This letter serves as a notice of decision and is issued pursuant to TMC 18.104.170 on the following project
and permit approval.
I. PROJECT INFORMATION
Project File Number: L08 -066 (Parking Determination)

Type of Permit Applied for: Parking Determination for a proposed park.
Project Description: Set the minimum number of parking stalls as being eight (8) for Phase I and
II of the Duwamish Riverbend Hill Passive Park Preserve.

II. DECISION
SEPA Determination: The City SEPA Responsible Official has determined that the project, as proposed,
does not require a threshold determination under SEPA because it qualifies as a planned action pursuant to
WAC 197 -11 -172, that the probable significant adverse environmental impacts of the project were adequately
analyzed in the EIS previously prepared for the planned action and will implement the conditions and
mitigation measures imposed by the planned action approval.
Decision on Substantive Permit: The City Planning Commission has determined that the application for
Parking Determination to provide eight (8) parking stalls to serve Phase I and II of the Duwamish Riverbend
Passive Park Preserve does comply with applicable City and state code requirements and has approved that
application based on the findings and conclusions contained in the staff report, subject to any conditions
which are set forth in the Decision.

III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 4 decision pursuant to Tukwila Municipal Code
18.104.010. Other land use applications related to this project may still be pending.
One administrative appeal to the City Council of the Planning Commission Decision is permitted.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Planning Commission decision on the Permit Application, a written notice of appeal
must be filed with the Department of Community Development within 21 days of the issuance of this
Decision, which is by December 8, 2008.
The requirements for such appeals are set forth in Tukwila Municipal Code18.116. All appeal materials
shall be submitted to the Department of Community Development. Appeal materials MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation,
association or other group, the address and phone number of a contact person authorized to receive
notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in
the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief
sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee of $210
V. APPEAL HEARINGS PROCESS
The City Council hearing regarding the appeal shall be conducted as a closed record hearing before the
based on the testimony and documentary evidence presented at the open record hearing conducted by the
Planning Commission. The City Council decision on the appeal is the City's final decision.
Any party wishing to challenge the City Council decision on this application must file an appeal pursuant
to the procedures and time limitations set forth in RCW 36.70C.

VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are
available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd.,
Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The

PROJECT INFORMATION
Tukwila Parks and Recreation Department has filed an application for Special Permission
from the City's Planning Commission to determine the minimum number of parking
spaces for phase one of the Duwamish Riverbend Hill Park. The City's Parks and
Recreation Department is proposing a total of eight gravel parking stalls for the park.
Projects applied for include: L08 -066, Special Permission from the Planning Commission
Other known required permits include: SEPA Planned Action (E08 -019) and Shoreline
Permit Exemption Request (A08 -023)
Studies required with the applications include: None.
This project is subject to SEPA and is being reviewed under the City's Planned Action
requirements for the Manufacturing Industrial Center.
FILES AVAILABLE FOR PUBLIC REVIEW
The application is available for review at the City of Tukwila, Department of Community
Development (DCD), located at 6300 Southcenter Blvd #100.
OPPORTUNITY FOR PUBLIC COMMENT
You are invited to comment on the project at a public hearing before the Planning
Commission, scheduled for 7:O0PM November 13, 2008 at the Tukwila City Council

written comments on the application or desiring to receive notification of the final decision on the application may do so
within 30 days of the notice of application. If a hearing will be held on the application, the hearing notice must include the

Shoreline Substantial Development Permit # - 2009 NW 90009
Purpose: Notification of Receipt of Approved Substantial Development Permit (SDP)
On March 13, 2009 the Department of Ecology received notice that the City of Tukwila
approved your application for an . SDP. Your permit is for construction park
improvements including trails, landscaping, and parking. This activity will occur within
an Urban environment within the shoreline jurisdiction of the Duwarnish River.
By law, local governments must review all SDPs for compliance with the following:
• The Shoreline Management Act (Chapter 90.58 RCW)
• Ecology's Substantial Development Permit approval criteria (Chapter 173 -27 -150
WAC)
• The City of Tukwila Local Shoreline Master Program
Local governments, after reviewing the SDP for compliance, are required to submit the
SDPs to Ecology for filing. Your approved SDP has been received and filed by Ecology.
What Happens Next?
Before you begin activities authorized by this permit, the law requires you to wait at least
21 days from the date we received the decision letter from the City of Tukwila on
March 13, 2009. This waiting period allows anyone who (including you) disagrees with
any aspect of this permit, to appeal the decision to the state Shorelines Hearings Board.

You must wait for the conclusion of an appeal before you can begin the activities
authorized by this permit.
If no appeal is submitted you may begin activities any time after April 3, 2009.
The Shorelines Hearings Board will notify you by letter if they receive an appeal. We
recommend, however, you contact the Shorelines Hearings Board before you begin
permit activities to ensure no appeal has been received. They can be reached at

If you want to appeal this decision, you can find appeal instructions (Chapter 461-08
WAC) at the Shorelines Hearings Board website above. They are also posted on the

Other federal, state and local permits may be required in addition to this shoreline
permit.
If this permit is NOT appealed, this letter constitutes the Department of Ecology's final

10. ALL WORK PERFORMED SHALL BE PER APPROVED PLANS AND SPECIFICATIONS
ONLY. THE CONTRACTOR I5 REQUIRED TO MAINTAIN A SET OF APPROVED PLANS
AND SPECIFICATIONS AND ASSOCIATED PERMITS ON THE JOB SITE. WORK SHALL
BE PERFORMED IN ACCORDANCE WITH ALL FEDERAL, STATE, AND LOCAL LAWS.
11. AS THE FIRST ORDER OF BUSINESS, THE CONTRACTOR SHALL INSTALL EROSION
PREVENTION AND SEDIMENT CONTROL MEASURES PER THE ESC AND SHALL
INSTALL THE DOWNSTREAM TEMPORARY ESC MEASURES BEFORE ANY SITE
DISTURBANCE OCCURS. BEFORE THE TEMPORARY MEASURES ARE REMOVED,
INSTALL AND ESTABLISH THE UPSTREAM PERMANENT ESC MEASURES.
12. THE CONTRACTOR SHALL AT ALL TIMES PROTECT SENSITIVE AREAS, THEIR
BUFFERS, AND ADJACENT PRIVATE PROPERTIES AND PUBUC RIGHTS -OF -WAY OR
EASEMENTS FROM DAMAGE DURING GRADING OPERATIONS. THE CONTRACTOR
SHALL RESTORE, TO THE STANDARDS IN EFFECT AT THE TIME OF THE ISSUANCE
OF THE PERMIT, SENSITIVE AREAS, THEIR BUFFERS, AND PUBLIC AND PRIVATE
PROPERTIES AND IMPROVEMENTS DAMAGED BY THE CONTRACTOR'S OPERATIONS.
