situated in the County of King, state of Washington:
Lots 21,22,23,24 and that portion of lot 25, lying
northwesterly of the line 146 feet and 4 inches
along a line drawn from the southwest corner of lot
25 to intersect the south line of lot 24, all in block 9,
Hillman's Seattle Garden Tracks, according to the
plat thereof recorded in volume 11 of plats, page 24,
records of King County, Washington.
Situated in the County of King, State of
Washington.
Assessor's Tax Parcel Nos.: 336590 -1035, 336590 -1026, and 336590 -1025
Steve Dowen, as owner of the real property legally described above hereto
( "Burdened Property "), assigns, grants and conveys to the CITY OF TUKWILA ( "City "),
a Washington municipal corporation, an Easement for Access to the Duwamish River.
The legal description and map for the Access Easement are shown on Exhibits A and B,
attached. From and after conveyance of this easement, the City shall have the right to
access, inspect, repair and maintain the existing riverbank within the Access Easement.
All operations within the Easement shall be performed safely, diligently and in a
reasonable manner to minimize interference with uses on the Burdened Property.
Following completion of any work within the Easement, the party undertaking the work
shall restore, in a timely manner, any disturbed area and shall repair any damage to the
Easement area and any property outside thereof to substantially the same condition as
existing before the work. The party undertaking the work shall indemnify the owners of
the Burdened Property for any loss, damage, injury or death from use of or work related
to the Easements except if such loss, damage, injury or death is due to the concurrent
negligence of the owner of the Burdened Property or any third party, then this indemnity
shall be only to the extent of the negligence of the party undertaking of the work.
IN WITNESS WHEREOF, this easement is executed effective upon the last
signature below and shall be recorded in the real property records of King County,
