This Agreement is made and entered into this 5th day of September, 2007, by and between
Julie 14. Quach, "GRANTOR and the City of Tukwila, "GRANTEE
WHEREAS, GRANTOR is the owner of property legally described above, "Property as
depicted on Exhibit `A', attached hereto and incorporated herein by this reference; and
WHEREAS, located on the Property is a single side sewer servicing an adjacent property;
and
WHEREAS, GRANTOR is developing the Property pursuant to building permit no.
D06 -246 and has requested that she be allowed to connect to the single side sewer located
on the Property;
NOW THEREFORE, the GRANTOR and GRANTEE do hereby agree as follows:
1) SIDE SEWER
In consideration of GRANTEE'S approval of GRANTOR'S connection to the single side
sewer, GRANTOR agrees to be responsible for the maintenance and repair of that portion
of the side sewer located on the Property.
2) HOLD HARMLESS
The GRANTOR agrees to hold harmless, indemnify and defend the GRANTEE, its
officials, members, employees, and agents from all liabilities, penalties, costs, losses,
damages, expenses, causes of action, claims, demands, or judgments, including reasonable
attorney's fees, arising from or in any way connected with adjacent properties connection
to the single side sewer located on the Property.
3) THIS AGREEMENT shall be a covenant running with the Property and burden said
Property, and shall be binding on the successors, heirs and assigns of all parties hereto.
IN WITNESS WHEREOF, said individual have caused this instrument to be executed
this day of 2007.
