Box 53 Winlock, WA 98596 RE: Premises at 5005S.124 1h St., Tukwila, WA Parcel No. 179003210 CASE NO: RFA 02 -211 Unsecured Buildings, Trash and Debris, Junk Vehicles, Weed Covered Premises Dear Mr. Olsen: The City has been receiving complaints regarding the conditions of the above captioned property since 1995. During the past several years, you have been sent multiple Pre Citation Notices and Correction Notices, in an effort to advise you of the condition of the property, and to remediate the many nuisance ordinance violations. Our most recent correspondence included a Notice and Order, dated June 17, 2003. (Attachment B) There was no response from you. On March 23, 2005 and again on May 6, 2005, the Tukwila Police Department were called to respond to suspicious activity on the property. Police reports indicate there have been individuals trespassing on the site, hacking through the blackberry and weed overgrowth in order to gain access into the house. It appears likely that this will continue to be a haven for trespassers, and possibly illegal activity, until the property is cleaned up. On April 1, 2004, a letter was sent to you, advising you of the City's intent to remedy the violations. (Attachment C) There have been no utilities on the property for years, making it uninhabitable. The home and structure on the site are unsecured. In addition, the property is covered with severe overgrowth and the yard is strewn with garbage and other debris. There are multiple abandoned, junk vehicles on the property. The property is an attractive nuisance, a harbor for rats, a safety and health hazard to the public, and is in violation of the following International Property Maintenance Codes: (see enclosed photos Attachment D) 6300 Southcenter Boulevard, Suite #100 Tukwila, Washington 98188 Phone: 206 431 -3670 Fax. 206 431 -3665 ,Harry D. Olsen Notice and Order September 2, 2005 Page 2 VIOLATIONS: Unsafe/unfit building(s) International Property Maintenance Code 108.1.3 Structure unfit for human occupancy. "A structure is unfit for human occupancy whenever the code official finds that such structure is unsafe, unlawful, or, because of the degree to which the structure is in disrepair or lacks maintenance, ...lacks ventilation, illumination, sanitary or heating facilities... constitutes a hazard to the occupants of the structure or to the public." Closing of Vacant Structures. International Property Maintenance Code 108.2 Closing of vacant structures. "If the structure is vacant and unfit for human habitation and occupancy, and is not in danger of structural collapse, the code official is authorized to post a placard of condemnation on the premises..." Junk Vehicles International Property Maintenance Code 302.8 Motor vehicles. "Except as provided for in other regulations, no inoperative or unlicensed motor vehicle shall be parked, kept or stored on any premises, and no vehicle shall at any time be in a state of major disassembly, disrepair..." Rubbish Accumulation International Property Maintenance Code 307.1 Accumulation of rubbish or garbage. "All exterior property and premises, and the interior of every structure, shall be free from any accumulation of rubbish or garbage." Overgrowth of weeds International Property Maintenance Code 302.4 Weeds. "All premises and exterior property shall be maintained free from weeds or plant growth in excess of 24 inches. All noxious weeds shall be prohibited..." CORRECTIVE ACTION Based upon these findings, this property is deemed a public nuisance. In accordance with Tukwila Municipal Code TMC Chapter 8.45, you are required to proceed with the following corrective actions: Apply for and obtain a permit for demolition of the house and structure within 15 days from the date of service of this Notice and Order (September 23, 2005). Demolish the house and structure, according to permit requirements. Remove all building materials and debris, and dispose of in an approved, legal manner. Clear blackberries and uncultivated plants or weeds from the site. Remove all junk vehicles located on the property. Call the Department of Community Development Permit Center at (206) 43 1-3 670 for a final inspection when the work is complete. Harry D. Olsen Notice and Order September 2, 2005 Page 3 TIME IN WHICH TO COMPLY Work shall commence on or before 30 days after service of the Notice and Order (October 6, 2005) APPEAL You may appeal this Notice and Order to the City of Tukwila Hearing Examiner. The appeal should contain the information outlined on Attachment A of this Notice and Order. Your request must be in writing and filed with the City Clerk of the City of Tukwila within ten (10) days after service of this Notice. A 1 1 At,rilvlr,tr 1 A APPEAL Any person serviced with a Notice and Order may appeal from any Notice and Order or any action of the Building Official under the Tukwila Municipal Code by requesting such appeal within 10 days after service of this Notice Order. The request shall be in writing and shall be filled with the City Clerk. The appeal should include the following: 1) A heading in the words: "Before the hearing examiner of the City of Tukwila" 2) A caption reading: "Appeal of giving the names of all appellants participating in the appeal. 3) A brief statement setting forth the legal interest of each of the appellants in the building or the land involved in the notice and order. 4) A brief statement in ordinary and concise language of the specific order or action protested, together with any material facts claimed to support the contentions of the appellant. 5) A brief statement in ordinary and concise language of the relief sought and the reasons why it is claimed the protested order or action should be reversed modified or otherwise set aside. 6) The signatures of all parties named as appellants and their official mailing addresses. 7) The verification (by declaration under penalty of perjury) of at least one appellant as to the truth of the matters stated in the appeal. Failure to file an appeal in accordance with the provisions stated herein shall constitute a waiver of the right to an administrative hearing and adjudication of the Notice Order or any portion thereof, Attachment A
