The undersigned City of Tukwila Code Enforcement Officer, hereby certifies and states that:

is declared to be an Unfit Building in violation of Tukwila's Municipal Code (TMC),
TMC Chapter: TMC 16.04.020 Codes Adopted International Building Code (IBC),
International Residential Code (IRC), Uniform Plumbing Code (UPC),
Washington State Ventilation and Indoor Air Quality Code WSVIAQ).
Specifically: IRC 8310: Bedrooms on second floor do not have openable emergency escape and
rescue windows and do not provide minimum required opening dimensions.
IRC R303.8: All bedrooms lack heating facilities. Use of space heaters does not
achieve compliance with this code section.
IRC R311.5.6.1 Stair handrail is no longer anchored to wall. Backing and lag
screws need replacement.
IRC 8313.1 Smoke alarms are not in existence in the bedrooms or in other
required locations.
IBC 3401.2 Maintenance. Entrance stairs are not constructed to any
construction standards. They have been repaired in an unconvential manner
that is unacceptable by any standards. They are racking and deteriorated due to
rot. Entire stair and handrail needs to be replaced. Entire entry porch decking,
framing members, support posts, footings and guardrails need to be replaced
with all treated structural framing. The existing decking is unsupported in
places where the deck joists have collapsed due to rot.
UPC Chapter 5. Temperature /pressure relief valve at the water heater is drained
by a line of approximately 6 to 8 inches vertical. This condition is hazardous to
anyone standing the proximity of this drain when the valve discharges. Drain
for this valve must not be smaller than the diameter of the outlet for the valve,
and shall terminate outside of the building.
UPC Chapter 9. The drain for the clothes washer is inserted into a hole in the
wall. There seems to be the end of an ABS pipe in the hole, but there does not
appear to be a "vent" or "trap" at this location.
UPC 101.5.5 Maintenance. Bathroom sink and kitchen sink drains leak.
WSVIAQ Code Section 303.3.1 Source specific mechanical ventilation at
kitchen, bathroom, and laundry room is required.
TMC Chapter TMC 8.28.020 International Property Maintenance Code adopted (IPMC)
Specifically IPMC 305.3 Interior Surfaces. Mold is present on virtually all walls and the
ceilings in stairway and upstairs bedrooms. Paint /wallboard is peeling on
ceiling in bedrooms and in stairway.
IPMC 305.4 Stairs and walking surfaces. Upstairs floor flexes under normal
walking conditions and exhibits signs of structural decay.
Specifically IPMC 108.1.3 Structure Unfit for Human Occupancy. "A structure is unfit
for human occupancy whenever the code official finds that such
structure is unsafe, unlawful or, because of the degree to which the
structure is in disrepair or lacks maintenance, is insanitary, vermin or rat
infested, contains filth and contamination, or lacks ventilation,
illumination, sanitary or heating facilities or other essential equipment
required by this code..."

lack of emergency egress from upstairs bedrooms, rotted and unsafe exterior
deck and stair, lack of ventilation in the kitchen, bathroom and laundry room,
and other conditions noted above.
You are hereby notified of a Complaint Hearing before the Tukwila Improvement Officer scheduled as follows:

By receipt of this Complaint of Unfit Building, you are required to attend a Hearing before the Tukwila Improvement
Officer at which all parties in interest shall be given the right to appear in person, to bring witnesses, and to give
testimony regarding the complaint. At any time prior to or at the time of the hearing, any party may file an answer to
the Complaint. All rules governing the procedure of such Hearing, are available for public inspection at the Tukwila
Department of Community Development.
Within ten days of the Complaint Hearing, the Improvement Officer shall issue a Determination, Findings of Fact,
and Order stating whether the subject dwelling, building, structure, or premises is unfit for human habitation or
other use, findings of fact supporting the determination, an order specifying the actions necessary to address any
unfitness, and a deadline for completing the actions.
If the structure is a rental dwelling unit and the unit is found to be unfit for human habitation, then the provisions for
Relocation Assistance may apply under TMC 8.46.
If you fail to comply with the Determination and Order and no appeals have been filed, the Improvement Officer may
order the building to be repaired or demolished. The cost of such action shall be assessed against the subject property
as a tax lien, pursuant to Chapter 35.800. Revised Code Co of Washington (RCW).
