WHEREAS, the property described herein is presently classified by Ordinance No. 251, as amended, as R -1, single family residence, and 2. WHEREAS, the owners of said property have petitioned the Planning Commission of the City of Tukwila for a change of zoning classification from R -1 to R -4, low density apartments, and R.M.H., multiple, high density apartments, and 3. WHEREAS, the petitioners have agreed to develop the streets and water system for said property in accordance with the needs of an R -4 and R -M -H land use district, and for the preservation of the health, safety, and welfare of the City of Tukwila and its inhabitants have agreed to the following conditions: (a) To install or continue as a developer's extension an eight inch water main from Three Tree Point Road;. and (b) To widen the street at 65th Avenue South by ten feet for the entire length of the subject property and (c) To make adequate provision for fire hydrants; NOW THEREFORE, the City Council of the City of Tukwila do ordain as follows: The following described property is hereby rezoned from a land use classification of R -1, single family residence to R -4, low density apartments, and R -M -H, multiple, high density apartments, in accordance with Tukwila Ordinance No. 251, as amended, and hereby adopts the attached map showing said classification, and amends the comprehensive plan of the City of Tukwila accordingly, for the following described property: -1- )09 Pr E 5D2 From R -1 to R -4: 1. Vacated Lots 1 through 11, and Lots 28 through 33, Block 1, Together with adjoining vacated streets, AND vacated Lots 1 through 9, and Lots 32 through 35, Block 2, TOGETHER WITH adjoining vacated streets; all in Gundaker's Interurban Addition as recorded in Volume 14 of Plats, Page 46, Records of King County, Washington. From R -1 to R.M,H.: 2. Vacated Lots 12 through 27, Block 1, TOGETHER WITH adjoining vacated streets, AND vacated Lots 10 through 16, and Lots 21 through 31, Block 2, TOGETHER WITH adjoining vacated streets; all in Gundaker's Interurban Addition as recorded in Volume 14 of Plats, Page 46, Records of King County, Washington. This rezoning is expressly conditioned upon the petitioners developing their property in the manner indicated in paragraph .3, and provided further, that the petitioners cause to be executed a performance bond in favor of the City of Tukwila in the amount of $3,500 to guarantee such performance. The City Clerk is directed to file a copy of this ordinance and map with the King County Auditor.
