(206) 431 -3665 8.45.050(D) The undersigned City of Tukwila Code Enforcement Officer, hereby certifies and states that: Violation Location: 12909 East Marginal Way So. File RFA05 -048 Owner Name: Robert W Karch Address. 6905 S. Tyler St. City/State/zip: Tacoma, WA 98409 is in violation of Tukwila's Municipal Code (TMC), TMC Chapter: TMC 8.28.020 International Property Maintenance Code (adopted) Specifically: IPMC 108.1.3 Structure unfit for human occupancy. "A structure is unfit for human occupancy whenever the code official finds that such structure is unsafe, unlawful or, because of the degree to which the structure is in disrepair or lacks maintenance, is insanitary, vermin or rat infested, contains filth and contamination, or lacks ventilation, illumination, sanitary or heating facilities or other essential equipment required by this code, or because the location of the structure constitutes a hazard to the occupants of the. structure or to the public." The City has been notified by King County Housing Authority that the septic system at this residence has failed completely and that Public Health has been notified to inspect. Lack of a functional septic system renders this residence unfit for human occupancy. You must take immediate action to repair or replace the system as required by Public Health. This structure cannot be occupied until you can demonstrate to the City that all repairs have been made and the system is functional. You must immediately secure the .structure against unlawful entry. A Notice of Condemnation has been posted. Specifically: IPMC 307.1 Accumulation of rubbish, debris, garbage. "All exterior property and premises, and the interior of every structure, shall be free from any accumulation of rubbish or garbage." IPMC 307.2.1 Rubbish storage facilities. "The owner of every occupied premises shall supply approved covered containers for rubbish, and the owner of the premises shall be responsible for the removal of rubbish." There is an accumulation of debris around the residence: plastic garbage bags pijed up, many discarded tires covered by blackberry vines, garbage and discards in the front, side and back yard areas. Compliance Date January 31, 2006 Corrective Action Remove all debris, garbage, lumber, tires, building materials, etc. from the entire premises. FAILURE TO COMPLY WITH THIS ORDER MAY SUBJECT YOU TO A MONETARY PENALTY OF UP TO $500 PER DAY FOR EACH DAY THAT THE VIOLATION EXISTS UNDER THE PROVISIONS SET FORTH IN TMC 8.45.100(2). Anneal Provisions: A person may, within ten days of receipt of this notice, file with the City Clerk a written notice of appeal containing the following: 1. A heading with the words: "Before the Hearing Officer of the City of Tukwila; 2. A caption reading: "Appeal of giving the names of all appellants participating in the appeal; 3. A brief statement setting forth the legal interest of each of the appellants in the property involved in the notice and order; 4. A brief statement of the specific order or action protested, together with any material facts claimed to support the contentions of the appellant or appellants; 5. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order should be reversed, modified, or otherwise set aside; 6. The signature of all persons named as appellants, and their official mailing addresses; 7. The verification (by declaration under penalty of perjury) of each appellant as to the truth of the matters stated in the appeal. Failure to appeal this Violation Notice and Order shall constitute a waiver of all rights to any additional administrative hearings.
