Dear Mr. Thomson:
On April 20 "i, 2005 the City issued a Determination, Findings of Fact and Order regarding
municipal code violations at the above- captioned sites. Your attorney was also faxed a copy of
the Determination. (copy attached)
The Determination called for the application and issuance of demolition permits for the structures
on both sites. You did apply for and were issued Permit D05 -132 for demolition and removal of
all materials from the upper property (Parcel No. 3351400011). The Determination required
"removal of all building materials and debris including concrete foundations and slabs from the
site and dispose of in an approved and legal.manner as required by the terms of the demolition
permit. Contact the Permit Center to schedule a final inspection of the site when the work is
completed, according to the instructions on the demolition permit. This permit must be finalized
within 30 days from date of permit issuance. No extensions will be granted." This permit was
issued on May 26, 2005.
As of this date, no inspections have been requested, and the building materials and debris have
not been removed from the site. This work should have been completed no later than
June 26, 2005.
You are now in violation of the Determination of Findings.
With regard to the lower property (3922 S. 1 15 St.,) our inspection this week revealed that both
buildings are unsecured (front doors open). The larger building also has broken windows in
front, providing easy access and the potential for illegal trespass. Both buildings also pose a
safety threat to children and others in the area. (see enclosed photos)
It is imperative that you contact our office upon receipt of this letter. Failure to do so will result
in the City taking the next steps to clear both properties of the derelict buildings, trash and debris,
weed overgrowth, and attach a lien to the properties. I can be reached at (206) 431 -3682.

Findings'of Fact
Procedural History
1. Complaint Issued March 4, 2005, Hearing scheduled for 3/23/05. Owner did not
appear.
2. On March 23, 2005, City contacted owner via phone and agreed to reschedule hearing
for March 31, 2005. Confirming letter mailed March 23, 2005.
3. March 30, 2005, attorney for owner called to request new hearing date of April 11,
2005.
4. April 11, 2005, hearing conducted at 10:30 a.m.
Under Property (Parcel #3351400011)
1. Originally, there were two structures on this property.
2. Both buildings were in danger of collapse, as the buildings which were located 3 feet
apart at the base, lean against each other at the eaves.
3. Prior to March 31, 2005, both buildings were partially demolished.
4. No demolition permits were issued for this work.
5. On March 31, 2005, the Tukwila Building Inspector posted the property for failure to
obtain the required demolition permit.
Lower Property (Parcel #3351400010)
1. The lower property consists of two structures which are deteriorated.
2. The roof of each is damaged and no longer prevents rain from entering the buildings.
Gutters are deteriorated, damaged or missing.
3. There are no utilities of any kind in either structure.
Determination
Upper Property (Parcel 3351400011)
1. Prior to demolition, the buildings were in violation of International Property
Maintenance Code Section 108.1.3.
2. The two structures have been partially demolished without the required City permit,
in violation of the City adopted International Property Maintenance Code, Section
108.1.3 Structure Unfit for Human Occupancy, and Tukwila Municipal
Code 16.04.050, Building, Moving and Demolition Permits.

Lower Property (Parcel #3351400010)
1. The two structures on this property meet the definition of Structure Unfit for Human
Occupancy due to deteriorated roof, gutter and lack of utilities (heat, septic system,
and water service), in violation of the City adopted International Property
Maintenance Code, Section 108.1.3.
Order
Upp Pro perty
1. Apply for a demolition permit with the City of Tukwila for each structure partially
demolished within seven days of receiving this determination (April 29, 2005).
2. Obtain the demolition permit within five days of notice that the permit is ready to be
issued.
3. Within 30 days from the date of issuance of the demolition permits, complete the
following:
Demolish the remaining portion of the structures.
Remove all building materials and debris including concrete foundations and
slabs from the site and dispose of in an approved and legal manner as required by
the terms of the demolition permit.
4. Contact the Permit Center to schedule a final inspection of the site when the work is
completed according to the instructions on the demolition permit. This permit must
be finalized within 30 days from date of permit issuance. No extensions will be
granted.
Lower Property
1. Apply for a demolition permit with the City of Tukwila for each structure within 45
days of the completion of the above permit (for the upper property demolition).
2. Obtain the demolition permit within five days of notice that the permit is ready to be
issued.
3. Within 180 days from the date of issuance of the demolition permits, complete the
following:
Demolish the two structures.
Remove all building materials and debris including concrete foundations and
slabs from the site and dispose of in an approved and legal manner as required by
the terms of the demolition permit.
4. Contact the Permit Center to schedule a final inspection of the site when the work is
completed according to the instructions on the demolition permit. This permit to be
finalized within 180 days from date of issuance. No extensions will be granted on
this permit.

Appeal
You are entitled to appeal this Determination, Findings of Fact, and Order. You must
request an appeal within thirty (30) calendar days after receiving this Determination. The
appeal must be in writing to the Tukwila Office of the City Clerk, 6200 Southcenter
Boulevard, Tukwila, WA 98188. The appeal hearing will be scheduled within sixty (60)
days from the date the appeal is filed. The appeal hearing will be held before the Tukwila
Hearing Examiner.
Remediation /Penalties
If you do not appeal this ruling and fail to comply with the Determination, Findings of
Fact, and Order, the Improvement Officer may direct or cause the subject dwelling,
building, structure or premises to be repaired, altered, improved, vacated, and closed,
removed or demolished pursuant to RCW Chapter 35.80.
The cost of any action taken by the Improvement Officer under TMC 8.45.200 shall be
assessed against the subject property pursuant to RCW Chapter 35.80. Upon certification
by the City of Tukwila Finance Director that the assessment amount is due and owing,
the King County Treasurer shall enter the amount of such assessment upon the tax rolls
against the subject property pursuant to the provisions of RCW 35.80.030.
