Tukwila, WA 98168 RE: File RFA05 -064 Single Family dwelling at 11710 —40 Avenue S. Tukwila, WA Parcel 7340600122 SUBJECT: Notice of condemnation. STATEMENT OF VIOLATION Our records show that a Notice Order was served to Teresa Peycke on March 23, 2005. The notice found that the premises was unfit for human habitation and an order to abate the condition was issued. Action to abate the condition has not occurred and no appeal has been filed. The Notice Order has been ignored and therefore an alternative action has be taken. In accordance with Tukwila Municipal Code, by reference, the International Property Maintenance Code Section 108.2. the Building Official is authorized to post a placard of condemnation on the premises and order the structure closed so as not to exist as an attractive nuisance. REQUIRED ACTION The premises shall be vacated. No persons shall occupy the premises except for the purpose of securing the structures or making the required repairs and clean -up. All utilities shall be shut off. The dwelling and garage shall be secured against entry with (minimum 2 inch) plywood panels over all windows and doors. Plywood (or O.S.B.) shall be secured over windows and doors with wood screws installed at corners and at 8" on center at panel edges. Wood blocking may be necessary at irregular surfaces to provide for a competent surface to anchor the plywood panels. Upon completion of the work, call the Permit Center and schedule an inspection of the premises. The premises will then be placarded as "Condemned 6300 Southcenter Boulevard, Suite #100 Tukwila, Washington 98188 Phone: 206 431 -3670 Fax: 206 431 -3665 August 12, 2005 File RFA05 -064 Notice Order Page 2 TIME IN WHICH TO COMPLY The dwelling is to be vacated upon service of this Notice Order and posting of the condemnation placard. Work to secure the dwelling against entry shall begin within five days (5) of this notice August 22, 2005. The work shall be completed within 15 days from the date that the Notice Order is posted, no later than September 1, 2005. APPEAL You have the right to an appeal of this Notice Order provided that a written application for appeal is filed with the City Clerk's office within ten (10) days of service of the Notice Order— August 25, 2005. The form of appeal is enclosed as Attachment "A Failure to secure the building will result in further action by this department. All legal means available will be pursued to enter upon this property and cause the buildings to be secured against entry in the manner prescribed herein. The cost of securing the buildings will be charged against the real estate upon which the dwelling is located and shall be recorded as a lien against said real estate. Sinc Robe Benedicto, Building Official Cc: City attorney Kathy Stetson, Code Enforcement Don Tomaso, Fire Marshal ATTACHMENT "A" APPEALS PROCESS Form of Appeal: Any person serviced with a notice and order may appeal from any notice and order or any action of the Building Official under this code by filling at the office of the City Clerk a written appeal containing: 1) A heading in the words: "Before the hearing examiner of the City of Tukwila" 2) A caption reading: "Appeal of giving the names of all appellants participating in the appeal. 3) A brief statement setting forth the legal interest of each of the appellants in the building or the land involved in the notice and order. 4) A brief statement in ordinary and concise language of the specific order or action protested, together with any material facts claimed to support the contentions of the appellant. S) A brief statement in ordinary and concise language of the relief sought and the reasons why it is claimed the protested order or action should be reversed, modified or otherwise set aside. 6) The signatures of all parties named as appellants and their official mailing addresses. 7) The verification (by declaration under penalty of perjury) of at least one appellant as to the truth of the matters stated in the appeal. The appeal shall be filed within 10 days from the date of the service of the order. As soon as practicable after receiving the written appeal, the hearing examiner shall fix a date, time and place for the hearing of the appeal. Such date shall not be less than 10 days nor more than 30 days from the date the appeal was filed with the City Clerk. Written notice of the time and place of the hearing shall be given at least 10 days prior to the date of the hearing to each appellant. A copy of such notice shall be delivered to the appellant personally or by mailing a copy thereof, addressed to the appellant at the address shown on the appeal.
