The scope of work covered under the application was to renovate an existing apartment complex by enclosing the outdoor balconies; adding enclosed garages; adding an addition and completing other site work. As of today the work approved by L08 -025 has not been completed. The purpose of this letter is to inform you that pursuant to Tukwila Municipal Code (TMC) 18.60.070 (E) your design review approval has been expired because construction permitting did not begin within three years from the Notice of Decision being issued. If you wish to pursue this project at a later date you will have to submit a new design review application and comply with all development regulations in place at the time of submittal of a complete application. DECISION SEPA Determination: The City SEPA Responsible Official has determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Planning Commission has determined that the application for Chul Kim does comply with applicable City and state code requirements and has approved the application on the findings and conclusions contained in the staff report, subject to any conditions which are set forth in the Decision. Prior to issuance of any building permits for the proposed project, the applicant shall provide color renderings for the sides and rears of the existing apartment complexes. The proposed colors shall be consistent with the colors of the front for each apartment complex. The Director of DCD shall approve the final colors for the sides and rears of the existing apartment complexes. 2. Prior to issuance of the building permits for the proposed detached garages, the applicant shall provide color renderings depicting the color of the proposed garages. The proposed colors shall be consistent with the colors of the front apartment buildings as depicted in attachment I. The Director of DCD shall approve the final colors for the garages. 3. Prior to issuance of any building permits, the applicant shall provide color details for the trash enclosure's CMU walls. 4. Prior to issuance of the building permit required to enclose the existing balconies, the applicant shall provide details on the finishes for the enclosures. The finishes shall be of the same material as the existing apartment building. The Director of DCD shall approve the finishes used to enclose the existing balconies. 5. Prior to issuance of any building permits, the applicant shall provide a lighting plan which demonstrates compliance with the City's lighting standards and shall be reviewed and approved by Director of DCD who shall solicit input from the Police Department. 6. Prior to issuance of any building permits, the applicant shall update the landscaping plan to include an irrigation plan which shall be approved by the Director of DCD. 7. Prior to issuance of any building permits, the applicant shall provide details on the type of furniture that will be utilized within the community patio area. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 4 decision pursuant to Tukwila Municipal Code 18.104.010. One administrative appeal to the City Council of the Board of Architectural Review Decision is permitted. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Board of Architectural Review decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by December 29, 2008. The requirements for such appeals are set forth in Tukwila Municipal Code18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $210 V. APPEAL HEARINGS PROCESS The City Council hearing regarding the appeal shall be conducted as a closed record hearing before the based on the testimony and documentary evidence presented at the open record hearing conducted by the Board of Architectural Review. The City Council decision on the appeal is the City's final decision. If no appeal of the City Council decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. Miles Page 2 12/05/2008 H:\Developments \Woodside \Staff Report.doc Vicinity /Site Information Project Description The applicant is proposing renovations to the existing Woodside Apartments located at 3721 S. 152nd Street, Tukwila, Washington. The project involves enclosing existing balconies; constructing 12 garages; adding an addition which will include an exercise room on the first floor and a family room on the second and third floor; installing perimeter and interior fences; constructing a trash enclosure; covering a storm detention vault to create a private community patio and installation of landscaping. The applicant is not proposing to add any units to the complex. Existing Development The site is currently developed with a total of four apartment buildings. A parking area divides the property into two sections, with two apartment buildings on the west and east sides of the parking area. The existing apartment complex was built in 1982 and was developed under the King County regulations in effect at the time of construction. Given that the complex was constructed prior to annexation into the City there are certain development regulations and design standards that the complex does not meet. Surrounding Land Uses: As noted the property is zoned High Density Residential (HDR). The surrounding properties to the north, west, and south are also zoned HDR. The properties to the east are zoned Low Density Residential (LDR). A mobile home park is located north of the subject site. A single family home is located west of the property; however this property is zoned HDR. Two separate apartment complexes are located south of the project site. Three single family homes are located east of the project site. In between these three single family homes and the project site is a small private roadway that essentially functions as an alley. Topography: As noted the site is an existing apartment complex and thus the site is relatively flat. The existing topography will remain unchanged after the proposed modifications are completed. B. Miles Page 3 12/05/2008 H:\Developments \Woodside \Staff Report.doc Vegetation: There are six mature trees on the project site. The tree species include Douglas fir, Alder, Cedar, and Sycamore. All existing trees on the site will be retained. Other landscaping on the site will be modified as part of the project (See Attachment C: Landscaping Plan). Public Comments The City did receive one comment letter during the Notice of Application period. The comment letter is included at attachment H. Design Review Criteria TMC 18.14.060 requires design review for any new multi - family structure when new square footage is proposed. The design review criteria for multi - family complexes are found in TMC 18.60.050 (C). Listed below is each criteria followed by a discussion by staff. The applicant has not provided a response to each of the design review criteria. The applicant provided several letters which provide some details regarding the project and its consistency with design standards. (See Attachment F: Letter from applicant, dated April 14, 2008 and Attachment G: Letter from applicant, dated October 15, 2008). Site Planning A. Building siting, architecture, and landscaping shall be integrated into and blend harmoniously with the neighborhood building scale, natural environment, and development characteristics as envisioned in the Comprehensive Plan. For instance, a multi family development's design need not be harmoniously integrated with adjacent single family structures if that existing single family use is designated as "Commercial" or "High Density Residential" in the Comprehensive Plan. However, a "Low Density Residential" (detached single family) designation would require such harmonious design integration. As noted the site is an existing apartment complex and thus there are limitations in site planning. The four existing apartment buildings are located around a common parking area that serves the complex, this layout will be unchanged. Perimeter landscaping will be located around the north, south, east and west property lines. The applicant proposes to install 12 garages on the site (See Attachment B: Site Plan). These garages will be located within the exiting parking lot, along the south edge of the property. The applicant has also proposed to install fences around the property. Private fenced areas will also be installed for tenants on the first floor. These private fenced areas will enclose existing patio areas. B. Miles Page 4 12/05/2008 H:\Developments \Woodside \Staff Report.doc The exercise room will be located on building number four along the southeast portion of the property. The addition has been constructed to comply with setback requirements. The proposed private community patio area will be located in the southeast corner of the property. B. Natural features which contribute to desirable neighborhood character shall be preserved to the maximum extent possible. Natural features include, but are not limited to, existing significant trees and stands of trees, wetlands, streams, and significant topographic features. Existing trees on the site will be retained as part of the project (See Attachment C: Landscaping Plan). There are not other natural features on the site that can be retained or preserved as part of this project. C. The site plan shall use landscaping and building shapes to form an aesthetically pleasing and pedestrian scale streetscape. This shall include, but not be limited to facilitating pedestrian travel along the street, using architecture and landscaping to provide a desirable transition from streetscape to the building, and providing an integrated linkage from pedestrian and vehicular facilities to building entries. As noted the site is an existing apartment complex and thus there are limitations in site planning. There are no sidewalks along S. 152nd Street and the proposed project does not trigger the installation of sidewalks. The existing buildings do not front towards S. 152nd street; instead the sides of the building are located along the street. The existing entry drive along S. 152nd Street will be retained. The applicant has proposed to install a pedestrian path along the west side of the existing access drive. The applicant proposes to install Type I landscaping along the front of the property. Type I landscaping is also proposed along the west, east and south property lines. A further discussion on the proposed landscaping is provided later in this report. The parking stalls are currently located directly in front of each apartment complex. The location of the existing parking on the site will be unchanged. The existing pedestrian paths that provide access from the parking stalls to the apartment buildings will remain. Pedestrian access to adjacent properties is not proposed and given the high crime in this area would not seem appropriate. Perimeter fencing will be constructed around the south, west and east property lines. Landscaping will be located around the south and east edges of the proposed community patio area. D. Pedestrian and vehicular entries shall provide a high quality visual focus using building siting, shapes, and landscaping. Such a feature establishes a physical B. Miles Page 5 12/05/2008 H:\Developments \Woodside \Staff Report.doc transition between the project and public areas, and establishes the initial sense of high quality development. The existing development does not comply with design review criteria. The applicant has proposed Type I landscaping along S. 152 "d Street as way to improve the visual image along the street. However, given that the existing buildings are proposed to be retained, there is no opportunity to redevelop the buildings on the site in order to create more of a presence along S. 152 "d Street. E. Vehicular circulation design shall minimize driveway intersections with the street. There is currently one access point along S. 152 "d Street. The applicant is not proposing any additional access points. F. Site perimeter design (i.e. landscaping, structures, and horizontal width) shall be coordinated with site development to ensure a harmonious transition between adjacent projects. The HDR zoning requires a minimum foundation setback of ten feet along side property lines. Additionally, the HDR development standards require that the second floor be 20 feet from the property lines. The applicant's existing development does not comply with these development standards. Along the east and west property lines the buildings only maintain a setback of nine feet. The proposed exercise addition has been designed to have a setback of 15 feet. In order to comply with the setback requirements the second and third floors have been stepped back from the side property lines. The goal of the Type I landscaping along the sides (west and east) and the rear (south) is to assist in screening the apartment complex from adjacent properties. The applicant has also proposed to install fencing around the entire perimeter of the property. Along the east and west property lines, a "board on board" fence will be installed (See Attachment C: Landscaping Plan and Attachment D: Fencing Detail). This type of fence allows partial visibility in and out of the project site. A solid wood fence will be installed along the south property line. This fence will assist in providing some privacy to the community patio area located along the southeast property line. G. Varying degrees of privacy for the individual residents shall be provided; increasing from the public right -of -way, to common areas, to individual residences. This can be accomplished through the use of symbolic and actual physical barriers to define the degrees of privacy appropriate to specific site area functions. Again, since the site is already developed, the ability to comply with this design criterion is limited. Landscaping and fencing is being used around the entire perimeter of the property to provide a physical separation around the property. However, the inability of the building to meet setbacks limits the privacy around the side property lines. B. Miles Page 6 12/05/2008 H:\Developments \Woodside \Staff Report.doc H. Parking and service areas shall be located, designed, and screened to interrupt and reduce the visual impact of large paved areas. The existing building and parking layout on the site will remain in its current form. The site layout with the buildings bordering around the parking area assists in reducing the impacts associated with having a large paved area. I. The height, bulk, footprint, and scale of each building shall be in harmony with its site and adjacent long -term structures. There will be no change in the height, bulk, footprint or scale of the existing apartment buildings. The only building modifications will be enclosing the existing balconies and adding an exercise room. The exercise room addition will have the same height as the existing apartment buildings. Building Design A. Architectural style is not restricted; evaluation of a project shall be based on the quality of its design and its ability to harmonize building texture, shape, lines and mass with the surrounding neighborhood. The only modifications to the existing apartment buildings on the site will be to enclose the existing units' balconies and to add a small addition to building number four. The type of materials that will be used to enclose the balconies is unknown as the applicant has not provided the specific building details to the City. The existing balconies have patio doors which will be replaced with windows when the balconies are enclosed. The proposed garages will have a roof pitch of 5:12, this matches the roof pitch of the existing apartment buildings. The applicant is proposing to use shingles for the garage. It appears that lapboard siding is being used for the exterior elevations, however call outs have not been provided on the plans. The proposed garage door design has a typical appearance for a residential garage. The garage material is unknown since they have not been called out on the plans. The material shall match the materials of the existing building. B. Buildings shall be of appropriate height, scale, and design /shape to be in harmony with those existing permanent neighboring developments which are consistent with, or envisioned in, the Comprehensive Plan. This will be especially important for perimeter structures. Adjacent structures which are not in conformance with the Comprehensive Plan should be considered to be transitional. The degree of architectural harmony required should be consistent with the non - conforming structure's anticipated permanence. B. A small addition will be located on the southeast side of building number four.. The addition will be the same height as the existing apartment building. The proposed garages located along the south property line will have a total height of 13 feet. The maximum height permitted within the HDR zone is 45 feet. The existing apartment buildings on the site have a height of approximately 27 feet. The new garages will face towards existing apartment buildings on the south property line. While the exact height of these apartment complexes is not known, these buildings are clearly taller than the proposed garages. C. Building components, such as windows, doors, eaves, parapets, stairs and decks shall be integrated into the overall building design. Particular emphasis shall be given to harmonious proportions of these components with those of adjacent developments. Building components and ancillary parts shall be consistent with the anticipated life of the structure. The architectural elements of this project include: enclosing existing balconies to create livable space; an addition to building number four and the construction of detached garages. The applicant has provided no specific details on the materials that will be used as the exterior finishes for enclosed balconies or the garages. Shingles will be used as the finish for the roof of the garages. D. The overall color scheme shall work to reduce building prominence and shall blend in with the natural environment. The applicant has provided color schemes for the fronts of all four buildings (See Attachment I, Front Renderings and elevations for proposed project). As noted, the front elevations face the interior parking area. Each building will have its own color scheme: Building 1 "Charcoal Shadow" for the roof "Charro" for the concrete siding "Oyster" for the horizontal siding "Bravdo" for the dormers "Swiss Coffee" for the trim Building 2 "Charcoal Shadow" for the roof "Sand Pebble" for the concrete siding "Villita" for the horizontal siding "Bravado" for the dormers "Navajo White" for the trim B. Additionally, the colors for the garages are not known. E. Monotony of design in single or multiple building projects shall be avoided Variety of detail, form, and siting shall be used to provide visual interest. Otherwise monotonous flat walls and uniform vertical planes of individual buildings shall be broken up with building modulation, stairs, decks, railings, and focal entries. Multiple building developments shall use siting and additional architectural variety to avoid inappropriate repetition of building designs and appearance to surrounding properties. The proposed project involves exterior renovations of four existing apartment buildings. The four apartment buildings are identical in design. The applicant has attempted to break up the monotony of design on the site by having each building have its own color scheme. Landscape and Site Treatment F. Existing natural topographic patterns and significant vegetation shall be reflected in project design when they contribute to the natural beauty of the area or are important to defining neighborhood identity or a sense of place. Existing significant trees on the site will be retained and incorporated into the landscape design for the site. G. Landscape treatment shall enhance existing natural and architectural features, help separate public from private spaces, strengthen vistas and important views, provide shade to moderate the affects of large paved areas, and break up visual mass. The applicant has proposed Type I landscaping around all property lines of the project site. The landscaping includes a mix of trees, shrubs, grasses and ground cover. Selected B. Miles Page 9 12/05/2008 H:\Developments \Woodside \Staff Report.doc planting species include, Katsura Tree, Paperbark Maple, Sericeberry, Tricolor Hydrangea, Persian Lilac, Ice Dancer Carex, and Heather. H. Walkways, parking spaces, terraces, and other paved areas shall promote safety and provide an inviting and stable appearance. Direct pedestrian linkages to the public street, to on -site recreation areas, and to adjacent public recreation areas shall be provided. There are no proposed changes in the parking layout or the proposed pedestrian linkages that connect the parking area to the individual units. The applicant will provide a concrete walk from the parking area to the City street. However, this pedestrian linkage does not connect to a City sidewalk since no sidewalks are present along S. 152nd Street. I. Appropriate landscape transition to adjoining properties shall be provided. The applicant will be providing Type I landscaping around the entire property. Adjacent properties have significant landscaping deficiencies and thus appropriate landscaping transition between properties is difficult. However, as these adjacent properties redevelop they will be required to provide an appropriate landscaping transition between the project site. Miscellaneous Structures A. Miscellaneous structures shall be designed as an integral part of the architectural concept and landscape. Materials shall be compatible with buildings, scale shall be appropriate, colors shall be in harmony with buildings and surroundings, and structure proportions shall be to scale. Proposed miscellaneous structures on the site include a variety of fence types, a trash enclosure, and a monument sign. The fencing material includes the following (See Attachment C: Landscaping Plan and Attachment D: Fencing Detail): • Rod Iron fence along the front of the property; • Board on Board fencing along the east and west property lines; • Paneling with lattice for the private yard fences; and • Solid board fencing along the south property line. In the applicant's letter dated October 16, 2008, the applicant has noted that the trash enclosure will be constructed of split face CMU bricks and that a metal gate will be used. The applicant has provided no details on the proposed colors of the CMU walls. The applicant has provided no details on the type of furniture, if any, within the community patio space located along the southeast corner of the property. B. Screening of service yards, and other places which tend to be unsightly, shall be accomplished by the use of walls, fencing, planting, berms, or combinations of these. Screening shall be effective in winter and summer. The current dumpsters on the site are not enclosed. The applicant is proposing to screen the dumpsters by using split face CMU walls and a metal gate. Additionally, the enclosure itself will be screened by the perimeter landscaping. The dumpster location shown on Attachment "B" and Attachment "C" does not meet setbacks. The applicant has provided an additional detail as Attachment K showing the dumpster's proposed location which will comply with setbacks The proposed monument sign will have a rock base and will utilize individual channel cut letters (See Attachment E: Sign Example). At the time of submittal the applicant will be required to comply the City's sign code requirements. The applicant has proposed to utilize a brick material for the floor area for the community patio area (See Attachment L: Community Patio Flooring Detail) C. Mechanical equipment or other utility hardware on roof ground or buildings shall be screened from view. Screening shall be designed as an integral part of the architecture (i.e., raised parapets and fully enclosed under roof) and landscaping. The applicant is not proposing any new mechanical or utility hardware as part of the application. The applicant is proposing to cover the existing stormwater detention and convert that area into a community patio area. D. Exterior lighting standards and fixtures shall be of a design and size consistent with safety, building architecture and adjacent area. Lighting shall be shielded, and restrained in design with no off -site glare spill over. Excessive brightness and brilliant colors shall not be used unless clearly demonstrated to be integral to building architecture. The applicant is not proposing to update the lighting on the entire site. Staff noted a concern regarding the proposed community patio in the rear of the property. In the staff's letter to the applicant dated August 29, 2008 the City noted, "The application proposes to cover an existing storm detention vault. The area will be used as a passive recreation space for tenants. Please provide additional details indicating how this area will be used. This area is isolated and needs to be designed in a manner to ensure safety. People who use this area should not feel isolated and trapped. Please provide a lighting plan for this area. The lighting should provide a minimum of five foot - candles of illumination in this area of the site. Lighting from the site should not extend off of the property or disturb residents of the apartment complexes ". The applicant provided the following response in his letter dated October 15, 2008, "Attachment 3 shows location of light fixtures on south wall of building 4 to provide B. Miles Page 11 12/05/2008 H:\Developments \Woodside \Staff Report.doc lighting for this space. Sodium vapor lamp with lamp with enough candle power will be selected to provide a minimum of five foot candle of illumination in this area ". A full lighting plan, prepared by a qualified professional should be prepared. A condition has been placed to address this matter. Conclusions Site Planning: Site planning on the site is extremely limited given the fact that existing buildings on the site will remain. The ability to place the proposed garages is extremely limited. The applicant has proposed to locate the garages in the existing parking area. There is no other possible location for the garages. The proposed dumpster enclosure is appropriate in that it is screened from view and is located away from the single family homes located on the east property line. The community patio area is being located in the only practical location; however, this location could have significant safety issues for individuals using the site. The patio area will only have one way in an one way out. In order to mitigate safety concerns with the patio lighting should be installed and the lighting plan should be approved by DCD and the Police Department. The proposed landscaping will assist in providing a buffer between adjacent single family homes located on the east property line. Additionally, the landscaping will assist in providing a transition between the apartment complexes located south of the project site. Building Design: The existing buildings on the site will remain. The proposed painting scheme of painting each building a different color is appropriate and will assist in reduce the monotony of design on the site. The proposed elevations for the exercise room addition will comply with the setback requirements with the HDR zone. The proposed elevations for the garages are harmonious with the existing apartment buildings on the site. The garages will be well below the maximum height standards within the HDR zone. The applicant has not provided any details on the treatments for the enclosed patios or the garages nor has he provided color renderings for the sides and rear of the existing buildings. These deficiencies have been addressed as conditions of approval. Landscaping and Site Treatment: The proposed landscaping plan will be a dramatic improvement over what is currently on the site and within the area. Existing mature trees on the site will be retained and incorporated into the landscape design. The project will provide a model with regards to landscaping for other apartment complexes within the area. In order to ensure large term health of the landscaping; adequate irrigation needs to be provided. The applicant's landscaping plan did not provide an irrigation plan. B. Miles Page 12 12/05/2008 H: \Developments \Woodside \Staff Report.doc Miscellaneous Structures The proposed trash enclosure will be an improvement over the current situation which has the dumpster in the middle of the parking lot. The applicant has not provided a detail on the color of the CMU walls. The color could be addressed as a condition. Multi- Family Design Manual In 1992 the City adopted a design manual for multi - family projects. The City's design standards requires that multi - family projects be evaluated both using the design guidelines found in the TMC and the design manual. As noted, the applicant is proposing a small addition and exterior renovations to an existing apartment complex. As further indicated in the staff report, the ability of the applicant to fully comply with design standards found in the TMC is limited given that existing buildings will be retained. Planning staff reviewed the design manual for guidance in applying the design criteria. Planning staff also found that some of the guidelines in the manual were not applicable that the guidelines anticipate new development. Recommendation Staff recommends approval of the renovation of the Woodside apartment with the following condition(s): 1. Prior to issuance of any building permits for the proposed project, the applicant shall provide color renderings for the sides and rears of the existing apartment complexes. The proposed colors shall be consistent with the colors of the front for each apartment complex. The Director of DCD shall approve the final colors for the sides and rears of the existing apartment complexes. 2. Prior to issuance of the building permits for the proposed detached garages, the , applicant shall provide color renderings depicting the color of the proposed 4 garages. The proposed colors shall be consistent with the colors of the front Capartment buildings as depicted in attachment I. The Director of DCD shall approve the final colors for the garages. 3. Prior to issuance of any building permits, the applicant shall provide color details for the trash enclosure's CMU walls. 4. Prior to issuance of the building permit required to enclose the existing balconies, the applicant shall provide details on the finishes for the enclosures. The finishes shall be of the same material as the existing apartment building. The Director of DCD shall approve the finishes used to enclose the existing balconies. 5. Prior to issuance of any building permits, the applicant shall provide a lighting plan which demonstrates compliance with the City's lighting standards and shall be reviewed and approved by Director of DCD who shall solicit input from the Police Department. On 9/7/07 you provided a letter informing me that the application as submitted has been found to be incomplete and additional information and changes to the proposed designs need to be submitted. I have asked Chan Soggie Architect to incorporate your comments and zoning requirements for rear setbacks in the architectural designs he provided. Unfortunately he took much longer than I expected to come up with designs being submitted with this application because he informed me that he need to finish designs for other clients first and changes made from the original designs were substantial. Following responses are provided to answer comments in your letter dated 9/7/07. a. Existing apartment buildings were designed and approved by King county based on zoning and building codes effective around 1980 and were completed in 1982. Thus, existing buildings do not meet all of City of Tukwila 2008 design review criteria. However, style of the buildings as built are similar to other multi - family buildings in the area. Architectural design by Chan Soggie Architect provide upgraded exterior view of the buildings and some indoor and outdoor recreational spaces within limitation of existing site. Renovation of existing buildings will contribute meeting city's fair share of regional housings at moderate price compared to new buildings. To meet desire of residents second bath room and washer /dryer hook up will be provided to all existing 2 bedroom/1 bath units under a separate building permits. Also, all existing decks /patio areas will be enclosed to be part of living area which allows private spaces for computer desk, storage and sunroom. In addition all existing aluminum framed windows will be replaced with vinyl clad double pane windows for energy efficiency. Further, perimeter of the property will be secured with a gated entrance and wrought iron fences at front and cedar fences on east and south sides of the Attachment F property to ensure safe, stable living environments for residents. In addition, landscaping as designed by landscape architect Richard Graves will be constructed to upgrade landscaping and other improvements on the site for residents. 12 — one car garages will be constructed to provide some residents enclosed secure spaces for their cars. Spaces above ground level recreational building will be utilized meeting setback requirements to provide extra spaces for adjoining two bedroom units. In this way two bedroom unit on second floor will have a family room and third bedroom and two bedroom unit on third floor will have a family room. In this way there will be two units with more spaces for families desiring larger spaces. b. Color rendering of the building is provided as attachment 1. Exterior of the building will be cedar lap siding in the front, T -111 for rear and side walls and cedar shake on top face of gable roof over stairways. Areas to be fences are marked in colored highlighted pens in landscape plan L1 with insets indicating what type of fences are proposed to be installed. Type A fence is wrought iron fence which will be installed along north boundary of the property. Type B fence is so called Board on Board fence which allows see through between fence boards at oblique angle top to bottom. Type C fence shows lattice top. This type of fences is proposed in front yards of buildings one and two to provide some privacy to small yard spaces for ground floor residents. Because these fences are to be installed about 2 ` above parking lot grade. Height these fences will be shorted to about 4' rather than typical 6' height fences. Type D fence shows different type of solid board fences. 2. Landscape plan L1 shows adequate number of trees are provided in most of areas. For example, north property line frontage, entrance to the property, shows 75' plus 83' or total of 153' frontage. If one tree need to be planted for every 30' linear feet distance, then only 5 trees need to be planted. Landscape plan shows total of 2 existing trees, cedar plus sycamore, plus 7 new tree or total of 9 trees, exceeding 5 required. Along east side of the property, one tree will be planted within each rear yard of ground floor enclosed patio areas. Widths of each patio areas are approx. 25'. Thus, one tree per each patio area will meet type 1 landscape requirement. Landscape plans shows adequate number of trees to meet one tree per 30' liner space for the reminder of east boundary of the property. Yard spaces along west side of the property are very narrow leaving very little room to plant large trees. Because of tight spaces landscape designer has choosen tree species called Amelanchier Alnifolia along west side of the property boundary. Still Attachment G there are enough trees, both existing and new trees, to meet one tree per 30' requirement. Total length of south boundary of the property is 180' requiring 6 trees for this span. There are three existing trees and five new trees shown, total of 9 trees exceeding requirement to plant total of 6 trees. It is intent of applicant to plant few more trees along southern boundary than shown in landscape plan to shield dumpsters on south west neighbor's property. 3. Color elevations for rear of the buildings will be similar to those in front of the buildings. The reason I ask, is that I've only gone to a handful of Council Committee meetings and a while ago I went to one when there was going to be some discussion about Tukwila Pond that I was interested in, but they also addressed recreational space at multifamily housing. I recall this latter discussion, because if my memory serves me correctly, Council member Linder gave me a lecture about how I was suppose to take back a certain point to the Planning Commission. Well my memory is fading as to what that point was, but I'm hoping that if it was important, the city council would have written it down and sent it to us and that DCD has a record of that request. If Linder does not recall the point, I believe Robertson was in attendance at this same committee meeting. The basic point was that we need to make sure that these complexes provide adequate recreational space for tenants and especially their children. From the staff report, it isn't clear to me if the new community patio and exercise room are extra items added by the applicant to attract tenants, or are required to mitigate the loss of recreational balcony space, which by the way neither may not be considered ideal play areas for children although I'm not sure a balcony is either. If the answer is that a trigger hasn't been reached to make the applicant comply with with any recreational space requirements, is there a arguement that these balconies are recreational space and that there should at least be no "net loss" (to use a term from the Shoreline Management Program) of recreational space at the complex. Please address this topic during your staff report, especially in light of the citizen comment in the package about lack of child play area (see S. A Notice of Application was posted on the site and mailed to all tenants and property owners within 500 feet of the subject property on August 4, 2008. The Notice of Application period concluded on August 18, 2008. The proposed application was also routed to the Fire, Public Works, Police and Building Departments for their review and comments. After meeting with you I gained a clear understanding of the proposed project, however the plans do not clearly reflect the project. The project requires the approval of the Board of Architectural Review and the plans must be clear and concise in showing the proposed project. The City's comments are as follows: 1. Clearly show the location of areas to be fenced. Provide insets indicating what type of fencing material will be used and where. 2. The landscaping plan does not provide the required number of trees. The front, sides and rear are required to have type .I landscaping. Type I landscaping requires that at least one tree be planted for every 30 feet of linear distance. Thus, a total of 12 trees needs to be located along the front (north property lines); 18 trees along the sides (east and west property lines); and 12 along the rear property line (south property lines). Please note that you can get credit for existing mature trees. Yet, you can not get credit for the dead tree located in the front of the property. 3. The color elevations provided are acceptable for the project. When we talked on August 19`s you had brought up the idea of each building having its own color palette. That would seem like an appropriate design element to incorporate into the project. The proposed cedar fencing will create blind spots on the property and will encourage graffiti on both sides of the fence. You had noted that a lattice would be used at the top of the fence, this will only provide minimal visibility. A fencing material that provides adequate visibility needs to be used. 6. The application proposes to cover an existing storm detention vault. The area will be used as a passive recreation space for tenants. Please provide additional details indicating how this area will be used. This area is isolated and needs to be designed in a manner to ensure safety. People who use this area should not feel isolated and trapped. Please provide a lighting plan for this area. The lighting should provide a minimum of five foot - candles of illumination in this area of the site. Lighting from the site should not extend off of the property or disturb residents of the apartment complexes. 7. The dumpster enclosure needs to be moved slightly to the east in order to meet the minimum setback requirement of ten feet. You might want to move the dumpster location slightly to the south in order to avoid a conflict with the adjacent garage. Please provide details for the materials that will be used to enclose the dumpsters. Staff recommends that split face CMU be used for the exterior wall and that a metal gate be used to provide access. 8. On the plans list the building square footage for the site, both existing and proposed. 9. Ensure that all plans have the correct scale on them.
