In order to make the appearance of the fence less noticeable, the chain link fence shall be black vinyl- coated. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 4 decision pursuant to Tukwila Municipal Code 18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the City Council of the Planning Commission Decision is permitted. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Planning Commission decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision; that is by June 10, 2008. The requirements for such appeals are set forth in Tukwila Municipal Code18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $105. V. APPEAL HEARINGS PROCESS The City Council hearing regarding the appeal shall be conducted as a closed record hearing based on the testimony and documentary evidence presented at the open record hearing conducted by the Planning Commission. The City Council decision on the appeal is the City's final decision. The school is located within the Low Density Residential (LDR) zoning district of the Tukwila Municipal Code. Within the LDR district, schools are listed as a Conditional Use, according to TMC 18.10.040. Approval to construct new school facilities within the LDR zone requires special permission from the Planning Commission following an open record public hearing according to TMC 18.108.040, Type 4 Decision Processes. FINDINGS Vicinity /Site Information Project Description The applicant is requesting approval of a Conditional Use Permit (CUP) to build two portable buildings on the Foster High School campus. Each portable is 1,792 square feet, and contains two classrooms, for a total proposed addition of 3,584 square feet of classroom space to the Foster High School site. Access improvements included with the project include a new sidewalk, ramps and stairs located on the west side of the portable buildings between portable entrances and the parking area to the west. An existing six foot chain link fence separating the field from the parking area is proposed to be removed as part of the site preparation work for the project. This fence will be replaced with another six foot chain link fence located on the east (back) side of the portables to separate and protect the portable buildings from sports activities occurring on the field. Landscaping will be added on the north side of the project area to screen the portables from single family homes along S 142 °a Street. Existing Development The parcel on which Foster High School is located is approximately 24.5 acres. Existing development on the project site includes the Foster High School building, which has frontage on both S 144th Street and 42°d Ave S. Sports facilities associated with the high school are also located on the site, including soccer and football fields, track, and tennis courts. Showalter Middle School is located to the east on the same parcel as Foster High School. Surrounding Land Uses Located in the middle of the Low Density Residential zoning district, surrounding land uses are mostly single family homes. Other land uses include the Foster Library located directly to the west at the comer of 42 °a Ave S and S 144th Street, apartment complexes located just north of the library to the west of the high school, a church located on the north side of the high school, and the Tukwila Pool, located along S 144th Street between Foster High School and Showalter Middle School. JR Page 2 of 6 05/15/2008 10:20 AM H: \CUPs\Foster HS\FosterHS_Staff Report_CUP.doc • • CONDITIONAL USE CRITERIA The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. The applicant's response to the conditional use criteria is attached to this staff report as Attachment E. Staff makes the following findings under the city's Conditional Use Permit criteria (TMC 18.64.050): (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated Construction of the two portable buildings is proposed to address crowding that is occurring in existing classrooms at Foster High School. The proposed location of the portable buildings will not displace existing parking or outdoor activity areas. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The portables will be set back almost 60 feet from the north property line of the Foster High School parcel, meeting the minimum rear setback requirement of 10 feet. The height of the portables, at 13.5 feet, is under the 30 foot height limit within the LDR zone. The applicant's response to the Conditional Use Permit criteria from TMC 18.64.050 states "Required parking for the proposed portables can be accommodated by the existing parking on the site." According to Figure 18 -7 — Required Number of Parking Spaces for Automobiles and Bicycles, the number of required parking stalls for high schools is one for each staff member and two for every five students or visitors. Per request by DCD staff, the applicant provided a count of total parking spaces, and a count of Foster High School staff and student enrollment. According to the information provided by the applicant, there are 50 staff members at Foster High School, and student enrollment is approximately 820 students. The number of required parking spaces for Foster High School, according to Tukwila's parking standards for high schools, is 378 spaces (50 for staff, 328 for students). According to the applicant, there are currently 297 parking stalls at Foster High School. Foster High School was built in 1991, before current parking standards were adopted by the City of Tukwila in 1995. Since the number of parking spaces at Foster High School was approved prior to adoption of the current TMC parking standards, the parking lot at the school is legally nonconforming. The addition of portables to the Foster High School site is meant to provide additional room for current enrollment numbers, and not to provide additional capacity for new students. At the request of staff, Tukwila School District Assistant Superintendent Bill Van de Bogert provided information on the typical usage of parking at Foster High School to explain why there are a low number of student drivers compared with high schools in other school districts. According to Mr. Van de Bogert, the Foster High School parking lot is usually only half to two -thirds full. He says there are two reasons why Foster High School has a relatively low number of students who drive to school: (1) the school district is small and served by public transportation; and (2) there is a high level of poverty among the families of students at Foster JR Page 3 of 6 05/15/2008 10:20 AM H: \CUPs\Foster HS\FosterHS_Staff Report_CUP.doc • • High School, who cannot afford an additional vehicle for their high school children. The portables are meant to address the existing condition of a large number of students per classroom rather than to accommodate any anticipated increase in enrollment. Therefore, existing parking conditions are expected to remain the same with the addition of the two portable buildings proposed with this application, and will not increase the degree of nonconformity of the existing parking at Foster High School. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The applicant's response to the criteria explains that the portables are not intended to accommodate additional enrollment capacity. Given that enrollment does not increase, the addition of the portables to the site will not result in increased traffic impacts. A new sidewalk proposed for construction on the west side of the portables will provide access from the main building of Foster High School to the portable buildings, without students having to walk through driveway or parking areas. The location of the portables on site is such that the main building of Foster High School will screen the portable buildings from view from the south side of the site along S 144t Street. Existing perimeter landscaping located along the north property line, as well as adjacent to the parking area will help screen the portables from 42nd Ave S and S 142nd Street. Additional landscaping proposed along the north side of the building includes a cluster of trees, shrubs, and groundcover, to help screen the portables from view of the single family homes located along S 142nd Street. The portable buildings will be painted to match the color scheme of the main building of Foster High School. While the portion of Foster High School that faces 42nd Ave S and S 144th Street is mostly brick, the back side of the building where the portables will be located is scored concrete. Red awnings are located along the sides of the main building to provide pedestrian weather protection, with a blue color used for bollards, railings, and mullions around all window areas (on both the brick and concrete walls of the main building). The predominant color used for the siding of the portables will be painted an off -white color, labeled Sail Cloth on the colored elevations submitted with the application materials (see Attachment D). The roof, gutter, and downspouts will be gray. These colors are neutral, in keeping with the concrete walls of the main building of the high school. A dark, Hamilton Blue color is used for accent around the windows and on the doors to the portable, to match the blue colors used for accent on the main building. A six foot chain link fence will be removed as part of this project from its current location in the field on the east side of the parking area. Another six foot chain link fence is proposed on the east side of the portables, to protect them from sports activity occurring in the field to the east. As a condition of the permit, the chain link fence shall be black vinyl- coated to mitigate the appearance of the fence by making it less noticeable. Questions from DCD staff regarding this project included the expected length of time the Tukwila School District will need the portables, and what the school district's plans are to make permanent improvements to the site to add classroom space. These questions were addressed to JR Page 4 of 6 05/15/2008 10:20 AM H:\CUPs\Foster HS\FosterHS_StaffReport_CUP.doc • • Tukwila School District Assistant Superintendent Bill Van de Bogert, who responded with information that the portables will likely be used until school enrollments decline or additional classroom space is built at Foster High School. He said that the school district has undertaken a long term facility planning process that includes a committee of local citizens and district administrators to address crowding and construction needs. The facility study will be completed this fall, at which time he anticipates that the facility committee will make a recommendation to add classrooms to the site. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan The proposed project is consistent with the following goals and policies of Tukwila's Comprehensive Land Use Plan: Goal 7.1 Neighborhood Quality: Urbanization and development that fosters a sense of community and replaces lost vegetation and open spaces with improvements of at least equal value to the community. Construction of the proposed portables is proposed to help reduce overcrowding at Foster High School, with the intent to improve school quality by providing room for a smaller number of students per classroom. Any existing landscaping disturbed during site work and/or construction of the portable buildings will be replaced, per the Planting Plan & Details sheet (Attachment B), and as verified by the applicant. Additionally, new landscaping will be added to the north side of the site with this project. Goal 7.3 Overall Land Use Pattern: A land use pattern that encourages a strong sense of community by grouping compatible and mutually supportive uses and separating incompatible uses. Construction of portables makes possible the expansion of an existing use on the site, without the need for acquisition of or expansion on to additional land, or a reduction in the usability of the existing facilities. 5) All measures have been taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located Possible adverse impacts related to this project include lack of safe access for students to the portables, visual impacts for surrounding development, damage to existing landscaping and impacts that would make portions of the Foster High School site and facilities unable to be used. These impacts are addressed by the installation of site improvements including sidewalks and ramps, the proposed location of the portables behind the main building and screening provided by additional landscaping to the site, as well as the agreement as indicated on plans that any existing landscaping that is damaged will be repaired or replaced. The visual impact related to the installation of chain link fencing is mitigated by the condition of approval that the fence to be located between the portable buildings and the playfield to the east be black vinyl- coated. The addition of portables to the high school site will help the Tukwila School District maintain school quality by allowing the district to address the problem of overcrowding in existing classrooms. None of the improvements will displace existing site improvements, including parking and outdoor activity areas. 2. Construction of the portables as proposed meets the zoning requirements of the LDR zone. The number of parking spaces on the Foster High School, at 297, does not meet the 378 spaces required according to Tukwila's parking standards. However, since the number of parking spaces at Foster High School were approved during construction of the school, prior to adoption of the City's current parking standards, the parking lot at Foster High School is a legally nonconforming parking lot. Since the addition of portables is not meant to accommodate students in addition to current enrollment numbers, this proposal will not increase the degree of nonconformity of the existing parking lot. Additionally, Tukwila School District Assistant Superintendent Bill Van de Bogert provided evidence that existing parking meets the needs of users of the site without causing impacts to surrounding areas. The evidence he provided included the following: (1) existing parking areas are typically only half to two -thirds full, (2) the majority (60 %) of students at Foster High School come from families that experience poverty and cannot afford cars for their children, and (3) Foster High School is served by public transportation. 3. The project is consistent with the current use of this site as a school. Since the portables are intended to redistribute existing students into additional classrooms with the goal of achieving smaller class sizes, there are no additional traffic impacts anticipated with this project. For pedestrian access, a sidewalk is proposed to connect the main building of Foster High School to the portable entrances. This sidewalk is located so that students will not have to walk within any driveway or parking areas to move from the main campus to the portable buildings. A six foot chain link fence is proposed to separate the portable buildings from the playfield to the east. To minimize the visual impacts of this fence, a condition of approval of this permit is that the chain link fence will be required to be black -vinyl coated. 4. This project meets applicable goals and policies of the Tukwila Comprehensive Plan, including Goal 7.1 Neighborhood Quality and Goal 7.3 Overall Land Use Pattern. 5. Potential adverse impacts have been addressed by the applicant. Any remaining potential adverse impacts are addressed by the recommended condition of approval of this permit, below. RECOMMENDATIONS Staff recommends approval of the Conditional Use Permit with the following condition: 1. The six foot chain link fence proposed on the east side of the portable is to provide protection from the sports activities in the field to the east. In order to make the appearance of the fence less noticeable, the chain link fence shall be black vinyl- coated. -021) - comments I've completed a review of your Conditional Use Permit application for the Foster High School Portables, and there are a few remaining items I need some clarification on for my staff report, prior to being able to schedule a date for the public hearing. These items are listed below: 1. Please provide color elevations and /or a colors and materials board that shows how the portables will be consistent with the architectural design of the existing school buildings. 2. The detail for the 6' chain link fence that will be located on the east side of the portables does not indicate whether the chain link fabric and hardware is vinyl- coated or just galvanized metal. Please indicate what the finish for the chain link fence and associated hardware will be. 3. Will there be any landscaping between the portables and the new 6' chainlink fence to the east? How will this area be kept free of debris? 4. The Planting Plan & Details Sheet mentions "Contractor shall repair existing lawn (reseed) and landscape areas that are disturbed during construction activities." Does this include all landscaping that is disturbed, including the shrubs located between the parking area and the sidewalk that will be constructed in front of the portables? There is some mature landscaping in the area where the portables will be placed (in between the parking lot and the sidewalk, as well as along the north property line). Please verify that placement of the portables will not damage or destroy this landscaping, and if it does, that replanting will occur to mitigate for the damage. 5. The response to the criteria mentions that new landscaping will be added along the northern property line to screen the proposed portables from the single - family homes, but the Planting Plan & Details sheet shows the only landscaping to be added to the site located on the north side of the portables, directly adjacent to the portable buildings. Since there is already a row of trees along the northern property line, the location as shown on the plans is preferable. Please verify that landscaping will be located as shown on the Planting Plan & Details sheet. 6. Will the railing provided along the ramp be painted to match the color scheme of the portables? The district is undertaken a long term facility planning process, (a committee of local citizens, and district administrators) to address crowding and address construction needs. Unfortunately the committee won't have completed the facility study until this fall. At which time they would make a recommendation to the full board of directors. What are the school districts' plans (if any) as far as building more permanent structures to add classrooms, adding buildings that are consistent with the architectural style of the existing school building? Is there a schedule, or process by which the school district is raising money to come up with the funds to make these kinds of improvements? Any permanent structures will require the sale of bonds. I think it is reasonable to assume the facility committee will make a recommendation to add additional classrooms in the near future. COMMUNITY DEVELOPMENT Tukwila School District is in the process of applying for permits to install two new double classroom portable facilities on the Foster 1 -ligh School campus, located at 4242 S 144th Sr., Tukwila, WA in the City of Tukwila. The structures will each be 1,792 square feet in size for a total of 3,584 square feet. The project will include access ramps, electrical utilities and related site work. Site grading will be less than 500 cubic yards. While Tukwila School District is the lead agency on the project as authorized in the SEPA Rules (WAC 197 -11), the SEPA exemption level is set by the City of Tukwila.
