I. The applicant removed 7 trees, placed approximately 180 cubic yards of gravel in the shoreline zone, and started to construct an 8' tall chain link fence. Within the river environment the applicant is proposing to remove the gravel, plant 12 native Western Red Cedar and reseed with an erosion control mix. No use is proposed for the remaining gravel area; the 8' fence has been eliminated from the proposal and a 6' fence will be allowed at the property line so long as it is setback 40' from the river. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Community Development Director has determined that the application for a Shoreline Substantial Development Permit does comply with applicable City and state code requirements and has approved that application, subject to the condition set forth below based on the findings and conclusions contained in the staff report. The applicant shall apply for a Public Works (PW) type `C' permit for approval. Plans shall be signed and stamped by a Washington State Licensed Engineer. The Public Works permit is for the proposed storm drainage system, erosion control, and approximately 180 cubic yards of land altering. 2. The landscape plan does not show the area in which gravel is to be removed and seeded. Follow the erosion control/drainage plan sheet to determine the gravel removal and reseeding areas. 3. If the applicant chooses to put up a fence 6' or lower, it is allowed under this permit so long as it is placed outside of the 40' river environment. Per TMC 18.104.150.C, the grant of this permit does not provide vesting for any subsequently required permits or approvals, nor does it affect the requirements for vesting of subsequent permits or approvals, including any permits required for any use or development on this parcel. The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. III. YOUR APPEAL RIGHTS One administrative appeal to the Shorelines Hearings Board of the Decision is permitted. Any person appealing to the Shorelines Hearings Board may raise certain SEPA issues as part of the appeal to the Shorelines Hearings Board. Appellants should consult the rules and procedures of the Shorelines Hearings Board for details. IV. PROCEDURES AND TIME FOR APPEALING The requirements and procedures for appeals to the Shorelines Hearings Board are set forth in RCW 90.58 and WAC 461.08. V. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the Shoreline Substantial Development. The only use is in the northwest corner which has approximately 300 square feet paved for parking. The paved area is preexisting and in the high- impact environment where this use is permitted. There is no change to the paved area. The river directly touches this parcel in the southeast corner. A vacant parcel, not owned by the applicant, lies between much of the river to the east and the applicant's property. The parcel to the west fronts Interurban Avenue and is developed with a warehouse owned by the applicant. The north side of the parcel is lined by the eastern terminus of S. 144`h Street. The property to the south is also vacant and owned by the applicant. Shoreline Regulations The site is within the jurisdiction of the Tukwila Shoreline Management Program (SMP). This program was adopted in June, 1974 and amended March 16, 1982. The City's SMP was reviewed and approved by the State Department of Ecology as being consistent with the State Shoreline Management Act, adopted in 1971. The Shoreline Master Program establishes three management environments for the 200' adjacent to the Green/Duwamish River: the river environment from river's edge landward for 40', the low- impact environment from 40' -100' landward of the river, and the high- impact environment from 100' to 200' landward from the river. Per TMC 18.104.150.C, the grant of this permit does not provide vesting for any subsequently required permits or approvals, nor does it affect the requirements for vesting of subsequent permits or approvals, including any permits required for any use or development on this parcel. The applicable policies of the City's Shoreline Management Program are set forth below along with a discussion of the proposed project. City of Tukwila Shoreline Master Plan Overall Goals: 1. Promote reasonable and appropriate use of the shorelines, which will promote and enhance public interest. 2. Protect against adverse effects against the public health, the land, its vegetation and wildlife and the waters and their aquatic life within Tukwila. 3. Protect public rights of navigation. 4. Recognize and protect private property rights consistent with public interest. 5. Maintain a high quality of environment along the shorelines of Tukwila. 6. Preserve and protect fragile natural resources and culturally significant features. 7. Provide safe and reasonable access for the public to the shorelines. 8. Recognize, protect, and improve aquatic habitats and spawning grounds of the Green River, which are invaluable natural resources. 9. Recognize, protect and improve those wildlife habitats, which are valuable natural resources of the State. 10. Encourage recreational activities unique to or dependent upon the use of the river which benefit the public interest. Response: The vacant site was covered with weeds and seven 6 -10" caliper tree located in the low- impact environment. The applicant is proposing to replace the removed trees with twelve native evergreens and an erosion - controlling seed mix within the 40' river environment. The gravel area will not be used; the applicant believes it will be easier to maintain with gravel over the former weeds. A fence no taller than 6' may be installed along the west and east property lines provided that it is no closer than 40' from the shoreline (the river environment). Economic Development Element Goals: 1. Encourage economic development along shorelines that will enhance the quality of life for the residents of Tukwila with minimum disruption of the environment. 2. Encourage economic development along shorelines that will result in long -term over short-term benefits for the river shoreline. Recognize the quality of the existing economic activities along the river and discourage any future economic activities that may be of less quality. 4. Encourage inland location of development so that access along the shorelines is enhanced. 5. Encourage commercial development of public recreational facilities consistent with shoreline goals and policies. Response: This vacant lot will remain vacant. No vesting of development or use to the current shoreline master program will result from this permit. Any use or development proposed in the future will be subject to the shoreline master program in effect at the time a complete application is received. Public Access Element Goals: 1. Encourage safe, convenient and diversified access for the public to the shorelines of Tukwila. 2. Assure that the intrusions created by public access will not endanger life, property or have adverse effects on fragile natural features. 3. Increase public access to publicly owned shorelines. 4. Encourage public access to privately owned shorelines, consistent with private property rights. 5. Encourage inland location of development so that access along shorelines is enhanced. Response: No public access is provided nor proposed. The 40' river environment will be enhanced with planting of 12 trees along the shoreline. When mature, these trees should visually screen the existing development from the river. Circulation Element Goals: 1. Encourage a safe, convenient and diversified circulation system to assure efficient movement of persons during their daily and other activities with minimum disruption to the shoreline environment and minimum conflict between the different users. 2. Encourage a balanced system for transporting people and moving goods in existing corridors. Response: There is no change to existing circulations patterns and no additional impacts as a result of this proposal. Recreational Element Goals: 1. Encourage recreational activities and related facilities unique to or dependent upon the use of the river, which benefit the public interest. 2. Encourage diverse, convenient and adequate recreational opportunities along the shorelines for the local residents and a reasonable number of transient users. Response: The Green River Trail runs along the east side of the Green/Duwamish River opposite the project site. The trail is used by pedestrians, bike riders, and runners. Adding native trees to the river environment should visually enhance the appearance of the project site from the trail. Shoreline Use Element Goals: 1. Encourage appropriate development in suitable locations without diminishing the quality of the environment along the shorelines of the river. 2. Shoreline activities should be consistent with the overall goals for development along the river. Response: Removing the unapproved gravel and planting native trees and a seed mix in the 40' river environment will improve the quality of the environment along the shoreline. The continued vacant use of the site will not adversely impact the shoreline and is consistent with the uses specified in the shoreline management environment designations. Conservation Element Goals: 1. Encourage preservation of unique, fragile and scenic elements, and of non - renewable natural resources; assure continued utilization of the renewable resources. Encourage the preservation of resources and ecology of the river and its shoreline. 4. Water quality in the river should be sufficiently high to permit human use and provide a suitable use and habitat for desirable forms of aquatic life. Response: The natural character of the 40' river environment will be enhanced with the addition of plantings native to the Puget Sound region. To ensure that the project meets state and federal water quality regulations, the project will comply with the 1998 King County Stormwater Design Manual. Historic /Cultural Element Goals: 1. Protect or restore areas having historic, cultural, educational or scientific values. 2. The long -term effects upon the river must be considered over short -term benefits, economic or otherwise. Response: Long -term benefits will be provided to the shoreline through the addition of native trees adjacent to the river in the 40' river environment. Following are the relevant review criteria as contained in the Tukwila Shoreline Regulations (Tukwila Municipal Code, Chapter 18.44) as applied by the City of Tukwila. TMC 18.44.110 General Shoreline Regulations All uses within the shoreline overlay district must conform to the following general regulations: 1. The use is in conformance with the regulations of the underlying zone district. Response: The zoning on this parcel is Commercial /Light Industrial (C /LI). There is no proposed change of use of the site for this vacant site. 2. The use does not conflict with the goals and policies of the shoreline master program or the provisions of the Shoreline Act and shoreline regulations. Response: Above is a discussion of the goals of the City's adopted Shoreline Management Program. The proposed project will be consistent with the City's adopted Shoreline Management Program. 3. No structures or accessory facilities shall be located over the river unless such structure protects or promotes the public interest. Response: No structures or accessory facilities will be located over the river. 4. There shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as part of an approved shoreline substantial development permit; Response: The gravel dumped without a permit will be removed from the river environment and a seed mix will be planted in that area. The 7 trees removed from the site will be replaced with 12 trees planted in the river environment. 5. No effluent shall be discharged into the Green River which exceeds the water quality classification as established by the State for the adjacent portion of the river. Response: The core requirements of the 1998 King County Surface Water Design Manual will be met as described in the Technical Information Report. Response: The project will comply with all State and federal water quality regulations. 5. Wildlife habitat in and along the river should be protected. Response: Wildlife habitat in and along the river will not be altered by the construction of this project. The addition of native trees included in this project proposal will enhance the quality of wildlife habitat within the 40 'river environment. 6. All perimeters of landfills or other land forms susceptible to erosion shall be provided with vegetation, retaining walls or other satisfactory mechanisms for erosion prevention. Response: According to the Erosion Control /Drainage Plan submitted with application„ a silt fence will be placed for 220' on the waterward edge of the area where gravel will be removed The area where gravel is to be removed will be reseeded with an erosion - control seed mix. 7. All necessary permits shall be obtained from federal, State, County or municipal agencies. Response: A Public Works permit is required prior to releasing the code enforcement violation against this property for the work performed without a permit. 8. Dredging for purposes other than for navigational improvements or flood control is prohibited. Response: No dredging is involved with this project. 9. Mining is prohibited along the river shoreline. Response: No mining is involved with this project. 10. Solid waste disposal is prohibited along the river shoreline. Response: No solid waste disposal will occur along the shoreline. 11. No property will be acquired for public use without dedication by or just compensation to the owner. Response: No property is being acquired for public use. 12. Landfilling is prohibited within the river channel unless such landfill is determined by the Planning Commission to protect or promote the public interest. Response: This project does not propose any landfilling within the river channel. 13. Notwithstanding any provisions of this Code to the contrary, removal of any cottonwood tree within the river environment or the low impact environment, which tree is 12 inches or greater in diameter as measured 4.5 feet above grade, shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations. Response: No cottonwood trees are proposed for removal or have been removed from this site. SM Page 5 of 8 08/25/2009 H:U.08 -050 A &B Shoreline\shoreline SR.doc • • TMC 18.44.130 Specific Shoreline Regulations — River Environment The river environment is a 40 -foot wide management zone, measured on a horizontal plane from the mean high water mark. This zone offers the highest level of environmental protection of all the management zones within the Shoreline Overlay District. Uses within this zone are limited to public access and recreation, pollution control, dikes for bank stabilization, signage, bridges, and access for fire and maintenance. Response: The gravel that was previously placed in the river environment will be removed and the area will be reseeded The 7 trees removed from the site will be replaced with 12 Western Red Cedars o be planted in the river environment. TMC 18.44.140 Specific Use Regulations - Low- Impact Environment The low impact environment is a 60 -foot wide management zone, located between the river environment and 100 feet from the mean high water mark. This zone allows the same uses as within the river environment, as well additional uses including structures no taller than 35 feet, parking/loading and storage facilities that are adequately screened or landscaped, public and private roads, utilities, and signs. Response: No uses are proposed within the low- impact environment. Gravel has been placed on top of a previously weed - covered, vacant lot. The lot will continue to remain vacant. A fence 6' or lower may be placed within the low - impact environment under this permit. 18.44.150 Specific Use Regulations — High Impact Environment The High Impact Environment is located between 100 feet and 200 feet from the mean high water mark. Within the High Impact Environment, allowed uses are the same as all of those uses allowed within the underlying zoning district. Response: No change of use is proposed within the high- impact environment. Gravel has been placed on top of a previously weed - covered, vacant lot. Parking and storage are not permitted in this area beyond parking on the previously paved area in the northwest corner of the parcel. A fence 6' or lower may be placed within the high - impact environment under this permit. Public Comments Comments were received from Karen Walter of the Muckleshoot Tribe (attached). She asked that all the gravel be removed and the entire area be revegetated with native species. A copy of the e-mail from Karen Walter is attached. SEPA and other City approvals The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Recommendation Approval of the shoreline substantial development permit with the following conditions: 1. The applicant shall apply for a Public Works (PW) type `C' permit for approval. Plans shall be signed and stamped by a Washington State Licensed Engineer. The Public Works permit is for the proposed storm drainage system, erosion control, and approximately 180 cubic yards of land altering. 2. The landscape plan does not show the area in which gravel is to be removed and seeded. Follow the erosion control/drainage plan sheet to determine the gravel removal and reseeding areas. The landscape plan is red -lined to reflect City codes; follow the red -lined plan set. 3. If the applicant chooses to put up a fence 6' or lower, it is allowed under this permit so long as it is placed outside of the 40' river environment. According to the Notice, the applicant is proposing to replace 7 illegally removed trees with 12 new trees and remove the illegally placed 8' fence. There is no proposal from the applicant to remove the over 5000 square feet of gravel placed within the shoreline zone of the Green River. We recommend that the all of the gravel placed without a permit be removed and that the entire shown as the area of fill on Sheet 1 be revegetated with native trees and shrubs to partially restore riparian functions within this area necessary to create and maintain salmonid habitat. We appreciate the opportunity to comment on this proposal and look forward to the City's responses to our comments. This waiting period allows anyone who (including you) disagrees with any aspect of this permit, to appeal the decision to the state Shorelines Hearings Board. When your message came in, I was drafting a motion for Tukwila in a litigation matter, and somehow missed your lead line in the forward, asking me to respond. I saw the body of the e-mail, which started with the note that Shelley could forward your request to me if she preferred. Shelley forwarded me your message of today, which took me a little bit by surprise, since I hadn't recalled your request for an answer. Here are my thoughts on your substantive question: It seems that the concern is that granting a shoreline SDP for placement of gravel could be deemed to vest the applicant to some other use permitted under the current SMP, but which will not be permitted under the SMP amendments currently under consideration. The case law (Talbot v. Gray, from the early 1970s) holds that shoreline substantial development permit applications do vest, but the application at issue there was a dock permit. The Court held that the dock permit vested to the dock regulations in effect at the time of the application. Those regulations did not include a requirement for notice, as did a later enacted ordinance, that would have alerted neighboring property owners in time to appeal. The Court held that because the application had vested, the subsequently- enacted notice requirement did not apply to consideration of the dock permit. Here, the question seems to be not whether the SDP for the gravel will vest to regulations pertaining to grade and fill or gravel placement, but whether approval of that permit will vest the applicant to some other use of the loit. The only caselaw I am aware of that provides for vesting in this fashion is Noble Manor v. Pierce County, which held that a short plat application vested the application not only to the regulations then in effect pertaining to processing a short plat, but also the regulations pertaining to future development on those lots. The Noble Manor decision turned on some particular vesting language in RCW Chapter 58.17, the Subdivision Act, and is not in my view generally applicable to other types of development permits. In addition, Tukwila Municipal Code Section 18.104.150.0 provides that "Vesting of an application does not vest any subsequently require permits, nor does it affect the requirements for vesting of subsequent permits or approvals." This would seem to speak directly to Minnie's concern. In light of the above, and the Tukwila code provision, I would suggest a slight modification of the proposed condition, to read as follows: "Per TMC 18.104.150.C, the grant of this permit does not provide vesting for any subsequently required permits or approvals, nor does it affect the requirements for vesting of subsequent permits or approvals, (09/01/2009) Stacy MacGregor - Re: Fwd: including any permits required for any use or development on this parcel." PROJECT OVERVIEW Existing Conditions: This project is located directly east of 6437 S. 144TH Street in Tukwila, Washington. The property is located south of S. 144th Street and west of the Green River. The property is approximately 34,617 sf or 0.79 acres measured west of the top of the river bank. The site is a vacant lot. The lot previously consisted of tall grass with a little bit of asphalt at its northwest corner. Recently a thin layer of gravel was spread across the property where the grass once existed. The existing drainage infiltrates into the on site soils. Proposed Conditions: There are no proposed uses for the site. The property will remain as is with the exception of some gravel being removed from the 40' stream buffer. The new gravel surface and the underlying soils will act as an infiltration facility. The soils on site have fairly fast measured infiltration rates of 1.5 min /in to 1.76 min /inch. Please see Appendix for the soil logs /infiltration tests. An overflow system will be constructed to convey runoff away from the site if the soils become saturated and don't infiltrate. A. new catch basin will be provided along the edge of asphalt along the west property line to collect the overflow and will be connected to an existing catch basin near our southwest property corner. The existing system eventually flows to a storm system in S. 144th Street. II. CONDITIONS AND REQUIREMENTS SUMMARY The core requirements of the 1998 King County Surface Water Design Manual (KCSWDM) for a Full Drainage Review Project have been or will be provided as follows: Core Requirement #1, Discharge at the Natural Location: The site's drainage pattern currently infiltrates into the onsite soils. The proposed runoff will also continue to infiltrate into the onsite soils. Core Requirement #2, Offsite Analysis: An offsite analysis is not provided for this project because the runoff does not leave the site. Per Section 1.2.2, projects are exempt if the project does not change the rate, volume, duration, or location of discharges to and from the site. Since the runoff currently infiltrates onsite and the proposed runoff will infiltrate onsite, an offsite analysis seems to be unwarranted. Core Requirement #3, Flow Control: Infiltration will be provided for the onsite runoff. The existing gravel and the underlying soils will act as an infiltration facility to direct runoff into the ground. Please see Appendix A for infiltration test results. Core Requirement #4, Conveyance System: A conveyance system has been designed to direct runoff to an existing storm system west of the project in the unlikely event that the infiltration system fails. The new system will consist of two catch basins and pipe connected to the existing system. Conveyance system calculations will be provided at a later date if requested. Core Requirement #5, Erosion and Sediment Control: An erosion and sediment control plan has been designed. Some of the ESC measures to be provided are silt fence and seeding. Core Requirement #6, Maintenance and Operations: A maintenance and operations manual will be provided at a later date if necessary. Core Requirement #7, Financial Guarantees and Liability: The owner will provide this information at a later date if necessary. Core Requirement #8, Water Quality: No water quality facilities are proposed for this project. In reviewing for completeness, the City has found a number of possible development options for you to consider with your application and wants to make you aware of them as you work towards submitting a complete application. It appears that more than 5,000 SF of new impervious surfaces were added making Storm Water improvements necessary. The City of Tukwila uses the 1998 King County Surface Water Design Manual (KCSWDM). A Technical Information Report (TIR) needs to be provided as outlined in the 1998 KCSWDM that discusses this project's impacts on surrounding drainage systems. If detention and water quality facilities are required, these improvements need to be constructed or the area restored to the pre - development condition. Restoration to the pre - development condition will require removing the gravel and hydroseeding or landscaping across the entire unpaved portion of the parcel. If you choose to leave the area as gravel, you will be required to provide a TIR and install required detention and water quality facilities; you cannot use the area for parking or storage; no use is approved and no vesting to the current shoreline code is provided with the shoreline permit. If you choose to revise your proposal to include parking or outdoor storage, you will need to meet the requirements of the Tukwila Municipal Code and Shoreline Master Program in effect at the time your application is considered complete. As you know, the City is in the process of adopting a new Shoreline Master Program. The current code allows parking and outdoor storage in the low- impact environment but it is anticipated that the new code will not permit either of these uses in the low- impact environment. A complete application to the City requires you to submit a revised plan that includes removal of the existing gravel and landscaping of the unimproved area or a civil plan that includes stormwater detention and a TIR. If you choose to add parking or storage to the site, please revise your plans to reflect the TMC requirements referenced above.
