DECISION SEPA Determination: The City SEPA Responsible Official has previously: i determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Community Development Director has determined that the application for a Wireless Telecommunication Facility permit does comply with applicable City and state code requirements and has approved that application, subject to any conditions which are set forth in the Decision. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010. The appeal body for any filed appeal will be the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by October 7, 2008. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $210. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. Feed lines and associated cables will remain the same. Existing Development The applicant will be modifying existing equipment for this permit on property that is owned by Legacy Pertners I. The office is being used as a commercial office building. Surrounding Land Uses The property is zoned TUC and there is a Chevron service station directly to the east, a residential motel and restaurant to the south and a commercial retail development directly to the west. The site is bordered to the west by Southcenter Pkwy and to the north by Strander Blvd. BACKGROUND In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. The WCF being modified was originally approved by the City in 1998 (L98 -0023) through a conditional use permit. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co- locations and utilizing existing structures are favored over the development of new standalone WCF within the City. The wireless provider in 1998 was Airtouch Wireless. The site, through mergers and acquisitions, is now operated by Verizon Wireless. The applicant is modifying an existing transmission tower co- location antenna array. This decision does not require the use of any new facilities for placement of the new antennas. Design Standards The City provides specific design standards for the placement of WCF within the City of Tukwila. The table below indicates if the applicant's proposal complies with required standards. Only safety signage must be placed on the WCF The applicant does not propose any signage. 4. Accommodations for parking for maintenance personal must be provided. Parking is not affected by this modification. 5. Towers shall either maintain a galvanized steel finish or be painted a neutral color so as to reduce its visual obtrusiveness. This is a co- location, building mounted facility. 6. The design of all buildings and ancillary structures shall use materials, colors, textures, screening, and landscaping that will blend the tower facilities to the natural setting and built environment. The antennas will be painted white as to blend in with the building's color scheme. Screening will not be required because its use would reduce the visual appearance of the building itself. 7. Antennas shall have the same color scheme as the structure they are located on. Antennas will be painted white as to blend with the existing color scheme of the building. 8. WCF poles and towers shall only have safety lights if required by a government agency. No lighting is proposed. 9. No advertising is permitted on WCF No advertising is proposed. 10. Each service provider shall be limited to an equipment enclosure of 360 square feet. 11. In residential zones, the height of the replaced utility pole is limited to 10 above the replaced pole and no taller than 50. The existing facility being modified is not within a residential zone. 12. The replaced utility pole must be used by the owner of the utility pole to support their utility lines. This is not a utility pole facility. 13. The replaced utility pole must have the color and general appearance of the adjacent utility pole. This is not a utility pole facility. 14. Coaxial cables greater than one -half inch in diameter must be within the utility pole. Existing coaxial cables will not be modified. 15. The proposal shall not result in a significant change in the pedestrian environment or preclude the City from making pedestrian improvements. The proposed modifications will not affect pedestrian facilities. 16. All cabinet equipment must be placed outside of the City ROW, unless and exception is granted. The cabinet equipment is not mounted in the public ROW. 17. The WCF shall meet setbacks for the zone it is located within, unless an exception is granted. The WCF is co- location mounted to an existing office building that does meet setback requirements for the associated TUC zoning requirements. CONCLUSIONS 1. The proposed modifications to the existing antenna array will not significantly alter the conditions that currently exist. The new antenna array will not be taller than the current array, the number of antennas will not increase, and the existing pole mounts for the array will be reused. 2. Screening of the WCF will not be required. The visual impact of the antennas will be minimal in relation to the size of the building, all cables, feed lines, and cabinet equipment are concealed and paint matched to the antenna array as to reduce its visibility, and due to the design of the building and its relationship to the surrounding streets the use of screening would reduce the visual appearance of the building. 3. The existing coaxial cables and feed lines will not be altered. 4. As demonstrated in Table 1 the project meets all applicable development standards. 5. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 6. No noise will be generated from the new antennas being installed. 7. The wireless communications facility has been designed in a way to minimize any visual impact from the project. 8. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATIONS The recommendation to the Director of Community Development is to approve this application for a Type I Wireless Telecommunication Facility permit as applied for by Verizon Wireless. Site plan and elevation /mounting drawings furnished by KDC show that the modified personal wireless facility will be configured as follows: Replacing the existing antennas from each sector with Antel antennas (total 8 antennas). Re- orienting the azimuth and installing new antenna pipe mounts for the Alpha sector. The new antennas and pipe mounts will be mounted and centered at approximately the 73 feet above grade. This is a rooftop site on an existing building at 16400 Southcenter PKWY Seattle, WA 98188. The rooftop has restricted access and is granted to maintenance personnel only. All of the antennas are mounted well above head height for persons standing on the ground. Therefore it is unlikely that anyone other than an authorized person could approach near enough to the rooftop mounted antennas and other wireless equipment to cause RF exposure that exceeds FCC limits. It is expected that RF exposure conditions near ground level at the SEA -MALL RATS site, and on all adjacent properties, due to the contributions from all transmitting antennas, will be well below the FCC public exposure limit. To verify output at the modified VZW facility, 1 have performed EMF power density calculations to determine the exposure conditions that are likely to exist in accessible areas near the modified facility. CALCULATIONS OF RF POWER DENSITY NEAR GROUND LEVEL RF Power densities are computed in accordance with methods described in Evaluation Compliance with FCC Guidelines for Human Exposure to Radiofrequency Electromagnetic Fields, OET Bulletin 65, August 1997. Radio facilities are required to comply with the FCC "Rules & Regulations" CFR 47 §1.1310, Radiofrequency radiation exposure limits. The OET Bulletin 65 RECEIVED D . TAUG 1 9 2008 DEVELOPMENT describes the methods established by the FCC for predicting compliance with the FCC - specified exposure limits. Compliance is determined by comparing RF field predictions with the general population /uncontrolled environment (i.e., "Public ") Maximum Permissible Exposure (MPE) limits allowed by the FCC rules, as specified in CFR47 §1.1310. The following formula has been used to calculate the power densities at specific locations: S(mW /cm2) = 0.36 x ERP (watts) / (Distance in feet)2 This formula is derived from Equation 9 on page 21 of OET Bulletin 65. It includes the effect of ground reflections. The Effective Radiated Power (ERP_ depends on the vertical antenna pattern. THEORETICAL ANALYSIS According to information supplied by KDC personnel, all of the new panel antennas will be mounted and centered at or above 73 -foot level. The panel antennas will project the majority of the transmitted RF energy horizontally and well above all nearby accessible areas. The following theoretical calculations predict the peak exposure condition for a six - foot person standing at the nearest ground -level approach to the transmit antennas. A six -foot tall person standing on the ground near the SEA -MALL RATS site would be at least approximately 67 feet below the center lines of all transmit antennas. The modified VZW facility will operate within both the Cellular and Personal Communications Services (PCS) frequency bands. The calculations assume that the vertical pattems of all new and existing Verizon antennas suppress the maximum ERP by a factor of 50 (i.e., 17dB) downwards towards ground level. CONTRIBUTION OF VERIZON CELLULAR FACILITY TO RF EXPOSURE ENVIRONMENT According to information provided by VZW, Renald Gasparovic, Senior RF Engineer, the maximum ERP from any sector will be less than 711 watts with all cellular channels activated. By use of the power density formula shown on the first page, with input values of 14.22 watts downwards ERP, and a distance of 67 feet, the worst -case calculated power density at head height from the modified VZW cellular facility to a six -foot person standing near this site is 0.001212mW/cm2. The VZW cellular antennas transmit within the base station frequency band of approximately 880 -895 MHz. The Public MPE limit for the lowest base station frequency is 880/1500 = 0.587 mW /cm2. The worst -case calculated exposure condition resulting from the VZW cellular facility is the power density divided by the Public MPE limit for the lowest base station frequency: 100% x 0.001212 /0.587 = 0.206% of the Public MPE limit. CONTRIBUTION OF VERIZON PCS FACILITY TO RF EXPOSURE ENVIRONMENT According to information provided by VZW, Renald Gasparovic, Senior RF Engineer, the maximum ERP from any sector will be equal to 570 watts with all cellular channels activated. Therefore the worst -case downward ERP will be 570/50 = 11.4 watts from the modified VZW cellular facility. By use of the power density formula shown on the first page, with input values of 11.4 watts downwards ERP, and a distance of 67 feet, the worst -case calculated power density at head height from the modified VZW cellular facility to a six -foot person standing near the this site is 0.00097mW /cm2. The VZW PCS antennas transmit within the base station frequency band of approximately 1940 -1945 MHz. The Public MPE limit for PCS frequencies is = 1.0 mW /cm2. The worst -case calculated exposure condition resulting from the VZW PCS facility is the power density divided by the Public MPE limit for the lowest base station frequency: 100% x 0.00097/1.000 = 0.097% of the Public MPE limit. fAUG 1 9 ?PPR coMMu,„, All ground level areas near the SEA -MALL RATS site are expected to have exposure conditions Tess than 0.097% of the Public MPE due to the modified VZW PCS facility. PUBLIC EXPOSURE CONDITIONS NEAR GROUND LEVEL The predicted maximum worst -case RF exposure conditions resulting from the modified VZW cellular and PCS wireless operations, at all ground -level areas near the SEA -MALL RATS site, is the arithmetic sum of the percent contributions from each facility: 0.303% of the Public MPE limit = 0.206% + 0.097% This calculation exposure level is well below the 100% FCC limit. Actual exposure conditions are likely to be much Tess than this worst -case predicted value. FCC COMPLIANCE The Federal Communications Commission (FCC) has determined through calculations and technical analysis that cellular and broadband PCS facilities, such as those operated by VZW, are highly unlikely to cause human RF exposures in excess of FCC guideline limits. Operators of these facilities are thus "categorically excluded" (i.e., exempt) from the requirement for routine environmental processing for determining compliance with the FCC's RF exposure rules. In particular, building- mounted cellular facilities are considered categorically exempt if the maximum transmitted power in any direction is less than 1000 watts ERP, and building- mounted PCS facilities are considered categorically exempt if the maximum transmitted power in any direction is Tess than 2000 watts ERP. According to VZW engineers, the facility atop the building will meet both of these conditions. Thus according to FCC rules, the VZW facility is exempt from further RF safety environmental assessment because it is presumed to be in compliance with the FCC's RF exposure rules. FUTURE COMPLIANCE If future changes at the SEA -MALL RATS site causes excessive exposure conditions in publicly accessible areas, the FCC would not hold VZW responsible for the excessive exposure conditions as long as the contribution from the VZW facility to the RF exposure environment in below 5 %. VEC 'AUG RECE: 1 9 ?008 DEVELOPMENT RF facilities that produce Tess than 5% of the applicable MPE exposure limit at accessible locations are also considered to be exempt from further study. As demonstrated in this report by worst -case exposure calculations, the modified VZW facility will produce far less than 5% of the applicable exposure limit for the public environments. In fact the contribution from the modified VZW facility is predicted to be less than 0.303% of the Public MPE limit. Therefore, pursuant to §1.1310(b)(3) of the Commission's rules no further calculations measurements or other RF studies are required, and the modified VZW facility is presumed to be in compliance with the FCC's RF exposure rules. According to OET Bulletin 65: "...the rules adopted by the FCC specify that, in general, at multiple transmitter sites actions necessary to bring the area into compliance with the guidelines are the shared responsibility of all licensees whose transmitters produce field strengths or power density levels at the area in question in excess of 5% of the exposure limit (in terms of power density or the square of the electric or magnetic field strength) applicable to their particular transmitter." (See §1.1306, Actions which are categorically excluded from environmental processing AND §1.1307, Actions that may have a significant environmental effect for which Environmental Assessments (EAs) must be prepared.) Thus VZW will not be responsible for any future compliance problems at the SEA - MALL RATS site as long as the contribution form the VZW facility to the RF exposure environment remains below 5% COMPLIANCE WITH LOCAL REGULATIONS Because the modified VZW facility is in compliance with federal rules, it is also in compliance with local regulations concerning RF exposure. The following is the complete text of 47 U.S.C. § 332(c)(7)(B)(iv): TAU& 1 9 2008 u vEL-OP ENT "No State or local government or instrumentality thereof may regulate the placement, construction, or modification of the personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commission's regulations concerning such emissions." CONCLUSIONS BASED ON CALCULATIONS, AND FEDERAL REGULATIONS Based on my calculations and information supplied to me by VZW representatives, the modified VZW facility, designated as "SEA -Mall Rats ", will comply with current FCC and local rules regarding public exposure to radiofrequency electromagnetic fields. This conclusion is based solely on the comparison of estimated RF exposure conditions in specific areas with the corresponding safe exposure limits set forth in the FCC rules. The FCC exposure limits are based on recommendations by federal and private entities with the appropriate expertise in human safety issues. To ensure full compliance with current FCC rules regarding human exposure to radiofrequency electromagnetic fields, the VZW transmitter should be turned off whenever maintenance and repair personnel are required to work in the immediate vicinity of the VZW antenna. This safety procedure should apply to all future wireless transmission facilities at this site. Any transmit antenna should be de- energized whenever maintenance and repair personnel are required to work in the immediate vicinity of that antenna aperture. E Iris. Camp, PE Design Leaders Since 1978 SEA MALL RATS — VERIZON WIRELESS RECEIV 0 'AUG 1 91008 DevE opNi" WIRELESS TELECOMMUNICATION FACILITY APPLICATION PROJECT DESCRIPTION LETTER PROJECT DECRIPTION: Verizon Wireless, hereinafter referred to as "VZW" or "Applicant ", proposes to modify its existing antenna array at 16400 Southcenter Parkway. The existing array is located on the rooftop of the existing commercial building and consists of two sectors, 4 antennas per sector, mounted on steel pipes that are attached to a structural frame that supports the existing VZW equipment shelter. VZW proposes to swap out the antennas for different models, and relocate one of the sectors to a slightly different azimuth. This will constitute a structural revision /addition to the steel beams that support the pipe mounts. The current antenna tip- height is 77 -feet and the new antennas will maintain the same tip height. . COMPLIANCE WITH THE CITY'S CODE REQUIREMENTS: The following are general requirements for all Wireless Communication Facilities. 1. Noise — Any facility that requires a generator or other device which will create noise must demonstrate compliance with TMC Chapter 8.22, "Noise ". A noise report, prepared by an acoustical engineer, shall be submitted with any application to construct and operate a wireless communication facility that will have a generator or similar device. The City may require that the report be reviewed by a third party expert at the expense of the applicant. N/A — The facility does not have a generator 2. Business license requirement — Any person, corporation or entity that operates a wireless communication facility within the City shall have a valid business license issued annually by the City. Any person, corporation or other business entity which owns a tower also is required to obtain a business license on an annual basis. VZW has a business license with the City 3. Signage — Only safety signs or those mandated by other government entities may be located on wireless communication facilities. No other types of signs are permitted on wireless communication facilities. VZW understands 4. Parking — Any application must demonstrate that there is sufficient space for temporary parking for regular maintenance of the proposed facility. Parking is not affected by this modification 5. Finish — A tower shall either maintain a galvanized steel finish or, subject to any applicable standards of the FAA or FCC, be painted a neutral color so as to reduce its visual obtrusiveness. Design — The design of all buildings and ancillary structures shall use materials, colors, textures, screening and landscaping that will blend the tower facilities with the natural setting and built environment. The color of the antennas (white) will remain the same 7. Color — All antennas and ancillary facilities located on buildings or structures other than towers shall be of a neutral color that is identical to or closely compatible with the color of the supporting structure so as to make the antenna and ancillary facilities as visually unobtrusive as possible. The color of the antennas (white) will remain the same — only the models will change 8. Lighting — Towers shall not be artificially lighted unless required by the FAA, FCC or other applicable authority. If lighting is required, the reviewing authority shall review the lighting alternatives and approve the design that would cause the least disturbance to the surrounding areas. No strobe lighting of any type is permitted on any tower. N/A 9. Advertising — No advertising is permitted at wireless communication facility sites or on any ancillary structure or facilities equipment compound. VZW understands 10. Equipment Enclosure — Each applicant shall be limited to an equipment enclosure of 360 square feet at each site. However, this restriction shall not apply to enclosures located within an existing commercial, industrial, residential or institutional building. N/A 18.58.110 Non - concealed Building Mounted Development Requirements. 1. Height — The proposed facility must meet the height requirements of the applicable zoning category. If the building where the facility is located is at or above the maximum height requirements, the antennas are permitted to extend a maximum of 3 feet above the existing roof line. Non - concealed building mounted facilities shall not qualify as "Rooftop Appurtenances" under TMC 18.50.080. The zoning category is TUC where the maximum height allowance is 115 -feet. The replacement VZW antennas will maintain the current tip- height of 77 -feet. 2. Antenna aesthetics — The first preference for any proposed facility is to utilize flush- mounted antennas. Nonflush- mounted antennas may be used when their visual impact will be negated by the scale of the antennas to the building. "Shrouds" are not required unless they provide a better visual appearance than exposed antennas. Antennas shall be painted to match the color scheme of the building(s). Feed lines and coaxial cables — Feed lines and cables should be located below the parap VFMppiw��t of the rooftop. If the feed lines and cables must be visible, they must be painted to match the color scheme of the building(s). VZW will not need to change out the feed lines. They will remain unchanged. 4. Cabinet equipment— If cabinet equipment cannot be located within the building where the wireless communication facilities will be located, then it must be located on the rooftop of the building. If the equipment can be screened by placing the equipment below the parapet walls, no additional screening is required. If screening is required, then the proposed screening must be consistent with the existing building in terms of color, style, architectural style and material. If the cabinet equipment is to be located on the ground, the equipment must be fenced with a 6- foot -tall fence and materials shall be used to screen the equipment from view. Barbed wire may be used in the TVS, LI, HI, MIC /L, and MIC /H zones. The equipment building is located on the rooftop and painted white to match the main color of the building.
