DECISION SEPA Determination: The City SEPA Responsible Official has determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Hearing Examiner has determined that the application for a zoning location modification does comply with applicable City and state code requirements and has approved that application, subject to following conditions: 1. The applicant has only provided a conceptual site plan of the site. As part of subsequent land use approvals, the applicant shall provide the City with a survey map that shows the location of all lots on the property. The survey map shall show the location of the existing zoning boundary line and the location of when it is moved 50 feet to the west. 2. Based upon King County maps, it is assumed that lot 11 is 50 feet wide. By extending the NCC zoning an additional 50 feet to the west it would allow all of lot 11 to have the same zoning; however the City does not have a survey of the property. Should it be determined that lot 11 is greater than 50 feet wide, the location of the new zoning line shall be considered the boundary line for the property and all structures shall meet setbacks from the zoning line. Should it be determined that lot 11 is less than 50 feet wide than the extension of the NCC boundary shall extend only to the actual width of lot 11 and not extend past the property line. 3. The applicant has proposed a specific project, which if completed, shall be consistent with the Comprehensive Plan for the area. This Hearing Examiner's decision is based on a specific development proposal presented by the applicant, which is development of both lots (11 and 13) together for a mixed use building. Therefore this zoning determination is only relevant to the specific proposal presented by the applicant as part of this application. Additionally, the construction of the project will be subject to an extensive land use review including design review by the City. Any impacts to adjacent uses shall be addressed and mitigated during that design review process. This decision shall only be valid for one year. Additional time may be granted provided one of the two milestones listed below are met: A. The applicant has entered into a Development Agreement with the City for the development of the site and the agreement is still valid (i.e. has not expired); or B. The applicant has been granted design review approval to construct a mixed use project on the site and the approval has not expired. III. YOUR APPEAL RIGHTS The Decision on this Application is a Type 3 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. 1 • No administrative appeal of the Decision is permitted. A party who is not satisfied with the Hearing Examiner's decision may file an appeal in King County Superior Court. IV. PROCEDURES AND TIME FOR APPEALING Any party wishing to challenge the Hearing Examiner's Decision must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. Bargain and Sale Deed from 2008 Vicinity /Site Information Project Description The applicant is proposing to extend the NCC zoning an additional 50 feet west from where it terminates on the subject property. Existing Development The property is approximately 15,000 square feet and has an irregular "L" shaped pattern. There is currently a vacant single family home located on the property. The property currently does not have a functional septic system and the City has posted the house as being unfit for human occupancy. The subject property consists of two legal lots of record. The property is legally described as follows: LOTS 11 AND 13, ESSICO ADDITION TO RIVERTON, ACCORDING TO THE PLAT THEROF RECORDED IN VOLUME 13, PAGE(S) 49, RECORDS OF KING COUNTY, WASHINGTON, ALSO THE SOUTERLY ONE HALF OF VACATED RIVERTON PLACE ADJOINING LOTS 11 AND 13. Lot 11 is zoned LDR, while lot 13 is zoned NCC. The surrounding land uses to the west include single family homes; a vacant lot' is located to the south; a parking area for the Tukwila School District is located to the north; and East Marginal Way is directly adjacent to the property on the east side. Proposed Project The applicant has proposed to combine this property with the property that they own to the south to build a mixed -use building. Preliminary plans indicate that the building will be three stories tall, have an area of approximately 16,000 square feet, and will include 25 multi - family units. Two commercial tenants will be located that will face towards East Marginal Way South. The applicant has noted that the project would seek LEED certification. This area along East Marginal Way is slowly moving towards a mixed use environment. In 2008, the City approved the construction of a mixed use project on the east side of East Marginal Way, directly across the street from the applicant's property. A small mixed use building is located at the corner of S. 130th Street and East Marginal Way South. 1 This vacant lot will be part of the overall development project, but is not part of this zoning determination request. The house on the property appears not to meet setbacks and may actually be built over the lot line separating lots 11 and 13. In situations such as this, the City has consistently treated the subject property as being one lot. Applicable Criteria TMC 18.08.040 (7) notes, "Where a district boundary line divides a lot which was in single ownership at the time of passage of this title, the Hearing Examiner may permit, as a special exception, the extension of the regulations for either portion of the lot not to exceed 50 feet beyond the district line into the remaining portion of the lot ". Analysis As noted, the property consists of two lots. Lot 11 is zoned LDR and Lot 13 is zoned NCC. While the property consists of two lots, the City recognizes the property as essentially being one lot given the circumstance in which the property is utilized. The applicant has requested to extend the NCC zoning an additional 50 feet to the west. King County records indicate that lot 11 is 50 feet wide, thus the proposed expansion of the zoning boundary would apply to all of lot 11. The City adopted its growth management required comprehensive plan and zoning map in 1995. Thus, in order to determine if the property can qualify under the criteria listed in TMC 18.08.040 (7) it must be demonstrated that the property was under common ownership in 1995. If the property was not under single ownership, but area added to the property after adoption of the City's Comprehensive Plan in 1995, it would not qualify to have the zoning line adjusted. Attachment D is information from King County regarding the sales history for the subject property. Since 1992, the property has been sold or quit claimed a total of eight times; with the first time being in 1992 and the last time being in 2008. In December of 1993, the subject property transferred from Brett Prodzinski to Harold Prodzinksi. The Quit Claim Deed with legal description is included as Attachment E. The legal description described on Attachment E is as follows: Lots 11, 12, AND 13, ESSICO ADDITIONL TO RIVERTON, ACCORDING TO THE PLAT THEROF RECORDED IN VOLUME 33 OF PLATS, PAGE 49, RECORDS OF KING COUNTY, WASHINGTON; EXCEPT THE SOUTHERLY 15 FEET OF LOT 12; ALSO THE SOUTHERLY ONE HALF OF VACATED RIVERTON PLCE ADJOINING SAID LOTS 11 AND 13. SITUATE IN THE COUNTY OF KING, STATE OF WASHINGTON. City Of Tukwila Page 3 03/12/2009 C: 1Temp\XPgrpwise\Staff Report.doc • • The transfer of the property from Brett Prodzinski to Harold Prodzinksi occurred prior to the adoption of the City's current Comprehensive Plan and Zoning Map. In 2002, seven years after adoption of the current Comprehensive Plan, the property was transferred from Harold Prodzinksi to Martha Fuentes. The Statutory Warranty Deed for this transaction is provided as Attachment F. The Statutory Warranty Deed listed the following legal description: LOTS 11 AND 13, ESSICO ADDITION TO RIVERTON, ACCORDING TO THE PLAT THEROF RECORDED IN VOLUME 13, PAGE(S) 49, RECORDS OF KING COUNTY, WASHINGTON, ALSO THE SOUTERLY ONE HALF OF VACATED RIVERTON PLACE ADJOINING LOTS 11 AND 13. In 2008, Brie Campbell purchased the property from Freemont Investment and Loan. The Bargain and Sale Deed for this transaction is included as Attachment G. The following legal description was listed on Attachment G: LOTS 11 AND 13, ESSICO ADDITION TO RIVERTON, ACCORDING TO THE PLAT THEROF RECORDED IN VOLUME 13, PAGE(S) 49, RECORDS OF KING COUNTY, WASHINGTON, ALSO THE SOUTERLY ONE HALF OF VACATED RIVERTON PLACE ADJOINING LOTS 11 AND 13. It appears from reviewing the transaction history for the property, that the property's legal configuration is similar to how it existed prior to adoption of the current Comprehensive Plan. The property is actually smaller than it existed prior to the adoption of the Comprehensive Plan. The legal description in Attachment E references a lot 12. Lot 12 is no longer part of the subject property, but is included as part of a parcel located to the south. Conclusion Based upon a review of the transaction history for the subject property, the property complies with the requirements of TMC 18.08.040 (7) and the NCC boundary could, with approval of the Hearing Examiner, be extended an additional 50 feet west. The property's configuration is largely the same at the time of adoption of the City's Comprehensive Plan. The only difference being that lot 12 was segregated off and was joined with an adjacent property. Compatibility with Adjacent Land Uses Before permitting commercial zoning to be moved closer to existing residential uses a brief discussion on zoning compatibility is necessary. As noted, the applicant proposed to move the NCC zoning an additional 50 feet west pursuant to TMC 18.08.040 (7). TMC 18.22.010 notes the City's intent with regards to the NCC zone: "It is intended to provide for pedestrian friendly areas characterized and scaled to serve multiple residential areas, with a diverse mix of uses. Uses include residential uses at second City Of Tukwila Page 4 03/12/2009 C: \Temp\XPgrpwise \Staff Report.doc • • story or above when mixed with certain retail, service, office, recreational and community facilities, generally along a transportation corridor ". The applicant's project as proposed will meet the above intent. The project would provide small commercial uses that can serve the adjacent residential uses. Granting of this request will allow the applicant to have additional room to construct a building, provide parking and meet the City's recreation requirements for the proposed residential units. Additionally, the applicant's project still requires SEPA and design review approval and these processes can be used to mitigate any impacts to surrounding land uses. The development will include a surface parking lot for 42 vehicles. The south lot is currently vacant. The north lot has a single story single family house that is in a state of disrepair and will be demolished. The entire development site is strewn with trash and is in desperate need of re- development. Our goal is to build a well designed and meaningful development that will have a positive impact on the streetscape while helping to create a lively neighborhood commercial district. The development will be LEED certified and integrate low- impact design features such as rain -water harvesting and on -site storm water infiltration and retention. Currently the western 50' of the north lot lies within an LDR zone and this proposal seeks the approval to develop that portion of the site as NCC. The adjacent single - family lots are located at a higher elevation along the western edge of the site and will be above the new development which will greatly mitigate the perceived height and bulk of the new building. We feel that if approved, given the elevation difference and the low -rise scale, the new development will have a minimal visual impact on the LDR zoning to the West and be a benefit to the neighborhood. Introduction The applicant seeks to extend the regulations for the zoning boundary on its property, pursuant to Tukwila Municipal Code (TMC) 18.08.040. A public hearing on the application was held on March 19, 2009, at City Hall, Tukwila, WA. Represented at the hearing were: the Department, by Brandon Miles, Senior Planner, and the applicant, Matt Wasse, Case Design. Following the hearing, the record was held open for the Examiner's site inspection and to receive additional information from the Department. The Department submitted supplemental information on April 6 which was added to the record. After due consideration of the evidence presented at the public hearing, the following shall constitute the findings of fact, conclusions and decision of the Hearing Examiner on this application. Findings of Fact 1. The property is addressed as 12909 East Marginal Way South in Tukwila. The property is approximately 15,000 square feet in size, and is developed with a single family house. The house is vacant and has been posted as unfit for human occupancy, because the site lacks a functioning septic system. 2. The property is comprised of two lots of record, Lots 11 and 13, Essico Addition to Riverton. However, the lots are treated as a single tax parcel, and the King County Parcel number for the site is 238400055. 3. The zoning on Lot 11 is Low Density Residential (LDR), and the zoning on Lot 13 is Neighborhood Commercial Center (NCC). 4. The property has historically been treated a single lot. The house is primarily located on Lot 11, but a survey dated 2008 shows that the house is located on the lot line, and may extend onto Lot 13. The concrete walk that serves the house is completely located on Lot 13, as is the septic system. 5. The City has consistently treated such older adjoining lots of record (which were created prior to the current platting laws as well as incorporation into the City) as a single • • Hearing Examiner Decision L08 -080 Special Exception Page 3 of 5 parcel, when it appears that the lots have been used and transferred as a single parcel. The City notes that many similar "lots" in the older Allentown and Ryan Hill areas of Tukwila, were created for the purpose of transfer and that many of the individual lots do not meet current City standards and are therefore not buildable sites unless combined with adjacent lots. 6. Surrounding land uses include the vacant property to the south, which is owned by the applicant, a parking area for the Tukwila School District to the north, and single family houses to the west. The property is bounded on the east by East Marginal Way. There is a small mixed -use building at the corner of S. 130th Street and East Marginal Way South, and another mixed -use project is currently under construction directly east across East Marginal Way South from the site. 7. At the time of hearing, the exact width of Lot 11 was not known. The King County maps indicate that Lot 11 is 50 feet wide. 8. King County records of the sales history for the property since 1992 are shown in Attachment D. Since 1992, the property has been sold or quit claimed eight times. In 1993, prior to the 1995 adoption of the City's Comprehensive Plan and Zoning Map, Lots 11 and 13, along with Lot 12 to the south, were conveyed by Brett Prodzinski to Harold Prodzinki. Lots 11 and 13 were transferred in 2002 conveyed by Harold Prodzinski to Martha Fuentes, as shown in Attachment F. 9. The City adopted its Comprehensive Plan and zoning map in 1995. 10. The proposal is to extend the NCC zoning boundary on the property 50 feet west, so that Lot 11 would have the same zoning designation as Lot 13. 11. The applicant intends to develop the property, along with property they own to the south, as a mixed use building. The preliminary plans are for a three -story building with 25 multifamily units and commercial uses facing East Marginal Way South. Conclusions 1. The Hearing Examiner has jurisdiction over this application pursuant to TMC 18.08.040 and 18.108.030. TMC 18.08.040(7) provides that, "where a district boundary line divides a lot which was in single ownership at the time of passage of this title, the Hearing Examiner may permit, as a special exception, the extension of the regulations for either portion of the lot not to exceed 50 feet beyond the district line into the remaining portion of the lot." Under TMC 18.08.040(8), "in case uncertainty exists which cannot be determined by the application of the foregoing rules," the Hearing Examiner is to determine the location of the use district boundaries. Hearing Examiner Decision L08 -080 Special Exception Page4of5 2. The initial issue is whether the site is eligible for a special exception under TMC 18.08.040. The property consists of two lots that have developed, transferred and taxed as a single parcel, and the City has consistently treated such property as a single lot for purposes of administering its Codes. Under the circumstances presented here, the property should be treated as a single lot for purposes of TMC 18.08.040(7). 3. The property was in single ownership in 1995, the time of adoption of Title 18 of the Code and the City's 1995 Comprehensive Plan. 4. The extension of the NCC boundary line would allow the site to be developed with the adjacent NCC -zoned property into a mixed -used site that will provide new residential units as well as commercial services to serve nearby residential areas. Such development would be consistent with the purpose of the NCC zone and the Comprehensive Plan. The conditions recommended by the Department should be adopted, in order to address future impacts on adjacent properties from development under the NCC standards. Decision The requested exception to extend the NCC regulations is hereby approved subject to the following conditions: 1. As part of subsequent land use approvals, the applicant shall provide the City with a survey map that shows the location of all lots on the property, the location of the existing zoning boundary line, and the location of the line when it is moved 50 feet to the west. 2. Should the above survey map show that Lot 11 is greater than 50 feet wide, the location of the new zoning line shall be considered the boundary line for the property, and all structures shall meet setbacks from the zoning line. Should it be determined that Lot 11 is less than 50 wide, the NCC boundary line shall extend only the width of Lot 11, and shall not extend beyond that point. 3. The exception is granted only for the purpose of the specific development proposal which was presented by the applicant to the Department at the time of the hearing. Development of the project will be subject to City land use review, including design review, and impacts to adjacent uses will be addressed and mitigated as required by the design review process and other review processes required by the City. It was noted at the Hearing and in the City's staff report dated March 12, 2009 that the subject parcel consisted of two legal lots. However, given the development pattern on the property, the City has historically considered the property one lot. The Hearing Examiner requested that the City provide additional documentation to justify the City's conclusion that the property should only be treated as one lot. The subject property consists of two lots: Lot 11 is located in the rear of the property and is zoned Low Density Residential (LDR); Lot 13 in the front of the property along East Marginal Way South and is zoned Neighborhood Commercial Center (NCC). There is a house located on the site that has been posted "Unfit for Human Occupancy" by the City's Building Official. The posting of "Unfit for Human Occupancy" was a result of a failing septic system on the property. After the hearing the applicant provided the City with a survey of the subject property. Historically, the City has treated similar situations in the same manner it is proposing herein — to consider the property as one lot. There are portions of Tukwila, such as Allentown and the Ryan Hill area, that have lots that were platted prior to the requirements of the 1937 platting laws the make up the basis of Washington State's current platting requirements. These lots typically do not meet the City's minimum lot area requirements. These lots were created as a way to easily transfer property from one individual to another rather than to create separate building sites and that in most cases each lot is not separately buildable. The property could easily be described by noting the lot, block, and subdivision information. This method replaced the more cumbersome metes and bounds method of describing property. Due to the inadequate size of these lots, many of the older homes in the Allentown were built over property lines. These properties consisted of multiple lots and an analysis of the ownership records would typically indicate that the multiple lots were bought and sold as one parcel. Thus, the position presented by the City in this matter is consistent with its past application of the code and is consistent with the development pattern found on the subject property. While the property consists of two platted lots, it is the City's opinion that the property should be treated and developed as one lot. Attachment(s): A.
