Regular Meeting
October 5, 2015 - 7:00 P.M.
CALL TO ORDER/PLEDGE OF ALLEGIANCE /ROLL CALL
Mayor Haggerton called the Regular Meeting of the Tukwila City Council to order at 7:00 p.m. and led the
audience in the Pledge of Allegiance.
ROLL CALL
Christy O'Flaherty, City Clerk, called the roll of the Council. Present were Councilmembers Joe Duffie,
Dennis Robertson, Kate Kruller, Allan Ekberg, Verna Seal, Kathy Hougardy, De'Sean Quinn.

PROCLAMATIONS
The order of the first 2 proclamations was reversed from what appeared on the published agenda to allow
time for the Emergency Manager to arrive at the meeting.
a. A proclamation declaring October 2015 as "Community Planning Month."
Mayor Haggerton read a proclamation declaring October 2015 as "Community Planning Month" and
encouraging everyone to recognize the participation and dedication of the members of Planning
Commissions and other citizen planners who have contributed their time and expertise in the City of
Tukwila.
Mayor Haggerton presented the proclamation to Jack Pace, Community Development Director.
b. A proclamation declaring October 15, 2015, as the "Great Washington ShakeOut."
Mayor Haggerton read a proclamation declaring October 15, 2015 as the "Great Washington ShakeOut"
and encouraging all residents, schools, businesses and community stakeholders to participate in the
ShakeOut "Drop, Cover and Hold on" earthquake drill at 10:15 a.m. that day.
Mayor Haggerton presented the proclamation to Marty Grisham, Emergency Manager.
c. A proclamation declaring October 2015 as "Domestic Violence Awareness Month."
Mayor Haggerton read a proclamation declaring October 2015 as "Domestic Violence Awareness Month,"
encouraging everyone in the community to take an active role in supporting all victims, so they can lead
healthy lives, safe from violent and abusive behavior.
Mayor Haggerton presented the proclamation to Liz Mills, Advocate and Policy Director, from the YWCA
Seattle.
Ms. Mills thanked the City for its commitment to ending violence and making the community safer.

CONSENT AGENDA
a. Approval of Minutes: 9/21/15 (RegularMtg.)
b. Approval of Vouchers #370405 - 370511; #150800, 150904 - 150907 in the amount of $2,056,772.98
c. Authorize the Mayor to sign a contract with Perteet Engineering for the Residential Street Prioritization
Study and Walk and Roll Plan update in the amount of $185,957.00.

d. A resolution ordering the cancellation of past due accounts receivable and returned check write -offs.

UNFINISHED BUSINESS
a. An ordinance adopting the 2015 Edition of the International Property Maintenance Code;
amending the International Property Maintenance Code with specific provisions of the National
Healthy Housing Standard; repealing Ordinance No. 2406; reenacting Section 8.28.020 of the
Tukwila Municipal Code.
MOVED BY SEAL, SECONDED BY QUINN THAT THE PROPOSED ORDINANCE BE READ BY TITLE
ONLY. MOTION CARRIED 7 -0.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
ADOPTING THE 2015 EDITION OF THE INTERNATIONAL PROPERTY MAINTENANCE
CODE; AMENDING THE INTERNATIONAL PROPERTY MAINTENANCE CODE WITH
SPECIFIC PROVISIONS OF THE NATIONAL HEALTHY HOUSING STANDARD; REPEALING
ORDINANCE NO. 2406; REENACTING SECTION 8.28.020 OF THE TUKWILA MUNICIPAL
CODE; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE.

Jerry Hight, Building Official, introduced clarifying language to Page 14 of the ordinance as follows:
Revise section 702.4 of the proposed 2015 International Property Maintenance Code to reflect the
following exception:
Exception: Structures in existence at the time of the adoption of this code may have their
existing use continue without change, if such use was legal at the time of the adoption of this
code, provided such continued use is not dangerous to life as deemed by the code official.
The Washington Multi - Family Housing Association has expressed concerns that existing permitted and
inspection structures would have to replace existing windows if the 2015 International Property
Maintenance Code is adopted.
The intent of adding this section was not to retrofit all legally existing rental structures with emergency
escape openings described in Section 702.4. The intent was to provide emergency escape openings in
structures that have undergone conversions or remodels, without the benefit of permits or inspections.
Some such conversions may have been completed many years ago where the original owner has been
four times removed.

Emergency escape openings have been addressed in the code in one form or another for many years.
The current 2012 code cycle verbiage for emergency escape openings has been in the code as far back
as the 1976 Uniform Building Code; this requirement is not new.
Based on a question by Councilmember Seal, Mr. Hight explained this language does exist in another
section of the code, and including it in this section of the code improves clarity.
Councilmember Duffie emphasized the significance of having the grass height in the ordinance reduced
from 12 inches to 6 inches. (Reference #10 on page 7 of the ordinance.)
MOVED BY DUFFIE, SECONDED BY SEAL TO AMEND THE PROPOSED ORDINANCE TO REDUCE
THE GRASS HEIGHT FROM 12 TO 6 INCHES. **
Discussion ensued among the Councilmembers on this issue with the following comments: Concern that
#10 on Page 7 of the ordinance references the height of weed and plant growth, which involves more
than just grass; Appreciation for the spirit in which the amendment was offered; Concern that reducing the
standard will create greater workload; Suggestion that the City try the 12 -inch standard, and if it does not
work, the ordinance can be amended; Emphasis on only adopting ordinances that will be enforced.

Nora Gierloff, Deputy Community Development Director, referenced Attachment A in the packet, which is
a matrix of changes that were discussed and agreed to at the September 28, 2015 Committee of the
Whole meeting. The ordinance is also in the packet that will complete the Comprehensive Plan update.
There are also exhibits that contain formatted versions of each of the sections, to include photos and
sidebars. Special thanks to the Communications Division for their assistance compiling the end product.
Kathleen Wilson, 4803 South 162nd Street, thanked the Councilmembers for not just hearing the citizens,
but also heeding their concerns.
Brennon Wilson, 4803 South 162nd Street, expressed appreciation to the Council and staff for considering
the comments of all the parties involved and coming up with a good compromise.
*MOTION CARRIED 7 -0, TO ADOPT ORDINANCE NUMBER 2482.
REPORTS
a. Mayor
The Mayor had no report.
b. City Council
Council President Kruller attended a recent public innovators training session for 2.5 days, which focused
on turning outward to the public to become better connected with neighborhoods.
Councilmember Seal received an email from resident Katrina Dohn regarding the intersection of South
146th Street and 42nd Avenue South. A child was almost lost this past weekend due to the way the street
coincides with parked cars. While this has been reviewed in the past, she would like to see this brought
before the Transportation Committee for review and consideration.
Council consensus existed to forward this item to the Transportation Committee.
Ms. Seal asked that Ms. Dohn be contacted when the item comes up for discussion at the Transportation
Committee.
Additionally Ms. Seal said she will be attending the Tukwila School Board meeting regarding options for
the Traveler's Choice Motel, and she will also update members of the Arts Commission on the same
topic.
Councilmember Ekberg suggested the Transportation Committee also look at the intersection of South
140th Street and 42nd Avenue South as that is a dangerous area, and multiple accidents have occurred at
that location.
c. Staff
David Cline, City Administrator, referenced the City Administrator (CA) Report and offered to answer any
questions.
d. City Attorney
There was no report.
e. Intergovernmental
There was no report.
