Bowles Address: 18707 SE Newport Way, Apt. 106 City /State/Zip: Issaquah, WA 98027 is in violation of Tukwila's Municipal Code (TMC), TMC Chapter. 8.28.020 International Property Maintenance Code adopted (IPMC) Specifically IPMC 108.1.3 Structure unfit for human occupancy. "A structure is unfit for human occpancy whenever the code official finds that such structure is unsafe, unlawful or because of the degree to which the structure is in disrepair or lacks maintenance, in insanitary, vermin or rate infested, contains filth and contamination, or lacks ventilation, illumination, sanitary or heating facilities or other essential equipment required by this code, or because the location of the structure constitutes a hazard to the occupants of the structure or to the public." IPMC 301.2 Responsibility. "The owner of the premises shall maintain the structures and extetior property in compliance with thes requirements..." IPMC 301.3 Vacant structures and land. "All vacant structures and premises there of or vacant land shall be maintained in a clean, safe, secure and sanitary condition... so as not to cause a blighting problem or adversely affect the public health or safety." IPMC 302.1 Sanitation. "All exterior property and premises shall be maintained in a clean, safe and sanitary condition..." IPMC 302.8 Motor Vehicles. "...no inoperative or unlicensed motor vehcile shall be parked, kept or stored on any premises..." IPMC 303.1 Swimming Pools. "Swimming pools shall be maintained in a clean and sanitary condition and in good repair." IPMC 307.1 Accumulation of rubbish or garbage. "All exterior property and premises, and the interior of every structure, shall be free from any accumulation of rubbish or garbage." C.\ !`..A.. -4 D:....\ Specifically Notifir 1 ?y Tukwila Police Department of a .cant and unsecured house. Inspection on April 6, 2007 showed vacam house with broken windows and doors, at least a foot of water in the basement, four junk vehicles, broken glass littering the entire driveway and parking areas. The swimming pool is filled with green, dirty water. The interior of the house is filled with broken furniture, broken glass, rotting food, and appears to be occupied by transients. Some photos attached. Corrective Action required: Compliance Date May 7, 2007 Corrective Action Secure the house against unlawful entry. Repair and /or replace all broken windows and doors. Ensure that all locks securely prevent unauthorized entry. Remove all junk vehicles. Remove all debris, broken glass, old appliances and other discards from the exterior property and the interior of the home. Drain the swimming pool. Drain the water accumulation in the basement. FAILURE TO COMPLY WITH THIS ORDER MAY SUBJECT YOU TO A MONETARY PENALTY OF UP TO $500 PER DAY FOR EACH DAY THAT THE VIOLATION EXISTS UNDER THE PROVISIONS SET FORTH IN TMC 8.45.100(2). ADoeal Provisions: A person may, within ten days of receipt of this notice, file with the City Clerk a written notice of appeal containing the following: 1. A heading with the words: "Before the Hearing Officer of the City of Tukwila; 2. A caption reading: "Appeal of giving the names of all appellants participating in the appeal; 3. A brief statement setting forth the legal interest of each of the appellants in the property involved in the notice and order; 4. A brief statement of the specific order or action protested, together with any material facts claimed to support the contentions of the appellant or appellants; 5. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order should be reversed, modified, or otherwise set aside; 6. The signature of all persons named as appellants, and their official mailing addresses; 7. The verification (by declaration under penalty of perjury) of each appellant as to the truth of the matters stated in the appeal. 8. The appeal fee for violations in the LDR zone is $100.00 and in all other zones is $200.00. Fees must accompany the written notice of appeal. Failure to appeal this Violation Notice and Order shall constitute a waiver of all rights to any additional administrative hearings. Failure to respond may result in the matter being forwarded to the City Attorney for further action.
