HOW TO TESTIFY If you would like to address the Council, please go to the podium and state your name and address clearly for the record. Please observe the basic riles of courtesy when speaking and limit your comments to five minutes. The Council appreciates hearing from citizens but may not be able to take immediate action on comments received until they are referred to a Committee or discussed under New Business. COUNCIL MEETINGS No Council meetings are scheduled on the 5th Monday of the month unless prior public notification is given. Regular Meetings - The Mayor, elected by the people to a four -year term, presides at all Regular Council Meetings held on the 1 st and 3rd Mondays of each month at 7:00 p.m. Official Council action in the form of formal motions, adopting of resolutions and passing of ordinances can only be taken at Regular Council meetings. Committee of the Whole Meetings - Council members are elected for a four -year term. The Council President is elected by the Council members to preside at all Committee of the Whole meetings for a one -year term. Committee of the Whole meetings are held the 2nd and 4th Mondays at 7:00 p.m. Issues discussed are forwarded to the Regular Council meeting for official action. GENERAL INFORMATION At each Council meeting citizens are given the opportunity to address the Council on items that are not included on the agenda during CITIZENS COMMENTS. Please limit your comments to 5 minutes. Special Meetings may be called at any time with proper public notice. Procedures followed are the same as those used in Regular Council meetings. Executive Sessions may be called to inform the Council of pending legal action, financial, or personnel matters. PUBLIC HEARINGS Public Hearings are required by law before the Council can take action on matters affecting the public interest such as land -use laws, annexations, rezone requests, public safety issues, etc. Section 2.04.150 of the Tukwila Municipal Code states the following guidelines for Public Hearings: The proponent shall speak first and is allowed 15 minutes for a presentation. 2. The opponent is then allowed 15 minutes to make a presentation. Each side is then allowed 5 minutes for rebuttal. 4. Citizens who wish to address the Council may speak for 5 minutes each. No one may speak a second time until everyone wishing to speak has spoken. 5. After each speaker has spoken, the Council may question the speaker. Each speaker can respond to the question, but may not engage in further debate at this time. 6. After the Public Hearing is closed and during the Council meeting, the Council may choose to discuss the issue among themselves, or defer the discussion to a future Council meeting, without further public testimony. Council action may only be taken during Regular or Special Meetings. City of Tukwila Jim Haggerton, Mayor TO: City Council ,/_ ,. .14_� FROM: Jim Haggerton, Mayor BY: Brandon Miles, Econftic Development Liaison Cheryl Thompson, Executive Assistant DATE: October 22, 2015 SUBJECT: 2016 Lodging Tax Advisory Committee ISSUE I am recommending that the City Council reappoint three existing members and appoint five new members to the City's Lodging Tax Advisory Committee (LTAC). BACKGROUND The City imposes a 1% lodging tax on the certain overnight stays at area hotels and motels. In 2015, the City's budget estimated that the City will receive approximately $600,000 in lodging tax funds. Under Washington State law, lodging tax proceeds can only be used for tourism promotion (overnight and day visitors) and other tourism related activities (RCW 67.28.1816). In order to collect the lodging tax and spend the funds collected, the City is required by State Law to have a Lodging Tax Advisory Committee. The Committee makes recommendations to the City Council on any request to use lodging funds, including requests by the City. The City Council can accept or reject any of the LTAC recommendations. However, the City Council cannot change the specific funding amounts recommended by the LTAC. The City's LTAC has nine members. Four of the members are representatives of businesses that are required to collect the tax (hoteliers), four are persons involved in activities authorized to be funded by the tax (non- hoteliers); and one member is a City elected official who serves as the LTAC chair. Historically, the Council President has served as the City's elected official on the LTAC. State Law requires that the City Council, "review the membership of the advisory committee annually and make changes as appropriate (RCW 67.28.1817)." This annual review requirement is also found in City Council Resolution # 1533. DISCUSSION In order to meet the requirements of State Law and the City Council's adopted resolution, I am recommending that the following individuals be reappointed to the LTAC to continue to serve through 2016. 1 am also recommending five new appointments to the Committee, copies of the applications for the new appointments are attached for your ease of reference. 3 INFORMATIONAL MEMO Page 2 Position Name Note Position #1 Elected Typically the Council President selected Official at the first Council Meeting in January. Page 2 of 2 SECOND AMENDMENT TO DEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY OF TUKWILA AND SOUTH CENTER WA, LLC FOR THE 223 ANDOVER PARK EAST DEVELOPMENT THIS SECOND AMENDMENT TO DEVELOPMENT AGREEMENT (the "Second Amendment ") is made and entered into this day of November 2015, by and between the CITY OF TUKWILA ( "City "), a non - charter, optional code Washington municipal corporation, and SOUTH CENTER WA, LLC, a Washington limited liability company ( "Developer "). I. RECITALS WHEREAS, the City of Tukwila and South Center WA, LLC entered into a Development Agreement for the 223 Andover Park East Development effective the 19th day of March, 2013 (and approved by Ordinance No. 2399); and WHEREAS, the City of Tukwila and South Center WA, LLC entered into the First Amendment to the Development Agreement for the 223 Andover Park East Development effective the 19th day of May 2014 (and approved by Ordinance No. 2438); and WHEREAS, Developer has continued to proceed with the project per the terms of the development agreement and has submitted a building permit for the proposed development; and WHEREAS, Developer has requested a minor amendment to the building height provisions listed under the Development Agreement in order to proceed with the proposed development; and WHEREAS, the Development Agreement stipulated a maximum height of 180 feet for 50 percent of the site, which was subsequently amended to 190 feet by the First Amendment to the Development Agreement; and WHEREAS, due to the benefits as described in the Development Agreement, the City desires the proposed development to proceed; and WHEREAS, as required pursuant to TMC Section 18.86.050, the City conducted a public hearing on the 9th day of November 2015 to take testimony regarding this Second Amendment to the Development Agreement; and 29 WHEREAS, the City Council, pursuant to City Ordinance No. , approved this Second Amendment to the Development Agreement as proposed and authorized execution of this Second Amendment to the Development Agreement; and WHEREAS, the Parties desire to enter into this Second Amendment to the Development Agreement upon the terms and conditions as set forth herein, NOW, THEREFORE, in consideration of the mutual promises set forth herein and the long -term benefit to both the City and the Developer, the Parties hereby agree as follows: II. AGREEMENT 1. Additional Building Height: Section 4.3 of the Development Agreement is hereby amended so the maximum building height for 50 percent of the site shall be 200 feet. The maximum height of the parapet wall of the elevator penthouse shall be 205 feet. The remainder of the site is limited to the height permitted by the zoning code in effect at the time of a complete building permit submittal. Rooftop appurtenances are exempt from this height requirement per TMC Section 18.50.080. The building(s) may have no more than nineteen (19) floors. The nineteenth floor may be used for common area open space such as a clubhouse, rooftop deck, other common areas, a green roof and mechanical equipment but may not be used for residential units or hotel guest rooms. This increase in building height is consistent with the goals of the Comprehensive Plan to encourage residential development within the Urban Center and is consistent with the City's vision of increased urban density. 2. This Second Amendment shall be recorded against the Property as a covenant running with the land. 3. Intergovernmental Update • Puget Sound Regional Council Growth Management Planning Council (PSRC /GMPC): On November 6 Community Development Director Jack Pace and Code Enforcement Officer Kathy Stetson gave a presentation to the PSRC /GMPC Housing Consortium on Tukwila's Rental Licensing program and the effect on the quality of housing in Tukwila as well as the adoption of the National Healthy Housing Standard. • Amtrak Advisory Committee: Staff participated in an Advisory Committee for WSDOT and ODOT regarding the Amtrak Cascades Corridor Policy for Station Stops. The purpose of this committee is to provide policy guidance for the development of a permanent station stop policy for the Amtrak Cascades service between Eugene and Vancouver, Washington. • Meeting with South King County Chamber of Commerce Workforce Development Committee Chair: Project Development Manager Joyce Trantina met with Dustin Stevens, Chair of the South King County Chamber's Workforce Development Committee to discuss the efforts to expand mentor /internship activities in conjunction with the Tukwila School District and local businesses. • Prep for Elected Officials Economic Development Summit: Economic Development Administrator Derek Speck attended a meeting of economic development staff hosted by Sound Cities Association, King County and Seattle to reviewthe agenda for an Elected Officials Economic Development Summit they are hosting on December 11 at the Tukwila Community Center. • Boeing Access Road: Staff met with Harold Taniguchi, head of the King County Department of Transportation to discuss the Boeing Access Road light rail and commuter rail stations and the City's desire to see them included in ST3. The discussion centered around ensuring that KCDOT's long range planning assumes a station at Boeing Access Road (it does), how to better enhance non - motorized access to the station, specifically through trails, and working with KCDOT to develop an employer- sponsored shuttle service that would serve the station in the 33 City Administrator Report November 12, 2015 Page 2 future. There was also discussion as to how stations at Boeing Access Road could better serve people working at King County International Airport. • Meeting with Tukwila School District Administration: On November so the City hosted a lunch meeting between City staff from various departments and the Tukwila School District Administrative staff to learn more about how both agencies intersect in service to the Tukwila community and to identify opportunities to collaborate in the future. II. Staff Updates Public Safety • Police Panel meets with Civics Class: On October 28 Deputy Chief Linton, Commander Drever, Sgt. Mettlin, SRO Harrison, Detective Kunsman and Detective Balcom participated in a Civics Class outreach forum with Foster High School Seniors. The students asked the panel members to respond to well- thought -out questions. The meeting between students and police was received well and provided an opportunity for both parties to better understand each other and their needs. • Chief of Police Appreciation Award Challenge Coin: In November Police Chief Villa rolled out the "Chief of Police Appreciation Award" challenge coin. This beautiful coin is given on the spot by the Chief of Police to employees or others who are caught demonstrating one or more of the police core values of Leadership, Excellence, Accountability, and Dedication. Sergeant Bisson and Officer Kerin worked together to design the coin and received the first two coins for demonstrating Excellence in the product that they designed. Project Updates • Museum of Flight B -52 Memorial: The Museum of Flight is proposing a park and memorial site on the vacant lotjust south of the Raisbeck Aviation High School for the B -52 aircraft that is currently being stored at Paine Field in Everett. The project will be developed in 2 phases: development of the landscape /park area in 2016 and placement of the B -52 aircraft in 2017. • Proposed Quail Park of Tukwila Project: A market rate senior housing project containing 121 independent living apartments and 21 memory care units is proposed on a 10 acre parcel at 13112 Military Rd South, east of Highline Medical Center. The project will require administrative SEPA and Parking Determination decisions as well as Planned Residential Development (PRD) and Design Review approvals. • Operation Warm: Firefighter James Booth has been spearheading "Operation Warm" for IAFF Local 2088. Operation Warm is a community service project that provides winter coats for children in need and has gained momentum across the country and impacted the American factory providing the coats, to the point that they have doubled their workforce in an effort to fulfill the increase in demand. This week Local 2088 delivered coats to every kindergartener at Thorndyke Elementary School. • Duwamish Hill Preserve Phase z: Planting is underway and is the main activity going on right now. Remaining work to be done includes planting and seeding, rabbit fencing, concrete driveway, clean -up and punch list. Installation of the granite artwork began November g. We 34 City Administrator Report November 12, 2015 Page 3 have received official notice that Duwamish Hill Preserve is being recommended to the King County Council for a $200,000 grant which will help finalize Phase 2. • Community Organization Collaboration: Fitness and Athletic Coordinator Marlus Francis and Fitness and Athletic Specialist Steve Batz met with Adam Taylor, Executive Director of Global to Local and Cesar Amaral of MX18o to try and develop collaboration between the three organizations. MX 18o's mission is to encourage and inspire the Latino community to live a healthier and activate life style. We will be looking at where and when we can offer classes, workshops, and opportunities for Latinos in our community. • Interurban Ave S Roadway: Work continues on the final paving and the west side sidewalk placement prior to the end of this year. South end traffic by Fort Dent has been shifted into the center lanes, pavement grinding is complete in anticipation of pre -level placement and the soldier pile wall cap and east side improvements are continuing as the work area becomes available. Sidewalk on the west side of Interurban Ave S will be placed from Fort Dent Way moving north should be completed within the next few weeks.
