Signature of Requesting Party Note to submitter: Do not sign above nor pay additional $50 fee if the document meets margin/formatting requirements City of Tukwila Jim Haggerton, Mayor Department of Community Development Jack Pace, Director DETERMINATION, FINDINGS OF FACT, AND ORDER OF THE CITY OF TUKWILA IMPROVEMENT OFFICER DATE: September 1, 2015 TO: RE: Phillip D Gerking 4618 S 150th St Tukwila, WA 98188 4618 S 150th St Tukwila, WA 98168 Parcel #: 004200 -0235 ( "Subject Property ") CASE NO.: CE13 -0001 SUMMARY OF HEARING On August 27, 2015, at 9:30 a.m., the Improvement Officer held a hearing regarding this matter to gather information to supplement what was discovered during the Code Enforcement Officer's initial investigation of the Subject Property. The following City of Tukwila staff attended the hearing: Kathryn Stetson, Improvement Officer Mary Hulvey, Code Enforcement Officer Shari Fields, Code Enforcement Admin. Representing the property owner: Phillip Gerking, property owner 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • Phone 206 - 431 -3670 • Fax: 206 -431 -3665 FINDINGS OF FACT Based on the Code Enforcement Officer's initial investigation of this matter, and the information gathered at the above - described hearing, the Improvement Officer makes the following Finding of Facts: 1. Mr. Phillip Gerking is the property owner of the subject property, addressed 4618 S 150th St. 2. In 2007, the house was damaged by fire. The areas damaged were the living room and the front porch. 3. On March 24, 2008, an electrical permit (EL08 -297) was issued for temporary service to the house. 4. In September 2008, the electrical permit (EL08 -297) for temporary service expired. Since that time, the owner has been utilizing extension cords to connect to the temporary electrical service. 5. On November 4, 2013, Senior Plans Examiner Dave Larson conducted a site visit to the property and then requested that Code Enforcement open a case on this property. 6. On November 14. 2013, a Violation Notice and Order was issued to Mr. Gerking regarding the expired electrical permit EL08 -297, requiring that a new permit be obtained along with an safety inspection of the structure. 7. On November 18, 2013, Mr. Gerking obtained an electrical permit (EL13 -1173) to install a permanent electrical connection on the house and connect to the service. 8. On December 3, 2013, CE Officer Mary Hulvey, Sr Plans Examiner Dave Larson, and Electrical Inspector Jim Benner met Mr. Gerking at the property to conduct a safety inspection. Larson determined that a building permit is required to complete the repairs to the structure and he reviewed the submittal requirements with Mr. Gerking. 9. On January 7, 2014 Mr. Gerking submitted a building permit application (D14- 0004). 10.On December 8, 2014 the electrical permit (EL13 -1173) expired without receiving final inspection approval. 11.On March 15, 2015, the building permit (D14 -0004) expired without receiving final inspection approval. 12.On July 14, 2015 Code Enforcement issued and posted a Complaint of Unfit Building hearing notice, requiring the owner to attend a hearing to discuss the violations and needed resolutions. 13.On July 15, 2015 Mr. Gerking obtained new building permit (D15 -0178) and electrical permit (EL15- 0633). 14.The structure remains unfinished — drywall and insulation is missing, there is not a complete kitchen (no cooking stove), the front porch is missing or damaged and not structurally sound. kas Page 2 of 4 09/03/2015 W: \Code Enforcement \CODE ENFORCEMENT CASES \2013 \CE13 -0001 (Gerking -Fire damage structure) \CE13 -0001 Determination Findings & Order.docx Determination: Based on the initial investigation of this matter, and the information gathered at the above - described hearing, the Improvement Officer makes the following Determination and Order: 1. The structure is unfinished. Wallboard and insulation is missing, the front porch needs to be rebuilt, the floor is structurally unsound, the kitchen Tacks required stove. 2. The owner has obtained a new electrical permit to permanently install service to the house. This permit has not yet received final inspection approval. 3. The owner has obtained a new building permit to make all the necessary repairs to the house. This permit has not yet received final inspection approval. Order: The property owner is hereby ordered to: 1. By October 30, 2015 obtain a final electrical inspection for permit EL15 -0633 for the permanent installation of electrical service. 2. If additional electrical work is required for the interior repairs, obtain a new permit for that work. Consult with the electrical inspector about the need for additional electrical permits. 3. By October 30, 2015 obtain at least one inspection under permit D15 -0178. 4. Obtain at least one inspection each month thereafter until the repairs are completed. 5. Obtain all final inspections for all required permits. 6. Do not allow either of these permits to expire without completion. If permits expire without completion the City may require that the entire structure be demolished as permitted under IPMC 110.1. Appeal You are entitled to appeal this Determination, Findings of Fact, and Order. You must request an appeal within thirty (30) calendar days after receiving this Determination (by October 2, 2015). The appeal must be in writing to the Tukwila Office of the City Clerk, 6200 Southcenter Boulevard, Tukwila, WA 98188. An appeal fee must be submitted with the written appeal request. An open record appeal hearing will be scheduled before the Tukwila Hearing Examiner within 30 days from the date the appeal is filed. At that hearing you may present evidence and testimony from you and other witnesses, including new information not previously presented to the Improvement Officer, challenging this Determination, Findings of Fact, and Order. Remediation /Penalties If you do not appeal this ruling and fail to comply with the Determination, Findings of Fact, and Order, the Improvement Officer may direct or cause the subject dwelling, building, structure or premises to be repaired, altered, improved, vacated, and closed, removed or demolished pursuant to RCW Chapter 35.80. kas Page 3 of 4 09/03/2015 W: \Code Enforcement \CODE ENFORCEMENT CASES \2013 \CE13 -0001 (Gerking -Fire damage structure) \CE13 -0001 Determination Findings & Order.docx The cost of any action taken by the Improvement Officer under TMC 8.45.200 shall be assessed against the subject property pursuant to RCW Chapter 35.80. Upon certification by the City of Tukwila Finance Director that the assessment amount is due and owing, the King County Treasurer shall enter the amount of such assessment upon the tax rolls against the subject property pursuant to the provisions of RCW 35.80.030.
