HOW TO TESTIFY
If you would like to address the Council, please go to the podium and state your name and address clearly for
the record. Please observe the basic riles of courtesy when speaking and limit your comments to five
minutes. The Council appreciates hearing from citizens but may not be able to take immediate action on
comments received until they are referred to a Committee or discussed under New Business.
COUNCIL MEETINGS
No Council meetings are scheduled on the 5th Monday of the month unless prior public notification is given.
Regular Meetings - The Mayor, elected by the people to a four -year term, presides at all Regular Council
Meetings held on the 1 st and 3rd Mondays of each month at 7:00 p.m. Official Council action in the
form of formal motions, adopting of resolutions and passing of ordinances can only be taken at Regular
Council meetings.
Committee of the Whole Meetings - Council members are elected for a four -year term. The Council
President is elected by the Council members to preside at all Committee of the Whole meetings for a
one -year term. Committee of the Whole meetings are held the 2nd and 4th Mondays at 7:00 p.m.
Issues discussed are forwarded to the Regular Council meeting for official action.
GENERAL INFORMATION
At each Council meeting citizens are given the opportunity to address the Council on items that are not
included on the agenda during CITIZENS COMMENTS. Please limit your comments to 5 minutes.
Special Meetings may be called at any time with proper public notice. Procedures followed are the same as
those used in Regular Council meetings.
Executive Sessions may be called to inform the Council of pending legal action, financial, or personnel
matters.
PUBLIC HEARINGS
Public Hearings are required by law before the Council can take action on matters affecting the public interest
such as land -use laws, annexations, rezone requests, public safety issues, etc. Section 2.04.150 of the
Tukwila Municipal Code states the following guidelines for Public Hearings:
The proponent shall speak first and is allowed 15 minutes for a presentation.
2. The opponent is then allowed 15 minutes to make a presentation.
Each side is then allowed 5 minutes for rebuttal.
4. Citizens who wish to address the Council may speak for 5 minutes each. No one may speak a second
time until everyone wishing to speak has spoken.
5. After each speaker has spoken, the Council may question the speaker. Each speaker can respond to the
question, but may not engage in further debate at this time.
6. After the Public Hearing is closed and during the Council meeting, the Council may choose to discuss
the issue among themselves, or defer the discussion to a future Council meeting, without further public
testimony. Council action may only be taken during Regular or Special Meetings.

SUBJECT: 2016 Property Tax Levy
ISSUE
By November 30, 2015, approve ordinances adopting the general property tax levy for 2016,
increasing the regular levy from the previous year, and declaring substantial need thereby
enabling the 1% increase.
BACKGROUND
A Public Hearing for adoption of the 2016 property tax levy is required by RCW 84.55.120. The
Hearing is scheduled for November 9, 2015.
The City was notified on October 15, 2015 that the assessed value for Tukwila for 2016 is
projected to be $5,222,624,289.
State law allows the City to increase property taxes by 1% or the Implicit Price Deflator (IPD),
whichever is less unless an additional ordinance showing substantial need is adopted by City
Council. The ordinance showing substantial need must be approved by a majority plus one.
The IPD for calculating the 2016 property tax levy is .0025 %, substantially less than 1 %. The
allowable levy projected by King County and documented on the Preliminary Levy Limit
Worksheet -2016 Tax Roll using the IPD is $14,388,492. The allowable levy using 1% is
14,495,407, representing additional property tax revenue of $106,915 if City Council approves
the ordinance showing substantial need.
The budget adopted by Council for the 201 -2016 biennium is based, in part, on a property tax
revenue increase of 1 % plus new construction.
DISCUSSION
Levy Amount
The assessed value and the allowable levy are subject to change until final levy rate
determination. A levy amount of $14,700,000 will be used for the ordinance. If the final allowable
levy is less than the ordinance amount, King County Department of Assessments will adjust the
ordinance amount to the final allowable levy amount and no further action by the Council will be
required.

Levy Limit
RCW 27.12.390 allows for a maximum statutory levy rate for cities at $3.60 less the actual regular
levy made by a library district. RCW 41.16.060 also allows for an additional levy of $0.225 if a
city has a firemen's pension fund. The maximum allowable levy for 2016 is estimated to be
$3.39836. However, due to the 1% limitation, the Levy Limit Worksheet received from King
County estimates the City's preliminary levy rate for 2016 at $2.77550, the ordinance estimates
the rate at $2.82 and the actual rate, after all valuations and the final King County worksheet have
been completed, will be a rate that lies within the range of these two rates.
RECOMMENDATION
The City Council is being asked to approve the ordinance adopting the General Tax Levy, the
ordinance showing substantial need to increase property taxes by the full 1 %, and the ordinance
showing the dollar and percent increase from the previous year at the November 9, 2015
Committee of the Whole meeting and subsequent November 16, 2015 Regular Meeting. A public
hearing has also been scheduled at the November 9, 2015 Committee of the Whole.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, INCREASING THE CITY OF
TUKWILA REGULAR LEVY FROM THE PREVIOUS YEAR,
COMMENCING JANUARY 1, 2016, ON ALL PROPERTY,
BOTH REAL AND PERSONAL, IN COMPLIANCE WITH
RCW 84.55.120; PROVIDING FOR SEVERABILITY; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Tukwila has properly given notice of a public hearing held on
November 9, 2015, pursuant to RCW 84.55.120; and
WHEREAS, after hearing and duly considering all relevant evidence and testimony
presented, the City Council has determined that in order to discharge its expected
expenses and obligations the City requires an increase in property tax revenue from the
previous year, in addition to the increase resulting from the addition of new construction
and improvements to property and any increase in the value of State - assessed property,
and
WHEREAS, the City Council has determined it is in the City's best interest and
necessary to meet its expenses and obligations for the property tax revenue to be
increased for 2016, and the final assessed valuation calculation has been determined;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:
Section 1. An increase in the regular property tax levy, in addition to any amount
resulting from the addition of new construction and improvements to property and any
increase in the value of State - assessed property, is hereby authorized for the 2016 levy in
the amount of $94,870, which is a percentage increase of 1 % from the previous year. This
increase is exclusive of additional revenue resulting from new construction, improvements
to property, any increase in the value of State - assessed property, any annexations that
have occurred and refunds made.

Section 2. Corrections by City Clerk or Code Reviser. Upon approval of the
City Attorney, the City Clerk and the code reviser are authorized to make necessary
corrections to this ordinance, including the correction of clerical errors; references to
other local, state or federal laws, codes, rules, or regulations; or ordinance numbering
and section /subsection numbering.
Section 3. Severability. If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance or its application to any person or situation should be held to be
invalid or unconstitutional for any reason by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of the
remaining portions of this ordinance or its application to any other person or situation.
Section 4. Effective Date. This ordinance or a summary thereof shall be published
in the official newspaper of the City, and shall take effect and be in full force and effect
January 1, 2016.

WHEREAS, the City Council of the City of Tukwila has considered its budget for the
2015 -2016 biennium; and
WHEREAS, in the course of considering the 2015 -2016 biennial budget, the City
Council reviewed all sources of revenue and examined all anticipated expenses and
obligations; and
WHEREAS, due to the needs regarding parks, residential and arterial streets, City
facilities, and police and fire services, the City Council found that there is substantial need
to increase the regular property tax limit factor above the rate of inflation; and
WHEREAS, the City Council desires to continue that rate in order to meet service
needs in the City in 2016 and beyond;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:
Section 1. Regular Tax Levy. The City Council of the City of Tukwila finds that
there is substantial need to increase the regular property tax limit factor above the rate of
inflation, and hereby establishes that the limit factor for the regular levy for the calendar
year 2016 shall be 101% of the highest amount of the regular property taxes that could
have been lawfully levied in Tukwila in any year since 1985.
Section 2. Corrections by City Clerk or Code Reviser. Upon approval of the
City Attorney, the City Clerk and the code reviser are authorized to make necessary

OF THE SEVERAL DEPARTMENTS OF SAID CITY FOR THE

WHEREAS, the City Council of the City of Tukwila has considered the City's
anticipated financial requirements for 2016 and the amounts necessary and available to be
raised by ad valorem taxes on real, personal and utility property; and
WHEREAS, the following sentence is provided for information only: The maximum
Statutory Levy Rate for the City of Tukwila, as allowed by RCW 84.52.043, is $3.825,
which includes $0.225 for the Firemen's Pension Fund as allowed by RCW 41.16.060; and
WHEREAS, the final assessed valuation calculation has been determined;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:
Section 1. Regular Tax Levy.
A. There shall be and hereby is levied on all real, personal and utility property in the
City of Tukwila, in King County, whose estimated assessed valuation is $5,222,624,289,
current taxes for the ensuing year commencing January 2016, in the amount and at the
rates specified below:

B. The said taxes herein provided for are levied for the purpose of payment upon the
general bonded indebtedness of the City of Tukwila, the General Fund, and for the
maintenance of the departments of the municipal government of the City of Tukwila for the
fiscal year beginning January 1, 2016.
Section 2. Collection. This ordinance shall be certified to the proper County
officials, as provided by law, and taxes here levied shall be collected to pay to the Finance
Director of the City of Tukwila at the time and in the manner provided by the laws of the
State of Washington for the collection of taxes for non - chartered code cities.

Notes:
1) Rates for fire districts and the library district are estimated at the time this worksheet is
produced. Fire district and library district rates affect the maximum allowable rate for cities
annexed to them. These rates will change, mainly in response to the actual levy requests
from the fire and library districts. Hence, affected cities may have a higher or lower
allowable levy rate than is shown here when final levy rates are calculated.
2) This figure shows the maximum allowable levy, which may differ from any actual prior levy
if a district has levied less than its maximum in prior years. The maximum allowable levy
excludes any allowable refund levy if the maximum was based on a limit factor. The
maximum allowable levy excludes omitted assessments if the maximum was determined by
your district's statutory rate limit. If your district passed a limit factor ordinance in the year
indicated, that limit factor would help determine the highest allowable levy. However, if the

ISSUE
The owners of 223 Andover Park East have requested an amendment to the Development
Agreement to allow an increase in maximum height from 190 feet to 195 feet.
BACKGROUND
In March 2013 Tukwila executed a development agreement with South Center WA, LLC to allow
a 180 feet high building that included apartments and a hotel. Subsequently the development
agreement was amended to allow a maximum height of 190 feet. The developer has continued
to work on the detailed construction plans and has determined that additional height is required.
A foundation permit has been issued and construction related to piles and foundations has been
ongoing. The final design includes 185 hotel rooms and 371 apartments with a total of 19 floors.
The design review application for the proposed development was approved by the Board of
Architectural Review on May 23, 2014. The developer has submitted a request for minor
modification to the approved design including modifications to colors, materials, landscape and
height. Tukwila Municipal Code authorizes the Director of Community Development to approve
minor modifications to the design review approval. However, Section 5 of the Development
Agreement prohibits any changes to the development standards section from being considered
minor modifications. Per the language in the Development Agreement any changes to the
development standards have to be approved as a major amendment to the Development
Agreement. The other minor modifications to the design review application and the building
permit are currently under review.
DISCUSSION
Detailed building permit drawings have been prepared and the maximum height of the building
at mid -point of the sloping roof is now shown as 192' -10 ", which is higher than the maximum
allowed under the Development Agreement. The height at the highest point of the sloping roof is
195 feet and the elevator penthouse roof is at 196 feet with parapet walls at 202 feet. See
attached plans.
The adopted standards under Tukwila Municipal Code TMC 18.28 allow a maximum height of
115 feet (with multifamily and frontage improvement incentives). The current Development
Agreement allows a maximum height of 190 feet for 50% of the site. Per International Building
Code, building height is calculated from the average grade plane around the building to the mid-
point of the height sloping roof. Additionally, rooftop appurtenances such as elevator
penthouses are exempt from the height requirement per TMC 18.50.080, if they are setback 10
feet from the edge of the building. The proposed elevator is not setback 10 feet from the edge of
the building, therefore is not exempt from the maximum height requirements.

Since the underlying zoning allows 115 feet and the current Development Agreement allows a
maximum of 190 feet; an amendment to the Development Agreement is required to approve
anything taller than 190 feet.
The proposed second amendment to the Development Agreement allows the maximum building
height of 200 feet for 50 percent of the site. Additionally, it allows the maximum height of the
parapet wall of the elevator penthouse to be 205 feet.
FINANCIAL IMPACT N/A
RECOMMENDATION
The Council is being asked to hold a public hearing at the Committee of the Whole meeting on
November 9, 2015 and approve the ordinance authorizing the amendment to the development
agreement on November 16, 2015.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:
Section 1. The Second Amendment to the 223 Andover Park East Development
Agreement by and between the City of Tukwila and South Center WA, LLC, a copy of
which is attached hereto as Exhibit A, is hereby approved and the Mayor is authorized
and directed to execute said Second Amendment to Development Agreement on behalf
of the City of Tukwila.
Section 2. Corrections by City Clerk or Code Reviser. Upon approval of the
City Attorney, the City Clerk and the code reviser are authorized to make necessary
corrections to this ordinance, including the correction of clerical errors; references to
other local, state or federal laws, codes, rules, or regulations; or ordinance numbering
and section /subsection numbering.
Section 3. Severability. If any section, subsection, paragraph, sentence, clause
or phrase of this ordinance or its application to any person or situation should be held to
be invalid or unconstitutional for any reason by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of the
remaining portions of this ordinance or its application to any other person or situation.
Section 4. Effective Date. This ordinance or a summary thereof shall be
published in the official newspaper of the City, and shall take effect and be in full force
five days after passage and publication as provided by law.

THIS SECOND AMENDMENT TO DEVELOPMENT AGREEMENT (the
"Second Amendment ") is made and entered into this day of November
2015, by and between the CITY OF TUKWILA ( "City "), a non - charter, optional
code Washington municipal corporation, and SOUTH CENTER WA, LLC, a
Washington limited liability company ( "Developer ").
I. RECITALS
WHEREAS, the City of Tukwila and South Center WA, LLC entered into a
Development Agreement for the 223 Andover Park East Development effective
the 19th day of March, 2013 (and approved by Ordinance No. 2399); and
WHEREAS, the City of Tukwila and South Center WA, LLC entered into
the First Amendment to the Development Agreement for the 223 Andover Park
East Development effective the 19th day of May 2014 (and approved by
Ordinance No. 2438), and
WHEREAS, Developer has continued to proceed with the project per the
terms of the development agreement and has submitted a building permit for the
proposed development; and
WHEREAS, Developer has requested a minor amendment to the building
height provisions listed under the Development Agreement in order to proceed
with the proposed development, and
WHEREAS, the Development Agreement stipulated a maximum height of
180 feet for 50 percent of the site, which was subsequently amended to 190 feet
by the First Amendment to the Development Agreement; and
WHEREAS, due to the benefits as described in the Development
Agreement, the City desires the proposed development to proceed; and
WHEREAS, as required pursuant to TMC Section 18.86.050, the City
conducted a public hearing on the 9th day of November 2015 to take testimony
regarding this Second Amendment to the Development Agreement; and

WHEREAS, the City Council, pursuant to City Ordinance No. ,
approved this Second Amendment to the Development Agreement as proposed
and authorized execution of this Second Amendment to the Development
Agreement; and
WHEREAS, the Parties desire to enter into this Second Amendment to the
Development Agreement upon the terms and conditions as set forth herein,
NOW, THEREFORE, in consideration of the mutual promises set forth
herein and the long -term benefit to both the City and the Developer, the Parties
hereby agree as follows:
II. AGREEMENT
1. Additional Building Height: Section 4.3 of the Development Agreement
is hereby amended so the maximum building height for 50 percent of the site
shall be 200 feet. The maximum height of the parapet wall of the elevator
penthouse shall be 205 feet. The remainder of the site is limited to the height
permitted by the zoning code in effect at the time of a complete building permit
submittal. Rooftop appurtenances are exempt from this height requirement per
TMC Section 18.50.080.
The building(s) may have no more than nineteen (19) floors. The nineteenth
floor may be used for common area open space such as a clubhouse, rooftop
deck, other common areas, a green roof and mechanical equipment but may not
be used for residential units or hotel guest rooms. This increase in building
height is consistent with the goals of the Comprehensive Plan to encourage
residential development within the Urban Center and is consistent with the City's
vision of increased urban density.
2. This Second Amendment shall be recorded against the Property as a
covenant running with the land.
3. Except as amended herein, the terms and provisions of the
Development Agreement remain in full force and effect.

C. Ordinance: Amending Development Agreement for Washington Place Development
Staff is seeking Council approval of an ordinance that would authorize a second amendment to
the Development Agreement with South Center WA, LLC for the property known as Washington
Place. The owners of 223 Andover Park East have requested this amendment as detailed
construction plans have revealed a need for a small amount of additional height. The existing
agreement as amended in May 2014 stipulates a maximum height of 190 feet for 50% of the site.
If approved, this second amendment will stipulate a maximum building height of 200 feet for 50%
of the site, with the maximum height of the parapet wall of the elevator penthouse being 205 feet.
As before, the building may have no more than 19 floors.
Councilmember Ekberg inquired about plans for wireless facilities that may impact the building's
height and DCD staff confirmed that the City has not seen anything in the design. Any future
modification to accommodate wireless facilities will require DCD approval. Councilmember Ekberg

ISSUE
Award contract to Construction Group International, LLC for the demolition of the Great
Bear, Boulevard, and Spruce Motels and Sam's Smoke Shop on Tukwila International
Boulevard (TIB) and award bid alternate No 1 to demolish the Traveler's Choice motel on
South 146th Street.
BACKGROUND
The City purchased the Great Bear, Boulevard and Traveler's Choice motels from the
Federal Government in 2014 and Sam's Smoke Shop and the Spruce Motel in 2015 as part
of the TIB Redevelopment Project. Depending on future Council approval, the properties will
be sold.
ANALYSIS
Six bids were received and opened on October 22, 2015 for the TIB Redevelopment Project
and all bids were reviewed and tabulated (see attached sheet). Three errors were
discovered in the bid submittals, but no errors were found in the low bid from Construction
Group International, LLC. Construction Group International submitted the apparent low bid
of $470,247.75 and $132,779.70 for Bid Alternate No. 1 (Traveler's Choice) for a total of
$603,027.45. The base bid determines the bid award and the bid alternate is an additive
and is not included in the bid decision. The Engineer's Estimate was $843,122.63 including
the bid alternate.
References have been checked for Construction Group International, LLC and they have
completed similar types of projects and their work was found to be satisfactory.

With the awarding of the contract bid items at $603,027.45, we also have a 15%
contingency on the project. The contingency amount of $90,454.12 is the allowable
expense that the Mayor will be able to approve for any change orders to the construction
contracts. If at any time the project overruns the contingency amount, staff will return to
Committee and Council for approval. In order to award a bid including the Traveler's
Choice, Council will need to approve an increase to the CIP project budget of $140,000
which would come from the City's 302 fund.
The Traveler's Choice demolition was includes a Bid Alternate No. 1 in order to give the City
the option whether to demolish the motel. Staff presented options for the Traveler's Choice
to the Community Affairs and Parks Committee (CAP) on September 28, 2015 and
continues to explore a lease to 4Culture for art related uses. Staff plans to brief CAP again
on November 9, 2015. The 4Culture board has expressed interest in the opportunity and is
expected to vote on it at their meeting on December 2, 2015.
Staff recommends the Council make a decision after the 4Culture board meeting; however,
if the Council is not interested in considering the 4Culture option, then the Council could
award the bid at the Regular meeting on November 16, 2015. In that case, it is likely
demolition would start in mid - December.
RECOMMENDATION
Council is being asked to consider this item at the Committee of the Whole meeting on
November 9, 2015 and forward it for a decision at the Regular meeting on December 7,
2015.

This Tukwila International Blvd (TIB) Redevelopment Project is for the acquisition and disposition of properties
DESCRIPTION:

The City has completed appraisals and is in negotiations with the property owners and the US Attorney
