Purpose: Notification of Receipt of Approved Substantial Development Permit (SDP)
On August 28, 2008, the Department of Ecology received notice that the City of Tukwila
approved your application for an SDP. Your permit is for the conversion of an existing
parking area into a park within shoreline jurisdiction of Green River.
By law, local governments must review all SDPs for compliance with the following:
• The Shoreline Management Act (Chapter 90.58 RCW)
• Ecology's Substantial Development Permit approval criteria (Chapter 173 -27 -150
WAC)
• The City of Tukwila Local Shoreline Master Program
Local governments, after reviewing the SDP for compliance, are required to submit the
SDPs to Ecology for filing.
Your approved SDP has been received and filed by Ecology.
What Happens Next?
Before you begin activities authorized by this permit, the law requires you to wait at least
21 days from the date we received the decision letter from the City of Tukwila on
August 28, 2008. This waiting period allows anyone who (including you) disagrees with
any aspect of this permit, to appeal the decision to the state Shorelines Hearings Board.
You must wait for the conclusion of an appeal before you can begin the activities
authorized by this permit.

II. DECISION
SEPA Determination: The City SEPA Responsible Official has previously determined that this
application does not require a SEPA threshold determination because it is categorically exempt.
Decision on Substantive Permit: The City Community Development Director has determined that
the application for a Shoreline Substantial Development Permit does comply with applicable City
and state code requirements and has approved that application, subject to the condition set forth
below based on the findings and conclusions contained in the staff report.
Conditions of Approval:
1. Provide documentation (easement agreement or statement from owner of the railroad
spur) authorizing paving an access route over their railroad spur.
2. Relocate the access to the Green River Trail from the south end of the property to the
north end of the property. The access path shall be at least 6 feet wide.
The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal
Code §18.104.010. Other land use applications related to this project may still be pending.
III. YOUR APPEAL RIGHTS
One administrative appeal to the Shorelines Hearings Board of the Decision is permitted. Any
person appealing to the Shorelines Hearings Board may raise certain SEPA issues as part of the
appeal to the Shorelines Hearings Board. Appellants should consult the rules and procedures of the
Shorelines Hearings Board for details.
IV. PROCEDURES AND TIME FOR APPEALING
The requirements and procedures for appeals to the Shorelines Hearings Board are set forth in
RCW 90.58 and WAC 461.08.
V. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the
Shoreline Substantial Development Permit are available for inspection at the Tukwila Department
of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from

1. PROJECT DESCRIPTION
Scott Campbell of Rainier Industries has proposed to convert an abandoned parking area
on the Rainier Industries site into a "Yurt Park ". Rainier Industries occupies a site
between Olympic Avenue and the Green River. The Green River Trail is located on the
property parallel to the river at the top of an earthen levee. The new yurt park will be
located at the landward base of the levee. The park will be an accessory use to the yurt
manufacturing building owned by Rainier Industries on the same site. The park will
straddle both the low and high- impact environments and will be located between 78 and
143 feet from the OHWM of the Green River. The park will be used as a display area of
yurts and tents and as a recreational area and facility for employees.
The park will have three yurts and one tent for display purposes. They will not be
occupied, plumbed, or have electricity. A 6 foot tall black vinyl coated security fence will
surround the perimeter of the park. Improvements include removing the existing asphalt
and installing landscaping, paved paths, and picnic tables. The applicant does not propose
to remove any trees but will be adding a significant amount of native vegetation and
removing the existing invasive plant species (blackberries and ivy). The yurts will be
constructed on pier blocks that are non - permanent in nature and will require annual
replacement with new blocks. A paved path will be created over the existing railroad spur
(pending approval from the railroad) and will provide ADA- accessible access to the yurts.
2. POLICIES OF THE SMA/SMP
The site is within the jurisdiction of the Tukwila Shoreline Management Program (SMP).
This program was adopted in June, 1974 and amended March 16, 1982. The City's SMP
was reviewed and approved by the State Department of Ecology as being consistent with
the State Shoreline Management Act, adopted in 1971. The Shoreline Master Plan
establishes three management zones adjacent to the Green/Duwamish River:
River Zone: An impact buffer area which provides for resource protection, flood
control maintenance, pollution control and landscape enhancement. This zone
includes the first 40 feet from the mean high water mark.
Low Impact Zone: A transition area intended to minimize physical and visual
impact on the river zone while accommodating shoreline development. This zone
includes the second 60 feet from the mean high water mark.
High Impact Zone: An area to provide for more intensive use of the shoreline
resource. This zone includes the area from 100 feet to 200 feet from the mean high
water mark.
The applicable policies of the City's Shoreline Management Program are set forth below
along with a discussion of the proposed project.

City of Tukwila Shoreline Master Plan Goals and Policies:
Overall Goals:
1. Promote reasonable and appropriate use of the shorelines, which will promote and
enhance public interest.
2. Protect against adverse effects against the public health, the land, its vegetation and
wildlife and the waters and their aquatic life within Tukwila.
3. Protect public rights of navigation.
4. Recognize and protect private property rights consistent with public interest.
5. Maintain a high quality of environment along the shorelines of Tukwila.
6. Preserve and protect fragile natural resources and culturally significant features.
7. Provide safe and reasonable access for the public to the shorelines.
8. Recognize, protect, and improve aquatic habitats and spawning grounds of the
Green River, which are invaluable natural resources.
9. Recognize, protect and improve those wildlife habitats, which are valuable natural
resources of the State.
10. Encourage recreational activities unique to or dependent upon the use of the river
which benefit the public interest.
Response: These goals will either be met through this project or are not applicable. The
use of the shoreline on this property is enjoyment of the Green River Trail which runs
along the entire property. The existing access from the site to the trail will be removed to
discourage trail users from entering the site. Employee access to the trail will be created
along the north edge of the property. The park will not create any discharge to surface or
groundwater and will not create any pollution into either the air or water. The existing
impervious surface will be removed and no new impervious surface will be created.
Existing invasive plants (ivy and blackberries) will be removed by mechanical means or by
hand. No existing trees will be removed and the area under the scope of the project will be
landscaped with native species.
The project will not interfere with the navigation of the Green River. There are no
culturally significant features on the site. The project will not interfere with the aquatic
habitat and spawning grounds found in the Green River. While the Green River trail runs
along the property, public access to the trail is not available from this property.
Economic Development Element Goals:
1. Encourage economic development along shorelines that will enhance the quality of
life for the residents of Tukwila with minimum disruption of the environment.
2. Encourage economic development along shorelines that will result in long -term
over short-term benefits for the river shoreline.
3. Recognize the quality of the existing economic activities along the river and
discourage any future economic activities that may be of less quality.

4. Encourage inland location of development so that access along the shorelines is
enhanced.
5. Encourage commercial development of public recreational facilities consistent with
shoreline goals and policies.
Response: The proposal will replace an abandoned parking area with a sales display area
and employee recreation space. The area will be landscaped to mimic the natural
environment. The yurt park will occur between the public access trail and the existing
commercial development. The removal of the parking area and replacement with
landscaping will enhance and soften the transition between the public access trail and the
commercial warehouse development.
Public Access Element Goals:
1. Encourage safe, convenient and diversified access for the public to the shorelines of
Tukwila.
2. Assure that the intrusions created by public access will not endanger life, property
or have adverse effects on fragile natural features.
3. Increase public access to publicly owned shorelines.
4. Encourage public access to privately owned shorelines, consistent with private
property rights.
5. Encourage inland location of development so that access along shorelines is
enhanced.
Response: The Green River trail runs along the property and there will be no change to
the trail and there is no public access to the trail. The existing private access from the site
to the trail will be relocated from its current location to the north end of the property where
employees can easily access the trail from an exit door on the westem end of the north side
of the building.
Circulation Element Goals:
1. Encourage a safe, convenient and diversified circulation system to assure efficient
movement of persons during their daily and other activities with minimum
disruption to the shoreline environment and minimum conflict between the
different users.
2. Encourage a balanced system for transporting people and moving goods in exiting
corridors.
The Circulation Element of the City's Shoreline Master Program applies to the location of
proposed major roads, transportation routes and other public facilities within the shoreline.
The proposed project does not impact public transportation facilities or routes.

Recreational Element Goals:
1. Encourage recreational activities and related facilities unique to or dependent upon
the use of the river, which benefit the public interest.
2. Encourage diverse, convenient and adequate recreational opportunities along the
shorelines for the local residents and a reasonable number of transient users.
Response: The Recreational Element of the City's Shoreline Master Program has already
been met on this site via the Green River trail. The proposed project does not impact the
trail or recreational opportunities the trail affords.
Shoreline Use Element Goals:
1. Encourage appropriate development in suitable locations without diminishing the
quality of environment along the shorelines of the river.
2. Shoreline activities should be consistent with the overall goals for development
along the river.
Response: The river environment is not changed with this proposal. Replacing an
abandoned parking lot with a landscaped yurt park improves the shoreline zone.
Conservation Element Goals:
1. Encourage preservation of unique, fragile and scenic elements, and of non-
renewable natural resources; assure continued utilization of the renewable
resources.
2. Encourage the preservation of as much as possible of the natural character of the
river and its shoreline.
3. Encourage the preservation of resources and ecology of the river and its shoreline.
4. Water quality in the river should be sufficiently high to permit human use and
provide a suitable use and habitat for desirable forms of aquatic life.
Response: The natural character along most of the river in the City has been altered to a
major extent due to the construction of levees and revetments to provide flood protection.
The proposal will not change the existing character of the river but will remove existing
impervious surface and replace it with native vegetation, mulch, and a paved walking path.
Historical/Cultural Element
1. Protect or restore areas having historic, cultural, educational or scientific values.
2. The long -term effects upon the river must be considered over short term benefits,
economic or otherwise.
Response: Any historical and cultural elements of the river and shoreline are not altered
through the removal of a parking lot and the creation of a landscaped yurt park.

3. SHORELINE REGULATIONS
Following are the review criteria as contained in the Tukwila Shoreline Regulations
located in Tukwila Municipal Code, Chapter 18.44.
A. TMC 18.44.110 General Shoreline Regulations
All uses within the shoreline overlay district must conform to the following general
regulations:
1. The use is in conformance with the regulations of the underlying zone district
Response: The site is zoned commercial /light industrial (C/LI). The proposed yurt park
will be used as an employee recreation space as well as an outdoor display area to
showcase the yurts manufactured and sold on -site. Manufacturing and sales are both
allowed in the C/LI zone and the yurt park supports those functions.
2. The use does not conflict with the goals and policies of the shoreline master
program or the provisions of the Shoreline Act and shoreline regulations.
Response: Section 2, above, is a discussion of the goals of the City's adopted Shoreline
Management Program. The proposed project is consistent with the City's adopted
Shoreline Management Program.
3. No structures or accessory facilities shall be located over the river unless such
structure protects or promotes the public interest.
Response: No structures or accessory facilities located over the river are included in this
project.
4. There shall be no disruption of existing trees or vegetation within the river
environment unless necessary for public safety or flood control, or if allowed as
part of an approved shoreline substantial development permit;
Response: No disruption of any existing vegetation in the River Environment will take
place. All work will occur landward of the toe of the levee and outside the River
Environment.
S. No effluent shall be discharged into the Green River which exceeds the water
quality classification as established by the State for the adjacent portion of the
river.
Response: No effluent will be discharged into the Green River.

6. All State and federal water quality regulations shall be strictly complied with.
Response: The project will comply with all State and federal water quality regulations.
7. Wildlife habitat in and along the river should be protected.
Response: Wildlife habitat in and along the river will not be altered by the construction of
this project.
8. All perimeters of landfills or other land forms susceptible to erosion shall be
provided with vegetation, retaining walls or other satisfactory mechanisms for
erosion prevention.
Response: No work is proposed within an area subject to erosion or in the vicinity of a
landfill. No vegetation will be removed and native trees and shrubs will be added.
9. All necessary permits shall be obtained from federal, State, County or municipal
agencies.
Response: As the application consists of removing an abandoned parking lot and
replacing it with canvas yurts, a paved path, and landscaping no other permits are required.
The State Department of Ecology will review the shoreline permit. The project proposal
involves creating a paved footpath across an abandoned railroad spur. The proposal will
be conditioned upon the applicant obtaining permission to pave across this railroad
easement.
10. Dredging for purposes other than for navigational improvements or flood control
is prohibited.
Response: No dredging is involved with this project.
11. Mining is prohibited along the river shoreline.
Response: No mining is involved with this project.
12. Solid waste disposal is prohibited along the river shoreline.
Response: No solid waste disposal is involved with this project.
13. No property will be acquired for public use without dedication by or just
compensation to the owner.
Response: No property is proposed for acquisition with this project.

14. Landfilling is prohibited within the river channel unless such landfill is
determined by the Planning Commission to protect or promote the public interest.
Response: This project does not propose any landfilling within the river channel.
15. ...(R)emoval of any cottonwood tree within the river environment or the low
impact environment, which tree is 12 inches or greater in diameter as measured
4.5 feet above grade, shall be subject to the requirements of TMC Chapter 18.54,
Tree Regulations.
Response: No tree removal is proposed as part of this project.
B. TMC 18.44.130 Specific shoreline regulations — river environment.
The River Environment consists of a 40 -foot wide management zone, measured from the
mean high water mark. Uses in the River Environment are restricted to such uses as
footpaths or trails, recreation facilities, dikes, bridges, or fire lanes.
No work is taking place within the River Environment.
C. TMC 18.44.140 Specific shoreline regulations — low impact environment
The low impact environment consists of a 60 foot wide management zone, beginning at the
end of the river environment and proceeding 60 feet landward. Types of uses permitted in
the low impact environment include structures not exceeding 35 feet in height, adequately
screened or landscaped parking/loading and storage facilities, utilities, public or private
streets or signs.
For this project, about half of the proposed footpath, two yurts- 12 feet and 18 feet in
diameter, and a 14 foot by 16 foot tent will be located within the low impact environment.
Approximately 9,500 square feet of low impact area will be affected. The activities taking
place in the low impact area are as follows: first, existing asphalt will be removed
followed by clearing, grubbing and soil preparation to clear the project footprint for
landscaping, then the landscaping, footpath, and yurts will be installed along with a
temporary irrigation system. The project will be surrounded by a 6 foot high, black vinyl
coated chain link fence.
D. TMC 18.44.150 Specific shoreline regulations — high impact environment
The high impact environment permits all uses allowed in the underlying zoning district.
Approximately 3500 square feet of pavement will be replaced by landscaping and a portion
of the proposed footpath. A 30 foot diameter yurt will be installed in the high impact
environment.

4. COMMENTS
The Notice of Application for this project was issued on May 14, 2008. The comment
period closed on June 13, 2008. Comments were received from King County Department
of Natural Resources and Parks. Most of the comments were based on King County's
misunderstanding of the location of the proposed project. When King County realized the
project is proposed on the landward side of the levee the majority of their concerns were
eliminated. The applicant worked with King County and addressed all of their concerns.
See Attachment B. King County was sent a set of revised plans and made no comment.
5. SEPA
The City SEPA Responsible Official has previously determined that this application does not
require a SEPA threshold determination because it is categorically exempt.
6. CONCLUSIONS
1. The project site is located along the Green River at the southern most portions of the
City limits. The zoning and comprehensive plan designation is Commercial/Light -
Industrial. The proposed use is permitted within this zone.
2. The site will be improved through the removal of asphalt and invasive vegetation and
the subsequent replanting of the area with native vegetation. The private access to the
Green River trail will be relocated from the south end of the site to the north end of the
site.
3. Utilizing this area as a yurt display space and private park serves the economic
development goals of the business located on the site. Removing the abandoned
parking lot and replacing it with a yurt park enhances the site.
4. The public access, via the Green River trail, is not altered by this proposal. The site
and view of the site from the trail are improved with the addition of landscaping in the
yurt park in place of an abandoned parking lot.
5. The circulation, recreation, and shoreline use of the site are not altered by this proposal.
6. The natural character of the shoreline will be enhanced with the addition of native
landscaping and the removal of non - native invasive species.
7. No disturbance of the native soils is proposed as a result of this project.
8. The project is consistent with the General Shoreline Regulations set forth in TMC
18.44.110:
A. The use is consistent with the goals and policies of the City's adopted Shoreline
Management Program;
B. No additional structures or accessory facilities will be located over the river;
C. The project will not disrupt existing trees or vegetation within the river
environment.
D. No effluent will be discharged into the Green River and all state and federal water
quality regulations will be strictly complied with;
E. Wildlife habitat in and along the river will be protected;
F. All necessary permits will be obtained for this project;

G. No dredging or mining will occur with the project;
H. Solid waste will not be disposed of along the shoreline;
I. No property will be acquired for public use and no landfilling of property will

J. The project does not propose to remove any trees. Removal of any cottonwood
tree would be subject to the requirements of Tukwila Municipal Code, Chapter
18.54, Tree Regulations.
9. The project is consistent with the requirements of TMC 18.44.130, River Environment.
No work is taking place in the River Environment.
10. The project is consistent with the requirements of TMC 18.44.140, Low Impact
Environment — two yurts and a tent, a paved footpath, a 6 foot high chain link fence,
and landscaping will replace a parking area. The majority of the work will take place
in the Low Impact Environment.
11. The project is consistent with the requirements of TMC 18.44.150, High Impact
Environment. A third yurt and the completion of the fence and paved footpath will
occur in the high impact environment.
12. Comments were received from King County Water and Land Resource Division. The
issues raised were due to a misunderstanding on King County's part that the yurt park
was located riverward of the levee. Upon clarification, King County's concerns were
resolved.
13. This project is categorically except from SEPA
5. RECOMMENDATION
Approve the shoreline substantial development permit subject to the following conditions:
1. Provide documentation (easement agreement or statement from owner of the
railroad spur) authorizing paving an access route over their railroad spur.

Project Description for Shoreline Development Permit
The proposal is to convert an existing unused parking area on the Rainier
Industries site into a "Yurt Park ". The park would be an accessory use to the yurt
manufacturing building owned by Rainier Industries on the same site. The site is
partially located in the Low Impact Environment and partially located in the High
Impact Environment.
There are no critical areas on the site. The closest critical area is the Green
River, located off -site to the west. The proposed park is located between 78 feet
and 143 feet from the OHWM of the Green River.
Uses proposed for the yurt park include:
*Display of products (yurts and tents) for marketing purposes
*Recreational area and facilities for employees
Proposed improvements to create the "Yurt Park" include:
a. Erecting three yurts and one tent (products manufactured on the site).
The yurts will not be occupied, will not be plumbed and will not have
electricity.
b. Security fence around the perimeter
c. Installation of landscaping, gravel paths, and picnic tables;
d. Removal of existing asphalt.
No new impervious area will be created. No removal of existing trees is
proposed. The yurts are constructed on pier blocks that are non - permanent in
nature, and will be replaced on an annual basis with newer, Tess worn, products
of the same size and height.

18.44.110 General Shoreline Regulations
All uses within the Shoreline Overlay District must conform to the following general
regulations:
1. The use is in conformance with the regulations of the underlying zone district;
Tr/ad Comment: The primary use of the site for manufacturing yurts and tents is a
permitted use In the Commercial /Light Industrial zone. The proposed accessory use of
the site for product display is permitted as storage of materials manufactured on the
site. Employee picnic area (employee recreation and facilities) is a permitted accessory
use in the Commercial Light Industrial zone. Screening of the display area is proposed
2. The use does not conflict with the goals and policies of the shoreline master program
or the provisions of the Shoreline Act and shoreline regulations;
Triad Comment: The proposal Is consistent with goals of the shoreline management plan
and SMA that promote uses that do not pollute or damage the natural environment and
that do not interfere with the public use of the shoreline. The proposal will include
landscaping that will significantly improve the natural function and visual appearance of
the shoreline. The use itself will not discharge pollutants to either the air or water. No
overwater or other structures, fill or alteration are proposed within the River
Environment and the proposal will not impact existing public access to the shoreline
(Green River).
3. No structures or accessory facilities shall be located over the river unless such
structure protects or promotes the public interest;
Triad Comment: No structures or accessory facilities are proposed to be located over the
river.
4. There shall be no disruption of existing trees or vegetation within the river
environment unless necessary for public safety or flood control, or if allowed
as a part of an approved shoreline substantial development permit;
Triad Comment: No modification or alteration is proposed within the River Environment.
5. No effluent shall be discharged into the Green River which exceeds the water quality
classification as established by the State for the adjacent portion of the river;
Triad Comment: No effluent is proposed or will be generated or discharged from the site
as a result of the proposal.
6. All State and federal water quality regulations shall be strictly complied with;

Triad Comment: No discharge to surface or groundwater is proposed or will result from
the proposal. No additional impervious surfaces are proposed.
7. Wildlife habitat in and along the river should be protected;
Triad Comment.. There is little or no existing wildlife habitat on the site. The existing
vegetation on the site, and between the site and the river, offers very little habitat
value. Vegetation consists primarily of mowed grass and intermittent cottonwood trees.
The proposal includes significant landscaping with native plants and trees, and the
removal of aspha /t that will significantly improve wildlife habitat conditions on site.
8. All perimeters of landfills or other land forms susceptible to erosion shall be provided
with vegetation, retaining walls or other satisfactory mechanisms for erosion prevention;
Triad Comment: No landfills or alterations of landforms are proposed that would require
erosion stabilization. Additional landscaping provided by the proposal wi /l improve
stability on the site generally.
9. All necessary permits shall be obtained from federal, State, County or municipal
agencies;
Triad Comment: All necessary permits will be obtained prior to construction.
10. Dredging for purposes other than for navigational improvements or flood control is
prohibited;
Thad Comment: Dredging is not proposed.
11. Mining is prohibited along the river shoreline;
Triad Comment Mining is not proposed.
12. Solid waste disposal is prohibited along the river shoreline;
Triad Comment. Solid waste disposal is not proposed.
13. No property will be acquired for public use without dedication by or just
compensation to the owner;
Triad Comment: Public use of the site is not proposed.
14. Landfilling is prohibited within the river channel unless such landfill is determined by
the Planning Commission to protect or promote the public interest.
Triad Comment: No landfill is proposed on the site or within the river channel.

15. Notwithstanding any provisions of this Code to the contrary, removal of any
cottonwood tree within the river environment or the low- impact environment, which tree
is 12 inches or greater in diameter as measured 4.5 feet above grade, shall be subject
to the requirements of TMC Chapter 18.54, Tree Regulations.

18.44.140 Specific Use Regulations - Low - Impact Environment
The proposal is consistent with the specific use regulations of the Low - Impact
Environment (TMC 18.44.140). No structures will be over 35 feet in height, and there
are no railroad spurs, parking, public or private roads, utilities or signs proposed. The
area between the display area and the river will be landscaped with a combination of
evergreen trees and shrubs and fence sufficient to screen the area from view consistent
with the requirements of this section.

PROJECT DESCRIPTION
Part 1— GENERAL
1.01 SUMMARY
A. Planting shall include soil preparation, clearing and grubbing, planting mulching and
maintenance work.
B. Provide design —build irrigation system for the buffer plantings.
• A temporary irrigation system, similar to the system used by King County along the
Green River Trail, will be installed and maintained for at least 3 years.
• See 'Temporary Irrigation System" on this page for further description.
C. The Landscaping will include site clean-up. ground preparation, installation of a fence, paved
pathways and plantings.
D. The triangular area between the landward side of the levee toe, the railroad tracks and the
south property line will be fenced in to create a secure display area for Rainier Industries yurt
product line.
1. The fence will be a 6 -foot tail chain link style with black vinyl coating.
2. It will be set back 15 -feet from the center of the railroad track.
3. It will be set -back a minimum of 5 -feet (north) of the south property tine.
E. Paved paths will be installed to provide ADA access to each of the Rainier display yurts. The
path will cross the railroad. Appropriate authorization from the railroad to allow this path will
be provided to the city of Tukwila by Rainier Industries.
F. One of the Rainier yurts will have an ADA ramp, door and lockset to provide convenient
access for customer's with disabilities. The other's are mounted very close the ground and a
portable ramp will be available if needed. If the portable ramp is used, Rainier will provide
any necessary assistance to our customers who may need it.
G. The plantings wilt incorporate a mix of existing trees and shrubs along with the new trees and
shrubs described in this plan.
1. The new trees will be planted with a maximum space of roughly 20' to 30'.
2. The new shrubs will be planted at a maximum space of roughly 5' to 7'.
3. To the extent practical/possible, the plantings will be arranged to provide visual
Screening on the outside of the fence.
1.02 QUALITY ASSURANCE
A. All plant material shall conform to AAN Standards for nursery stock, latest edition.
1. Generat all plant material furnished shall be healthy representatives, typical of their
species or variety and shall have a normal growth habit They shall be full, well
branched, well proportioned, and have a vigorous, well developed root system. All
plants shall be hardy under climatic conditions similar to those in the locality of the
project
2. Trees shrubs and ground covers: quantities, species and varieties, sizes and
conditions as shown on the planting plan. Plants to be healthy, vigorous well foliated
when in leaf. Free of disease, injury. insects, decay, harmful defects, and all weeds.
No substitutions shall be made with out written approval from the Landscape Architect
or Owner.
B. The contractor shall be responsible to protect the root zones of existing mature trees per the
standards of the AAN, specific to each indvidual species. The contractor shall have the
plan(s) available (in writing) at the time of signing Tukwila's required affidavit attesting that
the plans described here and the conditions of the permit will be followed.
1.03 WARRANTY
A. Warranty shall include replacing and planting the same size and species of plant material, for
one year providing 100% guarantee replacement. Rejected Pants are to be removed from
the site immediately.
PART 2 — PRODUCTS
A. Planting soil: Where the asphalt will be removed, the soil will be prepared per 3.02 (A). In
areas were the native sal will remain, plantings shaft be planted per details and as noted
herein.
B. Mulch: Composted Wood chips provide 4' depth. Submit sample for approval by landscape
architect. Wood Chips shall be not greater than 3' in any dimension.
C. Plants: As described in this plan for quantities, type and quatity.
PART 3 — EXECUTION
3.01 PRIOR TO CONSTRUCTION
A. The contractor shall review the area of Bearing and grubbing. The contractor shall stake the
location of the buffer enhancement areallimit of work. The contractor shall not disturb beyond
the limits of the limit of work.
3.02 CLEARING AND GRUBBING
A. The first phase shall begin after the permit is issued b y the City of Tukwila and will take roughly
1 month. During this time period the contractor shall remove all trash, debris, building products,
asphalt, any human made products etc. Contractor shall mow grasses etc. to a height of 3' to
6'. No chemicals are to be used in the removal of foliage. Mechanical removal of blackberries
and other invasives is the preferred method.
a The contractor shall grub out the blackberries.
b. The contractor shall scarify (till) the soil where the asphalt was removed and add a
minimum 6' layer of ccmpest or approved soil amendment. The amendment shall be
incorporated into the native soil to a depth of 18'.
c. Root Zone Protection Measures
- The contractor will hand dig around shallow roots of existing plants and trees to
protect root zones.
d. Rainier employee access to the levee trail will be via the employee footpath located at
the north end of the Rainier property.
B. The next phase will take roughly 2 months. Contractor shall finish removing any remaining or
new blackberry or invasives growth by mechanical or manual methods. Contractor shall
remove sod or root mass in the 2' surrounding each new plant prior to planting.
3.03 PLANTING OPERATIONS
A. Planting operations shall begin November 1 and shall be completed by March 15
B. Prior to planting trees and shrubs, all burlap will be removed from b&b plants and roots will be
loosened, straightened, checked and pruned if necessary.
C. Layout and install plant material per plan, as detailed as approved by the landscape architect.
Provide 6" length survey tape flagging on each new plant to aid in identification. Provide
separate color for each type of latent. No plant substitutions shall be made without prior
approval of the Landscape Architect Inspection of the final plant installation shall be provided
by the Landscape Architect. Provide 4" depth mulch in the 4' diameter area around each plant
and to all areas disturbed by construction or left as otherwise bare soil.
3.04 MAINTENANCE AFTER PLANTING
A. Plant Maintenance during construction which shall consist of applying water, weeding intervals,
caring for the plants installed, resetting plants to prayer grade and upright position, removing
dead or damaged wood, temporary irrigation as required to prevent the drying out of plants.
The contractor shall maintain sufficient staff to adequately maintain the plant material in a
healthy condition. Any damage to planted areas shall be repaired, leveled and replanted. The
contractor shall replace, in kind, any plants which show signs of failure, injury or do not show
healthy condition.
B. Contractor shall keep the site clean of all the debris generated from planting operations.
Pavements shall be kept clean of soil and mulch.
C. Provide plant warranty replacements upon one year review.
3.07 PROJECT CLOSEOUT
A. Final cleanup: Prior to final inspection, remove deleterious material, replace dead plants and
remove debris from all areas, rake neatly planting areas to an even fine grade, and wash and
clean adjacent hard surfaces.
TEM RARY IRRIGATION SYSTEM
The irrigation system will be similar to and modeled after the one used by King County along the levee path.
The system will consist of a tank of water and a gravity operated drip irrigation network of piping.
• It will be maintained for at least 3 years while the native plantings take root and become
mature enough to survive without it.
A. There will be a plastic water tank positioned at an elevated location. The final location will be
determined during the landscaping process but will rnost likely be in the southwest comer of the
fenced area.
B. The tank will be filled by water using a hose from Rainier's main building.
C. At the base of the tank will be a valve and a network of pipes and drip irrigation hoses.
D. Each new plant or tree will have a drip'emitter(s)' routed to it. The size and number of emitters for
each plant will be determined by the landscape architect.
Rainier will maintain the system to promote the health and survival of our new plants. To insure the system
is maintained, Rainier will include it in our maintenance and calibration program to insure that it is both filled
as needed and functioning as designed.

The City has completed its review of the above shoreline permit application. The
application was submitted on April 9, 2008 and deemed complete on May 2, 2008. The
public comment period ended June 13, 2008. Comments were received from King County,
Department of Natural Resources and Parks. A pre - application meeting was held March 27,
2008; comments from that meeting also need to be addressed.
The project was reviewed by the City departments and interested agencies. What follows
are their comments.
King County: DNRP/WLRD/RS/Flood Hazard Reduction Services
Andy Levesque of King County has concerns regarding the landscaping, levee and maps
provided. Attachment A is an email response from him. Please work with Andy and the
Department of Community Development to address his comments.

soil has been paved over for many years. Scarify and add a minimum 6" layer of

Thank you for the drawings. I am familiar with the site, as it is
located along the Desimone Levee, near the downstream end of the setback
levee repairs we accomplished between 1997 and 2003. I am enclosing a
line drawing of the aerial survey of this site completed as part of our
new Green River flood study. This survey was flown in 2006, and shows
spot elevations and 2 foot contour intervals. The adjacent building
outlines are also shown, to get an idea of where the project area is
located.
Please note that additional setback levee reconstruction and repairs to
deteriorating portions of the Desimone Levee are proposed in the 2006
King County Flood Hazard Management Plan. These may affect the extreme
downstream portions of the site when this proposed work proceeds as
planned over the next several years. Any impacts on adjacent
properties, of course, and any related levee easement needs, will be
negotiated at that time with the affected landowners.
My questions about the information provided on the landscape drawings
are related to the enclosed aerial topographic survey information;
Reading the spot elevation shown on the topo, the land at the site
behind the levee is at about elevation 26.1 or 26.2 feet (NAVD 1988),
taken at the centerline of the adjacent railroad grade. The crest of
the levee trail is shown as about elevation 35.3 feet. This means the
height of the levee above the landward ground surface is about 9.1 or
92 feet, very close to the 9 feet 3 inches shown on the cross section
you provided.
Likewise, the enclosed aerial topo shows the riverward edge of the slope
at or very near the approximate OHWM near elevation contour 16.0. This
compares reasonably well with an independent calculation of the OHWM
performed about 2000 feet downstream by the Corps of Engineers, which
shows the OHWM at that location to be approximately elevation 15.0 feet.
Using the aerial survey then gives a vertical height difference between
the levee crest and the OHWM of about 19.3 feet, which is about 5 feet
less than the 24 feet 9 inches shown on the cross section.

It greatly depends on the site. Many locations commonly called levees
(not "levys ", which are taxes) are actually revetments without a
raised
earthen fill structure to confine floodwaters. Other levees are
managed
either by King County through the King County Flood Control Zone
District, or possibly by private parties, or are part of a state
highway
embankment, or a railroad. Also, the entire left bank of the Green
River in Tukwila from 1-405 to roughly South 196th Street is a
federally
authorized Section 205 levee project managed by Tukwila in accordance

Since the vertical position of the OHWM is therefore clearly in error on
the cross section provided as L1.20, then it seems likely the horizontal
position of the OHWM may also be in error on sheet L1.00.
A similar concern is present regarding the Mean High Water Line (MHWL)
shown. The aerial topo I have enclosed clearly shows the presence of a
constructed midslope bench between elevation 20 and 22. The cross
section drawing fails to show this obvious ground feature, which may
affect the horizontal location of the MHWL too. Since most of the
Shorelines Environments shown are dimensioned from this feature, this

may therefore affect site planning or permitting decisions.
In my past experience Tukwila has specified the flow levels associated
with a 9,000 cfs discharge in the Green River as defining the MHWL
elevation. Just downstream from this site location the Corps of
Engineers has computed the 9,000 cfs flow as corresponding to elevation
27 feet. Accurately locating the elevation 27 feet contour on both the
plan view and in the cross section at this site would seem to be
essential here. Perhaps the topographic information enclosed, or the
AutoCAD drawings from which this was obtained may be useful in this
regard.
That said, it is not clear to me from the cross section L1.20 whether
the vegetation shown on the riverward side of the levee crest is
intended to show existing vegetation as previously planted by King
County along the levee and midslope bench, or whether this is meant to
show new plantings. If the latter is proposed, a detailed planting plan
should be prepared and provided to King County for review by our
ecological and maintenance staff assigned to the Green River for
consistency with our levee maintenance and habitat restoration
standards.
Similarly, I cannot tell from the drawings if the vegetation shown on
the landward side of the levee is existing or proposed, nor what the
tree size and speciation may be. Since Section A/1.2 on Sheet L1.20
shows tree cover within the landward toe of the levee, this type of
information would be needed to provide a comprehensive response to the
proposal from a levee management perspective.

Federal levees like the one in Tukwila strictly limit the size and
spacing of the allowed plantings in accordance with the Seattle
District
Corps' Regional Variance to the federal levee vegetation management
standards. The federal standards themselves require grass only, mowed
between 4 inches and 12 inches tall. The Seattle District's Regional
Variance is subject to some interpretation, but basically states that
no
trees larger than 4 inches in diameter will be allowed to grow. Some
of
this depends also on the character of the riverbank. If there is a
mid -slope bench wider than 15 feet, for example, the Seattle District
will sometimes allow actual trees to be planted there and will spare
them from cutting once they begin to mature.
Like revetments, non - federal levees can support any brush and tree
cover
the local jurisdictions choose to permit. The one drawback is that
the
Corps will also inspect any local levees, at least once a year in
theory, and will decide whether or not they are eligible for any
future
federal flood damage repair funding. That is, they can help local
governments repair any future flood damages to the non - federal levees
under what they call their PL -84 -99 Levee Rehabilitation Program. The

Seattle District Corps Office also applies their Regional Variance for
levee vegetation to this determination of PL -84 -99 eligibility for the
local jurisdictions. This means that if the local governments choose
to
grow trees larger than 4 inches in diameter on the levee slopes, they
will not be eligible for future federal assistance if these levees are
ever damaged by floods. This is considered to be an entirely
"voluntary" decision on the part of local governments. In practice,
it's either "cut the trees or cut the budget." Guess who wins...
That said, for 18 years King County has tried every imaginable way in
which to plant or otherwise encourage restoration of native tree and
shrub cover on the banks of the Green River, including a fair number
of
levee repair projects in Tukwila. Even though the Corps has now told
us
to turn around and start to cut some of these trees, we are very
willing
to continue restoration efforts wherever feasible. If you want to
e -mail or fax me a location map or site plan, I will be glad to
provide
more specific comments.

The City has completed its review of the above shoreline permit application. The
application was submitted on April 9, 2008 and deemed complete on May 2, 2008. The
public comment period ended June 13, 2008. Comments were received from King County,
Department of Natural Resources and Parks. A pre - application meeting was held March 27,
2008; comments from that meeting also need to be addressed.
The project was reviewed by the City departments and interested agencies. What follows
are their comments.
King County: DNRP/WLRD/RS/Flood Hazard Reduction Services
Andy Levesque of King County has concerns regarding the landscaping, levee and maps
provided. Attachment A is an email response from him. Please work with Andy and the
Department of Community Development to address his comments.
Planning Division of DCD
1. On a site visit with you, we walked from the location of the proposed park up the
levee to the Green River Trail. This path to the trail is not shown on the plans.
Show the path and the interface between the path and the park.
2. Two different sheets are labels as L -1. Please correct the labeling.

3. Sheet L -1 identifies a plant as "PSE "; this is not shown in the legend on sheet L -2.
4. Sheet L -2, 2.A: states that plantings will occur in existing native soil. Much of the
soil has been paved over for many years. Scarify and add a minimum 6" layer of
compost or approved soil amendment. Incorporate amendment into native soil to a
depth of 18 ".
5. Sheet L -2, item 3.02: chemicals (particularly Glyphosate) are not allowed within
the shoreline area. Mechanical removal of blackberries and other invasives is the
preferred method.
6. Sheet L -2, item 3.02: mentions phase one and phase three. Explain phase two.
7. Sheet L -2, planting depth: Revise planting hole depth from 6" deeper than root ball
to planting depth only
8. Groundcover is required. The perspective shows bark mulch and the landscape plan
does not explain mulch or groundcover but talks of hydroseed. Please clarify and
revise planting plan so that it will achieve 90% landscape coverage within 3 years.
9. Describe the root zone protection measures for the existing mature trees. Measures
proposed need to extend beyond the dripline and be appropriate to the species.
10. Include a note on L -2 that prior to planting, all burlap will be removed from b &b
plants and roots will be checked and pruned if necessary.
11. Landscaping requires permanent irrigation. Provide an irrigation plan.
12. Explain the style and type of fence. If a chain link fence is proposed, a black vinyl -
coated fence is preferred.
13. Show on the plans the distance between the fence and the railroad spur. There must
be 15' between the two.
14. Public Works will require a paved path for accessiblity. Please reflect this change in
the plans.

Thank you for the drawings. I am familiar with the site, as it is
located along the Desimone Levee, near the downstream end of the setback
levee repairs we accomplished between 1997 and 2003. I am enclosing a
line drawing of the aerial survey of this site completed as part of our
new Green River flood study. This survey was flown in 2006, and shows
spot elevations and 2 foot contour intervals. The adjacent building
outlines are also shown, to get an idea of where the project area is
located.
Please note that additional setback levee reconstruction and repairs to
deteriorating portions of the Desimone Levee are proposed in the 2006
King County Flood Hazard Management Plan. These may affect the extreme
downstream portions of the site when this proposed work proceeds as
planned over the next several years. Any impacts on adjacent
properties, of course, and any related levee easement needs, will be
negotiated at that time with the affected landowners.
My questions about the information provided on the landscape drawings
are related to the enclosed aerial topographic survey information;
Reading the spot elevation shown on the topo, the land at the site
behind the levee is at about elevation 26.1 or 26.2 feet (NAVD 1988),
taken at the centerline of the adjacent railroad grade. The crest of
the levee trail is shown as about elevation 35.3 feet. This means the
height of the levee above the landward ground surface is about 9.1 or
9.2 feet, very close to the 9 feet 3 inches shown on the cross section
you provided.
Likewise, the enclosed aerial topo shows the riverward edge of the slope
at or very near the approximate OHWM near elevation contour 16.0. This
compares reasonably well with an independent calculation of the OHWM
performed about 2000 feet downstream by the Corps of Engineers, which
shows the OHWM at that location to be approximately elevation 15.0 feet.
Using the aerial survey then gives a vertical height difference between
the levee crest and the OHWM of about 19.3 feet, which is about 5 feet
less than the 24 feet 9 inches shown on the cross section.

Since the vertical position of the OHWM is therefore clearly in error on
the cross section provided as L1.20, then it seems likely the horizontal
position of the OHWM may also be in error on sheet L1.00.
A similar concern is present regarding the Mean High Water Line (MHWL)
shown. The aerial topo I have enclosed clearly shows the presence of a
constructed midslope bench between elevation 20 and 22. The cross
section drawing fails to show this obvious ground feature, which may
affect the horizontal location of the MHWL too. Since most of the
Shorelines Environments shown are dimensioned from this feature, this
may therefore affect site planning or permitting decisions.
In my past experience Tukwila has specified the flow levels associated
with a 9,000 cfs discharge in the Green River as defining the MHWL
elevation. Just downstream from this site location the Corps of
Engineers has computed the 9,000 cfs flow as corresponding to elevation
27 feet. Accurately locating the elevation 27 feet contour on both the
plan view and in the cross section at this site would seem to be
essential here. Perhaps the topographic information enclosed, or the
AutoCAD drawings from which this was obtained may be useful in this
regard.
That said, it is not clear to me from the cross section L1.20 whether
the vegetation shown on the riverward side of the levee crest is
intended to show existing vegetation as previously planted by King
County along the levee and midslope bench, or whether this is meant to
show new plantings. If the latter is proposed, a detailed planting plan
should be prepared and provided to King County for review by our
ecological and maintenance staff assigned to the Green River for
consistency with our levee maintenance and habitat restoration
standards.
Similarly, I cannot tell from the drawings if the vegetation shown on
the landward side of the levee is existing or proposed, nor what the
tree size and speciation may be. Since Section A/1.2 on Sheet L1.20

(not "levys ", which are taxes) are actually revetments without a
raised
earthen fill structure to confine floodwaters. Other levees are
managed
either by King County through the King County Flood Control Zone

River in Tukwila from I-405 to roughly South 196th Street is a

Variance is subject to some interpretation, but basically states that

trees larger than 4 inches in diameter will be allowed to grow. Some
of
this depends also on the character of the riverbank. If there is a
mid -slope bench wider than 15 feet, for example, the Seattle District
will sometimes allow actual trees to be planted there and will spare
them from cutting once they begin to mature.
Like revetments, non - federal levees can support any brush and tree
cover
the local jurisdictions choose to permit. The one drawback is that
the
Corps will also inspect any local levees, at least once a year in
theory, and will decide whether or not they are eligible for any
future
federal flood damage repair funding. That is, they can help local
governments repair any future flood damages to the non - federal levees
under what they call their PL -84-99 Levee Rehabilitation Program. The
Seattle District Corps Office also applies their Regional Variance for
levee vegetation to this determination of PL -84 -99 eligibility for the
local jurisdictions. This means that if the local governments choose
to
grow trees larger than 4 inches in diameter on the levee slopes, they
will not be eligible for future federal assistance if these levees are

"voluntary" decision on the part of local governments. In practice,
it's either "cut the trees or cut the budget." Guess who wins...

to turn around and start to cut some of these trees, we are very

Thank you for the drawings. I am familiar with the site, as it is
located along the Desimone Levee, near the downstream end of the setback
levee repairs we accomplished between 1997 and 2003. I am enclosing a
line drawing of the aerial survey of this site completed as part of our
new Green River flood study. This survey was flown in 2006, and shows
spot elevations and 2 foot contour intervals. The adjacent building
outlines are also shown, to get an idea of where the project area is
located.
Please note that additional setback levee reconstruction and repairs to
deteriorating portions of the Desimone Levee are proposed in the 2006
King County Flood Hazard Management Plan. These may affect the extreme
downstream portions of the site when this proposed work proceeds as
planned over the next several years. Any impacts on adjacent
properties, of course, and any related levee easement needs, will be
negotiated at that time with the affected landowners.
My questions about the information provided on the landscape drawings
are related to the enclosed aerial topographic survey information;
Reading the spot elevation shown on the topo, the land at the site
behind the levee is at about elevation 26.1 or 26.2 feet (NAVD 1988),
taken at the centerline of the adjacent railroad grade. The crest of
the levee trail is shown as about elevation 35.3 feet. This means the
height of the levee above the landward ground surface is about 9.1 or
9.2 feet, very close to the 9 feet 3 inches shown on the cross section
you provided.
Likewise, the enclosed aerial topo shows the riverward edge of the slope
at or very near the approximate OHWM near elevation contour 16.0. This
compares reasonably well with an independent calculation of the OHWM
performed about 2000 feet downstream by the Corps of Engineers, which
shows the OHWM at that location to be approximately elevation 15.0 feet.
Using the aerial survey then gives a vertical height difference between
the levee crest and the OHWM of about 19.3 feet, which is about 5 feet
less than the 24 feet 9 inches shown on the cross section.
Since the vertical position of the OHWM is therefore clearly in error on
the cross section provided as L1.20, then it seems likely the horizontal
position of the OHWM may also be in error on sheet L1.00.
A similar concern is present regarding the Mean High Water Line (MHWL)
shown. The aerial topo I have enclosed clearly shows the presence of a
constructed midslope bench between elevation 20 and 22. The cross
section drawing fails to show this obvious ground feature, which may
affect the horizontal location of the MHWL too. Since most of the
Shorelines Environments shown are dimensioned from this feature, this

may therefore affect site planning or permitting decisions.
In my past experience Tukwila has specified the flow levels associated
with a 9,000 cfs discharge in the Green River as defining the MHWL
elevation. Just downstream from this site location the Corps of
Engineers has computed the 9,000 cfs flow as corresponding to elevation
27 feet. Accurately locating the elevation 27 feet contour on both the
plan view and in the cross section at this site would seem to be
essential here. Perhaps the topographic information enclosed, or the
AutoCAD drawings from which this was obtained may be useful in this
regard.
That said, it is not clear to me from the cross section L1.20 whether
the vegetation shown on the riverward side of the levee crest is
intended to show existing vegetation as previously planted by King
County along the levee and midslope bench, or whether this is meant to
show new plantings. If the latter is proposed, a detailed planting plan
should be prepared and provided to King County for review by our
ecological and maintenance staff assigned to the Green River for
consistency with our levee maintenance and habitat restoration
standards.
Similarly, I cannot tell from the drawings if the vegetation shown on
the landward side of the levee is existing or proposed, nor what the
tree size and speciation may be. Since Section A/1.2 on Sheet L1.20
shows tree cover within the landward toe of the levee, this type of
information would be needed to provide a comprehensive response to the
proposal from a levee management perspective.

The Department of Community Development received you application for a Shoreline
Substantial Development Permit for a Yurt Park on the property located at 18375 Olympic Ave
S. You application is considered complete as of May 2, 2008 for the purposes of meeting state
mandated time requirements.
As the next step, the City will coordinate the required public notice for your project. You expressed
that you would like to handle the creation and installation of the required notice board. I am
including instructions for the fabrication of the board. I will be on your site in the next day or two
to determine the best installation location and will call you with instructions. The board will need
to be installed prior to May 16th. Once you have installed it, call me and I will coordinate the
posting and mailing notice of land use. At that point, the comment period will start and will
commence 30 days later. Following the public comment period, a decision on your shoreline
permit will be made by the Department of Community Development Director. The City's decision
will then be sent to the Department of Ecology for review; they have 21 days to take jurisdiction.
