Dear Ms. Reavis,
This is a letter of response to correction requests issued by the City of Tukwila technical comments letter
dated December 02, 2008.
As a general comment, ISD has worked closely with planning staff to minimize reductions of the stream
buffer, and has proposed elements within that area that have been approved by the planning staff. All
plant choices within the stream buffers have been reviewed and approved by planning and outsource
horticultural staff and are reflected in the submittal documents.
Additionally, ISD has received and reviewed Sound Transit proposed R.O.W improvement documents
reflecting elements such as sidewalks, illumination, utilities, and landscaping along the south side of S
154th Street. We believe that our plans are compatible and congruent with the Sound Transit plans.
In regards to proposed improvements within the public right of way, it is our understanding that you will be
issuing our re- submittal documents to the Tukwila Public Works Department for review and approval, at
which time it can be determined if any further permitting is required related to those elements. Please note
that the only proposed hardscape improvement within the public right of way consist of approximately 1' -3"
length of sidewalk which is an extension of the already approved sidewalk within the private portion of the
site.
In summary, I believe that the ISD plans and details, respond to the requirement for design corrections as
requested in the correction letter.
We look forward to your review and comment regarding the correction responses and to successfully
achieving municipal approval.

The following states the requested correction by number, and indicates our compliance response to the
issues raised in the 12 -02 -2008 correction letter cited above:
1.) COT request:
"Tree #'s 1, 2, and 3, as shown in the tree replacement table on Sheet L -0 shall not be removed.
Retaining these trees means the number of required replacement trees for the tree clearing permit
is reduced to 10. Five of these trees can be accommodated at the back of the new sidewalk. The
other five trees should be native species, and placed in the area south of the mailboxes where the
stream channel continues. Suggested trees include Shore pine (pinus contorta var. contorta) and
Vine maple (acer circinatum), since these are Tess likely to have wide - spreading roots than other
conifers."
ISD response:
Trees #143 noted to be removed in the plans dated 9 -29 -2008, shall be retained.
Trees proposed to be removed per plans dated 1 -05 -2009 include (5) previously shown and
allowed, plus one additional one located in a parking island which restricts adequate visibility for
drivers equaling (6) removed and (12) required as replacement.

2.) COT request:

ISD response:
The replacement trees are indicated on sheet L -2 by species and graphically by a bold circle, and
on sheet L-4 in the plant list with a plant note in the comments column..
3.) COT request:
"Monument sign shall be located on the east side of the existing entry drive, outside the 40 -foot
reduced buffer area, or other location outside of stream buffer area. Please show the proposed
location on plans."
ISD response:
The monument sign as shown on L -1 and L -2 has been relocated to the east side of the drive,
outside the site triangle, and outside the 40' reduced buffer boundary.
4.) COT request:
"Please indicate on plans the proposed height of the retaining wall"
ISD response:
The two retaining walls adjacent to the drive are indicated as being no more than 2' -6" in height and
are shown as such on sheet L -1
5.) COT request:
"Per our conversation on 12/1/2008, the trees shown on Sheet L -2 with a dashed line around them -
that were not shown as proposed for removal on sheet L -0 - will not to be removed."

Please find attached a summary response to the corrections as outlined in your October.
The response format reiterates the correction or clarification request and includes our response for
ease of your review.
City of Tukwila request for clarification
1. Tree Clearing Permit
a. Submit a notarized Affidavit of Ownership and Hold Harmless Permission to enter property
b. Written response to approval criteria of TMC 18.54.130, reason for removal of trees, type
and location of trees proposed as replacement and benefit to stream buffer area.
c. Other measures proposed to restore and enhance environmental and aesthetic benefits of
existing vegetation.
d. Proposed schedule for site work which may affect sensitive areas and buffer.
ISD Response:
a. Per discussion with the planner, this shall be submitted during the review process
b. Response to TMC 18.54.130 Criteria for tree retention and replacement:
• Retention: little or no vegetation exists in the proposed area of landscaping except for 2
alder and 1 cedar tree. (see photos #1,2,3)
• Tree Protection: measures specified in the code will be implemented
• Tree Replacement: (see replacement schedule sheet L -0) 26 trees are required for
replacement. 47 are provided with 26 to be at the required 2 -1/2" caliper for deciduous
and 6 -8' ht for conifers. The plant list shall be modified to require the Japanese Maple
and Cherry Trees to be 2 -1/2" caliper as opposed to the 1 -1/2" caliper shown.
Reasons for tree removal: The 2 alder and 1 cedar ( #1 -3) near the corner are proposed to
be removed as they are a significant visual impediment for drivers being able to clearly see
signage and the primary drive entry. The 4 ornamental trees ( #3 -7) were removed by a
maintenance crew due to their unsightly appearance and lack of adequate care resulting
their poor condition. The ornamental tree ( #8) located at a drive corner is a problem with line
of sight for vehicular traffic.
The tree replacements locations and type include:
• Drive entry: Magnolia Grandiflora
• Entry Drive: Ornamental Flowering Trees and Arborvitae
• Adjacent to the Drive corner: Magnolia Grandiflora
• Mitigation Area adjacent to the Sound Transit right of way improvements: Western
Red Cedar and Vine Maples (both are native species)

c. The majority of the stream buffer has existing improvements of long standing including
buildings, walkways, recreational spaces, a drive entry, and sidewalk/street. Existing
vegetation in the stream area consists of weeds and bamboo, and few trees. Sound Transit
is currently proposing plantings of alder and red twig dogwood shrubs. The area of our
proposed plantings that are within the buffer consist of native and NW hardy species that will
reduce erosion by surface water, provide habitat and forage for animals, and provide better
definition between the existing site elements and the stream area. These plants will be
harmonious in response to Sound Transit's proposed plantings.
Additionally, as there is little stream buffer available for planting due to existing elements, we
are proposing nearly 9,500 sf. of primarily native /low water use plantings (trees, shrubs, and
groundcover) in the areas disrupted by Sound Transit which will be a visual amenity as seen
from the public right of way. (see photo #4, 5 showing the eastern most area of ST const.)
d. The stream way will be protected from siltation and surface water erosion such that the
proposed site work could be undertaken at any time. If required, we can add to the currently
required measures and request a wet weather extension to allow a fall / winter/ or early
spring construction schedule.

2. Special Permissions Permit
a. Written description of all proposed work within the stream buffer area with assessment of the
proposed sidewalk, monument sign, retaining walls and other elements that will impact the
stream buffer. Additionally, determine the extent of buffer reduction necessary to
accommodate structures in consideration that this is a Type 3 Water course with an 80'
buffer width with a buffer reduction allowed at 50% or a 40' buffer width.
b. Demonstrate that the proposed site improvements are in compliance with Tukwila's
Sensitive Area Ordinance, indicated in the TMC Chapter 18.45 and TMC 18.45.100 (F)
related to criteria for variation of water course buffer widths. Explain why the buffer reduction
is needed and how the proposed improvements will improve vegetation, slope stability, and
water quality for the stream and buffer.
ISD Response:
a. The area of proposed modification within the buffer extends from the right of way to the
buffer boundary (north /south) and extends from the west side of the existing drive way west
to and in line with the existing fence and swimming pool. The current condition of the site,
within the buffer that we are proposing to modify, consists of fairly flat ground (see photo #1)
, with existing vegetation consisting of lawn in poor condition, some bamboo, some
Japanese knot weed, and an alder and cedar per the Sound Transit survey (see photos
#2,3). Adjacent and across the drive to the east are a sidewalk with numerous utilities, a
wall being built by Sound Transit, and a planting area steeply rising up to an existing parking
area (see photo's #4,5)
A summary of proposed elements and an assessment of them within the stream buffer:
• Renovation of the landscape - at the west side of the entry drive, utilizing native and nw
hardy species — this will provide screening and protection of the stream corridor, habitat
and winter forage for animals, and erosion control that is significantly greater than what
is there now. 2 trees are proposed for removal. Although the area for landscaping is
proposed at its closest up to the stream corridor, it is no closer and no less diverse and
in use of native species than the proposed Sound Transit plans. In terms of impact by
area, it is less than 5% of the buffer area.

• Addition of a concrete walkway - 4' -6" in width extending from the public walkway to the
buffer boundary. This element is similar in material and impact as the currently planned
public walkway and enables the residents a safe way to walk from the apartments to the
public walkway and bus stop. The buffer in most cases would require a 50% buffer
reduction except for a 16' long portion which would require a greater buffer reduction to
that of 18' in width. In assessment, the current condition in this area is a flat area
covered with grass, which if used by residents without the walkway may result in bare
ground and potential for erosion and siltation of the stream. The alternative is to place
the walkway to the east which will then require retaining walls and reduction of the
screen planting to Tess than code required width at the perimeter of the parking area,
and require a greater number of residents to cross the drive to reach the leasing office
and walkway to the bus stop than the proposed location will.
• Monument Sign - proposed to be located on the west side of the main entry drive,
outside the required sight triangle so as not to impair visibility, and meeting the
monument sign regulations regarding size and location. The proposed location will
require a 50% reduction in the stream buffer width at this location. In assessment, this is
the best location at the entry drive as the opposite side of the drive has a significant
number of utilities with setbacks, steep slopes, and the Sound Transit wall, all of which
would limit effective placement of the sign.
• Retaining Walls — no retaining walls are proposed to be located in the stream buffer.
b. The Sensitive Area Ordinance and delineation describe this as a Type III Water Course
which is non salmonid with perennial flow. The TMC states the intent of the buffer and any
modifications within it shall minimize long term impacts, preserve critical habitat value,
maintain stable water temperatures and vegetative cover, upgrade the soil biota, stabilize
banks during peak flows, reduce erosion, reduce loss or damage of property, and reduce
impact by human and domesticated animals.
The proposed improvements will both meet the needs of an existing housing area in terms
of safe pedestrian and vehicular access and protect the Gilliam Creek stream corridor. The
walkway will provide the most effective pedestrian travel from an existing development to the
public walkway and bus stop in a safe manner as opposed to the bare soil path now used.
The re- landscaping proposed is of substantially greater aesthetic and environmental value
compared to the bare ground that now exists. Although a buffer reduction is being
requested, the extent and value of the proposed vegetation in the impacted area as well as
the area designated for mitigation is significantly greater than the buffer area impacted by
the proposed improvements. The buffer reduction is needed so that the existing conditions
there now can be improved to meet the intent of buffer protection, and because the
proposed area is most viable for providing safe pedestrian access to public amenities.

3. Additional Requirements
a. Coordination of proposed site improvements with Sound Transit designs — ISD will
b. Requirements for future permits:
I. A building permit will be required for the retaining wall — the proposed wall is not within
the stream buffer area, is at or lower than 2.5' in height, and is a unit gravity wall that
typically has not required a building permit. ISD will certainly comply with the
requirement; however, will request a clarification regarding the requirement.
II. A street use permit will be required for the sidewalk construction — ISD will apply for this
once the location is approved by the City of Tukwila
III. A sign permit will be required for the monument sign (no signs over 6' ht.) A signage
company will be applying for this permit with the understanding that the location is
approved by the City of Tukwila.

to the completeness of the application.

COB Request:
SITE REQUIREMENTS
SRI. Specify on Site Plan that the Geo -tech Engineer will review and monitor all the site construction works per geo-
tech recommendation.
SR2. Specify on Site Plan with all the exterior retaining walls (at North -side) and details call out.
SR3. Provide all the permanent cut and fill slopes to be graded no steeper than 2H: 1V and should be stated on Site
Plan with appropriate vegetation per Geo -tech recommendation. The finish slope grade at the North side driveway
is steeper than the recommendation.
SR4. Provide surface drainage system to show the permanent control of surface runoffs are directed away from the
structure- slopes per Geo -tech recommendation.

Bellevue Development Review coordinator/ utilities department as determined during the Critical Area
Permit process.

Dear Mr. Campy:
The City of Tukwila has completed reviewing the above tree clearing permit. The permit
is to remove trees located within the buffer of a type IV stream. A review of the property
indicates that work has already occurred within the buffer area. The city has posted a
formal "stop work" order on the property and work is not to commence until the tree
clearing permit has been obtained.
At this time, the City requires that clarification and changes be made to the submitted
plans.
1. The plan needs to show which trees have already been removed and which
additional trees are proposed for removal. A justification is needed for removal of
any more trees that are located within the buffer. The City gives preference on
retaining existing trees within sensitive areas and along the perimeter of sites
(TMC 18.54.130 (1)(a)). A report from an arborist needs to be provided
providing a justification for why the trees needs to be removed. Existing trees to
remain must also be shown on the plan.
2. The wetland classifications are really not needed for this project, but for the
record, Achillea millefolium is not a FACW - it is an upland plant that prefers full
sun. Therefore, it is not really a good choice for riparian planting. Other
attractive forbs that could be used instead include: Dicentra formosaa Aruncus
dioicus (likes wetter conditions), Telima grandiflora, and Tolmiea menziesii.
3. Planting of only 3 trees does not meet the City's tree replacement standards. More
trees are required, depending on the diameter and number of trees already
removed or proposed for removal (See TMC 18.54.130 (3)). It is recommended
that additional species be added, such as vine maple, Douglas Fir, Western Red
Cedar, and Oregon Ash.

4. Use of herbicides in sensitive areas is generally not permitted by the City.
Therefore, the roots should be grubbed out by hand prior to planting new
vegetation. Another approach that could be used is to put down cardboard after
the new plants are installed and the blackberries are cut to the ground. This
method is called sheet mulching. The cardboard is then covered with wood chips
or bark. This technique, if done properly, will prevent resprouting of any
blackberry that is still there. The cardboard will biodecompose in a season or
two, allowing for additional future plantings, if desired. This is a good approach
for a single family property and avoids the use of herbicides.
5. A split rail fence will also need to be constructed along the 15 foot buffer line.
Signs denoting the presence of a sensitive area will need to be installed every 30
feet along the fence.
6. Please also clarify who will be performing the work of removing the trees with
the buffer area. Given that these trees are within a developed area the City will
require that the person removing the trees be licensed and have adequate liability
insurance.

c. Prior to any vegetation removal, the applicant shall demonstrate through a Landscape
Plan, Sensitive Area Mitigation Plan or other materials required per the requirements
of this chapter that vegetation replacement will meet the following minimum
standards:
(1) Minimum sizes shall be 2.5 -inch caliper for deciduous trees, 6 to 8 feet in height
for evergreen trees, 24 inches in height for shrubs, and 1 gallon for groundcover.
(2) Replacement plants shall meet current American Association of Nurserymen
standards for nursery stock;
(3) Planting and maintenance of required replacement vegetation shall be in
accordance with best management practices for landscaping which ensure the
vegetation's long -term health and survival.
4. Surrounding Environment - The timing of, and methods to be used in any proposed
vegetation removal shall be such that impacts to protected vegetation, wildlife, fisheries and
the surrounding environment are minimized.
5. Tree Relocation - Tree relocation shall be carried out according to best management practices,
and trees proposed for relocation shall have a reasonable chance of survival.
TREE REGULATION DEVIATIONS
❑ The Director may grant exceptions from the requirements of chapter 18.54 when undue
hardship may be created by strict compliance with the provisions of this chapter. Any
authorization for exception may prescribe conditions deemed necessary or desirable for the
public interest, or necessary to meet the intent of this chapter. An exception to this chapter
shall not be granted unless all of the following criteria are met:
1. Strict compliance with the provisions of this code may jeopardize project feasibility or
reasonable use of property.
2. Proposed vegetation removal, replacement, and any mitigation measures proposed, are
consistent with the purpose and intent given in this chapter.
3. The granting of the exception or standard reduction will not be detrimental to the public
welfare or injurious to other property in the vicinity.
In addition to the above criteria, the Director may also consider any of the following in
reviewing an exception request:

REVIEW CRITERIA
The applicant bears responsibility for demonstrating that the proposal satisfies all of the permit
approval criteria. Planning Division staff are available to discuss the decision criteria you must
respond to and necessary supporting materials.
PERMIT APPROVAL CRITERIA
To the extent that vegetation retention and/or replacement is consistent with project feasibility or
reasonable use of the property, vegetation clearing shall be planned and conducted to meet all of
the criteria below. These criteria shall be the basis for approval, approval with conditions or
denial of any tree clearing included in a Tree Clearing Permit application.
1. Tree Retention - Site improvements shall be designed and constructed to retain as many
existing healthy trees as possible, and to meet the following criteria:
• a. Priority shall be given to retention of existing stands of trees, trees at site perimeter,
trees within the shoreline Low - Impact Environment, in Sensitive Areas or Sensitive
Area Buffers, and healthy mature trees.
b. All understory vegetation within the essential root zone of protected trees shall be:
(1) retained; OR
(2) removed by methods which are non - damaging to the tree, and replaced with
vegetation with horticultural requirements which are compatible with protected
trees.
c. Vegetation removal shall be undertaken in such a manner as to preserve, to the degree
possible, the aesthetic and ecological benefits provided by such vegetation.
2. Tree Protection Measures -
a. The proposal shall include tree protection measures which meet or exceed best
management practices and current standards of professional arboriculture, and which
are sufficient to ensure the viability of protected trees and other vegetation identified
for retention pursuant to requirements of this chapter, and shall include measures
sufficient to protect any Sensitive Area, its Buffer and vegetation within the shoreline
Low - Impact Environment.
b. During clearing and/or construction activities, all protected vegetation shall be
surrounded by protective fencing which prevents adverse impacts associated with
clearing from intruding into areas of protected vegetation.
3. Tree Replacement - The site shall be planted with trees to meet the following minimum
requirements:
a. Each existing significant tree removed shall be replaced with new tree(s), based on the
size of the existing tree as shown below, up to a maximum density of 70 new trees per
acre.

a. Whether the recommendation of a certified arborist supports the exception.
b. Evidence that the size of the site or project cannot support the number of required
replacement trees, and off -site tree planting is proposed which furthers the goals of this
chapter and other City policies.
c. On -site planting of all required replacement trees is not feasible, and the project includes
an equivalent contribution in funds and/or labor and materials for off -site tree planting as
jointly agreed by the applicant and Director.
d. Smaller -sized replacement plants are more suited to the species, site conditions, and to
the purposes of this chapter, and are planted in sufficient quantities to meet the intent of
this chapter.
❑ Retention and Replacement of Canopy Cover - on undeveloped sites or sites with dense
stands of trees, where the cost of identification of individual tree species and sizes is
inordinate relative to the project, the Director may allow the applicant to use the tree canopy
cover approach outlined below to calculate retention and replacement of trees:
1. The site shall have a minimum canopy cover equal to 20% of the site area, or equal to the
existing canopy cover whichever is less.
2. To meet the requirements for site canopy cover, canopy cover may consist of any
combination of existing trees and replacement trees. Canopy cover of each new tree
shall be calculated at 314 square feet.

1.0 INTRODUCTION
iot Background
Charles and Sonya Campy own a 39,192 square foot parcel of land, number 7661600208. The lot is
legally described as Seattle land company's 5 acre tracts lot 4, City of Tukwila short plat No. L02 -051,
Recording No. 20050601900007 (being a portion of SW Qtr NW Qtr STR 23- 23 -04).
The Westside property line is described as a wetland with a Type 0 Stream with a 15 foot setback. The
land owners wish to do routine vegetation management on the wetland portion. As part of this process,
the homeowners will cut 5 black cottonwood trees and remove brush that is considered to be a potential
hazard to existing homes or future structures if the trees or brush were to fall (see photographs in
Appendix A).
The trees and brush to be removed create a number of issues, including the following:
• The trees and brush are adjacent to non salmon bearing stream mapped by the City of Tukwila
with a 15 foot setback
• The trees and brush in the riparian provide shade while leaves and twigs contribute organic
matter to stream.
1.2 Site Conditions
•
The cutting and removal is to occur along the low gradient, perennial stream, about eight inches wide
and drains a small depression wetland north of the parcel. The area is characterized by vegetation
typical of moist riparian conditions, although the northern section supports more upland plant species
such as Himalayan blackberry (R.anmeniacus= Rdiscolor) and Evergreen blackberry (R laciniatus) in the
stream setback. Although the stream is not fish bearing, it appears to be suitable habitat for a number of
amphibian species, most likely Pacific tree frogs (Pseudacaris regilla), rough skinned newts (Taricha
granulose), Northwest Salamanders (Ambystoma gracile) and Long Toed Salamanders
(A.macrodactylum). The adjacent property supports a variety of birds and ground animals. The area to
be cleared represents 2700 square feet on the east side of stream. The trees also reduce the overhead
canopy cover but will leave shrubs and other understory vegetation intact. Overall, it is estimated the
tree clearing will reduce the overall canopy cover by about 25 %. The hazard trees will remove from the
site with the branches chipped, with residual chips blown on the site.
The trees will be felled following safety standards set by the occupational safety and health
administration (OSHA) Washington Industrial Safety and Health Administration (WISHA) as well as
State Department of Health Administration (DNR) fire precaution levels and other measures as required
by the city. Tree stumps will be cut close to the ground (less than 2 inches high) to avoid being trip
hazard. The branches of trees to be felled will be chipped with residual chips blown on site less than 6
inches deep for mulch for new vegetation.
1.3 Goals and Objectives
•
The overall goal of this plan is to mitigate the impacts of the tree and brush clearing along the stream on
the west side of the property, and associated buffers as needed for a Clearing and Grading Permit from
King County.

• Reduce the need for frequent vegetation maintenance and improve the long term integrity of the
wetland.
• Address citizen concerns about maintaining a high quality wildlife habitat along the stream.
2.0 PLANTING PLAN
2.1 Plant Species Composition
•
To mitigate the impact of tree remove along the stream the, Campys will plant a variety of native tree and
shrub species suitable for the mixture of moist riparian and upland conditions of the site. Nine plant species
have been selected to provide vegetation cover and shade and to create both species and structural diversity
(Table 2). Shrubs were selected for their ability to provide food for wildlife in the form of seed or fruits.
The shrubs planted are expected to quickly shade the stream and benefit bird species that nest in scrub -
shrub wetland in riparian habitats. Plants will be ordered as 1 -5 gallon container or B &B (bagged and bur
lapped) stock.

2.2 Site Preparation
Because the tree cutting should not result in soil disturbance or removal of understory vegetation relatively
• only two tasks will be needed to prepare the site for planting.

• Debris Removal - tree crew will remove the branches that are left on site along the stream. This
will make planting easier and will ensure that this material does not block the flow of the stream
by capturing sediment and debris. All branches will be collected manually and removed from
the site or chipped and left as mulch. One tree trunk will be left onsite to provide ground cover
and wildlife habitat.
• Weed Control - owners will treat the existing infestation of blackberry which is the most
prevalent noxious weed on site. Although blackberry is not extensive it does have the potential
to spread quickly in open conditions. Pending the City of Tukwila's approval, land owners
propose using a combination of manual, mechanical, and chemical methods to control this
species, as outlined in the Best Management Practices (BMP's) (King County 2005b). Plants
growing along the stream, which are easily accessible, would be cut to the ground prior to
planting with resprouting treatment in 2009 & 2010. These plants would be spot treated with
Glyphosphate (Rodeo), which is approved for use near water. Applications would be with a
sprayer using low pressure and large droplet size, and would occur September- October 2008,
which is prior to planting and also the time when treatment with this herbicide is most effective.
Glyphosphate treatment would be by a licensed applicator according to the label instructions.
Herbicides would not be used to treat blackberry growing in water. Instead, these plants would
be removed by cutting or grubbing.
2.3 Planting
•
The overall objective of replanting the site is to restore native vegetation cover in the stream setback in a
way that reduces the need for frequent vegetation maintenance, improves the quality of wildlife habitat, and
satisfies land owners concerns. A formal landscape planting scheme has been prepared (see Stream Buffer
Planting Plan on last page).
Approximately 150 individual trees, shrubs, and ferns will be installed on the site. Plant placement will be
in accordance to the landscape planting scheme. Planting will occur in October or November of 2008 and
the work will be performed or directed onsite by land - owners. Photos of the site will be taken from fixed
points to provide a basis for monitoring activities.
3.0 MONITORING AND COORDINATION
Land owners will monitor the site for 3 years to ensure the success of planting and weed control efforts.
Because the site is densely stocked, additional planting will occur only if survival rate drops below 80 %.
Blackberry control using manual, mechanical, and chemical treatment is expected to occur in each of the
monitoring years. After each monitoring visit, land owners will prepare a brief report documentation the
number of surviving plants, the methods used for weed control activities, and any issues related to the site.
Photographs will be taken from the same fixed points established at planning and included in the report.
The report will be sent to City of Tukwila Planning Department by December of each year (2008, 2009,
and 2010). In addition, home owners will build a split rail fence meeting Tukwila Municipal Code at a
mutually agreed upon location and install wetland area signs. Signs will be replaced in each of the
monitoring years, if necessary.
