The SEPA planned action covers all improvements and construction activities associated with Phase I of the project. Phase I of the project includes: The construction of a neighborhood trailhead, some interpretive markers, trails, entrance bridge, stacked rock amphitheater, seatwalls at upper viewpoint, invasive plant removal and native restoration, interim parking and arrival area. Also, about 1000 cubic yards of fill will be brought and stored on the site. Phases II and III will be required to obtain separate SEPA approval at the time of construction. For informational purposes, Phases II and III include the following work: Phase II: More interpretive markers, wetland restoration, vegetative buffer and sculpted landforms, and wetland boardwalk. Phase III: More interpretive makers, realigned South 115th Street, restrooms with green roof and constructed wetland treatment system, bioretention swales, riverfront shoreline and beach restoration with hand boat launch, welcome plaza, entrance path, porous concrete sidewalks, streetside permanent parking. • • Most of the work proposed in Phase I would be considered categorically exempted from SEPA review. However, the applicant is proposing to bring in approximately 1,000 cubic yards of fill and under the City's exemption requirements, only 500 cubic yards of fill can be exempted from SEPA review. This is a Planned Action SEPA which removes the City's notice of application requirements. In order for the project to considered under a SEPA planned action the following criteria apply: 1. Is the proposal a permitted and/or accessory use located within the MIC /L or MIC/H zones? The property is currently zoned Manufacturing Industrial Center /Light (MIC /L). Parks and outdoor recreation activities are a permitted use within the MIC/L zone (TMC 18.36.020 (25)). 2. Will all impacts of the proposal be mitigated by the time the project is complete? The applicant is proposing to install an eight stall parking area within the shoreline zone. However, the work that is being done within the shoreline zone is on the north side of S. 115t Street which separates the Duwamish River from the proposed parking area. The parking area is proposed to be gravel as part of Phase I. In the future, when Phases II and III are completed, the parking will be paved. The parking area is still required to comply with the City's Stormwater requirements and the work within the shoreline zone requires Shoreline Substantial Permit. 3. Is the proposal consistent with the applicable sections of the Tukwila Comprehensive Plan? The proposed project is consistent with several goals and policies of the City's Comprehensive Plan. Goal 11.1.6 "Develop and designate appropriate zoning, buffers, mitigation and access opportunities where manufacturing zoning directly abuts or impacts residential zoning so that MIC uses may operate without significant degradation of the residential environment". As noted, the Park property is zoned MIC /L. While the proposed project is not an industrial use, the proposed Park will assist in buffering existing industrial uses from nearby single family homes. Goal 11.1.7 "Support the Duwamish River becoming a natural feature amenity in the MIC ". Goal 11.1.8 "Improve public access and use of the west side of the rive... improve employee access to the east side of the river, and emphasize restoration on both sides of the river ". As noted this is Phase I of a three phase project. Phase I will not provide direct access to the River, however significant views of the River will be provided as part of Phase I. Phase III calls for a major shoreline restoration project. This restoration project will move S. 115th Street which will allow for significant shoreline restoration work to be completed. Phase III will also provide hand boat launches for canoes and other non - motorized boats within the River. B. The proposed project will bring to fruition the City's goal. 4. The project is not one of the following: a. an essential public facility; b. a development related to the Regional Transit Authority light rail or commuter rail c. a decision about the 16th Avenue Bridge improvements or disposition which would normally require a SEPA threshold determination; or d. a development in which any portion includes shoreline modifications waterward of the ordinary high water mark. The proposed project is not one of the items listed above. Recommendation The Phase I of the project can be designated as a Planned Action and no further SEPA review or threshold determination is required. All impacts associated with Phase I of the project have been mitigated as part of 1998 EIS. B. The project is a collaborative effort between the City of Tukwila, Friends of the Hill, and the Cascade Land Conservancy to promote the natural history of the site. The project site is separated from the River by S. 115th Street. Work within the 200 foot shoreline area includes, construction of a gravel parking lot, grading, installation of landscaping, and associated grading. There will be no work within the ordinary high water mark or directly along the River's bank. Miles Senior Planner The following information was submitted as part of the application: A. Construction Plan dated October 1, 2008 prepared by SvR Design Company B. Shoreline Permit application, received by the Department of Community Development on December 23, 2008. Background: In 2001, the City of Tukwila, Cascade Conservancy and a local citizen group called Friends of the Hill formed a partnership to work for the preservation of an undeveloped parcel of land on the Duwamish River known historically as Poverty Hill. This property, now called Duwamish Riverbend Hill consists of an unusual outcropping of bedrock rising over 140 feet above the Duwamish River and 600 feet of river shoreline. BM page 1 of 7 H: \Developments \Duwamish Riverbend Hill \SMA Permit \Shoreline SR.doc 03/09/2009 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • Phone: 206 - 431 -3670 • Fax: 206 - 431 -3665 The property is culturally significant for its association with Southern Puget Sound Salish oral tradition and mythology, as a key location in the stories collectively known as the "Epic of the Winds ". The proposed property is zoned industrial and the previous owner of the site proposed an industrial development and proposed leveling the rock outcrop with dynamite to create a trucking and freight storage facility. Between 2001 and 2004, project partners raised $988,700 and the 8.6 acre property was purchased in March of 2004 by the Cascade Land Conservancy, who then transferred ownership of the land to the City. I. Project Description The overall development of the site will be done in three separate phases. The applicant is requesting shoreline approval for only Phase I of the proposed development project. Activities within the shoreline area associated with Phase I include: • Construction of a gravel parking lot • Grading • Construction of trailhead and trail system • Installation of landscaping and associated grading There will be no work within the ordinary high water mark or directly along the River's bank. II. Policies of the Shoreline Management Act /Shoreline Master Program This area was annexed into the City of Tukwila in 1989. The City of Tukwila is required to administer annexed areas based on the Shoreline Management Plan which was in place at the time of annexation, until such time as a new Master Plan is adopted and approved by the Washington State Department of Ecology. This area is subject to King County's Shoreline Master Program. III. Existing Development The project site is located along S. 115th Street just north of the Duwamish Neighborhood. The site is zoned Manufacturing Industrial Center/Light (MIC/L) and is currently vacant. The property contains rock outcroppings and a large bluff that overlooks the Duwamish River. Sound Transit used portions of the property for staging during the construction of the light rail line. Adjacent uses include commercial and light industrial uses to the north and west; single family residential uses are located to the east. S. 115th Street is located directly south of the property. The property is subject to compliance with the City's shoreline regulations due to the fact that development will be within 200 feet of a river of statewide significance (Duwamish River). However, most of the property lies north of S. 115`h Street and the street separates the construction area from the River. Shoreline Regulations King County Shoreline Management Program Applicable regulations of King County Shoreline Master Program: King County Code Chapter 25.16.030 General Requirements A. Non -water related development and residential development shall not be permitted waterward of the ordinary high water mark. The project does not propose any construction activities waterward of the ordinary high water mark. B. Except in those cases when the height requirements of the underlying zones are more restrictive, no structure shall exceed a height of thirty -five feet above average grade level. This requirement may be modified if the view of a substantial number of residences will not be obstructed, if permitted by the applicable provisions of the underlying zoning, and if the proposed development is agricultural, water related or water dependent. The only structures proposed as part of the project are small interpretive markers. The height of these structures are not known, however they will not be taller than 35 feet and most likely will not require a building permit. C. All development shall be required to provide adequate surface water retention and sedimentation facilities during the construction period. The applicant has proposed to not install permanent parking with the proposed project. As noted, the construction of the Duwmaish Riverbend Park will be done in three phases. Upon final completion of all three phases, the City hopes to relocate S. 115th Street further north. Relocating S.115th Street will allow the City to complete a salmon enhancement project along the river, however relocating the street will also require the parking area that is proposed with this phase to be removed. The applicant would like to use gravel for the parking area that is part of this phase of the project. Gravel is not an appropriate material for long term parking. However, it does seem prudent to allow gravel to be used on a temporary basis until phase III is constructed. Due to funding limitations there is no guarantee that phase III will be constructed in the future and long term use of gravel for parking would become problematic. The applicant will be required to construct a 20 foot asphalt apron at the entrance from S.115th Street. This apron will prevent gravel from getting onto S. 115th Street and subsequently within the City's stormwater system. A stormwater detention facility is not proposed within this phase of the project. Instead, the applicant will grade the area around the parking area to ensure that water runs towards the surrounding vegetated areas. Development shall maintain the first fifty feet of property abutting a natural environment as required open space. This criterion is not applicable, as the King County shoreline environment designation adjacent to this site as "Urban Environment ". E. Parking facilities except parking facilities associated with detached single-family and agricultural development shall conform to the following minimum conditions: E (1) Parking areas must be located beneath or upland of the development... E (2) Any outdoor parking area perimeter... must be maintained as a planting area with a minimum of five feet. E (3) One live tree... shall be required for each thirty linear feet of planting area. E (4) One live shrub...for each 60 inches of planting area shall be required. E (5) Additional perimeter and interior landscaping of parking areas may be required when large parking areas are proposed. The entire project, both the area within the shoreline zone and the area outside of the shoreline zone, consist of extensive native vegetation plantings. The grass species includes a variety of native species. F. Collection facilities to control and separate contaminants shall be required where storm -water runofffrom impervious surfaces would degrade or add to the pollution of receipt waters or adjacent properties. As noted, the proposed park is separated from the Duwamish River by S. 115`h Street. Only a small amount of impervious (gravel) will be installed within the shoreline zone. The grade around the parking area will be modified to allow water to discharge toward the native vegetation areas on the site. Stormwater will not be permitted to flow towards S. 115th Street or the River. G. The regulations of this chapter have been categorized in a number of sections; regardless of the categorization of the various regulations, all developments must comply with all applicable regulations. The proposed project is to restore a piece of industrial zoned land back to native conditions. A significant amount of native plantings will be planted, interpretive markers will be installed, and pedestrian trails will be constructed. The project will provide open space and passive recreation opportunities near the River. However, direct access to the River is prevented by the location of S. 115th Street. As noted, the City hopes to relocate S. 115th BM page 4 of 7 03/09/2009 H: \Developments\Duwamish Riverbend Hill \SMA Permit \Shoreline SR.doc Street and provide a park area directly along the River in a later phase. This later phase will need to be reviewed for compliance with Local, State and Federal regulations. H. Development proposed on shorelines of the State shall maintain setbacks, provide easements or otherwise develop the site to permit a trail to be constructed or public access to continue where; 1. There is a proposed trail in the King County Trail system; or 2. Part of the site is presently being used and has historically been used for public access. The proposed project will provide a significant amount of trails near the River. These trails will not be directly connected to the City or County's trail system. However, access to other trails within the area can be accomplished via S. 115th Street and other public streets in the area. The proposed project also includes a neighborhood trailhead. This trailhead is not located within the shoreline zone. It is the City's ultimate goal to eventually have additional trails located directly along the River. King County Code Chapter 25.16.100 Recreation Development Recreational development may be permitted in the urban environment subject to the general requirements (Section 25.16.030) of this chapter, and provided: A. The recreational development is permitted in the underlying zone; As noted, the subject property is zoned MIC /L. TMC 18.36.020 (25) permits public parks as an outright permitted use within the MIC /L zone. B. Swimming areas shall be separated from boat launch areas and marinas. The applicant is not proposing to install a swimming area. C. The development of underwater sites for sport diving shall not: 1. Take place at depths of greater than eight feet; 2. Constitute a navigational hazard; 3. Be located in areas where the normal waterborne traffic would constitute a hazard to those people who may use such a site. The applicant is not proposing to operate an underwater recreation site. D. The construction of swimming facilities, piers, moorages, floats and launching facilities below the ordinary high water mark shall be governed by the regulations relating to pier and moorage construction in the commercial development section (Section 25.16.070) of this chapter. This phase does not include the construction of any of items mentioned above. However, future phases may include the construction of a launch for non - motorized boats. E. Public boat launching facilities or marinas be developed, provided: 1. The traffic generated by such a facility can be safely and conveniently handled by the streets serving the proposed facility. 2. The facility will not be located on a Class I beach This phase does not include the construction of any of items mentioned above. However, future phases may include the construction of a launch for non - motorized boats. All future phases will need to be reviewed for compliance with Local, State, and Federal regulations at the time the phase is proposed. F. Upland facilities constructed in conjunction with a recreational development shall be setback and/or sited to avoid contamination of the shorelines of the state. No facilities are proposed with this phase of the project. G. All service facilities within and associated with marinas shall be provisions to prevent and control contaminants from entering the water. Provisions shall be available for clean -up of accidental spills of contaminants. No service facilities are proposed with this project. H. Marina facilities shall be prohibited on Class 1 beaches or where their development would interrupt littoral currents and starve Class I beaches. The proposed project does include the construction of a marina. 1. Public pedestrian and bicycle pathways shall be permitted adjacent to water bodies. The proposed project will include the construction of pedestrian paths. However, most of these pathways will be located outside of the shoreline zone. No paths will be located directly along the River. As noted, future phases will include the construction of paths along the River. 1 Public contact with unique and fragile areas shall be permitted where it is possible without destroying the natural character of the area. The proposed project's goal is to restore vacant industrial land to a natural setting. A significant amount of vegetation will be planted, rock outcroppings will be preserved, and a wetland' will be restored. Interpretive markers will be installed to help educate the public regarding the importance of the site with regards to its natural and cultural history. K. Water viewing, nature study, recording and viewing shall be accommodated by space, platforms, benches or shelter, consistent with public [sic]. 1 The wetland is located outside of the shoreline zone. Public Comments No public comments were received during the Notice of Application period. VI. SEPA and other City approvals The City SEPA Responsible Official has previously determined that the project, as proposed, does not require a threshold determination under SEPA because it qualifies as a planned action pursuant to WAC 197 -11 -172, that the probable significant adverse environmental impacts of the project were adequately analyzed in the EIS previously prepared for the planned action and will implement the conditions and mitigation measures imposed by the planned action approval. In November of 2008, the Planning Commission reviewed and determined the applicable number of parking stalls required for the proposed park. The land altering activities will require a Public Works permit. This permit has already been issued and work has been permitted to proceed outside of the shoreline zone. VII. The SEPA planned action covers all improvements and construction activities associated with Phase I of the project. Phase I of the project,includes: The construction of a neighborhood trailhead, some interpretive markers, trails, entrance bridge, stacked rock amphitheater, seatwalls at upper viewpoint, invasive plant removal and native restoration, interim parking and arrival area. Also, about 1000 cubic yards of fill will be brought and stored on the site. Phases II and III will be required to obtain separate SEPA approval at the time of construction. For informational purposes, Phases II and III include the following work: Phase II: More interpretive markers, wetland restoration, vegetative buffer and sculpted landforms, and wetland boardwalk. Phase III: More interpretive makers, realigned South 115`h Street, restrooms with green roof and constructed wetland treatment system, bioretention swales, riverfront shoreline and beach restoration with hand boat launch, welcome plaza, entrance path, porous concrete sidewalks, streetside permanent parking. Most of the work proposed in Phase I would be considered categorically exempted from SEPA review. However, the applicant is proposing to bring in approximately 1,000 cubic yards of fill and under the City's exemption requirements, only 500 cubic yards of fill can be exempted from SEPA review. This is a Planned Action SEPA which removes the City's notice of application requirements. In order for the project to considered under a SEPA planned action the following criteria apply: 1. Is the proposal a permitted and /or accessory use located within the MIC/L or MIC/H zones? The property is currently zoned Manufacturing Industrial Center/Light ( MIC/L). Parks and outdoor recreation activities are a permitted use within the MIC /L zone (TMC 18.36.020 (25)). 2. Will all impacts of the proposal be mitigated by the time the project is complete? The applicant is proposing to install an eight stall parking area within the shoreline zone. However, the work that is being done within the shoreline zone is on the north side of S. 115th Street which separates the Duwarnish River from the proposed parking area. The parking area is proposed to be gravel as part of Phase L In the future, when Phases II and III are completed, the parking will be paved. The parking area is still required to comply with the City's Stormwater requirements and the work within the shoreline zone requires Shoreline Substantial Permit. 3. Is the proposal consistent with the applicable sections of the Tukwila Comprehensive Plan? The proposed project is consistent with several goals acid policies of the City's Comprehensive Plan. Goal 11.1.6 "Develop and designate appropriate zoning, buffers, mitigation and access opportunities where manufacturing zoning directly abuts or impacts residential zoning so that MIC uses may operate without significant degradation of the residential environment ". As noted, the Park property is zoned MIC/L. While the proposed project is not an industrial use, the proposed Park will assist in buffering existing industrial uses from nearby single family homes. Goal 11.1.7 "Support the Duwamish River becoming a natural feature amenity in the MIC ". Goal 11.1.8 "Improve public access and use of the west side of the rive...improve employee access to the east side of the river, and emphasize restor'atiori on both sides'of the river". As noted this is Phase I of a three phase project. Phase I will not provide direct access to the River, however significant views of the River will be provided as part of Phase I. Phase III calls for a major shoreline restoration project. This restoration project will move S. 115th Street which will allow for significant shoreline restoration work to be completed. Phase III will also provide hand boat launches for canoes and other non - motorized boats within the River. B. The project is not one of the following: a. an essential public facility; b. a development related to the Regional Transit Authority light rail or commuter rail c. a decision about the 16`h Avenue Bridge improvements or disposition which would normally require a SEPA threshold determination; or d. a development in which any portion includes shoreline modifications waterward of the ordinary high water mark. The proposed project is not one of the items listed above. Recommendation The Phase I of the project can be designated as a Planned Action and no further SEPA review or threshold determination is required.
