosecution of any litigation for
which the Company has exercised its options under Paragraph 4, and the Guarantee
shall be surrendered to the Company for cancellation.
(b) To Pay or Otherwise Settle With Parties Other Than the Assured or With the
Assured Claimant.
To pay or otherwise settle with other parties for or in the name of an Assured claimant
any claim Assured against under this Guarantee, together with any costs, attorneys'
fees and expenses incurred by the Assured claimant which were authorized by the
Company up to the time of payment and which the Company is obligated to pay.
Upon the exercise by the Company of the option provided for in Paragraph (b) the
Company's obligation to the Assured under this Guarantee for the claimed loss or
damage, other than to make the payment required in that paragraph, shall terminate,
including any obligation to continue the defense or prosecution of any litigation for
which the Company has exercised its options under Paragraph 4.
7. Determination and Extent of Liability.
This Guarantee is a contract of Indemnity against actual monetary loss or damage
sustained or incurred by the Assured claimant who has suffered loss or damage by
reason of reliance upon the assurances set forth in this Guarantee and only to the
extent herein described, and subject to the Exclusions From Coverage of This
Guarantee.
The Liability of the Company under this Guarantee to the Assured shall not exceed the
least of:
(a) the amount of liability stated in Schedule A or in Part 2;
(b) the amount of the unpaid principal indebtedness secured by the mortgage of an
Assured mortgagee, as limited or provided under Section 6 of these Conditions and
Stipulations or as reduced under Section 9 of these Conditions and Stipulations, at the
time the loss or damage Assured against by this Guarantee occurs, together with
interest thereon; or
(c) the difference between the value of the estate or interest covered hereby as
stated herein and the value of the estate or interest subject to any defect, lien or
encumbrance Assured against by this Guarantee.
8. Limitation of Liability.
(a) If the Company establishes the title, or removes the alleged defect, lien or
encumbrance, or cures any other matter Assured against by this Guarantee in a
reasonably diligent manner by any method, including litigation and the completion of
any appeals therefrom, it shall have fully performed its obligations with respect to that
matter and shall not be liable for any loss or damage caused thereby.
(b) In the event of any litigation by the Company or with the Company's consent,
the Company shall have no liability for loss or damage until there has been a final
determination by a court of competent jurisdiction, and disposition of all appeals
therefrom, adverse to the title, as stated herein.

(c) The Company shall not be liable for loss or damage to any Assured for liability
voluntarily assumed by the Assured in settling any claim or suit without the
prior written consent of the Company.
9. Reduction of Liability or Termination of Liability.
All payments under this Guarantee, except payments made for costs, attomeys' fees
and expenses pursuant to Paragraph 4 shall reduce the amount of liability pro tanto.
10. Payment of Loss.
(a) No payment shall be made without producing this Guarantee for endorsement
of the payment unless the Guarantee has been lost or destroyed, in which case proof
of loss or destruction shall be furnished to the satisfaction of the Company.
(b) When liability and the extent of loss or damage has been definitely fixed in
accordance with these Conditions and Stipulations, the loss or damage shall be
payable within thirty (30) days thereafter.
11. Subrogation Upon Payment or Settlement.
Whenever the Company shall have settled and paid a claim under this Guarantee, all
right of subrogation shall vest in the Company unaffected by any act of the Assured
claimant.
The Company shall be subrogated to and be entitled to all rights and remedies which
the Assured would have had against any person or property in respect to the claim had
this Guarantee not been issued. If requested by the Company, the Assured shall
transfer to the Company all rights and remedies against any person or property
necessary in order to perfect this right of subrogation. The Assured shall permit the
Company to sue, compromise or settle in the name of the Assured and to use the
name of the Assured in any transaction or litigation involving these rights or remedies.
If a payment on account of a claim does not fully cover the loss of the Assured the
Company shall be subrogated to all rights and remedies of the Assured after the
Assured shall have recovered its principal, interest, and costs of collection.
12. Arbitration.
Unless prohibited by applicable law, either the Company or the Assured may demand
arbitration pursuant to the Title Insurance Arbitration Rules of the American Arbitration
Association. Arbitrable matters may include, but are not limited to, any controversy or
claim between the Company and the Assured arising out of or relating to this
Guarantee, any service of the Company in connection with its issuance or the breach
of a Guarantee provision or other obligation. All arbitrable matters when the Amount
of Liability is $1,000,000 or less shall be arbitrated at the option of either the Company
or the Assured. All arbitrable matters when the amount of liability is in excess of
$1,000,000 shall be arbitrated only when agreed to by both the Company and the
Assured. The Rules in effect at Date of Guarantee shall be binding upon the parties.
The award may include attorneys' fees only if the laws of the state in which the land is
located permits a court to award attorneys' fees to a prevailing party. Judgment upon
the award rendered by the Arbitrator(s) may be entered in any court having
jurisdiction thereof.
The law of the situs of the land shall apply to an arbitration under the Title Insurance
Arbitration Rules.
A copy of the Rules may be obtained from the Company upon request.
13. Liability Limited to This Guarantee; Guarantee Entire Contract.
(a) This Guarantee together with all endorsements, if any, attached hereto by the
Company is the entire Guarantee and contract between the Assured and the
Company. In interpreting any provision of this Guarantee, this Guarantee shall be
construed as a whole.
(b) Any daim of loss or damage, whether or not based on negligence, or any action
asserting such claim, shall be restricted to this Guarantee.
(c) No amendment of or endorsement to this Guarantee can be made except by a
writing endorsed hereon or attached hereto signed by either the President, a Vice
President, the Secretary, an Assistant Secretary, or validating officer or authorized
signatory of the Company.
14. Notices, Where Sent.
All notices required to be given the Company and any statement in writing required to
be furnished the Company shall include the number of this Guarantee and shall be

Three (3) new duplex structures on a parcel measuring nearly 1.5 acres, in an MDR zoning
district.
SITE PLANNING
The project site is surrounded on all sides by commercial and multi - family development. There
are no sensitive areas or significant natural features on the site or in the vicinity. This proposed
development has been designed with the surrounding land uses in mind, and is both compatible
and harmonious with those uses. All City code requirements will be met to produce a quality
development.
BUILDING DESIGN
Architectural plans have been submitted with this application. There will be no `flat' or
monotonous planes on any of the three proposed structures. Instead, the finished structures will
present a variety of planes and surfaces. None of the structures will exceed 30 feet in height, per
Tukwila Code requirements. The principal exterior building materials used will be typical of
residential development, while being chosen specifically to blend in with existing development
in the near vicinity.
LANDSCAPE AND SITE TREATMENT
A landscape plan has been prepared by a licensed landscape architect, and included with this
proposal. As required by City Code, the landscaping will consist of trees, shrubs and living
groundcover. The proposal is not located within a sensitive area. For the most part, the site is
flat. Any natural features to be preserved are shown on the signed, stamped landscape plans.

diecast aluminum and mounts directly to a pole or wall without the need of a
separate support arm. The multifaceted arc -image duplicating optical systems
provide IES Types I, II, III, IV and V distributions. The door frame is single -
piece diecast aluminum and retains an optically clear tempered flat glass lens.
The luminaire is completely sealed and gasketed preventing intrusion from
moisture, dust and insects. The Gullwing luminaires are finished with a fade
and abrasion resistant TGIC powdercoat.
HOUSING: A one -piece diecast aluminum housing mounts direct-
ly to a pole or wall without the need for a support arm. The low profile
rounded form reduces the effective projected area of the luminaire to only
1.2 ft2/.11 m2.
LENS ASSEMBLY: A single -piece diecast aluminum lens frame hinges
down from the housing and is secured by a stainless steel lanyard and hinge
pin.
An optically clear, heat and impact resistant tempered flat glass lens is
mechanically secured with eight retainers. The electrical and optical chambers
are thoroughly sealed with a one -piece memory retentive hollow -core EPDM
gasket to prevent intrusion by moisture, dust, and insects.
OPTICAL SYSTEMS: The segmented optical systems are
manufactured from homogenous sheet aluminum which has been
electrochemically brightened, anodized and sealed. The multifaceted
arc image duplicating systems are designed to produce IES Types I
(1), II (2XL), III (3XL), IV (4XL), and V (Q). With the 2XL, 3XL and 4XL
luminaries, the reflector facets form a conical fan around the arc tube
with each facet positioned to be precisely tangent to the top of the arc
tube.
The lampholder is glazed porcelain with a nickel plated screw shell.
Position - oriented mogul base sockets to accept high output horizontal
metal halide lamps are supplied standard.
Fluorescent luminaires use a Medium Throw refledor with a Solite® glass lers (MIS).
ELECTRICAL: All electrical components are UL recognized, factory
tested, and mounted on a unitized plate with quick electrical disconnects.
Each high power factor ballast is the separate component type capable
of providing reliable lamp starting down to
-20 °F / -29 °C. Standard fluorescent ballasts are solid state.
FINISH: Each standard color luminaire receives a fade and abrasion
resistant, electrostatically applied, thermally cured, triglycidal isocyanurate
(TGIC) textured polyester powdercoat finish. Standard colors include bronze
(BRP), black (BLP), white (WP), and natural aluminum (NP). Consult factory
for specs on optional or custom colors.
LABELS: All luminaires bear UL or CUL (where applicable) Wet Location labels.
FULL CUTOFF PERFORMANCE: Full cutoff performance means a luminaire distribution where
zero candela intensity occurs al an angle of 90° above nadir. Additionally, the candela per 1000 Iamp lumens
does not numerically exceed 100 (10 percent) at a vertical angle of 80° above nadir. This applies to all lateral
angles around the luminaire.
CUTOFF PERFORMANCE: Cutoff performance means a luminaire disbbution where the candela
per 1000 lamp lumens does not numerically exceed 25 (2.5 percent) at an angle at or above 90° above
nadir, and 100 (10 percent) at a vertical angle of 80° above nadir. This applies to all lateral angles around
the luminaire.

SCOPE:
THIS SPECIFICATION COVERS THE MANUFACTURE AND INSTALLATION OF THE
GALVANIZED — ASPHALT COATED AND PAVED CORRUGATED STEEL PIPE (CSP)
DETAILED IN THE PROJECT PLANS.
MATERIAL:
THE GALVANIZED COATED STEEL COILS SHALL CONFORM TO THE APPLICABLE
REQUIREMENTS OF AASHTO M 218 OR ASTM A 929.
COATING. PAVING. & LINING:
THE ASPHALT COATING SHALL CONFORM TO THE APPLICABLE REQUIREMENTS OF
AASHTO M & 190 OR ASTM A 849.
PIPE:
THE CSP SHALL BE MANUFACTURED IN ACCORDANCE MTh THE APPLICABLE
REQUIREMENTS OF AASHTO M -36 OR ASTM A 760. THE PIPE SIZES, GAUGES
AND CORRUGATIONS SHALL BE AS SHOWN ON THE PROJECT PLANS.
ALL FABRICATION OF THE PRODUCT SHALL OCCUR WITHIN THE UNITED STATES.
HANDLING. ASSEMBLY:
SHALL BE IN ACCORDANCE WITH NCSPA'S (NATIONAL CORRUGATED STEEL PIPE
ASSOCIATION) RECOMMENDATIONS.
INSTALLATION:
SHALL BE IN ACCORDANCE WITH AASHTO STANDARD SPECIFICATIONS FOR
HIGHWAY BRIDGES, SECTION 26, DIVISION II OR ASTM A 798 AND IN
CONFORMANCE WITH THE PROJECT PLANS AND SPECIFICATIONS. IF THERE ARE
ANY INCONSISTENCIES OR CONFLICTS, THE CONTRACTOR MUST BRING THEM TO
THE ATTENTION OF THE PROJECT ENGINEER.
IT IS ALWAYS THE CONTRACTOR'S RESPONSIBILITY TO FOLLOW OSHA GUIDELINES

PRIOR TO INSTALLATION OF THE DETENTION SYSTEM A PRE — CONSTRUCTION
MEETING SHALL BE CONDUCTED. THOSE REQUIRED TO ATTEND ARE THE
SUPPLIER OF THE DETENTION SYSTEM, THE GENERAL CONTRACTOR, SUB
CONTRACTORS AND THE ENGINEER.
FOUNDATION /BEDDING PREPARATION
PRIOR TO PLACING THE BEDDING, THE FOUNDATION MUST BE CONSTRUCTED TO
A UNIFORM AND STABLE GRADE. IN THE EVENT THAT UNSUITABLE
FOUNDATION MATERIALS ARE ENCOUNTERED DURING EXCAVATION, THEY SHALL
BE REMOVED AND BROUGHT BACK TO THE GRADE WITH A FILL MATERIAL AS
APPROVED BY THE ENGINEER. ONCE THE FOUNDATION PREPARATION IS
COMPLETE, THE 4 INCHES OF A WELL— GRADED GRANULAR MATERIAL SHALL BE
PLACED AS THE BEDDING.
BACKFILL
THE BACKFILL SHALL BE AN Al, A2 OR A3 GRANULAR FILL PER AASHTO
M -145 OR A WELL— GRADED GRANULAR FILL AS APPROVED BY THE ENGINEER
(SEE INSTALLATION GUIDELINES). THE MATERIAL SHALL BE PLACED IN 8 —INCH
LOOSE LIFTS AND COMPACTED TO 909E AASHTO T99 STANDARD PROCTOR
DENSITY. WHEN PLACING THE FIRST LIFTS OF BACKFILL IT IS IMPORTANT TO
MAKE SURE THAT THE BACKFILL IS PROPERLY COMPACTED UNDER AND
AROUND THE PIPE HAUNCHES. BACKFILL SHALL BE PLACED SUCH THAT THERE
IS NO MORE THAN A TWO UFT DIFFERENTIAL BETWEEN ANY OF THE PIPES AT
ANY TIME DURING THE BACKFILL PROCESS. THE BACKFILL SHALL BE
ADVANCED ALONG THE LENGTH OF THE DETENTION SYSTEM AT THE SAME RATE
TO AVOID DIFFERENTIAL LOADING ON THE PIPE.
OTHER ALTERNATE BACKFILL MATERIAL MAY BE ALLOWED DEPENDING ON SITE
SPECIFIC CONDITIONS. REFER TO TYPICAL BACKFILL DETAIL WITHIN THIS SET OF
PLANS FOR TYPE OF MATERIAL REQUIRED.
MINIMUM COVER
BACKFILL SHALL BE PLACED TO THE PROPER ELEVATION OVER THE SYSTEM AS
OUTLINED IN THE PLANS. MINIMUM COVER FOR CONSTRUCTION LOADING
NEEDS TO BE DETERMINED BASED ON THE TYPE OF EQUIPMENT THAT IS
PLANNED FOR CONSTRUCTION. PROPER COVER FOR CONSTRUCTION EQUIPMENT
