From and after conveyance of this easement, the City shall have the right to access, inspect, repair and maintain the existing riverbank within the Access Easement. All operations within the Easement shall be performed safely, diligently and in a reasonable manner to minimize interference with uses on the Burdened Property. Following completion of any work within the Easement, the party undertaking the work shall restore, in a timely manner, any disturbed area and shall repair any damage to the Easement area and any property outside thereof to substantially the same condition as existing before the work. The party undertaking the work shall indemnify the owners of the Burdened Property for any loss, damage, injury or death from use of or work related to the Easements except if such loss, damage, injury or death is due to the concurrent negligence of the owner of the Burdened Property or any third party, then this indemnity shall be only to the extent of the negligence of the party undertaking of the work.
