Weed Covered Premises
Dear Philip and Rita Copeland:
The City has been attempting 10 work with you for the past three years regarding multiple code
violations o1 the above-captioned property. Ao revealed io the attached photographs, the property
ie almost completely covered with abandoned, junk vehicles; trash and debris, and blackberry
overgrowth. There in also ot least one illegal container un the premises. Not only is the rmoddiou
of the property deplorable the amount of trash and debris provide harborage for rats and other
rodents, and are u public health concern. The condition and security of the buDdiug(m)on site are
unknown, but have been without utilities since February, 2001.
PROCEDURAL POSTURE
On April lg,2O02,uPre-citation letter was mailed to you, (Exhibit A) citing multiple
nuisance violations.
On July lO, 2002 Citations No. 24233 and 24234 were issued tnPhilip [mpe|uud (Exhibits
13, C)
On July 16, 2002, u letter requesting umeeting to discuss remedial uodou was sent to Rita
Copeland (Exhibit D). No such meeting ever took place.
On August 5, 2002 a Notice and Order was issued to Rita Copeland (Exhibit E)
On November 14, 2003, u Final Notice sent to Rita Copeland (Exhibit F1
()u November 30,2OO4 another Notice and Order was issued to Philip Copeland (Exhibit G)
The property is an attractive nuisance, a harbor for rats, a safety and health hazard to the public,
and is in violation of the following International Property Maintenance codes: (see eoc\nomd

VIOLATIONS:
Unsafe /unfit building(s)
International Property Maintenance Code 108.1.3 Structure unfit for human occupancy. "A
structure is unfit for human occupancy whenever the code official finds that such structure is
unsafe, unlawful, or because of the degree to which the structure is in disrepair or lacks
maintenance... lacks ventilation, illumination, sanitary or heating facilities... constitutes a hazard
to the occupants of the structure or to the public."
Closing of Vacant Structures.
International Property Maintenance Code 108.2 Closing of vacant structures. "If the structure is
vacant and unfit for human habitation and occupancy, and is not in danger of structural collapse,
the code official is authorized to post a placard of condemnation o the premises..."
Numerous abandoned, junk vehicles
International Property Maintenance Code I.P.M.C. 302.8 Motor Vehicles. "Except as provided
for in other regulations, no inoperative or unlicensed motor vehicle shall be parked, kept or stored
on any premises..."
Piles of trash, debris, and abandoned materials.
International Property Maintenance Code I.P.M.C. 307.1 Accumulation of rubbish or garbage.
"All exterior property and premises, and the interior of every structure, shall be free from any
accumulation of rubbish or garbage."
Overgrowth of weeds
International Property Maintenance Code I.P.M.C. 302.4 Weeds. "All premises and exterior
property shall be maintained free from weeds or plant growth in excess of 24 inches. All noxious
weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and vegetation,
other than trees or shrubs..."
CORRECTIVE ACTION:
Based upon these findings, this property is deemed a public nuisance. In accordance with
Tukwila Municipal Code TMC Chapter 8.45, you are required to proceed with the following
corrective actions:
Secure the house and any other buildings from unlawful entry
Remove all trash and debris, and dispose of in an approved, legal manner.
Remove all abandoned or inoperative vehicles or store them within a completely
enclosed building.
Trim, cut and /or remove the aforementioned overgrowth from the property.
Call the Department of Community Development Building Department
(206) 431 -3675 for a final inspection when the work is complete.

TIME IN WHICH TO COMPLY.
Work shall commence on or before thirty (30) days after service of this Notice and Order
(by November 13, 2005).
APPEAL
You may appeal this Notice and Order to the City of Tukwila Hearing Examiner. The appeal
should contain the information outlined on Attachment A of this Notice and Order. Your request
must be in writing and filed with the City Clerk of the City of Tukwila within ten (10) days after
service of this Notice. Failure to appeal will constitute a waiver of right to administrative hearing
and determination of this matter.

ATTACHMENT A
APPEAL
Any person serviced with a Notice and Order may appeal from any Notice and Order or any
action of the Building Official under the Tukwila Municipal Code by requesting such appeal
within 10 days after service of this Notice Order. The request shall be in writing and shall be
filled with the City Clerk. The appeal should include the following:.
1) A heading in the words: "Before the hearing examiner of the City of Tukwila"
2) A caption reading: "Appeal of giving the names of all appellants participating in
the appeal.
3) A brief statement setting forth the legal interest of each of the appellants in the building or the
land involved in the notice and order.
4) A brief statement in ordinary and concise language of the specific order or action protested,
together with any material facts claimed to support the contentions of the appellant.
5) A brief statement in ordinary and concise language of the relief sought and the reasons why it
is claimed the protested order or action should be reversed modified or otherwise set aside.
6) The signatures of all parties named as appellants and their official mailing addresses.
7) The verification (by declaration under penalty of perjury) of at least one appellant as to the
truth of the matters stated in the appeal.
Failure to file an appeal in accordance with the provisions stated herein shall constitute a waiver
of the right to an administrative hearing and adjudication of the Notice Order or any portion
thereof.
