NOTICE ORDER
Date of Notice: October 5, 2005

STATEMENT OF VIOLATION
Building "B" has a building sewer blockage that has resulted in an overflow of raw sewage into all units
on the ground floor. These units are contaminated with hazardous waste and are dangerous to any
occupants. The condition of this building.is in violation of the following:
Tukwila Municipal Code as referenced in Chapter 8.28.020. International Property Maintenance Code
Section 108.1 Unsafe Structure and Equipment, Section 108.1.3, Structure unfit for human occupancy.
REQUIRED ACTION
1. Employ the services of a plumbing service and repair company to investigate and locate the building
sewer blockage and clear.
2. Obtain a plumbing permit and install a cleanout for building "B" in accordance with the Plumbing
Code. Obtain final inspection approval of the installation. Submit a copy of the inspection approval to
Tukwila Code Enforcement.
3. Employ the services of an environmental consulting company to inspect the premises and prepare a
report that will establish the scope of work required to remove all contamination. Submit a copy of the
report to Tukwila Code Enforcement upon completion of the report.
4. Employ a facility maintenance company to complete the required cleaning of the contaminated units.
5. Upon completion of the contamination cleanup, contact Tukwila Building Division and schedule an
inspection of the premises. This inspection will determine if any code related repairs are necessary.
The requirements of the International Property .Maintenance Code shall be required in order to restore
the units to habitable condition.
6. Complete the work scheduled by the Building Division inspection.
7. Schedule an inspection by Tukwila Building Division upon completion of the work.

TIME IN WHICH TO COMPLY
Building `B" has been posted "Condemned" and no occupancy is permitted except to make the required
repairs and abate the hazardous contamination. Building "B" will remain condemned until all required
work is completed and final inspection approval is issued by Tukwila Building Division.
APPEAL
You have the right to appeal from the requirements of the Notice Order or any action of the Building
Official under the Tukwila Municipal Code by requesting such appeal within ten (10) days after receipt of
this Notice and Order. An appeal form is enclosed as Exhibit A.

ATTACHMENT A
APPEAL
Any person serviced with a Notice and Order may appeal from any Notice and Order or any
action of the Building Official under the Tukwila Municipal Code by requesting such appeal
within 10 days after service of this Notice Order. The request shall be in writing and shall be
filled with the City Clerk. The appeal should include the following:
1) A heading in the words: "Before the hearing examiner of the City of Tukwila"
2) A caption reading: "Appeal of giving the names of all appellants participating in
the appeal.
3) A brief statement setting forth the legal interest of each of the appellants in the building or the
land involved in the notice and order.
4) A brief statement in ordinary and concise language of the specific order or action protested,
together with any material facts claimed to support the contentions of the appellant.
5) A brief statement in ordinary and concise language of the relief sought and the reasons why it
is claimed the protested order or action should be reversed modified or otherwise set aside.
6) The signatures of all parties named as appellants and their, official mailing addresses.
7) The verification (by declaration under penalty of perjury) of at least one appellant as to the
truth of the matters stated in the appeal.
Failure to file an appeal in accordance with the provisions stated herein shall constitute a waiver
of the right to an administrative hearing and adjudication of the Notice Order or any portion
thereof.
