Signature of Requesting Party NOTICE OF LIMITED BUILDING OCCUPANCY This NOTICE OF LIMITED BUILDING OCCUPANCY is created November 15, 2006, 2006 by and between WACO ENTERPRISES a Washington general partnership, whose address is FJ (Grantor) and the City of Tukwila, Department of Community Development, whose address is 6300 Southcenter Blvd, Suite 100 Tukwila, WA 98188 (Grantee); The grantor is the fee simple title holder of real property located in the City of Tukwila, King County, and the State of Washington, legally described in Exhibit A. The Department of Community Development (DCD) for the City of Tukwila is charged with administrating Tukwila Municipal Code (TMC) 18.56 "Off- Street Parking and Loading Regulations Grantor is party to a development permit from DCD (DCD File Number D06 -325) to remodel the existing building on the site. Due to a change of use in the structure additional parking is required for the entire site. As part of permit review of D06 -325, the applicant has agreed to "abandon" 5,692 square feet of mezzanine office. For the purpose of this agreement the term "abandon" shall mean that the mezzanine area shall have no use, such uses include but are not limited to, retail, bulk retail, office, warehousing, storage of materials and manufacturing. The mezzanine area is to be empty of any goods, personal and shall be open space within the building. The City of Tukwila will agree that parking is not required for the 5,692 square foot area mezzanine area. In the event that circumstances change, the property owner may request that the City amend or release the Notice of Limited Building Occupancy. Any request to modify or release the Notice of Limited Building Occupancy must demonstrate that the subject property will comply with the parking requirements of TMC 18.56.
