subject to any conditions which are set forth in the Decision.

A party who is not satisfied with the Hearing Examiner's decision may file an appeal in King County

IV. PROCEDURES AND TIME FOR APPEALING
Any party wishing to challenge the Hearing Examiner's Decision must file an appeal pursuant to the
procedures and time limitations set forth in RCW 36.70C. If no appeal of the Hearing Examiner's
decision is properly filed in Superior Court within such time limit, the Decision on this permit will be
final.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are
available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd.,
Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The

Introduction
The applicant seeks a variance to allow placement of one freestanding sign within the
required sign setback area. A public hearing on the application was held on February 20,
2009, at the Department of Community Development, 6300 Southcenter Boulevard,
Tukwila, WA. Represented at the hearing were: the Department, by Courtney. Thomson,
Planning Intern; and the applicant, Andover Company, by Mike Hemphill and Steve
Zamberlin. No member of the public appeared at the hearing. The Hearing Examiner
inspected the site on February 20, 2009.
After due consideration of the evidence presented at the public hearing, the following
shall constitute the findings of fact, conclusions and decision of the Hearing Examiner on
this application.

Findings of Fact
•
1. The property is addressed as 6450 Southcenter Boulevard and is located at the
intersection of Southcenter Boulevard and 65`'' Avenue South. The King County parcel
number is 0003200011. The property is developed with a multi -tenant office building.
The property is zoned Office and the Comprehensive Plan designation for the area is
Office.
2. The southern property line is located 17 feet from the sidewalk edge, and there is
a wide landscaped area between the property line and the sidewalk edge. The site slopes
uphill (northward) as it moves away from Southcenter Boulevard.
3. The applicant proposes to place one freestanding sign at the property line. The
sign would be 48 square feet (24 square feet per side). The sign would be six feet tall
and would display the building's name (6450 Southcenter Boulevard Building) and the
building's tenants.
4. Under TMC 19.32.140(E), one freestanding sign with a maximum total sign area
of 200 square feet (100 square feet per side) is allowed at this site. TMC 19.32.070
requires that freestanding signs be set back from all property lines a distance at least
equal to the overall height of the sign.
5. The closest business to the east is over 100 feet away from the proposed sign
location. The closest building to the west is over 200 feet away.
6. TMC 19.12.060 sets forth the criteria for granting a sign variance. Currently, the
City has a moratorium on signs exceeding six feet in height.
Conclusions
1. The Hearing Examiner has jurisdiction over this application pursuant to TMC
19.12.060 and 18.104.010. Under TMC 19.12.060, all of the variance criteria must be
met in order for a variance to be granted.
2. The variance would not constitute a grant of special privilege inconsistent with
the intent of the sign code and would not contravene the limitations on uses under the
zoning code. The variance would allow the applicant to install a directory sign for the
multi -tenant office building at the site, which is a permitted use in the Office zone. The
intent of the Sign Code is to enhance street appearance and safety by minimizing clutter
and distraction. The freestanding sign is smaller than the maximum size allowed and

be 17 feet away from the sidewalk edge, so that street safety and appearance are not
affected by granting the variance.
3. The variance is necessary because of the unusually wide right -of -way found along
Southcenter Boulevard. The property line is 17 feet from the sidewalk edge, as opposed
to typical locations in the City where the property line is adjacent to the sidewalk edge.
Thus, while other properties could satisfy the setback for a sign of this height by placing
it six feet from the sidewalk edge, the strict application of the Code would require this
sign to be placed 23 feet from the sidewalk edge. At that location, the sign would be
uphill from the street and would not be very visible to motorists moving at street level.
4. The variance would not be materiaily detrimental to the public welfare or cause
injury to property or improvements in the vicinity or zone. The visibility of surrounding
businesses and their signs would not be affected. The closest properties are 100 or more
feet away from the sign location, and the sign would still be located some 17 feet from
the sidewalk edge, so would not pose hazards to pedestrians using the sidewalk.
5. The wide public right -of -way along Southcenter Boulevard was not caused by the
applicant.
6. The requested variance is the least amount of deviation from the regulations
necessary to accomplish the purpose for which the variance is sought. The variance is
sought in order to allow the sign to be visible to motorists or pedestrians moving at street
level. If the sign face were larger, its visibility from street level would not be markedly
improved, and it is at the maximum height allowed under the current moratorium. The
variance for setback to allow the sign next to the property line is therefore the minimum
relief that will accomplish the purpose for which the variance is sought.
7. The granting of this variance would result in a greater convenience to the public
in identifying the location of the signed businesses. The variance allows the sign to be
located closer to street level, in line with motorists' line of sight. so that the public can
see the sign and identify the businesses which are listed on the sign.
8. The granting of the variance would not constitute a public nuisance or adversely
affect public safety. The sign would still be located 17 feet away from the edge of the
sidewalk, which is further away than the typical six feet of distance that is required for
signs of this height. The sign meets the height limit and its face size is below the
maximum allowed. No impacts on visibility or safety are likely to result from this
variance.
9. The requested variance meets all of the applicable criteria, and should be granted.

BACKGROUND
The property is located at 6450 Southcenter Boulevard at the intersection of Southcenter
Boulevard and 65th Avenue South. Its zoning classification is Office and is currently occupied by
one multi - tenant office building.
According to TMC 19.32.140 (E), the site is allowed one freestanding sign with a maximum total
sign area of 200 sq. ft. (100 sq. ft. per sign face.), which is based on the street frontage. The
proposed sign is 48 sq. ft. (24 sq, ft. per side), and therefore meets the size requirements. The
sign must be set back from the property line a distance greater than or equal to its height. The
proposed sign is 6 feet tall.
The southern property line is located 17 feet from the sidewalk edge. If the sign were to be
installed according to the Sign Code requirements, it would be.placed 23 feet from the sidewalk
edge. The applicant is applying for a variance to waive the setback requirement so that the sign
can be placed directly on the property line.
VARIANCE CRITERIA
The proposed project must comply with criteria detailed in TMC 19,12.060, (1 -7), concerning
Variance requests. The applicant's response to variance criteria is attached to this staff report as
Attachment (E). Staff makes the following findings under the city's variance criteria (TMC
19.12.060):
Under TMC 19.21.060 the Hearing Examiner must find that all of the criteria are met in order to
approve the variance.
1. The variance as approved shall not constitute a grant of special privilege which is
inconsistent with the intent of this sign code, nor which contravenes the limitation uses of
property specified by the zoning classification in which this property is located.
This variance will not increase the number of signs allowed on the site, nor will it increase the
total sign area allowed. The proposed sign will serve as a directory for the multiple businesses

located at the site. A multi - tenant office building is a permitted use in the Office zoning
classification. The purpose of the Sign Code is to maintain a safe and orderly environment and
to minimize clutter and distraction. The proposed sign meets the intent of the setbacic
requirements by keeping the sign at a safe distance from the sidewalk.
2. The variance is necessary because of special circumstances relating to the size, shape,
topography, location or surroundings of the subject property in order to provide it with
use rights and privileges permitted to other properties in the vicinity and in the zone in
which the subject property is located.
The variance is requested due to a wide public right -of -way. The property line at the site is 17
feet from sidewalk edge. According to the Sign Code the sign must be placed 6 feet from the
property line, which would be 23 feet from the sidewalk edge. The setback requirements in the
Sign Code were written with the consideration that most property lines in the city run along the
sidewalk edge, so the properties along Southcenter Boulevard have a unique circumstance.
The slopes along the street would also affect the sign location options. Due to the topography of
the site, a sign placed at the required setback distance would be further uphill and above the
normal line of sight of passing motorists.
3. The granting of such variance will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity and in the zone in which the
subject property is located.
The variance will not interfere with the visibility of surrounding businesses or their signs. The
closest business to the east is over 100 feet away from the proposed sign location and the Xerox
building to the west of the subject property is over 200 feet away.
By waving the setback requirement, the sign would still be set back a sufficient distance so as not
to physically interfere with pedestrians or cyclists on the sidewalk.
4. The special conditions and circumstances prompting the variance request do not result
from the actions of the applicant.
The wide public right -of -way is an existing situation and did not result from actions of the
applicant. This has resulted in a wide landscaped area in between the property line and the
sidewalk edge.
5. The variance as granted represents the least amount of deviation from prescribed
regulations necessary to accomplish the purpose for which the variance is sought and

which is consistent with the stated intent of this code.
The total freestanding sign area allowed per TMC 19.32.140 (El) is 200 square feet (100 sq. ft,
per sign face.) The proposed sign is only 48 square feet (24 sq. ft. per side). By increasing the
size of the sign, it would be possible to increase the visibility of the sign without obtaining a
variance, but doing so would not meet the applicant's other purpose of the variance, which is to
lower the sign closer to the street level. In addition, there is a current moratorium on signs taller
than six feet, which Limits the ability of the applicant to install a taller sign.
6. The granting of the variance shall result in greater convenience to the public in
identing the business location for which a sign code variance is sought.
Granting the variance would bring the sign closer to the right -of -way and place it at a lower
elevation so it is closer to the street level. Locating the sign closer and at a horizontal plane that
is more in line with the motorist's line of sight will make it easier for motorists to read the sign
and locate the business quickly.
7. The granting of the variance will not constitute a public nuisance or adversely affect the
public safety.
By reducing the setback instead of increasing the sign size to increase visibility, the sign will be
consistent with the architectural scale of the site and be less visually obtrusive. Bringing the sign
closer to the level of the street will aid drivers in locating the business at this site more easily. If
the sign were installed at the property line, it would still be set back an adequate distance so as
not to compromise the safety of pedestrians on the sidewalk. The proposed sign location is far
enough away from the street intersection that it would not interfere with drivers' visibility of
oncoming traffic.
CONCLUSIONS
1. The privileges granted with this variance are consistent with the intent of the sign code.
With the reduced setback, the sign will still be located a safe distance away from
pedestrians. It does not grant any other privileges other than a reduced setback.
2. The unusually wide public right -of -way creates a unique circumstance for the site. Most
property owners have property lines near the sidewalk edge and therefore are allowed to
place a sign close to the sidewalk and street, where it is most easily read. Granting this
variance would allow the applicant the opportunity to advertise in the same manner.
3. The variance will not cause detriment to the public welfare or other properties in the

vicinity. It will not interfere with the visibility of surrounding businesses or their signs,
nor will it be a source of distraction.
4. The variance is sought because of a wide public right -of -way, which is an existing
condition and does not result from the actions of the applicant.
5. The applicant seeks to increase visibility of the sign by bringing it closer to the property
line and further downhill, so that it is lower to the street level and within passing
motorists' line of sight. The setback variance accomplishes this goal with the least
amount of deviation from the Sign Code.
6. By locating the sign closer to the street and more in line with motorists' line of sight, it
will make it easier for the public to identify the location of the businesses at the site.
7. This setback reduction will not create a public nuisance. The sign will be set back a safe
distance from the sidewalk to prevent interference with pedestrians. It is also far enough
away from the street intersection so it will not jeopardize the visibility of motorists.
RECOMMENDATIONS
Staff recommends approval of the variance.

To install an illuminated double sided monument sign display six (6) feet above
existing grade, with a face size of approximately eighteen (18) square feet each
side. The sign is located on the north side of Southcenter Blvd. just west of the 65th
Ave. S. intersection. The sign's primary purpose is to inform passerby of the name
of the property "6450 Southcenter Blvd. Building" and provide a listing of the
individual tenants within the property. This variance is requested to allow the sign
to be located at the property line with no setback. The sign will be entirely located
on private property, but the variance will relax the 6' -0" required by the sign code.
1. The sign code allows freestanding signs for commercial properties and details
the required setbacks depending on the sign's overall height. The intent of
the sign code is to locate signs on subject properties so signs appear orderly
and their placement is balanced architecturally within the property. The
proposed relaxed location is still setback a large distance from the sidewalk
and will be in a "natural" location on the property.
2. The sloped hillsides and large parking lot areas limit the possible locations for
a monument sign display. In the majority of surrounding properties the
property line location is at the sidewalk. This site's property line is located
seventeen (17) feet back from the sidewalk. If the sign were to be placed
per the sign code it would be setback twenty -three (23) feet back from the
sidewalk, or almost in the parking lot. In fact, there is an adjacent business
"Xerox" where their sign is located even closer to the street than this
proposed sign location.
3. This sign will not cause any material detriment to the public welfare and
properties in the vicinity as Southcenter Blvd. is a heavily — traveled major
arterial in Tukwila. There are many commercial businesses with signage
along the same street. Information on the sign is for the benefit of passing
motorists to properly locate the businesses at the site.

4. The sloped hillsides and the property line locations have been constant since
development and did not result from actions of the property owner.
5. The variance request to relax the setback to the property line is only an
adjustment of six (6) feet closer to the sidewalk. Since the property line is
located seventeen (17) feet back from the sidewalk, the proposed location is
still setback approximately eleven (11) feet from where the sign would be
located if the property line were at the sidewalk. The smaller size and scale
of the sign are consistent with directional type signs which are normally
located near property lines.
6. The proposed sign location at the property line will provide much better
visibility of the sign than the six (6) foot setback location per the sign code.
This location is also lower towards the street level due to the dramatic slope
of the hillside. If the sign were located farther away and higher it could even
be a distraction as motorists may not be able to properly read the sign both
quickly and clearly.
7. The sign will still be setback seventeen (17) feet from the sidewalk and is
placed roughly in the center of the grass landscape hillside. There are not
any site distance impairment visibility issues at this location.
