This letter is a follow -up to our site visit on Thursday, March 19. During the visit we discussed the following
requirements in order to be in compliance with your approved buffer reduction.
1. Extend the planting area to the edge of the existing driveway and fill in both sides of the stream buffer
with more native shrubs and groundcover. The stream buffer needs to be planted all the way back to the
back of your property. Anywhere that you have been clearing blackberries must be planted.
2. We emphasize that the plants must be native to Washington and Oregon. You should not put in any
more non - native plants in the stream buffer. Native plants are not sold at Home Depot or Lowes. You
will need to go to a native plant nursery (see the attached flyer for Thor's Nursery) or to Furney's
Nursery in SeaTac and ask them to order the plants if they don't have them in stock.
Thor's Nursery prices run between $3.25 and $5.50 for a 1 gallon plant (which is probably less than
what you paid at Home Depot for the non - native shrubs that you purchased). The people at Thor's
Nursery can help you select plants — you don't necessarily have to purchase the plants on the list we
provided you, as long as they are native and appropriate for the stream buffer. If you do not know if a
plant is native to Washington and Oregon, you can check with Jaimie at the City of Tukwila before you
purchase the plant. Thor's nursery does not open to the public until March 21St. Their hours will be
Wednesday through Saturday from 8 am — 5 pm and Sundays from noon to 5 pm.
3. Groundcover (at the top of the stream bank and along the sides of the bank) should be planted about 1
foot apart and can be staggered rather than planting in a straight line. Suggested groundcovers:
a. Fringecup (Tellima grandiflora) (this is the plant you have been transplanting from your
property)
b. Woodland strawberry (Fragaria vesca). Low growing, spreading groundcover for shady areas. It
has small white flowers and small edible strawberries.
c. Beach strawberry (Fragaria chiloensis). Low growing, spreading, good for sunny areas. Also
has white flowers and berries.
d. Sword fern (Polystichum munitum).
4. Add more red osier dogwood cuttings along both sides of the stream bank, close to the water's edge.
They should be put in one foot apart.

5. The buffer should be mulched after planting using wood chips (you can get them for free by calling
some of the tree cutting companies in the area and ask for a load of wood chips) or purchased shredded
bark. The nursery mentioned above carries bark and can show you what it looks like. Bagged bark is
also available at Home Depot. Mulch is important to retain moisture in the soil, prevent erosion, and
keep down the weeds.
The City will continue to monitor your progress on complying with the buffer planting requirements. Once
you have added additional native plantings to the stream buffer area this Spring, please call Jaimie Reavis at

This letter serves as a notice of decision and is issued pursuant to TMC 18.104.170 on the following
project and permit approval.
I. PROJECT INFORMATION
Project File Number: L08 -030

Type of Permit Applied for: Special Permission to allow a 50% reduction of the required stream
buffer on the east side of a Type 4 stream.
Project Description: The owners of the property at 6410 S. 153rd Street in Tukwila are proposing to
build additions to an existing house as part of a building permit that has been submitted to the City
of Tukwila. The additions proposed as part of the building permit currently under review include a
front porch on the south side of the house and conversion of a garage to a living space to include a
bedroom and bathroom. As part of a future building permit, the owners would also like to construct
an addition to the north (rear) side of the house. Construction of a footbridge to replace an existing
makeshift wooden bridge over the stream is also included on plans submitted with this Special
Permission application.
A Type 4 stream is located on the property to the west side of the existing house. The required
buffer for a Type 4 stream is 50 feet. Currently, approximately half of the building footprint is
located within the 50 foot buffer area. The applicant is requesting a 50% reduction to the required
stream buffer in order to construct the building additions proposed on the north and south sides of
the existing house. Approval of a 50% reduction to the required buffer would result in a 25 foot
buffer to the stream. The existing house is located at the edge of the reduced stream buffer, 25 feet
from the stream, and proposed additions to the house are located at least 25 feet away from the
stream. The applicant and owners have prepared a mitigation plan showing plantings proposed to

enhance the reduced 25 foot buffer area. Additional shrubs will be required to be planted in the fall
as one of the conditions of approval of the Special Permission permit.

II. DECISION
SEPA Determination: The City SEPA Responsible Official has previously determined that this
application does not require a SEPA threshold determination because it is categorically exempt.
Decision on Substantive Permit: The Community Development Director has determined that the
application for a Special Permission to reduce the required stream buffer area by 50% does comply
with applicable City and state code requirements and has approved that application, based on the
findings and conclusions contained in the staff report, and subject to the following conditions of
approval:
1. To better ensure their health, shrubs shall be planted within the stream buffer in the
fall. An inspection by city staff shall occur in the fall once the shrubs have been
planted.
2. Any future alteration or development activity in the existing driveway and parking
areas located within the 25 foot stream buffer, with the exception of maintenance and
repair activities, will require that their use as driveway and parking areas be
discontinued and buffer enhancement occurs. No additional fill materials may be
placed in the 25 foot buffer, and use of heavy construction equipment in the 25 foot
buffer is not permitted.
3. The applicant and/or property owners shall coordinate with City staff during planning
and construction of the new footbridge over the stream to ensure that impacts to the
stream and the stream buffer are kept at a minimum.
4. The property owner(s) shall submit a photograph of the stream buffer area each year
for a period of five years, to demonstrate that plantings are being maintained in a
healthy condition.

III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal
Code §18.104.010. Other land use applications related to this project may still be pending.
One administrative appeal to the Planning Commission of the Decision on the Permit itself is
permitted. A party who is not satisfied with the outcome of the administrative appeal process may
file an appeal in King County Superior Court from the Planning Commission decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director's decision on the Permit Application, a
written notice of appeal must be filed with the Department of Community Development within
14 days of the issuance of this Decision; that is by September 25, 2008.
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal
materials shall be submitted to the Department of Community Development. Appeal materials
MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a
corporation, association or other group, the address and phone number of a contact person
authorized to receive notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of
the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant,
and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised
in the Notice of Appeal.
5. Appeal fee of $110.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as an open record hearing
before the Planning Commission based on the testimony and documentary evidence presented at
the open record hearing. The Planning Commission decision on the appeal is the City's final
decision.
Any party wishing to challenge the Planning Commission decision on this application must file
an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal

of the Planning Commission decision is properly filed in Superior Court within such time limit,
the Decision on this permit will be final.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits
are available for inspection at the Tukwila Department of Community Development, 6300
Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between
8:30 a.m. and 5:00 p.m. The project planner is Jaimie Reavis, who may be contacted at 206 -431-
3659 for further information.
Property owners affected by this decision may request a change in valuation for their property tax
purposes. Contact the King County Assessor's Office for further information regarding property tax
valuation changes. The notice board must be removed at the expiration of the appeal period if no
appeal is filed.

This project is exempt from the State Environmental Policy Act under WAC 197 -11 -800
(2), Other minor new construction.
BACKGROUND
Pavel Melnik of Urban Design Group, on behalf of property owners Alexei and Ludmila
Pinzari, has applied for a Special Permission decision from the Director to allow a
reduction in the buffer width of a Type 4 stream on the property located at 6410 S 153rd
Street (see Exhibit A showing the site plan and proposed mitigation). The request for a
buffer reduction is to allow construction of a porch and conversion of a garage to an
additional bedroom and bathroom on the front (south side) of the existing house, resulting
in the house having a total of three bedrooms and two bathrooms. A building permit has
been submitted to build the porch and the conversion of the garage into living space. Also
included in this Special Permission application is a planned building addition on the rear
(north side) of the house as part of a future building permit, as well as a request to impact
the buffer area for construction of a small pedestrian footbridge across the stream where
there is an existing makeshift wooden bridge.
According to Tukwila's parking regulations (TMC 18.56.065), "Two off -street parking
spaces shall be provided for each dwelling unit which contains up to three bedrooms ".
The minimum required parking for this house is two spaces. At least one parking space
was formerly provided within the garage that is now being converted to living space.
Parking and driveway use is an existing use located within the buffer, including area
between the stream and the west side of the house, as well as in the back of the house.
These areas were an existing use at the time the applicant purchased the house, and no

alteration or development activities are proposed within this area. Therefore, the
driveway and parking area can continue to be used according to 18.45.070 (1), until such
time that any changes are proposed to the driveway or a major redevelopment of the
property is proposed. The provisions of this section of the code do not allow alteration or
additional fill materials to be placed, or heavy construction equipment used.
DECISION CRITERIA
TMC 18.45.100 (F) permits the Director to reduce a buffer width based upon the
following criteria:
a) The reduced buffer area does not contain slopes over 15 %;
The subject parcel is relatively flat, with the exception of the northwest corner of
the parcel, areas along the west property line, and stream banks. No portion of the
reduced buffer area, including the areas where the porch and the rear addition to
the building are proposed, contains slopes over 15 %.
b) The buffer reduction is not greater than 50%;
No portion of the existing house or planned additions to the house will be located
closer than 25 feet from the stream, so a buffer reduction of greater than 50% will
not occur. However, as mentioned in the Background section above, no heavy
construction equipment associated with this or any other future project may be
located within the reduced buffer area.
The footbridge proposed to allow the property owners to cross the stream will be
located within the first 10 feet on either side of the river. The new structure will
replace an existing, informal wooden bridge. The purpose of a new bridge is to
provide a safer crossing of the stream than what currently exists, and could help
prevent damage to the stream bank such as erosion. As a condition of approval,
the applicant or property owners(s) will need to coordinate with DCD staff for
planning and construction of the new bridge to ensure that any impacts to the
stream and its buffer are kept at a minimum.
c) The buffer is vegetated and includes an enhancement plan as may be required to
improve the buffer function and value; or
City staff has been working with the applicant to develop an enhancement plan
for the stream buffer, to provide improved buffer function through the addition of
native plantings that will help shade the stream and improve vegetation coverage.
To date, several seedlings have been planted along both sides of the stream,
including Fringecup (Tellima grandiflora), Sword Fern (Polystichum munitum),
Indian Plum (Oemleria cerasiformis), and Pacific Willow (Salix lucida ssp.
lasiandra). The applicant has submitted an enhancement plan showing the location
of these plantings, as well as additional plantings proposed for the fall, to include
shrubs such as Red Osier Dogwood (Cornus sericea), Vine Maple (Ater
circinatum), and Red Flowering Currant (Ribes sanguineum).

d) If there is no significant vegetation in the buffer, a buffer may be reduced only if
an enhancement plan is provided. The plan must include using a variety of native
vegetation that improves the functional attributes of the buffer and provides
additional protection for the watercourse functions and values.
Except for the northern part of the stream buffer where there are some mature
trees, the buffer does not contain significant vegetation. The applicant has
prepared an enhancement plan that includes a variety of native vegetation.
Additional shrubs will be required to be planted in the fall. An inspection of these
plantings by city staff will be required as an additional condition of approval.
MITIGATION PLAN
TMC 18.45.090 B ALTERATIONS states that a mitigation or enhancement plan
must be developed and must comply with the standards of mitigation required in
TMC Chapter 18.45. The applicant has submitted a mitigation plan, showing
which plantings have already been added to the buffer area, which will be planted
in the fall when weather conditions are expected to be better for survival of new
shrub and tree plantings. Plantings currently in place as part of this application are
located in the area that extends six to ten feet on either side of the stream, and
include Fringecup (spaced 1 foot on center), Sword Fern (3 feet on center), Indian
Plum (spaced every 5 to 6 feet), Pacific Willow, and Red Leaf Maple.
In the fall, the property owner has agreed to plant additional shrubs to include
shrubs such as Red Osier Dogwood (Cornus sericea), Vine Maple (Acer
circinatum), and Red Flowering Currant (Ribes sanguineum) to provide shading
for the stream. To ensure that plantings are maintained in a good condition and
any plants that do not survive are replaced, the property owner(s) shall submit a
photo showing the condition of plantings within the buffer area every year for a
period of five years.
CONCLUSIONS
1. There are no slopes greater than 15% within the reduced buffer areas.
2. No portion of the existing house or planned additions to the house will be
located closer than 25 feet from the stream, so a buffer reduction of greater
than 50% will not occur.
3. Proposed construction of a footbridge over the stream will replace an existing
informal bridge. Planning and construction of the new bridge shall be
coordinated with DCD staff to ensure that any impacts to the stream or its
buffer will be kept at a minimum.

4. A mitigation planting plan that includes a variety of native plantings to
enhance the stream buffer area has been submitted by the applicant. The
recent addition of cuttings within the stream buffer area, and future addition of
shrubs to the buffer area in the fall required as a condition of approval, will
further improve buffer function and values.
RECOMMENDATION
Staff recommends approval of the Special Permission permit with the following
conditions:
1. To better ensure their health, shrubs shall be planted within the stream buffer
in the fall. An inspection by city staff shall occur in the fall once the shrubs
have been planted.
2. Any future alteration or development activity in the existing driveway and
parking areas located within the 25 foot stream buffer, with the exception of
maintenance and repair activities, will require that their use as driveway and
parking areas be discontinued and buffer enhancement occurs. No additional
fill materials may be placed in the 25 foot buffer, and use of heavy
construction equipment in the 25 foot buffer is not permitted.

1: Sandra and Jaimie inspected plantings on 3/19/09, and found that a wider area around both sides of the stream needs
plantings. Also, several of the plantings that have been added are non - native. Ludmila Pinzari was told that non - native
plantings are not allowed within the buffer area, and any additional non - natives will need to be removed and replaced
with native plantings.
The areas that have been planted need a higher density of plantings, including the west side of the stream bank, in the
area between top of bank and the ordinary high water mark, and the area on either side of the stream at the top of the
bank. A letter will be sent to Ludmila Pinzari with the names of native strawberry plantings for the top of bank, and
the contact info for a nursery in Carnation where she can buy natives. We will follow up with another inspection in the
Spring. JR
2: Sandra and Jaimie inspected plantings on 5/21/09, and found the plantings to be acceptable. Ludmila Pinzari will
send in pictures of plantings within the stream buffer, to serve as the as- built, for us to compare with future
conditions. As a condition of approval of the permit, Ludmila will submit photographs showing the condition of the

PROJECT INFORMATION
Pavel Melnik of Urban Design Group, on behalf of property owners Alexei and Ludmila
Pinzari, has applied for a Special Permission decision from the Director to allow a 50%
reduction in the buffer width of a Type 4 stream on the property located at 6410 S 153rd
Street (see Exhibit A showing the site plan and proposed mitigation). The request for a
buffer reduction is to allow construction of a porch and conversion of a garage to an
additional bedroom and bathroom on the front (south side) of the existing house. A
building permit has been submitted to build the porch and the conversion of the garage
into living space. Also included in this Special Permission application is a planned
building addition on the rear (north side) of the house as part of a future building
permit, as well as a request to impact the buffer area for construction of a small
pedestrian footbridge across the stream where there is an existing makeshift wooden
bridge.
Projects applied for include: D08 -246, Building permit for construction of the front
porch and conversion of the garage to a bedroom and bathroom.
Other known required permits include: None at this time — a building permit will need
to be obtained for the future addition on the north side of the house.
Studies required with the applications include: Mitigation plan for enhancement of the
proposed reduced buffer area.
This project is exempt from the State Environmental Policy Act under WAC 197 -11 -800
(2), Other minor new construction.

The application is available for review at the City of Tukwila, Department of Community
Development (DCD), located at 6300 Southcenter Blvd #100.
OPPORTUNITY FOR PUBLIC COMMENT
Your written comments on the project are requested. They must be delivered to DCD at
the address above or postmarked no later than 5:00 P.M., Wednesday, September 10,
2008.
