(206) 431 -3665 8.45.050(D) The undersigned City of Tukwila Code Enforcement Officer, hereby certifies and states that: Violation Location: 1 3717 S 128 St. I File RFA04 -194 Owner Name: I Russell D. Cleavelarid Address: 1 3717 S 128 St. City/State/Zip: I Tukwila, WA 98168 is in violation of Tukwila's Municipal Code (TMC), (see enclosed photos) TMC Chapter: 1 8.28.020 International Property Maintenance Code (adopted) TMC Chapter: I IPMC 301.3 Vacant Structures and Land. Specifically: "All vacant structures and premises thereof or vacant land shall be maintained in a clean, safe, secure and sanitary condition as provided herein so as not to cause a blighting problem or adversely affect the public health or safety." TMC Chapter. I IPMC 302.4 Protective Treatment Specifically: "All exterior surfaces, including but not limited to shall be maintained in good condition." The exterior of the house-is covered with a significant amount of moss, is not in good condition, and is unsightly. The roof is covered in moss. TMC Chapter I IPMC 302.4 Weeds Specifically: "All premises and exterior property shall be maintained free from weeds or plant growth in excess of 24 inches..." There is severe overgrowth on all sides of the property. TMC Chapter. I IPMC 307.1 Accumulation of rubbish, debris, garbage Specifically: "All exterior property and premises, and the interior of every structure, shall be free from any accumulation of rubbish or garbage." The back and side yard contain several piles of debris and materials. Notice and Order February 7, 2006 Page 2 TMC Chapter: 8.24.020 Storage of Junk Vehicles Prohibited Specifically. "It is unlawful for any person to keep, store or park, or permit any other person to keep, store or park, any junk vehicle upon any privately owned property in the City of Tukwila." There is one vehicle on the front of the property and there appear to be others in the backyard that meet the defmintion of "junk vehicles." CORRECTIVE ACTION REQUIRED: Take the necessary steps to clean the exterior of the house by replacing defective siding and painting the house. Remove moss from the roof and ensure that the flashing and shingles are free from defects/leaks. Remove all debris, garbage or rubbish from the site. Cut back and remove all overgrowth and weeds in excess of 24 inches. Remove all junk vehicles from this property or store them completely within a building. A heading with the words: "Before the Hearing Officer of the City of Tukwila"; 2. A caption reading: "Appeal of giving the names of all appellants participating in the appeal; 3. A brief statement setting forth the legal interest of each of the appellants in the property involved in the notice and order; 4. A brief statement of the specific order or action protested, together with any material facts claimed to support the contentions of the appellant or appellants; 5. A brief statement of the relief sought, and the reasons.why it is claimed that the notice and order should be reversed, modified, or otherwise set aside; 6. The signature of all persons named as appellants, and their official mailing address; 7. The verification (by declaration under penalty of perjury) of each appellant as to the truth of the matters stated in the appeal. Failure to appeal this Violation Notice and Order shall constitute a waiver of all rights to any additional administrative hearings. Failure to respond may result in the matter being forwarded to the City Attorney for further action.
